04/03/1980CITY OF GRAND TERRACE COUNCIL MINUTES REGULAR MEETING - APRIL 3, 1980 A regular meeting of the City Council of the City of Grand Terrace was called to order at 12354 Mt. Vernon, First Baptist Church of Grand Terrace, Grand Terrace, California, at 6:18 p.m. on April 3, 1980. PRESENT: Tony Petta, Mayor Thomas A. Tillinghast, Mayor Pro Tempore Doug Erway, Councilman Jack Allen, Councilman Hugh J. Grant, Councilman Seth Armstead, City Manager Ivan Hopkins, City Attorney Joe Kicak, City Engineer Myrna Lindahl, Executive Secretary/Deputy City Clerk ABSENT: None The meeting was opened with invocation by Councilman Tillinghast, followed by the Pledge of Allegiance led by Commissioner John McDowell. ITEMS ADDED TO AGENDA Agenda Item 4E - Census 1980 briefing by Mr. Gary Butler EXECUTIVE SESSION Council adjourned to an Executive Session at 6:20 p.m. with City Manager Seth Armstead, City Attorney Ivan Hopkins, City Engineer Joe Kicak, and Administrative Services/Finance Officer Edward Clark in attendance. RECONVENE REGULAR COUNCIL MEETING The regular meeting of the City Council reconvened at 6:23 p.m. with all members present. Mayor Petta announced the Executive Session was regarding litigation on the clean water plant between the City of Colton and the City of Grand Terrace. He then read a Council News Release regarding this matter. (A copy of this News Release, dated April 3, 1980, is on file in the City Clerk's Office.) APPROVAL OF MINUTES MARCH 20, 1980 CC-80-96 Motion was made by Councilman Erway, seconded by Councilman Allen and I carried unanimously to approve the Minutes of March 20, 1980, as presented. Page one - 4/3/80 CONSENT CALENDAR The following items were removed from the Consent Calendar: A. Approval of Check Register No. 040380 B. Approve amendment of Lease/Payback Agreement with Zampese/ DeBenedet Construction Company F. Establish the Tuesday preceding each Thursday City Council Meeting as day final Packets will be ready for Council. CC-80-97 Motion was made by Councilman Allen, seconded by Councilman Tillinghast and carried unanimously to adopt the following Items on the Consent Calendar: C. RESOLUTION NO. 80-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DESIGNATING THE LOCAL AGENT FOR THE CITY OF GRAND TERRACE TO EXECUTE DOCUMENTS FOR THE PURPOSE OF OBTAINING FEDERAL FINANCIAL ASSISTANCE UNDER PUBLIC LAW 93-288 D. Tract 9482 - Approve release of water bonds - Amount: $87,000.00 E. Tract 9483 - Approve release of water bonds - Amount: $56,000.00 CHECK REGISTER NO. 040380 Following clarification regarding over -payment refunds on sewer CC-80-98 connections by City Engineer Joe Kicak, Motion was made by Councilman Grant, seconded by Councilman Tillinghast to approve Check Register No. 040380. Following clarification of the Pacific Telephone billing, and a request by Councilman Tillinghast for a total accounting of the "Train Don't Strain" Run project, showing funds collected and the distribution of those funds, the Motion carried unanimously. LEASE/PAYBACK AGREEMENT WITH ZAMPESE/DE BENEDET CONSTRUCTION COMPANY CC-80-99 Following discussion and corrections, Motion was made by Councilman Tillinghast, seconded by Councilman Erway and carried unanimously to approve the Lease/Payback Agreement with Zampese/DeBenedet Construction Company, as amended. COUNCIL PACKET DAY Discussion was held regarding the possibility of changing the day Packets are to be ready for Council from Friday to the Tuesday preced- ing each Council meeting. Motion was made by Councilman Tillinghast to delete Item 3F. Motion died for lack of a second. 