1979-44 RESOLUTION NO. 79- 44
A RESOLUTION OF THE CITY COUNCIL OF. THE CITY OF GRAND
TERRACE, CALIFORNIA, CONFIRMING THE ORDER OF ANNEXA-
TION #1 TO THE CITY OF GRAND TERRACE (LAFC 1928)
WHEREAS, the City Council , as governing body of the City of
h Grand Terrace, hereby finds and determines:
a. That preliminary proceedings for annexation of certain
described territory to the City of Grand Terrace were initiated when
the City of Grand Terrace filed a resolution of application with the
Local Agency Formation Commission in the County of San Bernardino
pursuant to the provisions of the Municipal Organization Act of 1.977 (MORGA) ,
Gov. .Code Section 35000, et seq. ;
b. That the exterior boundaries of the territory to be
annexed are as written in the attached Legal Description (Exhitit "A") ;
c. That the Local Agency Formation Commission assigned to
said proposed. annexati.on a distinctive short form designation of LAFC No. 1928;
d. That thereafter appropriate proceedings were conducted by
the Local Agency Formation Commission and on September 12, 1979, the Commission
adopted a resolution making determinations being Resolution No. 1588,
approving the proposed annexation subject to the following conditions:
Condition No. 1 . The conducting authority shall not
make any changes in the boundaries hereby approved nor shall it impose
any new conditions or modify any conditions hereby approved unless and
until it receive-s the approval of the Local Agency Formation Commission
for such changes, modifications, or conditions pursuant to the procedures
prescribed in Section 35162 of the Government Code.
Condition No.- 2. The conducting authority shall provide
the Local Agency Formation Commission Executive Officer with a certified
copy of the resolution calling the hearing and the required number of
certified copies of the resolution indicating final disposition of the
proposal pursuant to Government Code Section 35350.
Condition No. 3. The boundaries are approved as set
forth in Exhibit "A" attached.
Condition No. 4. The conducting authority for this
annexation shall be the City of Grand Terrace.
Condition No. 5. The following distinctive short form
designation shall be used throughout this proceeding: LAFC 1928.

Condition No. 6. Included in the City' s resolution
depicting final action shall be the detachment of County Service Area 70
and CSA 70 Improvement Zone A without split of assets or liabilities.
Condition No. 7. County Service Area 38 and CSA 38
Improvement Zone G (fire protection) shall continue to overlay the area.
Condition No. 8. The date of issuance of the Certificate
of Completion shall be the effective date of this action.
e. That the Local Agency Formation Commission made the
following findings:
1 . This 43.89 acre area is legally inhabited with
55 registered voters. Assessed value is $268,055. The area is within the
sphere of influence of the City of Grand Terrace.
2. With less than 100% ownership consent, the item has
been advertised as required by law.

3. The matter has been subjected to environmental
review and a Negative Declaration has been issued indicating the annexa-
tion will not have a significant effect on the environment. The LAFC
adopted the Negative Declaration and a copy is on file in the Office of
the Clerk. The Clerk has been instructed to file the Notice of Determina-
tion. No EIR has been prepared in accordance with the California
Environmental Quality Act (CEQA) .
4. Special Districts which serve the area are listed
in the file. County Service Area 70 and CSA 70 Improvement Zone A (weed
abatement) will be detached upon annexation to avoid duplication of
services. The Commission makes the finding that County Service Area 38
and CSA 38 Improvement Zone G (fire protection) will continue to overlay
the area to assure the health and safety of the area's residents.
5. The City has pre-zoned the area for residential
uses which conforms with the City. General Plan for the area.
6. The City has submitted a plan for services, as
required by law, which indicates the availability of City services -�
upon annexation.
7. The area will benefit from City services.
8. This proposal and its anticipated effects conform'
with adopted Commission policies.
9. All notices required by law have been given; no
protests have been received.
10. Maps and legal descriptions meet State standards.
and;
WHEREAS, said Annexation has had Public Hearing as required per
MORGA; and

WHEREAS, said Public Hearing was advertised as required by
law; and
WHEREAS, said Hearing produced 0 protests in writing.
NOW, THEREFORE,' THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
DOES HEREBY approve the annexation of the territory described to the
City of Grand Terrace subject to the terms and conditions set forth
in the Local Agency Formation Commission Resolution No. 1588.
BE. IT FURTHER RESOLVED that the said territory be and is
hereby annexed to the City of Grand Terrace.
