79 ORDINANCE NO. 79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, RESCINDING ORDINANCE NO 74 AND ADOPTING DIVISION 8 OF TITLE 3 OF THE SAN BERNARDINO COUNTY CODE BY REFERENCE, INCLUDING AMENDMENTS THERETO, WHICH ADDS PROVISIONS PERTAINING TO UNDERGROUND STORAGE OF HAZARDOUS SUBSTANCES. WHEREAS, the City Council of the City of Grand Terrace has determined it to be in the best interest of the City to have the provisions pertaining to to underground storage of hazardous substances enforced by the County of San Bernardino; NOW, THEREFORE, the City Council of the City of Grand Terrace does hereby ordain as follows: SECTION 1. Rescission - Ordinance No. 74 is hereby rescinded in its entirety. SECTION 2. Adoption of Division 8 of Title 3 of San Bernardino County Code - Division 8 of Title 3 of the San Bernardino County Code is hereby aaFopted by reference, including any amendments thereto, as the law of the City of Grand Terrace. SECTION 3. Penalties - Any person violating any of the provisions of this Ordinance shall—e deemed guilty of a misdemeanor and, upon conviction thereof, shall be punishable by a fine of not more than Five Hundred Dollars ($500.00) or by imprisonment in the County Jail for a period of not more than six (6) months, or both such fine and imprisonment. Such person shall be deemed guilty of a separate offense for every day during any portion of which any violation of any provision of this Ordinance is committed, continued or permitted by such person and shall be punishable therefor as provided by this Ordinance. SECTION 4. Validity - This Ordinance and the various parts, chapters, sections, and clauses of— i vision 8 of Title 3 are hereby declared to be severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid, the remainder of this Ordinance shall not be affected thereby. The City Council hereby declares that it would have passed this Ordinance and each part thereof, regardless of the fact that one or more parts hereof be declared unconsititutional or invalid. SECTION 5. This Ordinance shall be in full force and effect at 12.01 a.m. on the 31st day after its adoption. SECTION 6. The City Clerk shall cause this Ordinance to be posted in three (3) public places designated for such purpose by the City Council . SECTION 7. First read at a regular meeting of the City Council of said City held on the 12th day of April , 1984, and finally adopted and ordered posted at a regular meeting of said City Council on the 26th day of April , 1984.