0 Page two - 4/3/80 Following further discussion, Motion was made by Councilman Tillinghast to delete Item 3F. Motion again died for lack of a second. CC-80-100 Following further discussion, Motion was made by Councilman Erway, seconded by Councilman Allen to leave the Agenda Packet Day as it is at the present time, and direct Staff to come back in two weeks with additional alternatives. Motion carried on AYE votes of Councilmen Tillinghast, Erway, Allen, and Mayor Petta, with Councilman Grant voting NOE. GENERAL PLAN AMENDMENT Planning Staff, Gil Haro, gave a Staff presentation giving the back- ground, analysis, alternatives, findings, Planning Commission action, and recommended amending the General Plan from "Commercial" to "Residential 2-4 DU/AC" for 3 + acres located south of Minona Drive and north of the Grand Terrace Independent Market between Mt. Vernon Avenue and Arliss Drive; adopt the Negative Declaration and instruct the City Clerk to issue a Notice of Determination. Following discussion and questions of Planning Staff, Mayor Petta opened Public Hearing on the matter, and the following citizens addressed Council: Opposing Testimony Mr. Robert Moore, 22779 LaPaix, addressed Council stating he and his wife had purchased that property to use as a family business upon retirement, possibly dolls or antique gun repair. Mr. Moore stated he felt this property should be zoned commercially, since it is on a main artery, and at one time had been zoned commercial. Joan Moore, 22779 LaPaix, stated there is only one house in that area in which the owner actually resides in the house, and stated she feels this area is not suitable for residential. Supporting Testimony Mr. Don Mangus, 12070 Arliss Drive, spoke in favor of amending the General Plan from commercial to residential, and stated he had earlier submitted a petition with 79 signatures of area residents who also wish the General Plan changed from commercial to residential. Other people speaking in favor of amending the General Plan from commercial to residential were Ken Howard, 22912 Minona Drive, and Jack Hall, 12060 Arliss Drive. Mayor Petta closed Public Hearing. CC-80-101 Following discussion, Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously to accept the recommendation of the Planning Commission, as follows: Page three - 4/3/80 Amend $he General Plan from "Commercial" to "Residential 2-4 DU/AC" for 3 - acres located south of Minona Drive and north of the Grand Terrace Independent Market between Mt. CC-80-102 Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously to adopt Resolution No. 80-12. ORDINANCE NO. (First Readi AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, PERTAINING TO THE ADVERTISING, DISPLAY AND SALE TO MINORS OF PARAPHERNALIA COMMONLY ASSOCIATED WITH THE USE OF NARCOTICS CC-80-103 Following briefing by Councilman Tillinghast, and discussion, Motion was made by Councilman Tillinghast, seconded by Councilman Allen and carried unanimously to move introduction of the Ordinance as presented. ENCUMBERANCES - 1978-79 AUDIT City Manager Seth Armstead briefed Council regarding this matter. Staff was requested to indicate the specific funds to be encumbered when requesting additional budget allocations. CC-80-104 Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously to approve the request submitted as follows: Approve encumbrances on the City's Books of Accounts at June 30, 1979, for the following amounts and reasons: ENCUMBRANCE REASON AMOUNT 1. Insurance Deductible portion $27,000 2. Attorney Fees Forecast increase 20,000 3. Sewer Additional litigation 60,000 TOTAL $107,500 1980 CENSUS BRIEFING Mr. Gary Butler, Field Operations Supervisor for the west end of San Bernardino County, United States Census Bureau, gave a presentation Page four - 4/3/80 regarding the manner in which the 1980 Census will be conducted, and stated the City of Grand Terrace will probably receive their results from Congressman Brown. Mr. Butler recommended the City not conduct its own Census. Mayor Petta opened Public Hearing, and the following citizens addressed questions to Mr. Butler regarding the Census: Mary Robinson, 22631 Minona Drive, and Bob Yeates, 12888 Fremontia. Mayor Petta closed Public Hearing. RECESS Mayor Petta called a Recess at 7:30 p.m. Council reconvened at 7:45 p.m., with all members present. COMMISSION & COMMITTEE REPORTS PLANNING COMMISSION Commissioner John McDowell stated Council had received the Minutes of the Planning Commission Work Shop held March 24, 1980. He thanked Council for upholding the decision of the Planning Commission regarding the General Plan Amendment. PARKS & RECREATION COMMITTEE Ron Poll, Chairman of the "Train Don't Strain" Run, reported the event was highly successful, with 682 entries. Another race is scheduled for October. Ron Poll thanked the volunteers for their support, the