1991-10 RESOLUTION NO. 91- 10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAND TERRACE OFFICIALLY PROTESTING SAN
BERNARDINO COUNTY ' S ILLEGAL OFFSET OF COUNTY
BOOKING FEE CHARGES AGAINST CITY PROPERTY TAX
AND OTHER REVENUES .
WHEREAS, the State Legislature , in the late hours of
the 1990 legislative session , approved SB2557 allowing Counties
to charge cities booking fees pitting cities against counties ;
and
WHEREAS , San Bernardino County adopted booking fees in
January 1991 over the protests of all the cities and law
enforcement agencies of the County, including the Sheriff ; and
WHEREAS , all 22 cities in the County filed suit against
San Bernardino County in Superior Court , Case #262309 ; and
WHEREAS , the County began billing cities for booking
fee charges retroactive to July 1 , 1990; and
WHEREAS , the cities dutifully protested such charges
pursuant to Government Code Section 907; and
WHEREAS , in April 1991 , the County began offsetting
such booking fee charges against property tax and other revenues
legally obligated to the cities in 'contravention to State - law ;
NOW, THEREFORE BE IT RESOLVED that the City of Grand
Terrace hereby officially protests San Bernardino County ' s
illegal offset of County booking fee charges against City
property tax and other revenues . The City Clerk is hereby
directed to have a copy of this Resolution sent to the San
Bernardino County Board of Supervisors.
