2001-23 RESOLUTION NO. 01-23 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, STATE OF CALIFORNIA,APPROVING TPM-01-02,TENTATIVE PARCEL MAP NO. 15780 WHEREAS,the applicant,James G.Lintern,has applied for the approval of Tentative Parcel Map 15780 to divide one(1)residential parcel into two(2) separate,residential parcels; and, WHEREAS, a properly noticed public hearing was held by the Planning Commission on October 18,2001; and WHEREAS,the California Environmental Quality Act(CEQA),Article 19, Section 15315,Class 15 -Minor Land Division of four or fewer parcels is Categorically Exempt; and WHEREAS,the Planning Commission recommended approval of TPM-01-02 to the City Council and approved Site and Architectural Review No.01-09 and Variance No.01-06 contingent on the Council's approval of the tentative parcel map; and WHEREAS, a properly noticed public hearing was held by the City Council on November 8, 2001 regarding the approval of Tentative Parcel Map-01-02(TPM 15780). NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY RESOLVE AS FOLLOWS: l. That the site is physically suitable for R1-20(Single Family Residential District-minimum required area 20,000 square feet)development. 2. That the design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage. 3. That the design of the subdivision or type of improvements are not likely to cause serious public health problems or cause a threat to life and property. 4. That the proposed subdivision,together with the provisions for its design and improvements are consistent with the General Plan. r 5. That the accompanying variance to modify the requirement for 50 foot of street frontage will not result in any aesthetic impacts to the neighborhood and the westerly parcel, requiring this modification,will have adequate access to a public street as a condition of approval. 6. That the proposed subdivision, its design, density and type of development and improvements conform to the conditions imposed by the regulations of the City's Development Code and the regulations of the City of Grand Terrace. BE IT FURTHER RESOLVED THAT TPM-01-02 is hereby approved subject to the following . conditions: Conditions Prior to Final Parcel Map Approval: 1. Upon approval of these conditions and prior to becoming final and binding, the applicant must agree to and sign the "Acceptance of Conditions" letter. The letter form and content to be prepared by the Community and Economic Development Department. 2. Provide a"will serve" letter from the Riverside Highland Water Company. 3. The development shall conform to all requirements of the Grand Terrace Municipal Code and the State of California Subdivision Map Act. 4. Provide that all utilities shall be run underground or bond for same as required by the Director of Building and Safety/Public Works in his memorandum dated September 12, 2001. 5. Comply with Condition F2PC of the County Fire Department in their letter dated June 20, 2001 regarding fire flow in the letter dated September 25, 2001. 6. The final map shall be properly prepared by a licensed land surveyor or registered civil engineer authorized to practice land surveying and based on a field survey. 7. The applicant shall provide proof of access rights from Palm Avenue direct to Parcels 1 and 2. The proof of access rights shall be in the form of an access easement,a title "Guarantee of Ingress and Egress" or any other method available to prove legal access. 8. The City Engineer of the City of Grand Terrace shall receive all required clearances, tax clearances and certificates before forwarding the final parcel map to the City Council for approval 9. The applicant or developer shall submit a "Geotechnical and Geology" study to recommend the work necessary to stabilize the existing building pads. Said study shall address any building setbacks required to protect from rock fall hazard, especially from the vertical rock faces above Parcel 1. 10. The San Bernardino County Fire Department shall determine the required width for the driveway serving Parcels 1 and 2. 11. The private street/drive,from Palm to the northerly boundary of Parcel 1,serving the two proposed lots shall be improved at a minimum to the standards for hillside, private streets as adopted by San Bernardino County. If improvements are required, the street/driveway shall be improved as required prior to the final parcel map approval or bonds shall be posted with the City to ensure that the improvements will be completed. 12. The City Engineer of the City of Grand Terrace shall approve a detailed drainage plan that addresses the increase and change of delivery for drainage. Notarized letters of acceptance shall identify the parcel accepting the runoff by legal description,the date of the plan reviewed by the adjoining property owner and that they accept the proposed drainage improvements. 