1994-24 ' RESOLUTION NO. 94-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA ADOPTING RV. COVER REVIEW PROCEDURE WHEREAS, R.V. covers, depending upon their materials, colors and size, may adversely affect the environment; and WHEREAS, R.V. covers may have a similar impact as other structure which are subject to design review; and WHEREAS, the Community Development Department and the City Planning Commission/Site and Architectural Review Board have the responsibility to ensure: "...that the location and configuration of structures are visually harmonious with their sites and surrounding sites and structures, that they do not interfere with neighbors'privacy,that they do not unnecessarily block scenic views from other structures and/or.public areas, and be in scale with the townscape and ��. natural landscape of the area; ...that the architectural design of structures and their materials and colors are visually harmonious with surrounding development, natural landforms, is functional for the proposed project and is consistent with this title; ...that plans for landscaping and open spaces provide a functional and visually pleasing setting. for the structures on the site and is harmonious with the natural landscape of the area and nearby developments." WHEREAS, this proposal is consistent with the Zoning Code and with the City General Plan;.and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Grand Terrace that R.V. Covers are subject to the following review policy: 1. Interpret subject items to be accessory structures as well as construction activity. 2. Require Land Use Application (Level 1 Design Review) including notices to adjacent property.owners, with the right to appeal to Planning Commission — and Site and Architectural Review option. 3. Require a Building Permit Application for determination if a permit is required or not. Recommended procedure can be incorporated without code amendments, as the definition of accessory structures is very broad and the Land Use Application process already requires staff review of any "construction above 6' in height. Covers triggered staff research of various types and forms of R.V. Covers. By studying the types, sizes, height, bulk colors and materials, staff concluded that in some cases, the impact of such structures could be compared to the impact of a room addition, accessory structure and/or a playhouse. Consequently, staff is proposing a review process for R.V. Covers. Currently, RV. Covers and tents or tarps have not bee considered accessory structures or construction activity..They are considered to be of a temporary nature and usually do not threaten public health and safety. Therefore, unless these covers are more substantial and they actually consist of wooden.carports or heavy metal structures or are used for habitable purposes, no permit is required 22795 Barton Road•Grand Terrace,California 92324-5295•(909)824-6621 At this time, as.a result of our research, staff proposes a minimal review process for R.V. i Covers, as follows: 1. Interpret subject items to be accessory structures as well as construction activity. 2. Require Land Use Application (Level 1 Design Review) including notices to adjacent property owners, with the right to appeal to Planning Commission and Site and Architectural Review option: $33.00. 3. Require a Building Permit Application for determination if a permit is required or not: $33.00. Recommended procedure can be incorporated without code amendments, as the definition of accessory structures is very broad and the'Land Use Application process already requires staff review of any "construction" above 6' in height. • t No pro-active code enforcement will take place; only complaint-based code enforcement. This process would function as an educational tool and would be used whenever applicants call for information, or in case of illegal construction. An example is the large R.V. cover at 23059 Merle Court which triggered neighbor complaints. Please refer to the second page of the memorandum to the City Manager for information on this case, Attachment B. ISSUES: Design Criteria: The only issue staff can see at this-Point is whether or not there is a need to develop design criteria. Staff feels that since these R.V.covers fit into the definition and can be considered accessory structures, and staff has design authority to review these and even larger construction of room additions,staff is prepared to review R.V.covers following existing Site and Architectural Review guidelines "as is", without additional design criteria. _ Should the Commission desire further guidelines, staff will pursue it. Please refer to polaroid pictures of"various R.V. covers found in our City. The angle of the pictures is minimizing the visual impact, however, it still shows the various types encountered. Cover Review Per your request, attached is our recommendation on how to handle similar cases in the future. • t As you are aware, R.V. covers and tents have not been considered accessory structures or construction activity in the past. They are of a temporary nature and usually do not threaten public health and safety. Unless these covers are made of wood or brick,with a roof or any other permanent type of construction material or are used for habitable purposes,no review- �� Js required We have recently,and for the 5rst time,received two citizen complaints for R.V.covers and have noticed a proliferation of them within the City. Some are neat and well done and some are very substandard. As with playhouses, R.V. covers may need some type of minimal review. The review will minimize bulk and visual impact of R.V. covers on adjacent neighbors. Review process recommended is as follows: 1. Attachment B Merle Court Citizen Complaint _ In terms of the current citizen complaint, I would like to inform you that Mr. Jensen, property owner of the property in question, has consulted with the Planning Department several times before erecting the subject R.V. cover (or before "building the subject structure") and was told that no permits or reviews were needed. He was also encouraged to use a color compatible with surroundings, one that was not brightly colored. In case we need to take him through this recommended process of Land Use Application and Building permit, the results may not alter the current appearance or placement of the RV cover. As is, it meets the accessory.structure setbacks and has a discreet color. Its height is not more than the height of a car garage. In addition,from a nuisance perspective, the RV.is operable and parked legally on a cement driveway. On the other hand,the ideal structure for this location would be a high quality wooden structure with beams and trellis, Simla r to a patio cover. However, it may not protect the R.V.from dust and sun exposure, thus, it may not be an option for the property owner. Yet,per Code,he-does have the right to the RV. cover. Consequently, the review process will likely cause an appeal to the City Council. Should I call a meeting of involved parties? Cover Structure As per request from the Planning Department, I visited the site to investigate the complaint regarding the R V. cover. Byron R.Matteson Mayor please be advised that this facility would not come under the jurisdiction of this department and therefore would not require a permit or any type of inspection. Id M.Christianson Mayor Pro Temporn .I.spoke with Mr.John Jensen,he stated that he had contacted the property owner to the west at 2306OMede Court and discussed this issue with him prior to,purchasing the cover and at Gene Carlstrom� that time his neighbor had no problem.