California Pacific Insurance Company for donating the shirts, and commended the San Bernardino County Reserve Deputy Sheriffs for their efforts during the "Train Don't Strain" Run. The Parks & Recreation Committee will make a substantial donation to the San Bernardino County Reserve Deputy Sheriff's Office. Requested Council authorize Staff to pay any outstanding bills from this run. The money collected for entry fees was used to cover awards and expenses. CC-80-105 Motion was made by Councilman Tillinghast, seconded by Councilman Allen and carried unanimously, with the knowledge that Council will have a complete accounting, authorized Staff to pay all the outstanding debts incurred in connection with the "Train Don't Strain" Run held March 20, 1980. Chairman Geoff Dooley reported the City Engineer and Dick Rollins met regarding the 5.35 park site, and plans are progressing well. A vacancy for an alternate member still exists. Commended Staff Member Ray Robles for his assistance to the Committee at their past two meetings. John Lotspeich, Vice -Chairman, briefed Council regarding a proposed Bicycle Motocross Raceway on the 1.88 acre site located at Mt. Vernon Page five - 4/3/80 and Grand Terrace Road. Stated the Committee will coordi.nante with Staff and will get Council approval prior to any formal action. 0 CC-80-106 Motion was made by Councilman Erway, seconded by Councilman Allen and carried unanimously to direct Staff to prepare Resolutions of Apprecia- tion, on behalf of the City, to Ron Poll for his efforts in the "Train Don't Strain" Run, and to the entire Parks & Recreation Committee. ENERGY COMMITTEE Leader Doug Erway stated response has been received from citizens wishing to serve on the Energy Task Force Committee, and indicated a resident of Highgrove wishes to participate. Council concurred with this. HISTORICAL & CULTURAL ACTIVITIES COMMITTEE The Committee asked Council for clarification regarding membership qualifications as set forth in the Policy Manual. Following discussion, Mayor Petta directed Staff to study this matter and bring recommendations to Council at the meeting of April 17, 1980. VOLUNTEER SERVICES COMMITTEE Chairman Bob Yeates reported the following: The next meeting will be held Thursday, April 10; plan to have a free dump day Saturday, April 26, 1980; will attend the CPR class sponsored by the Blue Mountain Radio Club; re -activating the "Accent on Youth" Program will be discussed at the next meeting. Councilman Tillinghast requested sometime in the future a free dump day be established for some day other than a Saturday. CRIME PREVENTION COMMITTEE CC-80-107 Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously to appoint Sharon White and Steve Schultz to the Crime Prevention Committee, as recommended by the Crime Prevention Committee. COUNCIL REPORTS Councilman Allen reported approval has been received for at least two covered bus stops in Grand Terrace. These will be used for the _ convenience of people taking buses and also for centers of activity for carpool ing Page six - 4/3/80 Councilman Tillinghast reported the following: Recommended Council oppose Assembly Bill 2474 regarding amending the Brown Act. CC-80-108 Motion was made by Councilman Tillinghast, seconded by Councilman Erway and carried unanimously to direct Staff to prepare the necessary letters to members of the Assembly Committee on Local Government, stating the City of Grand Terrace objects to AB 2474 and recommends that it be voted down. CC-80-109 Motion was made by Councilman Tillinghast, seconded by Councilman Erway and carried unanimously to state, as a policy of the City of Grand Terrace, all committees of the City of Grand Terrace shall have a representative of Staff who shall serve on the committee as a Recording Secretary. Staff is to revise the Policy Manual to reflect this policy. CC-80-110 Motion was made by Councilman Tillinghast, seconded by Councilman Grant and carried unanimously to direct Staff to prepare the necessary letters to Representative Brown, Senators Cranston and Hayakawa, and appropriate postal officials requesting the City of Grand Terrace be given its own Post Office and separate Zip Code from the City of Colton. Councilman