10/16/1997GRAND TERRACE PLANNING COMMISSION NUNUTES OF REGULAR MEETING OCTOBER 16, 1997 The regular meeting of the Grand Terrace Planning Commission was called to order at the Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California on October 16, 1997 at 7:00 p.m. by Chairperson, Fran Van Gelder. PRESENT: Fran Van Gelder, Chairperson Doug Wilson, Commissioner Moire Huss, Commissioner Matthew Addington, Commissioner QMary Trainor, Commissioner Larry Mainez, Associate Planner Pat Peterson, Community and Economic Development Department Secretary ABSENT: Gerry Ellis, Commissioner Patrizia Materassi, Community and Economic Development Director Hally Cappiello, Associate Planner Raul Colunga, Planning Intern * Call to Order * Pledge of Allegiance led by Commissioner Wilson * Roll Call Public address to Commission shall be limited to three minutes unless extended by the Chairman. PLANNING COMMISSION MEETING MINUTES PAGE 2 OCTOBER 16,1997 PUBLIC PARTICIPATION: Barney Karger 11668 Bernardo Way Grand Terrace, CA 92313 He gave a letter to each Planning Commission Member. He urged Planning Commission Members to consider how to best utilize the hillside areas for housing. He said houses can safely be built on steep hillsides. The lights of expensive houses on the hillsides are attractive at night. ITEM #1 PLANNING COMMISSION MEETING MINUTES - OCTOBER 2, 1997 MOTION PCM-97-50 PLANNING COMMISSION MEETING MINUTES - OCTOBER 2, 1997 Commissioner Addington made a motion to approve the Planning Commission Meeting Minutes of the October 2, 1997 meeting. OSeconded by Commissioner Trainor. Commissioner Trainor noted on page 3, under "Elections" the year should read 1998 instead of 1988. MOTION VOTE PCM-97-50 Motion carried. 5-0-1-0. Commissioner Ellis absent. ITEM #2 DU-97-02 AN APPLICATION FOR DETERMINATION OF USE TO OPERATE A CIGAR SHOP KYONG (STEVE) LEE 22497 BARTON ROAD, GRAND TERRACE, CA Staff report was presented by Associate Planner Mainez. He introduced Mr. Lee who was in the audience —� and available to answer questions. Applicant anticipates he will stock approximately 70% cigarettes and 30% cigars and related products, such as lighters, clippers and magazines for cigar aficionados. Staff's analysis of applicant's proposed products for the smoke shop found them to be very similar to those of the liquor store. PLANNING COMMISSION MEETING MINUTES PAGE 3 OCTOBER 16,1997 Staff recommended the Planning Commission consider the evidence and support staff findings determining the subject use is similar in nature and intent with uses specifically listed in the Barton Road Specific Plan. Commissioner Addington asked if the new business would be joined with the existing liquor store owned by applicant. Mr. Mainez said they will be separate. Chairwoman Van Gelder asked if a sign would be placed on the door indicating anyone under 18 years of age would not be admitted. Mr. Mainez said Mr. Lee is very adamant about not selling to underage individuals. Commissioner Trainor asked if applicant plans to have a "cigar bar" or "smoking salon" where cigars are smoked. Mr. Mainez said applicant is not currently proposing this use. Chairwoman Van Gelder invited the applicant to the podium. Kyong Lee 22730 Robin Way Grand Terrace, CA 92313 He said there is no reason for minor to be in his store. He is willing to put a sign up indicating only adults may enter the smoke shop. MOTION PCM-97-51 Commissioner Addington made a motion to support staff findings determining the Smoke Shop use is similar in nature and intent with uses specifically listed in the Barton Road Specific Plan. Motion seconded by Commissioner Trainor. MOTION VOTE PCM-97-51 Motion carried. 5-0-1-0. Commissioner Ellis absent. ITEM #3 CUP-93-06-A1/E-93-05-A1 AN APPLICATION FOR AMENDMENT OF A CONDITIONAL USE PERMIT (AND ADDENDUM TO NEGATIVE DECLARATION) TO OPERATE A WHOLESALE ELECTRICAL SUPPLY COMPANY. ESSCO-REDLANDS, INC. 22050 COMMERCE WAY, GRAND TERRACE, CA Staff report was presented by Associate Planner, Larry Mainez. The subject property was most recently occupied from 1993 until early 1997 by Johnstone Supply, a wholesale supplier of refrigeration, heating and air conditioning materials. Prior to that time ORCO Tools, a wholesale tool supplier, occupied the building. Applicant desires to take over the existing CUP under the current terms