Zoning Code Amendment 16-03; an Ordinance Repealing and Replacing in Its Entirety Chapter 18.91 (Marijuana Regulations) of Title 18 of the Grand Terrace Municipal Code Keith Collins presented a staff report. He answered some clarifying questions about the proposed changes. Chair Comstock asked if any written communication had been received. Director Molina responded that no comments had been received. PUBLIC ADDRESS There were no requests to speak from the public. Deliberation from Commission: There was a discussion with staff about cultivation.language and what it would apply to. Staff clarified that.the proposed changes would only apply to outdoor cultivation and not prohibit use within personal property indoors, as contained in the proposed initiative. Mr. Collins answered a question from the Commission about ordinance enforcement, stating that the Sheriff would oversee and enforce the revised regulations. Commissioner Cesena asked if the ordinance would remain as written if the proposed changes were not passed. Mr. Collins responded that the ordinance would still need to be rewritten. Commissioner Goatcher asked about the City imposing municipal tax rates to which Mr. Collins responded that a tax could be imposed by vote of the people under Proposition 218 and that the City would set the rate, if it were included to allow marijuana uses. There was additional conversation about enforcing marijuana delivery and altering indoor structures. Mr. Collins responded that law enforcement would conduct undercover buys halt marijuana delivery activity; and, that based on the indoor structure code, the city would declare altered structures a nuisance. 1) CONDUCT A PUBLIC HEARING; AND 2) ADOPT A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, CALIFORNIA, RECOMMENDING THAT THE CITY ( COUNCIL MAKE A DETERMINATION THAT ZONING CODE AMENDMENT 16-03 IS EXEMPT, PURSUANT TO SECTION 15061(B)(3), FROM THE City of Grand Terrace Page 2 Minutes Grand Terrace Planning Commission/Site and Architectural Review Board September 29, 2016 - . CALIFORNIA ENVIRONMENTAL QUALITY ACT AND RECOMMENDING THE CITY COUNCIL AMEND THE GRAND TERRACE MUNICIPAL CODE BY REPEALING AND REPLACING IN ITS ENTIRETY CHAPTER 18.91 (MARIJUANA REGULATIONS) OF TITLE 18 RELATING TO MARIJUANA REGULATIONS RESULT: APPROVED [UNANIMOUS] MOVER: Edward A. Zoning Code Amendment 15-02 and Specific Plan Amendment 15-01 Regulating Smoke Shops and Tobacco Stores Director Molina presented a staff report in the item. She responded to questions about written correspondence, stating none had been received. She explained the definition of tobacco and confirmed there are two smoke shops currently selling tobacco in the area. There was discussion from the Commission about the 250 sq. ft. storefront allowable space to sell tobacco and was in favor of keeping the code as written. However, the Commission unanimously preferred changing the proposed ordinance to include e- cigarettes in the 250 sq. ft. limitation. PUBLIC ADDRESS There were no requests to speak from the public. Deliberation from,Commission: Chair Comstock asked whether -the ordinance needed to be re-written in order to combine the tobacco definitions and Mr. Collins confirmed that more time would allow staff to create a clean version of the revised ordinance to'bring back for approval. Chair Comstock moved to continue the hearing item to a date certain of November 3, 2016. 1.
