1995-18 RESOLUTION 95-18 RESOLUTION OF-THE CITY.COUNCIL OF THE CITY OF Grand Terrace APPROVING - THE SITE IDENTIFICATION AND DESCRIPTION FOR: THE MILLIKEN SANITARY LANDFILL FACILITY FACILITY IDENTIFICATION#36-AA-0054 On this 13th day of July , 1995, on motion of City Councilmember Singlev , duly seconded by City Councilmember Buchanan , and carried, the following resolution is adopted by the Grand Terrace City Council, acting in its official capacity as the legislative body for the City of Grand Terrace WHEREAS,the facility under consideration is an existing, refuse disposal facility operating under permit since 1979; and WHEREAS,the San Bernardino County(SBCo) Solid Waste Management Department(SWMD), acting as the Lead Agency, with concurrence from the SBCo Planning Department as the SBCo Board of Supervisors'designated Environmental Lead Agency, will duly complete a Solid Waste Facilities Permit (SWFP) application; and WHEREAS,the County Department of Environmental Health Services/Local Enforcement Agency(LEA)will process the SWFP application according to provisions as provided in CEQA, all applicable State and/or Federal Regulations, the San Bernardino County Development Code, Title 8 and/or the SBCo General Plan standards; and WHEREAS, the SBCo SWMD has also completed the Site Identification and Description of the project for submission to the City of Grand Terrace , a copy.of which is attached and marked Exhibit"A"; and WHEREAS,this facility can continue to provide the SBCo SWMD a method of disposing of municipal solid wastes, inert wastes, and non-hazardous solid wastes; and WHEREAS, Public Resources Code§50000 requires that the"Site Identification and Description" of a new or expanded (a significant increase in the amount of waste handled) solid waste facility which has not been identified or described in a County Solid Waste Management Plan (CoSWMP) must be approved or disapproved by the County Board of Supervisors, and by a majority of the Cities and Towns within the County which contain a majority of the population of the incorporated area of the County, within ninety (90)days after the Site Identification and Description is submitted to the City or Town. If the City or Town fails to approve or disapprove of the Site Identification and Description within ninety (90) days, the City or Town shall be deemed to have approved the Site Identification and Description, as prepared and submitted by the applicant; and WHEREAS,the City Council of the City of Grand Terracemay not disapprove the proposed Site Identification and Description unless it determines, based upon substantial evidence in the record,, Revised April 28, 1995 that there will be one or more significant=adverse impacts within the.City's boundaries caused by the proposed project; and WHEREAS, pursuant to the California Environmental Quality Act(CEQA), a Mitigated Negative Declaration was adopted by the SBCo SWMD/Planning Department(s) and a Notice of Determination (NOD)was filed with the San Bernardino County Clerk of the Board on June 18, 1992, also subsequently filed at the State of California Governor's Office of Planning and Research on July 3, 1992; and WHEREAS,the County Department of Environmental Health Services/Local Enforcement Agency (LEA) Program, pursuant to CEQA, is the Regulatory Responsible Agency for the project entrusted to issue the SWF Permit with concurrence provided from the California Integrated Waste Management Board (CIWMB); and WHEREAS, provided that the conditions of the SWF Permit are complied with, there is no substantial evidence in the record that there will be one or more significant adverse impacts within the City of Grand Terrace boundaries as determined by the findings made by the CEQA Lead Agency noted above, caused by the proposed project. NOW,THEREFORE, BE IT RESOLVED that the City Council of the City of Grand Terrace , in the County of San Bernardino, State of California, hereby approves the Site Identification and Description for the Milliken Sanitary Landfill Facility. Revisions will update the existing permit with current operations and/or design of the facility and recent State-mandated operating requirements. Location The Milliken Sanitary Landfill is located at 2050 S. Milliken Avenue within the City of Ontario, specifically on a portion of the South 1/2 Section 36, Township 1 South, Range 7 West, San Bernardino Base and Meridian (see Figure 1). Landfill operations began in 1957 and presently the facility consists of 196 acres of which 140 acres are used for landfill, 30 acres for borrow material, and 26 acres for recycling, maintenance, and administration activities. Proiect Characteristics he County of San Bernardino has contracted operations of the facility to Norcal/San ~dernardino Inc. The Milliken Sanitary Landfill is designated as a Class III facility