2013-08 r RESOLUTION 2013 - 08 A RESOLUTION OF THE OVERSIGHT BOARD FOR THE SUCCESSOR AGENCY TO THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF GRAND TERRACE TRANSFERRING FORMER COMMUNITY REDEVELOPMENT AGENCY ASSETS TO THE GRAND TERRACE HOUSING AUTHORITY. WHEREAS, the State Legislature dissolved redevelopment agencies by enacting Assembly Bill Nos. 1x 26 and 1484, relating to redevelopment dissolution, ("Dissolution Statutes") which became effective on June 28, 2011 and June 27, 2012, respectively; WHEREAS, the City of Grand Terrace created the Grand Terrace Housing Authority ("Housing Authority") on January 30, 2012 to assume all rights, powers, assets, liabilities, duties, obligations and functions associated with the housing activities of the former Community Redevelopment Agency of the City of Grand Terrace; WHEREAS, the Housing Authority, as required by Health and Safety Code §34176(a)(2), submitted a Housing Assets Transfer Form (HAT) to the California Department of Finance on July 26, 2012; WHEREAS, the DOF on August 25, 2012 incorrectly denied the transfer of three (3) parcels of vacant land purchased with Low-Moderate Income Housing Funds to.the Housing Authority listed in the HAT on Exhibit A— Real Property; WHEREAS, the DOF held a Meet & Confer meeting on December 5, 2012 which included the transfer of the three parcels listed in the HAT on Exhibit A— Real Property; WHEREAS, the DOF issued a revised determination on January 25, 2013 approving the transfer of the three parcels listed in the HAT on. Exhibit A — Real Property to the Housing Authority thereby fully approving the Housing Assets Transfer Form submitted to the DOF on July 26, 2012; WHEREAS, the Oversight Board desires to memorialize and approve the transfer of all housing assets, as defined by Health & Safety Code section 34176, regardless of whether such assets were listed on the HAT. NOW THEREFORE, BE IT RESOLVED THAT THE OVERSIGHT BOARD DOES RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS: Section 1. The Oversight Board hereby transfers all housing assets to the Grand Terrace Housing Authority as defined by Health and Safety Code § 34176(e). This transfer shall include, but not be limited to, the assets listed in the Housing Assets Transfer Form submitted to the California Department of Finance on July 26, 2012 and included as an attachment to this Resolution. Section 2. The Oversight Board hereby transfers all water shares in the Riverside Highland Water Company associated with housing assets listed in Exhibit A — Real Property of the Housing Assets Transfer Form to the Grand Terrace Housing Authority. Section 3. The Oversight Board hereby transfers any housing covenants of the former Community Redevelopment Agency of the City of Grand Terrace to the Grand Terrace Housing Authority. Section 4. The Oversight Board hereby authorizes the Executive Director to take all actions necessary and required to carry out this Resolution. Section 5. This Resolution shall be effective five business days after its passage or in accordance with applicable law. Section 6. The Oversight Board Secretary shall certify to the adoption of this Resolution.
