2015-02 RESOLUTION 2015-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE ESTABLISHING A COMPREHENSIVE AND UPDATED FEE SCHEDULES FOR PLANNING, BUILDING AND SAFETY AND ENGINEERING SERVICES WHEREAS, on May 13, 2014, the City Council of the City of Grand Terrace adopted its 2030 Vision and 2014-2020 Strategic Plan with Goals that include Goal #1 to Ensure our Fiscal Viability; and Goal#3 Promote Economic Development; and WHEREAS, it was determined that in order to implement these goals,.the City would update its zoning, signage and development codes together with all related fees to ensure that they are appropriate and relevant to the current costs of providing services; and WHEREAS, at the City Council meeting of January 13, 2015, staff recommended to the City Council that in an effort to achieve recovery of staff costs, it is necessary to update and revise Planning, Building and Safety and Engineering fees charged by the;,City.o£Grand Terrace to provide City services without adversely impacting the City's general fund_;.and WHEREAS, Government Code section 66014 et seq. states-that, when a_local-agency charges fees for zoning changes, zoning variances, use permits, ,building permits,,building inspections, filing of applications for annexation or related reorganizations; subdivision maps, or planning services, those fees shall not exceed the estimated reasonable-.cost .of providing the service for which the fee is charged; and WHEREAS, the City's fees for the services of Planning, Building and Safety, and Engineering Divisions have been calculated based on a nexus study to ensure that they are reasonable and legally defensible; and WHEREAS, the Council now desires to amend the City's Fee Schedule to incorporate the updated fees for the services of its Building and Safety, Planning Engineering Departments; and WHEREAS, following a properly noticed public hearing at which oral and written testimony was received and considered, the City Council has determined that it is in the best interest of the City to adjust fees for City services. NOW THEREFORE, BE,IT RESOLVED by the City Council of the City of Grand Terrace, as follows: SECTION t. That the foregoing recitals are true and correct and are incorporated herein by reference. SECTION 2. The Council has duly considered the Planning, Building and Safety, and Engineering Fee Study and Fee Update, and hereby approves the updated Planning, Building and Safety, and Engineering Fee Schedules, which are attached hereto as Attachment 1 and incorporated herein by this reference. The Planning, Building and Safety, and Engineering Fee Schedules, attached hereto as Attachment 1, shall supersede those fees contained in Chapters 4.76 (Building and Safety Fees), 4.84 (Engineering Fees), and 4.88 (Planning Fees) of Title 4 Comprehensive Fee Schedules, Fines, and Taxes of the Grand Terrace,Municipal Code, which shall be repealed by separate ordinance. SECTION 4. This Resolution shall take effect immediately upon its adoption provided, however, that the fees shall not take effect until the 615t day after adoption of this Resolution, that is, March 29, 2015. Electrical permits. Any person filing an application for a permit to do electrical work shall pay a fee according to the following schedule: 1. Each service switch 600 volts or less and not over 200 amperes, $34.50; 2. Each service switch 600 or less and over 200 amperes to 1000 amperes, $69.00 3. Each service switch over 600 volts or over 1000 amperes, $115.00. The following permit fees are based on the actual dimensions and include all lighting fixtures, switches,receptacles and the circuit wiring thereof and are in addition to the fee for the electrical service. An additional fee shall apply to each motor, transformer or other electrical appliance that exceeds 50 units in accordance with the alternate fee schedule. 1. Warehouse, storage garages and aircraft hangers where no repair work is done, $0.13 per square foot; 2. All occupancies not listed, up to and including five thousand square feet, $0.14 per square foot; 3. All occupancies not listed, that part which is over five thousand square feet, $9.29 per square foot; 4. Plan Review Fees. Where no plan review fee is charged as listed in subdivisions 1 through 3 of this subsection, and an electrical plan is required to be submitted, a plan review fee of one-half the electrical permit fee shall be paid; 5. Alternate Fee Schedule. Alterations, additions, and new construction where no structural work is being done or where it is impractical to use the square footage schedule, convert to units as follows: a. For each motor or appliance, each horsepower, one unit, b. For each transformer or appliance, each kilowatt or kilowatt-ampere, one unit, c. For each three outlets, each three lighting fixtures or fraction thereof, where current is used or controlled, one unit, d. Illuminated Signs. Illuminated sign fees are fees are as follows: a. New,relocated or altered illuminated signs: i. 0.00 - - 300 square feet $35.00 ii. 300.01 square feet and over(Per square foot) $ 0.12 Plumbing permits. A. Any person filing an application for a permit to do plumbing work shall pay a fee according to the following schedule: 1. For each plumbing fixture or trap (including water, drainage piping and backflow protection therefore) $11.25 2. For each building sewer connection $30.00 3. For the installation or relocation of each floor furnace, including vent, $15.00 3. For the installation or relocation of each suspended heater, recessed wall heater or floor-mounted unit heater, $15.00 4. For the installation or relocation or replacement of each appliance vent installed and not included in an appliance permit, $10.00 5. For each appliance or piece of equipment regulated by the Uniform Mechanical Code, but not classed in other appliance categories, or for which no other fee is listed in this section, $15.00 — B. Plan Review Fees. Where no plan review fee is charged as listed in subsection A of this section, and a mechanical plan is required to be submitted, a