08/11/1980 PLANNING COMMISSION MINUTES CITY OF GRAND TERRACE AUGUST 11 , 1980 A regular meeting of the Planning Commission , City of Grand Terrace was held in the First Baptist Church of Grand Terrace, 12354 Mt. Vernon , California on August 11 , 1980 at 6:35 p.m. PRESENT: Frank Tetley, Chairman Sandy Collins , Vice Chairman Vern Andress , Commissioner Winifred Bartel , Commissioner William DeBenedet, Commissioner Doug Erway, Commissioner Lillian Smith , Commissioner Jean Laurin, Planning Staff Jim McLean, Engineering Staff Martine Gerg, Executive Secretary ABSENT: John McDowell , Commissioner Tom Rivera, Commissioner The meeting was opened with the Pledge of Allegiance led by Commissioner Collins and oral roll call . APPROVAL OF MINUTES - JULY 28, 1980 PCM-80-61 Following the correction to show Commissioner Smith as abstaining to Motion number PCM-80-60, MOTION was made by Commissioner Andress , seconded by Commissioner Erway and carried unanimously to approve the Minutes of July 28, 1980 as amended. REQUEST FOR A MINOR DEVIATION - CONTINUED FROM 7/28/80 Proposal : Request a Minor Deviation of Sideyard Setback Location: 23285 Westwood File/Index: 12-51303 Applicant: Carlo Marchese Engineering Staff, Jim McLean, stated that he had received additional information from Mr. Parker, owner of the adjoining property, which shows subject gazebo encroaching 3 inches onto his property. Due to the two conflicting surveys done by two qualified engineers , Mr. McLean recommends Page one - PC-8/11/80 that another survey be done with Mr. Marchese and Mr. Parker both present in order to determine exactly where the lot line is located. Discussion was held on the question of what portion of the gazebo is encroaching. Chairman Tetley called upon the applicant for input to the hearing. SUPPORTING TESTIMONY Mr. Carlo Marchese, 23285 Westwood, stated that he saw the mark which Mr. Parker placed on the gazebo showing the portion which is encroaching onto his property, and he felt the mark showed only a 1 inch encroachment, if in actuality there was an encroachment. Mr. Barney Karger, 11668 Bernardo Way, stated that from his past experience, it is not unusual for surveys to be up to three feet off in Grand Terrace. He also stated that the law states that if the encroachment is already there, nothing can be done about it. Chairman Tetley called for opposing testimony. OPPOSING TESTIMONY Larry Parker, 5935 Magnolia, Rialto, California, owner of adjacent pro- perty, stated that the second survey was done because he felt that the gazebo was encroaching onto his property. Mr. Parker feels that the Minor Deviation should not be granted. In discussion, Mr. McLean explained that the driveway adjacent to the gazebo has a 15% grade and the Fire Department generally feels that a grade 15-18% is not negotiable by their fire trucks. Even if the trucks were able to drive up the driveway, the gazebo would not hamper the trucks. Chairman Tetley stated that the Planning Commission has the power only to deal with the portion of the gazebo up to the property line. Anything beyond the property line would be the responsibility of the owner of the gazebo. Mr. Marchese re-emphasized the fact that it is being assumed th.at the second survey done by Mr. Parker is the correct survey. He felt that a third survey should be done in order to determine the actual lot line. PCM-80-62 MOTION was made by Commissioner Collins and seconded by Commissioner Smith, to deny the request for a minor deviation for a sideyard setback for a gazebo and patio cover by Carlo Marchese. Following discussion, motion carried on Aye votes by Commissioners Collins, Andress , Bartel , Erway and Smith , Noe vote by Chairman Tetley and Commissioner DeBenedet abstain- ing. Page two - PC-8/11/80 TRACT 9951 AND TRACT 10397 - EXTENSION REQUEST TRACT 9951 Proposal : Time Extension Request - 11 lots on 3 acres. Location : North side of DeBerry Street extending between Mt. Vernon and the Gage Canal . Applicant: Karger Construction Staff, Jean Laurin, gave a brief presentation stating that the Tract is eligible for a 6-month extension which will afford them the City author- ized total of 30 months. Ms. Laurin recommends that approval be given for a 6-month extension to February 17, 1981 . Chairman Tetley called upon the applicant for input to the hearing. SUPPORTING TESTIMONY Mr. Barney Karger, 11668 Bernardo Way, stated that he was requesting the 6-month extension for his Tracts because of the Moratorium, uncertain fin- ancial conditions and unsettled selling conditions. Mr. Karger feels that if a builder is given sufficient time, he can build a beautiful project. If he is made to