177 ORDINANCE NO. 177 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, INSTITUTING SECTION 10.04.275 AND AMENDING SECTION 10.04.030 OF THE GRAND TERRACE MUNICIPAL CODE PROHIBITING PARKING OR STOPPING UPON ANY ROADWAY WITH A DESIGNATED BIKE LANE WITHIN THE CITY. WHEREAS,the City of Grand Terrace was awarded a$369,472 transportation grant from the San Bernardino Association of Governments in December of 1995 for the purpose of constructing a Class II signalized bike lane and the Grand Terrace City Council approved the construction with subsequent construction begun in October of 1997; and WHEREAS, it is in the public interest to prohibit parking and/or stopping at any time on roadways with a designated bike lane to protect the safety of bicyclists,pedestrians and motorists; and WHEREAS, it is in the interest of the public health and safety that this parking ordinance become effective immediately. NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 10.04.275 be added and to read as follows: 10.04.275 Bike lane restrictions. A. The engineer is authorized to place signs and/or curb markings as described in Sections 10.04.390 and 10.04.400, indicating no parking or stopping upon any roadway with a designated bike lane. Designated bike lane defined per Section 10.04.030. B. When the engineer, finds that the conditions requiring stopping or parking be prohibited as authorized in subsection A of this section no longer exist,he shall remove such signs and such curb markings from such portion of such street or highway. Section 2. 10.04.030(R)to added to the Grand Terrace Municipal Code as follows: 10.04.030(R) "Designated Bike Lane"means a public or private land designated by the City Council and Department of Public Works and marked substantially in the manner prescribed by the Vehicle Code of the State of California. 8.060 Severability (Ordinance 153), is hereby amended to read as follows: F. A minimum distance shall be maintained from certain sensitive uses as follows: . 1. 500 feet from parks. schools, churches and day care centers. 2. 600 feet from the freeway. 2 ions as may be imposed to further the purposes of this chapter. 8.50.170 Penalty. Any person violating or failing to comply with any of the provisions of this chapter shall be guilty of a misdemeanor and shall be punished by a fine of not to exceed five hundred dollars, or by imprisonment not to exceed six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of the provisions of this chapter is committed. Violators may include not only those persons staging the street or special event but any person knowingly participating in the event after being advised of its illegality. th a company with a rating approved by the City attorney. The City and its officers, agents and employees shall be named as additional insureds on said policy and the City shall be provided with a certificate of insurance evidencing this fact. Both the applicant and any independent contractors shall also provide copies of their worker's compensation certificates for all employees. (b) The applicant shall also agree to indemnify the City, its officers and employees from any claim or liability arising out of the street or special event.
