311 ORDINANCE NO. 311
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, REPEALING AND
REPLACING CHAPTER 15.18 CALIFORNIA FIRE CODE IN
ITS ENTIRETY
WHEREAS, every three years, the State of California through the State Fire
Marshal amends and adopts the California Fire Code; and
WHEREAS, the most recent Code updates were completed and publicized on
July 1, 2016; and;
WHEREAS, local jurisdictions must enforce the State Code; and
WHEREAS, fire districts may make local code amendments; and
WHEREAS, the San Bernardino County Fire Protection District has responsibility
for enforcement of the California Fire Code within the City of Grand Terrace; and
WHEREAS, the San Bernardino County Fire Protection District has developed
amendments suited to our local conditions; and

WHEREAS, the San Bernardino County Board of Supervisors acting as the Board
of Directors for the San Bernardino County Fire Protection District voted to adopt these
local amendments on February 14, 2017;
WHEREAS, on September 12, 2017, the Grand Terrace City Council _adopted
Resolution 2017-29 ratifying the San Bernardino County Fire Protection District's
adoption of the 2016 California Fire Code which are enforceable- in the City of Grand
Terrace.
WHEREAS, on September 12, 2017, the City Council` of the City of Grand
Terrace conducted a duly noticed public meeting at the Grand Terrace City Hall Council.
Chambers'located 22795 Barton Road on this Ordinance and concluded the meeting
that date.
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,
( CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby finds that Municipal Code Amendment 17-01
does not constitute a project as defined by the California Environmental Quality Act
Guidelines Section 15378; therefore, no further review is required.
SECTION 2. The City Council finds that the above-stated recitals are true and
correct and are incorporated herein by this reference.
SECTION 3. Chapter 15.18 is repealed in its entirety and replaced with the
following:
"Chapter 15.18 CALIFORNIA FIRE CODE
Section 15.18.010 Adoption of the California Fire Code
The 2016 California Fire Code., with local amendments, is adopted by Resolution of the
City Council.
SECTION 4. Any provision of the Municipal Code or appendices thereto
inconsistent with the provisions of the Ordinance, to the extent'of such inconsistencies
and no further, are repealed or modified to that extent necessary to affect the provisions
of this Ordinance.
SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held out to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision will not affect the validity of the remaining
portions of this Ordinance. The City Council of the City of Grand Terrace hereby declares
that it would have adopted this Ordinance and each section, subsection, sentence, clause,
phrase or portion thereof irrespective of the fact that any one or more sections, subsection,
sentence clause, phrases or portions be declared valid or unconstitutionally.
SECTION 6. The Mayor shall sign and the City Clerk shall attest to the passage of
this Ordinance. The City Clerk shall cause the same to be published once in the official
newspaper within 15 days after its adoption. This Ordinance shall become effective 30
days from its adoption.
