08/25/1980 CITY OF GRAND TERRACE PLANNING COMMISSION MINUTES AUGUST 25, 1980 A regular meeting of the Planning Commission, City of Grand Terrace, was held in the First Baptist Church of Grand Terrace, 12354 Mt. Vernon, Grand Terrace, California on August 25, 1980 at 6:44 p.m. PRESENT: Frank Tetley, Chairman Sandy Collins , Vice-Chairman Vern Andress, Commissioner Winifred Bartel , Commissioner William DeBenedet, Commissioner Tom Rivera, Commissioner Lillian Smith, Commissioner Jean Laurin, Planning Staff Brian Esgate, Engineering Staff Myrna Lindahl , City Clerk ABSENT: Doug Erway, Commissioner John McDowell , Commissioner The meeting was opened with the Pledge of Allegiance led by Commissioner Smith and oral roll call . APPROVAL OF MINUTES - AUGUST 11 , 1980 PCM-80-65 Motion was made by Commissioner Collins, seconded by Commissioner Bartel and carried unanimously to approve the Minutes of August 11 , 1980 as submitted. ZONE CHANGE REQUEST - CONTINUED FROM CITY COUNCIL 8/7/80 Applicant: Laguna Pacific Development Company Proposal : Zone Change from A-1-5-T to R-1 on 21 .8 acres; 86 lot subdivision on 21 .8 acres. Location: E/s of Oriole Avenue, between Van Buren & Pico Rep: Madole & Associates, Inc. Planning Staff, Jean Laurin, made a presentation stating the adoption of a zone change for the subject property from A-1-5-T to R-1-10,000-T, with the lots to be 10,000 sq. ft. minimum, was heard by the City Council on August 7, 1980. She recommended Page one - PC-8/25/80 the applicant attend the City Council Meeting to present his case regarding overriding the Planning Commission decision; however, on the advisement of the City Attorney, Council referred the matter back to the Planning Commission for review. The property owner requests no zone change if the Planning Commission does not concur with the R-1 zone. Chairman Tetley called upon the applicant for input to the hearing. SUPPORTING TESTIMONY Mr. Chuck Costello, representing Laguna Pacific Development Company, stated a different concept was presented during discussion at the City Council Meeting of August 7, 1980, whereby three parcels of the subdivision could be zoned R-1, 7,200 square feet, with the fourth parcel which is located on a higher elevation could be zoned R-1- 10,000-T, 10,000 square feet minimum. He feels the lots in the R-1 zone will still be approximately 8,200 square feet average, and there will be no subdivision planned, unless some agreeable solution can be reached. Mr. Jerry Irby, 22738 Pico, the owner of one of the parcels , stated he doesn't feel three of the parcels are view lots , and would not be compatible for 10,000 sq. foot lots, since they will be integrated with the existing housing, which is zoned R-1. Mr. Denis Kidd, 22874 Pico, the owner of three of the parcels , stated many lots in a subdivision on DeBerry Street which are the same elevation as the parcels under consideration, are 7,200 sq. feet, and feels it is unfair to require larger size lots on this subject subdivision. Chairman Tetley called for opposing testimony. There was none. Following discussion, MOTION was made by Commissioner Rivera to approve the plan for the three parcels on the lower level to be zoned R-1, with the parcel on the higher elevation to be zoned R-1-10,000-T. The Motion died for lack of a second. Following discussion involving pad size versus lot size, and the fact that the other subdivisions were approved prior to incorporation, MOTION was made by Commissioner Collins , seconded by Chairman Tetley, to change the R-1-10,000-T to R-1, 7,200 sq . feet, for Assessor's Parcel Nos. 277-181-3, 277-181-08 and 277-181-09, and Assessor's Parcel No. 277-181-10 to be changed to zone R-1-8,500-T, with a T- Standard for these lots to be that zoning minumum level plot. Discussion was held regarding difficulties in designing a subdivision under that criteria. The MOTION failed on AYE vote of Commissioner Collins, with the remaining Commissioners present voting NOE Page two - PC-8/25/80 MOTION was made by Commissioner Rivera, seconded by Commissioner Andress, that the lots in the lower elevation be zoned R-1 , 7 ,200 square feet, with the higher elevation lots being zoned R-1-10,000-T as proposed by the developer. The Motion failed on AYE votes