2013-51 RESOLUTION NO. 2013-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 2013, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a Special Election under was held and conducted in the City of Grand Terrace, California, on Tuesday, November 5, 2013, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, reviewed and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution 2013-36, adopted July 23, 2013, the San Bernardino County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF .THE CITY OF GRAND TERRACE, i CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The whole number of votes cast in the City was 1,885. SECTION 2. The Measure voted upon at election is as follows: Measure C Utility User Tax Response Vote To ensure Grand Terrace has the funds necessary to remain an independent city and able to provide essential services to Yes residents including rapid response to 9-1-1 emergencies, maintenance/repair of local streets, adequate police services, and maintaining parks and public facilities, shall the City of Grand Terrace establish a utility users tax of 5% for six years No only with independent citizen oversight, all money staying local, and an exemption for low-income seniors? SECTION 3. The number of votes given in the City for and against the measure is listed in the attached Exhibit "A". SECTION 4. The City Council does declare and determine that as a result of the election, a majority of the voters voting on the measure relating to a Utility User's Tax did not vote in favor of it, and that the measure was not carried, and shall not be deemed adopted and ratified. SECTION 5. The City Clerk shall enter on the records of the City Council of the City of Grand Terrace, a statement of the result of the election showing the whole number of votes cast and the whole number of votes given for and against the measure. SECTION 6. The City Clerk shall certify the adoption of this Resolution and enter it into the Book of Resolutions. PASSED, APPROVED AND ADOPTED this 10th day of December, 2013.