Erway stated Blue Mountain is the City's greatest natural asset, and citizens are concerned about the encroachment of residential development on Blue Mountain. Recommended the State be requested to conduct a wildlife inventory to see whether there are some species of wildlife which would make Blue Mountain an area that could be declared a wildlife sanctuary. Recommended contacting the affected property owners regarding this proposed action. CC-80-111 Motion was made by Councilman Erway, seconded by Councilman Grant and carried unanimously to direct Staff to identify the property owners of Blue Mountain and to contact the State Department of Fish and Game and the County Environmental Services Department to determine how a wildlife inventory could be conducted on Blue Mountain. CITY ENGINEER REPORT TRAFFIC SIGNALS City Engineer Joe Kicak briefed Council regarding a proposed traffic signal at Barton Road and Michigan, giving the background on previous studies of that intersection. Stated a traffic engineering study is currently being conducted at the LaCrosse and Vivienda intersections. That study should be completed in two weeks. Mr. Kicak recommended delaying action until this study is completed and the results studied. Discussion was then held regarding other alternatives to relieve traffic congestion at the intersection of Barton Road and Michigan, and to ensure the safety of the school children. 0 Roxie Easter, 21963 Tanager, submitted a petition to the City Council with 61 signatures approving the proposal to move the traffic signal lights from Preston and Barton Road to Michigan and Barton Road. CC-80-112 Following discussion, Motion was made by Councilman Erway, seconded by Councilman Grant and carried unanimously to take immediate steps to have the City Engineer find and bring to Council a report of the costs and installation costs of a flashing yellow light on Barton Road that would indicate the area congested, and be prepared to stop. CC-80-113 Motion was made by Councilman Tillinghast, seconded by Councilman Grant and carried unanimously to direct Staff to hire another crossing guard for the intersection of Michigan and Barton Road to operate during school hours. POLICE CHIEF REPORT Captain Phil Schuyler reported the Sheriff's Department has a "Ride -A - Long" Program and is willing to make this program available to citizens of Grand Terrace. CITY ATTORNEY REPORT CC-80-114 Following recommendation by City Attorney Ivan Hopkins, Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously to approve the Settlement Agreement with San Bernardino County pertaining to the Community Redevelopment Agency Plan. CITY MANAGER REPORT City Manager Seth Armstead reported the following: Cl) Stated Hearings will be held on Assembly and Senate Bills within the next two weeks, and requested approval for him and City Attorney -Hopkins to go to Sacramento when these are held. CC-80-115 Motion was made by Councilman Allen, seconded by Councilman Tillinghast and carried unanimously to authorize the City Manager and the City Attorney, if necessary, to go to Sacramento when Hearings are being held on Senate Bills1352, 1389, 1438, 1495 and 1594. CC-80-116 Motion was made by Councilman Tillinghast, seconded by Councilman Allen and carried unanimously to direct Staff to prepare necessary letters of support to the authors of Senate Bill 1660 (Presley) and Assembly Bill 2442 (Levine). CC-80-117 Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously authorizing Staff to forward material for State and Federal matching grants for parks in the amount of $1.7 Million Dollars. Page eight - 4/3/80 I PUBLIC PARTICIPATION The following citizens addressed Council: Mr. Roy Nix, 12173 Country Club Lane, regarding traffic lights; Dolores Kossman, 22735 DeSoto, ragarding two crossing guards; and Mary Robinson, 22631 Minona Drive, stating opposition to flashing red lights. ADJOURN The regular meeting of the City Council was adjourned at 9:55 p.m. to an Adjourned Regular Meeting to be held at the First Baptist Church of Grand Terrace, 12354 Mt. Vernon Avenue, on Tuesday, April 15, 1980, at 5:00 p.m., to declare the results of the General Municipal Election of April 8, 1980, and Mayoral Election.