rush the project, he may build something less than what he intended to build. Mr. Karger stated that if the buildings are Spanish Style, they will have a Spanish Red Tile Roof. If they are the Norman type with wood exposed fronts , they will probably have a concrete shake roof. The walls will be plaster with wood definition. The lots were originally designed for apartment buildings , 3 units per lot on 11 lots , but now is undecided whether he will construct condominiums or apartment buildings. Staff, Jean Laurin , stated that the Planning Commission has the authority to extend a tract for any length of time, stating the circumstances of the extension. A particular tract could be extended past its deadline without taking action on all tracts. Each tract, as it expires , must come to the Commission for determination. PCM-80-63 MOTION was made by Commissioner Erway and seconded by Commissioner DeBenedet to approve the 6-month extension request for Tract 9951 . Motion carried on Aye votes from all Commissioners present with the exception of Commis- sioner Collins voting Noe. TRACT 10397 Proposal : Time Extension Request - 16 lots on 9.2 acres Location : North side of Pico Stree, approximately 1900 feet east of Mt. Vernon Avenue Applicant: Karger Construction Page three - PC-8/11/80 SUPPORTING TESTIMONY Mr. Barney Karger stated that most of the lots are 20,000 square feet and there are two lots that are 12-14,000 square feet. The actual zoning on that Tract is 14,000 square feet average with a minimum of 10,000 square feet. Chairman Tetley called for opposing testimony. OPPOSING TESTIMONY An unidentified resident of Grand Terrace asked for a definition of the Architectural Review Committee and whether it would affect this particular Tract. PCM-80-64 Following discussion, MOTION was made by Commissioner Erway and seconded by Commissioner Andress to approve the 6-month extension request for Tract 10397 to February 17, 1981 . Motion carried on Aye votes from all Commis- sioners present with the exception of Commissioner Collins voting Noe. T-STANDARDS Commissioner Collins stated that the T-Standards now in effect do not establish a minimum lot size , only an average lot size, which may be con- fusing. To clarify the T-Standards , Commissioner Collins made a MOTION that Grand Terrace establish a T-Standard which states that the area required for a lot is the minimum level plot for that particular building and does not include banks and level changes. Motion was seconded by Commissioner DeBenedet. Discussion was held by the Commission and Staff on the possible effects of this motion if it were to be passed. Following discussion, Commissioner DeBenedet withdrew his second, and the motion failed for lack of a second. TENTATIVE TRACT 11333 - LAGUNA PACIFIC Commissioner Collins made a MOTION that the Planning Commission designate the Laguna Pacific Development Company's proposed tract as R-1-10,000 zoning to indicate 10,000 square feet minimum level lots. Planning Staff, Jean Laurin , stated that the Planning Commission was not able to take any action on subject tract at this time. The Laguna Pacific Tract 11333 is scheduled for the August 25, 1980 Planning Commission agenda and action can be taken at that time, with the Applicant present. Motion died for lack of a second. ADJOURN TO PUBLIC WORK SESSION The regular meeting of the Planning Commission adjourned to Public Work Page four - PC-8/11/80 Session at 8:46 p.m. The Public Work Session adjourned at 9:20 p.m. The next regular meeting of the Planning Commission will be held on Monday, August 25 , 1980 at 6:30 p.m. Respectfully submitted, E k ec Al ve Secretary Approved: a Page five - PC-8/11/80 PLANNING COMMISSION Workshop Minutes - August 11 , 1980 The Planning Commission Workshop convened at 8:55 by Chairman Tetley. 1 . The Commission determined that the members should meet at 5:30 p.m. on August 25, 1980 (the next regular Planning Commission Meeting) , for a field trip to review the General Plan Amendments. 2. The Chairman announced a workshop on August 29, 1980, to be held at 1111 E. Mill Street, San Bernardino. It is designated as a Planning Commission Secretarys ' workshop and the Commission hopes that the City will be able to send one of its staff to that workshop. 3. Commissioner Smith discussed items which occured at the City Council meeting of August 7, 1980. All Commissioners took part in the discus- sion of these items . 4. It was determined that a Planning Commissioner will attend each City Council Meeting. Commissioner Andress will attend the meeting of August 21 , 1980 and Commissioner Smith will attend the first Council meeting in September.
