01/16/1997GRAND TERRACE PLANNING COMMISSION NIINUTES OF REGULAR MEETING JANUARY 16, 1997 The regular meeting of the Grand Terrace Planning Commission was called to order at the Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California on January 16, 1997 at 7:00 p.m. by Chairman, Jimmy W. Sims. 6:20 P.M. CONVENED PART I OF PUBLIC WORKSHOP SESSION - IN CITY COUNCIL CONFERENCE ROOM * 6:20 - 6:55 p.m. PRESENT: Jimmy W. Sims, Chairperson Doug Wilson, Commissioner Moire Huss, Commissioner Matthew Addington, Commissioner Mary Trainor, Commissioner Gerry Ellis, Commissioner Patrizia Materassi, Community Development Director Larry Mainez, Associate Planner Pat Peterson, Community Development Department Secretary ABSENT: Fran Van Gelder, Vice -Chairperson Commissioner Addington was appointed chairman due to the absence of Chairman Sims at the beginning of the meeting and Vice -chairperson Van Gelder. • Information was presented on Residential Care Facilities by Director Materassi. In 1993 there were 14 residential care facilities in Grand Terrace. In 1996 the State Community Care Licensing Department indicates only 6 in the City, on the latest report received. Commission members received a copy of the most recent report. Director shared some information from the Planning Law book detailing the definition of a "residential care facility". No CUP or zoning variance is required of a facility serving 6 or fewer residents. In Grand Terrace a CUP is required for facilities of more than 6 residents. There are 12 types of facilities per the State definitions. In order to address citizen concerns regarding property values there is an over concentration rule which allows the City to deny an application which would allow January 16,1997 Planning Commission Minutes Page 2 more than one facility within a 300' radius. Transitional shelters however, are excluded from the over concentration rule. Director distributed a copy of the formreceived from the State when a new license application is filed. If the proposed location is not within 300' of another residential care facility the Community Development Director signs the form, returning it to the Department of Public Social Services. In response to Commissioner Addington's question of code enforcement, Director said very few residential care facilities generate code enforcement problems. Chairman Sims joined the workshop. Commissioner Trainor told the group neighbors have a tremendous amount of control over group homes through the ability to file complaints with Community Care Licensing. 6:50 P.M. ITEM #3 CUP-96-04/E-96-14 AN APPLICATION FOR A CONDITIONAL USE PERMIT TO ESTABLISH A DANCE CLASS/BALLROOM IN THE GENERAL COMMERCIAL AREA OF THE BARTON ROAD SPECIFIC PLAN WITH ANCILLARY RETAIL USE AND ASSOCIATED ENVIRONMENTAL REVIEW DON CHRISTER AND PAUL TAYLOR 22320 BARTON ROAD, GRAND TERRACE, CA Staff report was presented by Hally Cappiello, Associate Planner. There is single family residential property adjacent to the proposed site. It is zoned General Commercial Area of the Barton Road Specific Plan. Across Canal St. is the Terrace Pines development and Towne and Country Center. Across Barton Road is the Terrace Retirement Hotel. Applicants propose to use this building as a ballroom to give social dance instruction. As discussed, one concern of staff was sufficient parking. Staff performed a parking analysis based upon current usage and need in the Potomac Center. Each business operator was contacted to determine the peak hours of operation. The City's contract traffic consultant, Craig Neustaedter, provided staff with some data from a study on peak business/parking hours for typical retail businesses. For the purpose of the parking study the dance studio was classified as a commercial school. Their peak hours of operation will not coincide with those of the retail businesses in the center. Group activities are restricted solely to evening hours with a maximum of 30 students + 3 employees. Another concern of staff was potential noise. Conditions were suggested by staff to restrict business hours and placement of sound speakers in the building. Special event permits would be required in the event applicants wished to have larger gatherings on an occasional basis. Chairman Sims asked staff if food and refreshments would be allowed. Staff responded that applicants have not made such an application, thus no health department approval was sought by staff. A CUP amendment must be sought should applicants desire to serve refreshments. January 16,1997 Planning Commission Minutes Page 4 Commissioner Trainor expressed concern that 13 parking spaces may be insufficient. Director explained we cannot require applicants to do more than meets code. However, should a parking problem arise then more stringent requirements can be placed on the project. 