A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, SELECTING A PROPOSAL
FOR THE CONSTRUCTION OF A BROADBAND TWO-WAY
COMMUNICATIONS SYSTEM AND AUTHORIZING THE CITY
MANAGER TO ENTER INTO NEGOTIATIONS WITH THE
SUCCESSFUL APPLICANT TO OBTAIN A MUTUALLY
ACCEPTABLE FRANCHISE AGREEMENT.
WHEREAS, the City Council of the City of Grand Terrace is interestedV
in obtaining a broadband two-way communications system for the City of.;Grand_
Terrace; and :
WHEREAS, the City Council of the City of Grand Terrace has ."Opted a-,
Resolution requesting proposals for the construction and operation .of e
broadband two-way communications system for the City of Grand Terrace,. and: ."
WHEREAS, proposals have been received and evaluated by a committee
made up of the City Manager, the City Attorney, the City Engineer, and
the Administrative Assistant; and
WHEREAS, the City Council of the City of Grand Terrace has held a
public hearing on this matter where both the applicants and the public were
given an opportunity to speak; and
WHEREAS, the City Council of the City of Grand Terrace is now prepared
to select a proposal for the construction and operation of a broadband two-way
communications system;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY RESOLVE AND DETERMINE AS FOLLOWS:
Section 1. That the proposal of Teleprompter of Southern California,
Inc., is tentatively selected to construct and operate a broadband two-way
communications system within the City of Grand Terrace.
Section 2. That the City Manager is authorized to enter into
negotiations with Teleprompter of Southern California, Inc., in order to
obtain a mutually acceptable franchise agreement.
Section 3. In the event the CATV Committee is unable to negotiate a
mutually acceptable franchise agreement with the successful applicant, or if
the City Council of the City of Grand Terrace finds the agreement negotiated
between the CATV Committee and the successful applicant not to adequately
serve or protect the public interest, the City Council of the City of Grand
Terrace may reject any and all such proposed franchise agreements and either,
at its option, select a different proposal and authorize the CATV Committee to
enter into negotiations with that operator, or reject all proposals and, if it
so elects, request new or additional proposals for the construction and
operation of a broadband two-way communications system within the City of
Grand Terrace.