and conditions. PLANNING COMMISSION MEETING MINUTES PAGE 4 OCTOBER 16,1997 Applicant and property owner have agreed to all staff -proposed conditions, including a 4' right-of-way street dedication for future landscaping and signage; and installation of a street light at the end of Commerce Way. Hours of operation are as follows: Monday through Friday 6:30 a.m. to 5:00 p.m. Parking is sufficient for the proposed use. This use will generate 12 jobs in the City, and approximately $4,000 to $5,000 in tax revenue annually. Staff recommended the Planning Commission adopt the resolution and addendum to the negative declaration approving this project subject to proposed conditions of approval. Commissioner Addington asked staff for a description of the form and content of the traffic impact analysis referred to in Condition #9. Furthermore, he wanted to know why it is being required after the fact. Mr. Mainez said the form and content would be at the discretion of the consultant doing the analysis. The current proposed use is very similar to that of the prior tenants so staff felt the traffic impacts are similar. The traffic impact analysis would detail the use and tie in with the traffic impact ordinance -to be fair in the amount charged. He said in the future the analysis will most likely be done up front but in this case the use is so similar it was not done. Applicant will be required to pay the traffic impact fee when it is developed and City Council enacts the fee. 7:35 P.M. PUBLIC HEARING OPENED Barney Karger 11668 Bernardo Way Grand Terrace, California 92313 He said the traffic analysis is not needed and is an added expense. It is one of the things which causes people not to do business with the City. The less paperwork we do, the less cost and the better off the City is for getting new businesses, which means new revenue. 7:38 P.M. PUBLIC HEARING CLOSED Commissioner Addington asked Mr. Mainez what impact it would have if the Planning Commission deleted condition #9 requiring a traffic impact analysis. Mr. Mainez said with the ordinance in place and work being done to determine the traffic impact fee, such analysis should be required so that all businesses will be treated equally proportionately to the amount of traffic they generate in the City. Street and intersection improvements will be made only if we collect traffic impact fees. This analysis is required of all CUP projects that have a potential traffic impact. MOTION PCM-97-52 Commissioner Wilson made a motion to strike Condition #9 requiring a traffic impact analysis. Condition #8 to be revised to read "Pay Traffic Impact Fee whenever the fee is installed by the City, in proportion to amount of trips generated by the proposed business, in accordance with a fair distribution worked out with staff." Motion seconded by Commissioner Addington. PLANNING COMMISSION MEETING MINUTES PAGE 5 OCTOBER 16,1997 MOTION VOTE PCM-97-52 Motion carried. 4-1-1-0. Chairwoman Van Gelder voted "no" and Commissioner Ellis absent. Commissioner Trainor brought to the attention of staff two date corrections to be made on Attachment F, the resolution. Staff noted the changes to be made. MOTION PCM-97-53 Motion by Commissioner Wilson to approve CUP-93-06-Al/E-93-05-A1. Seconded by Commissioner Addington. MOTION VOTE PCM-97-53 Motion carried. 5-0-1-0. Commissioner Ellis absent. 7:45 P.M. ADJOURNED PLANNING COMMISSION/SITE AND ARCHITECTURE REVIEW BOARD MEETING 7:45 P.M. CONVENED PLANNING COMMISSION WORKSHOP ♦ Information to Commissioners Associate Planner Mainez thanked the Commission Members for the wedding card and good wishes. He said his bride will be at the volunteer picnic this weekend. The Pacific Diversified Homes project may be coming back for City Council review at their November meeting, however they have not recently contacted the Community and Economic Development Department to review their proposed changes. The bike lane contractor is using part of the property on the north side of City Center Ct. for equipment storage, and the Azure Hills Church playground project has donated their excess dirt to use as fill for the bike lane project. ♦ Information from Commissioners • Commissioner Addington said he will be attending the Building Industry Association dinner on October 23, and invited fellow commissioners to car-pool with him. 7:58 P.M.
