RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAND TERRACE, CALIFORNIA, AUTHORIZING THE
SAN BERNARDINO COUNTY SHERIFF 'S DEPARTMENT TO
ACCESS SUMMARY CRIMINAL HISTORY INFORMATION FOR ti
EMPLOYMENT, LICENSING, OR CERTIFICATION PURPOSES.--
AND DECLARING THAT THE CITY OF GRAND TERRACE. - -
SHALL NOT CONSIDER PERSONS WHO HAVE BEEN
CONVICTED OF A FELONY OR MISDEMEANOR INVOLVING
MORAL TURPITUDE ELIGIBLE FOR EMPLOYMENT OR
LICENSING.. WITH CERTAIN EXCEPTIONS .
WHEREAS, Penal Code Sections 11105 (b) (10 ) and 13300 (b) (10 )
authorize cities, counties, and districts _to; access state. and
local summary criminal history information for employment,
licensing, or certification purposes; and
WHEREAS, Penal Code Sections 11105 (b) (10 ) and 13300 (b) (10 )
requires that there be a requirement or exclusion from
employment, licensing, or certification based on specific
criminal conduct on the part of the subject of the record; and
WHEREAS, Penal Code Sections 11105 (b) (10 ) and 13300 (b) (10 )
require the city council, board of supervisors, or governing
body of a city, county, or district to specifically authorize
access to summary criminal history information for employment
licensing, or certification purposes :
NOW, .THEREFORE, the City Council of the City of Grand
Terrace does hereby RESOLVE, DETERMINE AND ORDER as follows :
Section 1 . That the San Bernardino County Sheriff' s
Department, acting as the City Police Department under contract
with. -the, City of Grand Terrace is hereby authorized to access
summary -criminal history information for employment, licensing,
or- .certification purposes.
Secti6i2;J2. That the City of Grand Terrace shall not
consider; a. -person who has been convicted of a felony or a
Misdemeanor -involving moral turpitude eligible for employment
or licensing; except that such conviction may be disregarded
where_. initigating circumstances exist, or that the conviction is
not related to the employment or license. in question.
Section 3. That the City Clerk and the Sheriff' s
Department are hereby authorized to forward copies of this
Resolution to the California Department of Justice and such
other agencies, organization or persons as are necessary to
implement the purposes of this Resolution.
