1981-17 RESOLUTION NO. 81-17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, FINDING AND DECLARING
THAT THERE ARE PRIVATELY OWNED AND MAINTAINED
OFF-STREET PARKING FACILITIES THAT ARE GENER-
ALLY HELD OPEN FOR USE OF THE PUBLIC FOR PUR-
POSES OF VEHICULAR PARKING.
WHEREAS, there are privately owned and maintained off-street
parking facilities within the City of Grand Terrace that are generally
held open for use of the public for purposes of vehicular parking, as
stated in Section 21107.8 of the California Vehicle Code; and
WHEREAS, the City Council of the City of Grand Terrace is
concerned about vehicles left standing in stalls, or spaces, desig-
nated for physically handicapped persons in violation of California
Vehicle Codes 22507.8 and 22511 .8; and
WHEREAS, the City Council of the City of Grand Terrace is
concerned about vehicles being driven at a speed greater than is rea-
sonable or prudent in violation of California Vehicle Code 22350; and
WHEREAS, the City Council of the City of Grand Terrace is
concerned about vehicles being driven in willful or wanton disregard
for the safety of persons or property in violation of California Vehicle
Code 23103; and
WHEREAS, the City Council of the City of Grand Terrace is con-
cerned about persons engaging in motor vehicle speed contests and ex-
hibitions of speed in violation of California Vehicle Code 23109; and
WHEREAS, the City Council of the City of Grand Terrace is
concerned about the operation of off-highway vehicles in violation of
California Vehicle Code Division 16.5 (commencing with Section 38000) ;
and
WHEREAS, the City Clerk of the City of Grand Terrace has
caused prior written notice to be mailed to the owners and the operators
of the privately owned and maintained off-street parking facilities (names
and addresses for whom are as shown on Exhibit "A" attached hereto and
incorporated herein) at least ten (10) days prior to adoption of this
Resolution;
NOW, THEREFORE, be it resolved by the City Council of the
City of Grand Terrace as follows:
SECTION 1 . The City Council of the City of Grand Terrace, does
find and declare that there are privately owned and maintained off-street-
parking facilities that are generally held open for use of the publ i"c._f-or,7.,,,,,.
purposes of vehicular parking, as stated in Section 21107..8 of the Cali= _
fornia Vehicle Code.
SECTION 2. That Section 22507.8 of the California Vehicle Code
shall apply to any such privately owned and maintained off-street park-
ing facility, on which the owner or operator has caused to be posted in
a conspicuous place at each entrance to such off-street parking facility
a notice not less than 17 by 22 inches in size, with lettering not less
than one-inch in height, to the effect that such off-street parking
facility is subject to public traffic regulations and control .
SECTION 3. That Sections 22511 .5 and 22511 .7 of the California
Vehicle Code, concerning the definition of and rights granted to disabled
persons, respectively, shall be applicable to the provisions held herein.
SECTION 4. That Section 22511 .8 of the California Vehicle Code,
concerning the removal of unauthorized vehicles from disabled persons
designated parking areas, shall be applicable to the provisions held
herein, as stated in Section 21107.8 of the California Vehicle Code.
SECTION 5. That Sections 22350, 23103, and 23109 of the Cali-
fornia Vehicle Codes, concerning basic speed laws, reckless driving, and
speed contests, respectively, shall be applicable to the provisions
held herein, as stated in Section 21107.8 of the California Vehicle Code.
SECTION 6. That Division 16.5 of the California Vehicle Code
(commencing with Section 38000) , concerning the definition of and pro-
visions for off-highway vehicles, be applicable to the provisions held
herein, as stated in Section 21107.8 of the California Vehicle Code.
