1993-16 RESOLUTION NO. 93-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ESTABLISHING A SERVICE.AUTHORITY FOR THE ABATEMENT OF ABANDONED, JUNK AND INOPERATIVE VEHICLES; PROVIDING FOR A ONE DOLLAR ($1.00) VEHICLE REGISTRATION FEE TO BE UTILIZED FOR THE PURPOSE OF ABATING ABANDONED, JUNK AND INOPERATIVE VEHICLES IN THE INCORPORATED AREA OF THE CITY OF GRAND TERRACE AND DIRECTING THE MAYOR AND CITY COUNCIL TO ENDORSE THE CREATION OF A SERVICE AUTHORITY BY THE SAN BERNARDINO COUNTY BOARD OF SUPERVISORS WHEREAS, in the City of Grand Terrace the problem of abandoned, junk and inoperative vehicles is a hazard and public nuisance and has been recognized by the adoption of procedures for their abatement; and WHEREAS, by enacting Vehicle Code Section 22710, the State of California has similarly recognized the problem by adopting procedures for the inclusion of an annual one dollar ($1 .00) fee on registered vehicles, to be returned to the counties and cities, for abandoned vehicle abatement; and WHEREAS, any money so received shall be used only for abatement, removal and disposal as public nuisances of abandoned, wrecked, dismantled or inoperative vehicles or parts thereof from private or public property; and WHEREAS, the regulations and guidelines established by the State require that a county-wide Abandoned,Vehicle Service Authority ("Service Authority" herein) be established pursuant to Section 22710 of the California Vehicle Code; and WHEREAS, because of the delay in receipt of State guidelines for establishing an Abandoned Vehicle Service Authority, timeless is of the essence in fulfilling the requirements of Vehicle Code Section 22710 and the regulations promulgated thereto; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY RESOLVE, DECLARE, AND ORDER AS FOLLOWS: Section 1. The City of Grand Terrace, State of California, approves establishment of the Grand Terrace Abandoned Vehicle Service Authority . Section 2. That the Mayor of the City of Grand Terrace is authorized and directed to enter into all necessary contracts or agreements with the San Bernardino County Service Authority on behalf of the City Council, subject to City Attorney review and approval. Section 3. That the staff of the Grand Terrace Service Authority be staff from existing City personnel positions. Section 4. That any money so received shall be used only for abatement, removal, and disposal as public nuisance of abandoned, wrecked, dismantled, or inoperative vehicles or parts thereof from private or public property. Section 5. That an annual vehicle registration fee of one ($1 .00) be imposed for abandoned vehicle abatement purposes. IT IS HEREBY RESOLVED that the Mayor of the City of Grand Terrace, or authorized designee, solicit the cooperation of the other incorporated cities in the County for the establishment of their service authority in order that a majority of the incorporated cities participate in the creation of a service authority. BE IT FURTHER RESOLVED that the Mayor of the City of Grand Terrace, or authorized designee, lobby the San Bernardino County Board,of Supervisors for the creation of a San Bernardino County Service Authority.