13. If improvements are required for water service and fire flow,the water lines shall be extended to serve the properties, as required by the Riverside Highland Water Company and the County Fire Department or bonds shall be posted with the City to ensure that the improvements will be completed and shall be constructed to the standards of the Uniform Plumbing Code. Conditions Prior to Grading: 14. Provide grading and drainage plans memorandum from the City's Building and Safety/Public Works Department). 15. The grading plan shall conform to the requirements of the Uniform Building Code. 15. A detailed grading plan shall be prepared for the development of Parcel 1 addressing the rock fall hazard posed by the near vertical rock faces north of the proposed home, the rock projecting from the pad and its impact on the home and the corrective grading that is necessary to create a safe building site. 16. The grading plan for Parcel 1 shall detail the proposed drainage pattern and any improvements proposed to carry the drainage from the pad to the adjoining property. Once the drainage plan is detailed the affected neighbor or neighbors shall review the plan and accept the drainage as noted under the parcel map. 17. If the proposed grading occurs in an area off-site to the south, permission from the adjoining neighbor or neighbors will be required in written form which shall be submitted to the City and said written permission shall be recorded with the County's Recorder's Office prior to the issuance of a grading permit. 18. The land subdivider shall accept and properly dispose of all on and off site drainage flowing onto or through the site. Conditions at the Time of Development of the Parcels: 19. The proposed project of a single family residence shall be constructed in accordance with the Site and Architectural Review Board's approval on October 18,2001,minor changes and/or clarification may be made by the Community and Economic Development Director. The design,materials and colors shall match those approved by the Site and Architectural Review Board. 20. Any roof-top mechanical equipment shall be located at a distance from the edge of the building or shielded by means of a lattice or similar material or parapet so as not to be visible from pedestrian level, adjacent roads or adjacent properties. 21. The applicant or developer install sewer laterals to connect both parcels to the public sewer to the standards of the Uniform Plumbing Code and to the satisfaction of the Director of Building and Safety/Public Works. 22. Comply with all requirements of Director of Building and Safety/Public Works in his memorandum dated September 12, 2001. 23. Full compliance with the recommendations of the County of San Bernardino Fire Department- Community Safety Division- in the letter dated September 25, 2001. 24. Payment of applicable school fees to the Colton Unified School District with submittal of the proof of said payment to the City of Grand Terrace prior to the issuance of building permits. 25. Prior to the issuance of building permits, submit a work plan to the Community and Economic Development Department with the hours of construction and measures to minimize any impacts resulting from noise, dust or construction traffic. 26. All construction debris shall be collected and placed in appropriate containers on a daily basis and the construction site shall be maintained in a neat and orderly manner. 27. Comply with the requirements of the Riverside Highland Water Company set out in the letter from that agency dated September 7, 2001. 28. All plans shall be designed and improvements performed by person registered and licensed to perform such work pursuant to the State of California Business and Professions Code,which shall comply with the requirements of the Americans with Disabilities Act, 1997 U.B.C. and the Grand Terrace Municipal Code. 29. Comply with all recommendations listed in the County of San Bernardino Fire Department's letter dated June 20, 2001. 30. Pay all required fees, obtain all permits, inspections and approval on all work to be done. 31. Three copies of a landscaping and irrigation plan shall be submitted to the Community and Economic Development Department prior to the issuance of building permits. All manufactured slopes shall be appropriately planted to the satisfaction of the City. Said landscaping to be installed in the front yard area prior to issuance of occupancy for the proposed residence. 32. The landscaping plan shall include shade bearing trees such as olive trees to shade the southwest exposure of the proposed residential structure to help with energy conservation. 33. The developer shall comply with the requirements of the Gas Company in its letter to the City dated September 19, 2001. 34. Payment of the Traffic Signal and Circulation Improvement fees as established by Ordinance No. 190 of the City of Grand Terrace prior to the issuance of building permits. 35. If construction is conducted during the rainy season,November 1 to April 15,a wet weather erosion control plan shall be prepared and submitted to the City for approval prior to the issuance of building permits. 36. Access improvements to the common driveway serving each parcel, if required by the parcel map, shall be completed prior to the occupancy of the residence.