and accepts only non-hazardous municipal solid waste and inert wastes. The existing permit allows the facility to operate six days per week, Monday through Saturday, 8 a.m. to 5 for the SWFP Revision does not propose a change in the p.m. The request 9 types of waste currently accepted at the facility but a change in operating hours to Monday through Friday, 7 a.m. to 4;30 p.m. and Saturday, 8 a.m. to 4:30 p.m. Site personnel arrive at the facility at 6 a.m. to prepare operational equipment and depart at-7-P.m. after landfill activities are completed and equipment secure. The site will operate 309 days per year and will be closed Sundays, Independence Day, Thanksgiving, Christmas, and New Year's Day. Existing facilities at the Milliken Sanitary Landfill include a scalehouse/scales, administration building, a concrete drop-off pad previously used for sorting and aggregating recyclable materials, landfill gas (LFG)'collection system, storm water retention basins (3), and a groundwater*monitoring system. The concrete drop-off pad, LFG collection system, drainage flumes, and groundwater monitoring system are new facilities designed to meet more recent operational requirements. Access to the facility remains unchanged and is provided by Milliken Avenue, a paved road (see Figure 2). Graded dirt roads provide access to all areas within the landfill for operating and maintenance activities. Perimeter fencing and an entrance gate limit unauthorized access i ..- the facility during non-operating-hours. 05/16/95 mll #37 Pursuant to AB 939 waste diversion goals;the County-initiated-a-recycling program at _ the Milliken Sanitary Landfill. Vehicles entering the:facility are weighed and loads are visually scanned by the scalehouse attendant for potential household and other hazardous wastes not accepted at the landfill.. Disposal vehicles,are then directed to one of two possible waste discharge areas as directed by a spotter. The existing recycling program consists of diverting relatively homogeneous waste loads containing metal, plastic, tires, mattresses, bulky items (i.e., white goods) cardboard/paper, construction/demolition debris, etc. to designated storage areas for stockpiling and shipping recyclable materials to market. This is accomplished by the mixed municipal waste loads being delivered to the landfill working face. Sorters hand-pick recyclable materials which are transferred to the designated.storage areas. Refuse deposited at the toe of the working face of the landfill is spread and compacted and covered daily with a minimum of six (6) inches of compacted soil. Sufficient cover material is available from the borrow area. The 1979 SWFP and Report of Disposal Site Information (RDSI) prepared for the facility identified the remaining site capacity and site life as 1,300,000 cubic yards (cy) which was based on an average disposal rate of 1200 tons per day on 106 acres. Since no specific grading plan was included as part of the existing permit it is not possible to determine the basis for site capacity and site life calculations. Due to increasing population growth within the service area of the landfill, the rate of disposal has increased since the permit was originally issued for the facility. Presently, the facility receives an average of 1500 tons per day (tpd) of municipal solid waste. Revisions to the SWFP requests a permitted daily maximum tonnage of 2250 tpd of municipal solid waste and proposes to cease accepting trash at the Milliken Sanitary Landfill in December, 1996. The SWFP revision will include development of final grading plans which enable a more precise estimate of site capacity and site life of the landfill. Based on the development of a final development plan the ultimate height of the landfill will not exceed 1,086 feet above mean sea level. It is estimated that the total capacity of the 196 acre landfill will be approximately 25,494,000 cy, in-place volume approximately 22,594.,000 cy, and remaining capacity for waste and cover material excluding final cover material approximately 3,900,000 cy. The County of San Bernardino currently projects cessation of acceptance of trash in December of 1996. The existing Milliken Sanitary Landfill will be designed and operated in compliance with all applicable local and state regulations. The SWMD adopted a Negative Declaration for the project and filed the Notice for the project and filed the Notice of Determination with the Clerk of the Board of Supervisors of San Bernardino County on June 29, 1992, and with the Governor's Office of Planning and Research on July 3, 1992, pursuant to the California Environmental Quality Act. The SWFP application package for the Milliken Sanitary Landfill is scheduled to be submitted to the San Bernardino County Department of Environmental Health Services on or before July 28, 1995.
