1997-20 RESOLUTION NO. 97- 20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, INITIATING AN APPLICATION FOR A REORGANIZATION TO INCLUDE FORMATION OF THE EAST VALLEY FIRE PROTECTION DISTRICT AND DETACHMENT FROM COUNTY SERVICE AREA#38 SECTION 1. The City Council of the City of Grand Terrace, County of San Bernardino, hereby finds and determines: (A) That this Council desires to initiate proceedings pursuant to the Cortese-Knox Local Government Reorganization Act of 1985 (Government Code Section 56000 et sec) for a reorganization to include the formation of the East Valley Fire Protection District and detachment from County Service Area#38. (B) That the boundaries of the proposed new district are identified in the attached legal description identified as "Exhibit A", with the understanding that such boundaries may be later amended to include additional territory. (C) That this proposal is consistent with established spheres of influence. (D) That the reason for this proposal is to promote local decision-making on important fire - protection issues affecting the east valley area. i (E) That this proposed reorganization shall be subject to the condition that CSA #38 Improvement Zone L is also detached from the area, and that the appropriate assets and liabilities of CSA 38 within the subject territory shall be transferred to the East Valley Fire Protection District as the successor agency. (F) That property tax revenues for the East Valley Fire Protection District shall be determined pursuant to Government Code Section 56842, and as a condition of this reorganization, all other assets, and liabilities of CSA 38 and any other agencies attributable to the affected area shall be transferred to the successor agency. (G) The proposed reorganization is intended to be a joint application with the City of Highland and possibly other jurisdictions. SECTION 2. The City Council of the City of Grand Terrace, County of San Bernardino, therefore, hereby resolves and orders: (A) That this Resolution of Application is hereby adopted and approved by this Council, acting in its capacity as an"affected agency" as required by Government Code Section 56800(a), and as defined in Government Code Section 56014. (B) That the Local Agency Formation Commission for San Bernardino County is hereby requested to take proceedings for this proposed reorganization to include formation of the East Valley Fire Protection District and Detachment from County Service Area 38, as described in Exhibit"A" attached hereto, Resolution No. 97-20 Page 2 and according to the terms and conditions stated above and in the manner provided by the Cortese- Knox Local Government Reorganization Act of 1985. An indiction of when those services can feasibly be extended to the study area. 4. An indication of any improvement, or upgrading of infrastructure or other conditions the local agency would impose or require within the affected territory- (for example, the payment of tees, the upgrading of structures, roads..water and sewer facilities. etc.). 5. An indication of how the agency's services will be financed if the change is approved. 6. An indication.of whether the affected area is or will be proposed for inclusion within an existing or proposed inproveaent zone, redevelopment area, assessment district or community facilities district. the submitted Ilan for Services must demonstrate that the range and level of service currently avail- able will, at least. be maintained following completion of the change. The Plan for Services needs to be signed, dated, and certified as to its completeness and accuracy by an official representative of the affected city or district.