7:35 P.M. OPENED PUBLIC HEARING PAUL TAYLOR 16791 PALOMINO RIVERSIDE, CA He said he appreciates all the work staff has done on this project. He said the music will never be played loud enough to bother the neighbors, as the instructor must be able to speak to and instruct the students. He has tested the sound system at the studio already and it cannot be heard outside. He said he has taught at dance studios for 14 years. Most lessons take place in the evening hours, however he said he would like the flexibility of having Sunday hours available. The late Saturday closing time of midnight is usual at most dance studios. It is typically used for "practice party night" after an earlier lesson in the evening. Commissioner Addington asked applicant if the conditions concerning the business hours of operation are acceptable. Applicant answered, "yes" Commissioner Addington also asked if Conditions #5 and 7 are acceptable. Applicant answered "yes." Commissioner Addington asked applicant if he would prefer condition #16 read "three instead of two complaints". Applicant answered "yes." Chairman Sims asked applicant what sort of sign he plans to put up. Applicant answered that they will initially put up a banner. The landlord requires them to have a sign. 7:50 P.M. PUBLIC HEARING CLOSED MOTION PCM-97-02 Motion by Commissioner Addington to amend Condition #1 to read "Monday through Friday, 1 p.m. to 10:30 p.m." and "Sunday, 12 noon to 6:00 p.m." Seconded by Commissioner Trainor. RECONVENED AFTER 5-MINUTE RECESS ITEM #2 DU-96-02 AN APPLICATION FOR DETERMINATION OF USE REGARDING A PROPOSED RETAIL SALES BUSINESS OF WINDOWS AND DOORS WITH SHOWROOM IN A GENERAL BUSINESS DISTRICT (C2 Zone). DOUG WICK 12018 LA CROSSE AVENUE, GRAND TERRACE, CA Staff report was presented by Larry Mainez, Associate Planner. The proposed use in the C2 area is exempt per an initial environmental review performed by staff. The responsibility of the Planning Commission is to review and evaluate the proposed use as it compares to other uses in the district and make a determination if this proposed use is similar to those currently existing. The Commission is to determine if the use is permitted or not permitted. In the event it is permitted, does it require a CUP? January 16,1997 Planning Commission Minutes Page 6 The proposed use is commercial retail, selling doors, windows, hardware and woodwork. Delivery and installation is available if needed. Staff feels the proposed use is similar to appliance/repair stores, carpet and floor covering, hardware stores, and paint, glass and wallpaper stores. The similarities include the need for a showroom to display products; they are for home or business improvement; there is no manufacturing on site; and they provide installation for customers. Staff's recommendation is that the use is similar in nature and intent to the other retail businesses in the C2 District, deeming the proposed use permitted and not a conditionally permitted use. Chairman Sims asked applicant if he would like to address the Planning Commission members. Doug Wick 1306 Fulbright Redlands, California He said his showroom will have windows from three manufacturers, doors, hardware and moldings. He said he generally sells to contractors and homeowners. Installation is also available to customers. MOTION PCM-97-05 DU-96-02 Motion by Chairman Sims to support staff s findings and determine the proposed use is similar in nature and intent with other uses specifically list in the C2 District; and that it is a permitted use, not a conditionally permitted use. RECONVENED PLANNING COMMISSIONER'S WORKSHOP January 16,1997 Planning Commission Minutes • Information to Commissioners Page 7 0 Director Materassi talked about the flyer distributed to all Planning Commission members outlining the APA workshop entitled "Planning Commissioners' Forum." She said information will include rules and regulations pertaining to CEQA, the General Plan, monopoles and telecommunications, the Brown Act. Director encouraged any new or veteran commissioners who feel the need for further training to attend. The workshop is scheduled 1/25/97, 10 a.m. to 4 p.m. at the Riverside City Utility Operation Center. Commissioner Trainor said she would like to attend. 8:23 P.M.
