1981-55 RESOLUTION NO. 81-55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, FINDING THAT A POR-
TION OF A CERTAIN DRAINAGE EASEMENT IS UNNECES-
SESSARY FOR PRESENT OR PROSPECTIVE DRAINAGE
EASEMENT PURPOSES AND ORDERING THE VACATION OF
SAID PORTIONS
THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY RESOLVE, ORDER, AND
DEMAND AS FOLLOWS:
SECTION 1. The City Council of the City of Grand Terrace, ha-ving-.. ;'.,-
elected to proceed under the provisions of Division 9, Part 3, Chapter:.2;_of.-
the Streets and Highways Code of thr State of California, and having"he-ld a_
public hearing as provided therein, hereby finds from all evidence submitted -
that portions of a certain drainage easement described in this Resolution are:-
unnecessary for present or prospective drainage easement purposes and :,that =the
public interest and convenience require the closing of said portions._of a
certain drainage easement.
SECTION 2. The City Council hereby orders the vacation of a certain
portion of a drainage easement located in the City of Grand Terrace,
California, and more particularly described as follows:
The southerly 10.00 feet of Lots 10 through 17 inclusive,
Tract No. 6567 as per map recorded in Book 98 of Maps, pages
49 and 50, in the Office Recorder of said County. Said
southerly 10.00 feet is shown as "10' S.B.C.D.E." on said
map.
The southerly 10.00 feet of Lots 1 through 7 inclusive, Tract
No. 9082 as per map recorded in Book 120 of Maps, pages 94 and
95 in the Office of the County Recorder of said County. Said
southerly 10.00 feet is shown as "10' S.B.C.D.E." on said map.
SECTION 3. In the proceeding herein adopted by this City Council for
the vacation of portions of a certain street described in Section 2, the City
of Grand Terrace reserves and excepts from the vacation the permanent easement
and right at any time, or from time to time, to construct, maintain , operate,
replace, remove and renew upon, over and across any street or part thereof
proposed to be vacated and pursuant to any existing franchises or renewals
thereof, or otherwise, to construct, maintain, operate, replace, remove, renew
and enlarge lines of pipe, conduits, cables , wires , poles and other convenient
structures, equipment and fixtures for the operation of gas pipe lines,
telegraphic and telephone lines, railroad lines , and for the distribution or
transportation of electric energy, petroleum and its products, ammonia, water
and incidental purposes, including access and right to keep property free from
inflammable materials and wood growth, and to otherwise protect the same from
all hazards in, upon, and over the portion of the drainage easement proposed
to be vacated.
SECTION 4. The City Council hereby determines that the vacation. of
portions of the drainage easement described herein is required by public
interest, convenience, safety, and welfare.
