2017-10 RESOLUTION 2017-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA MODIFYING THE PUBLIC WORKS FEE SCHEDULE AS IT PERTAINS TO THE REVOCABLE ENCROACHMENT PERMIT FILING FEE WHEREAS, on May 13, 2014, the City Council of the City of Grand Terrace adopted its 2030 Vision and 2014-2020 Strategic Plan with Goals that in Goal#1 to Ensure our Fiscal Viability by protecting the City from Potential litigation that is not the responsibility,of the City; and Goal #2 "Maintain Public Safety" to ensure that our residents continue to enjoy an outstanding quality of life; and WHEREAS, at the City Council meeting of April 25, 2017, the City Council introduced an Ordinance revision to amend Section 12.04.060 (required when) and add Chapter 12.10 (revocable encroachment permit) to Title 12 (streets, sidewalks and public places) of the Grand Terrace Municipal Code relating to parkway encroachments; and WHEREAS, the adopted City's fees for the services of Planning, Building and Safety, and Engineering Divisions were calculated based= on the following { staff tasks and time associated to perform to ensure that they are reasonable and legally defensible; and 1. Review the application form consisting of a Revocable License and Encroachment Permit Agreement Form. 30 min 2. Check that the Encroachment Plan includes: 1 hour A) The plan(s) shall be to scale showing existing gradients and improvements within twenty-five feet of the project area; B) Property lines, easements, drainage patterns and cultural features shall be shown and opposite edge-of-pavement. C) Shown line and grade, including surface elevations, wall heights, fence heights, cut/fill slopes and materials; D) Grading information, if the proposal involves the grading of more than twenty cubic yards, a geotechnical report is also required. E) Site visit including photos and notes. 3. Ensure the Agreement form and accompanying materials have been properly completed and required information provided including a notification list and ownership verification. 30 min 4. Review with the Planning for Land use compliance. 30 min 5. Set a date and notify the applicant and post a notice on the property (10) days prior to the review, and the posting notice will be received and reviewed. 15min 6. Notices will be mailed by staff. 30 min 7. Review and approval by the Director of the original agreement form and inform the applicant when document is ready for recording. 30 min 8. Issue the revocable Encroachment Permit. 30 min Total Staff Time: 3 hours 45 min @ burden rate of$128.60 = $482.25 WHEREAS, Government Code section 66014 et seq. states that, when a local agency charges fees for zoning changes, zoning variances, use permits, building permits, building inspections, filing of applications for annexation or related reorganizations, subdivision maps, or planning services, those fees shall not exceed the estimated reasonable cost of providing the service for which the fee is charged; and WHEREAS, the Council now desires to amend the Engineering Division Fee Schedule as it relates to Revocable Encroachment Permits so that it now includes the cost for processing a revocable encroachment permit; and WHEREAS, on May 23, 2017, the 'City Council conducted a public meeting at the City Council Chamber located at 22795 Grand Terrace Road, Grand Terrace, California. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Grand Terrace, as follows: SECTION 1. That the foregoing recitals are true and correct and are incorporated herein by reference. SECTION 2. The City Council amends Resolution 2015-02, relating to Engineering Division Fees, as follows: Application Fee Revocable Encroachment Permit $482.25 2 PASSED, APPROVED, AND ADOPTED at a regular meeting of the City Council of the City of Grand Terrace, held on this the 23d day of May, M17.