plan review fee shall be equal to the consultant fee(s)plus 15% administrative fee. Any person filing an application for a permit to do grading work shall pay a fee according to the following schedule. Plan Review Fee. For excavation and fill on the same site, the fee shall be based on the volume of the excavation or fill, whichever his greater. Separate permits and fees shall apply to retaining walls or major drainage structures as indicated elsewhere in this chapter. There shall be no separate charge for standard terrace drains and similar facilities. The amount of the plan review fee for grading plans shall be a set forth in the following schedule: 0 - 100 Cubic yards $25.00 101 - 1,000 Cubic yards $40.00 1,001 - 100,000 Cubic yards $56.00 Plus $36.00 for each additional 10,000 cubic yards or fraction thereof over 10,001 cubic yards 100,001 —200,000 Cubic yards $310.00 Plus $15.00 for each additional 10,000 cubic yards or fraction thereof over 100,001 cubic yards 200,001 cubic yards and over $462.00 Plus $8.25 for each additional 10,000 cubic yards or fraction thereof over 200,001 cubic yards RESOLUTION NO. 2015-02 PAGE 11 OF 16 JANUARY 27, 2015 Miscellaneous permits and inspections. A. Permit Issuance Fees. 1. In addition to the fee prescribed in the electrical, mechanical, plumbing and solar energy schedules for each such permit on a single application form $ 25.00 2. Minimum total fee for any permit $ 55.00 3. -Filed investigation and report $ 85.00 4. Short-term installations: a. Temporary, construction, material processing $110.00 b. Approved temporary tents $ 66.00 5. Special inspection approvals $ 55.00 6. Standard plans: a. Fee to establish standard plan $ 40.00 b. Comparison plan review fee $ 55.00 c. Annual review $ 85.00 7. Service charge for cash deposits and other securities $ 25.00 B. Relocation Inspection Fees. The relocation inspection fees when a building is to be moved shall be equal to the consultant fee(s) plus 15% administrative fee. A minimum deposit of $150.00 shall be required. C. Rehabilitation and Demolition Processing Fees. 1. Preparation of job specifications $198.00 2. City council approval $100.00 3. Contract performance inspection $100.00 D. Billing fee $33.00 E. Record special assignment $99.00 F. Wire and/or wood fences (per lot) $20.00 G. Residential driveway approach $33.00 Swimming pool permits. The building permit fee for new swimming pools is as prescribed in this section. The permit fee includes plan review fees as shown below and all inspection fees for all phases of the construction including permit issuance fees, electrical permit fees, mechanical permit fees, plumbing permit fees and solar energy permit fees. A. Swimming pools accessory to a single-family dwelling: 1. With a standard plan $250.00 2. With other than a standard plan $310.00 B. All other swimming pools: 1. With a standard plan $350.00 - 2. Self contained $ 75.00 Residential aluminum patio cover permits. Residential aluminum patio cover permit fees are as follows: A. Residential patio covers, includes plan review and permit issuance fees, $75.00. B. When the patio cover is to be constructed from a San Bernardino County standard plan or an International Conference of Building Officials standard plan, the set fee will include comparison plan review and permit, issuance fees, $75.00. Fee refunds. The building department may authorize the refunding of any fee paid under the following conditions: A. A fee that was erroneously paid or collected; B. A refund shall not be more than eighty percent of the permit fee paid when no work had been done under a permit. A refund shall not be more than eighty percent of the plan review fee paid when an application for a permit for which a plan review fee has been paid is withdrawn or canceled before any play reviewing is done; C. A refund of not more than eighty percent of any planning fee when the request for the planning action is withdrawn or canceled before any work by the department is done; D. In no case shall the building official retain more than fifty-five dollars of the fees paid, as described in this section nor shall he refund any amount of the feed less than fourteen dollars; E. The building official shall not authorize the refunding of any fee paid except upon written application filed by the original permittee not later than one hundred eighty days after the date of fee payments. Exemptions. There shall be an exemption from all permit, plan review and inspection fees as set forth in this chapter when all of the following conditions exist: A. The building permit is for rebuilding or rehabilitating a structure because of damage caused by and occurring in the course of a disaster; RESOLUTION NO. 2015-02 PAGE 13 OF 16 JANUARY 27, 2015 B. The city council has adopted a resolution declaring a state of emergency due to the disaster, for damage caused by or occurring in the same disaster and the application for the building permit is filed with the department the resolution has been adopted by the city council. Residential solar energy permits. Any person filing an application for a permit to do solar energy work that meets the following criteria shall pay a simple fee of$75.00 for permitting: • A solar energy system no larger than 10 kW ac or 30 kW thermal. • A solar energy system installed on a single or duplex family dwelling. • A solar panel or module array does not exceed the maximum legal building height. Fines. Fines per infraction of this chapter are as follows: A. Building without a permit(other than a fence or wall), $1175.00; B. Erecting a fence or wall without a permit, $375.00. NPDES fees. All construction projects obtaining building permits that are regulated by the State Regional Water Control Board shall pay an NPDES permit inspection fee. The fee shall be $185.00 for each project. The fee will cover a six-month period starting on the date of the building permit issuance. Projects that continue beyond a six-month time limit shall pay an additional fee equaling$185.00 for each six-month period.