of Commissioners Rivera and Andress, with the remaining Commissioners present voting NOE. MOTION was made by Commissioner Smith to approve the lower three lots to be zoned R-1 , 7,200 square feet average minumum pad size, and the upper parcel to be zoned at R-1-10,000-T square feet average. The Motion died for lack of a second . PCM-80-66 MOTION was made by Commissioner DeBenedet, seconded by Commissioner Rivera, that Assessor's Parcel .dos. 277-181-03, 277-181-08 and 277- 181-09 be zoned R-1-8,500-T; that Assessor's Parcel No. 277-181-10 be zoned R-1-9,500-T, with the T-Standard to read the lot areas are average sizes, and the zone change and tentative tract are to be continued until a new map is prepared. The Motion carried unanimously. TENTATIVE TRACT 11450 Applicant: Roy Roberts Proposal : A) 13 lot subdivision on .78 acres B) 12 unit condominium on .78 acres Location: W/s Preston Street, approx. 190' N/o Palm Avenue File/Index: A) SUB/80-1005/E228-120/TR11450 B) LSH/80-1006/E228-120 Rep: Hawkins, Robertson & Associates Planning Staff, Jean Laurin, gave a presentation, stating this is a proposed large scale housing project, in two parts, which must be acted upon as one. The applicant plans to build a twelve-unit condominium, and create thirteen lots. Ms . Laurin recommended approval of the tentative tract and the large scale housing project. Commissioner DeBenedet asked Engineering Staff, Brain Esgate, if there will be a drainage problem. Mr. Esgate stated this is a concern, and will have to be coordinated with the adjacent property owners, the City, and the apartment owners , as to whether the drainage will be taken out or a dry well installed with overland flow. He stated Engineering Staff will have to be satisfied regarding drainage before the map is allowed to be recorded. Chairman Tetley called upon the applicant for input to the hearing. SUPPORTING TESTIMONY Mr. Roy Roberts, 5871 Argyle, Riverside, presented an architectural rendering of the view of the condominiums from Preston Street. Page three- PC-8/25/80 Mr. Curt Hawkins , Hawkins, Robertson & Associates, stated they are aware of the potential drainage problem, and believes the soil condition will allow setting up some type of percolation to handle the ten year storm and nuisance flow, with the possibility of obtaining a letter from the City to handle any super flow in the event of a tremendous storm. Chairman Tetley then called for opposing testimony. OPPOSING TESTIMONY Mrs. Lula Armstrong, 12172 Preston Street, stated she lives on the south side of the proposed development, and questioned there being enough room to build twelve condominiums plus an extra lot in that area, since the property is only 271 feet deep. She also questioned how far away from her property the building would take place. Engineering Staff, Brian Esgate, stated the building would be six feet from Mrs. Armstrong' s property, with a block wall on the side. The condominiums will be 1 ,400 feet in size, with a price range of approximately $80,000 to $81 ,500. The garages will all be at the rear of the development. Mr. Johnnie Lisenby, 12044 Preston Street, questioned what size the driveway will be, and whether it would be large enough for the ingress-egress of automobiles. He also questioned drainage. Mrs. Sharon Carlisle, 12073 Preston Street, voiced concern regarding the condominiums blocking the view from their property, and the potential increase in parking problems , stating a problem already exists with the present apartments. She stated they had signed a homeowner' s agreement stating they would not park on the street. Mr. Roberts stated two parking spaces per unit have been provided, as well as six extra spaces, and stated they can restrict parking. Chairman Tetley closed public hearing. PCM-80-67 MOTION was made by Chairman Tetley, seconded by Commissioner Bartel , and carried unanimously to amend the Conditions by adding Condition 5A as follows: "If, at the time of the application for the building permits, the City of Grand Terrace has an Architectural Review Committee, then those plans must be submitted to the Architectural Review Committee prior to the permits being issued, submitted to and approved by the Architectural Committee. " PCM-80-68 MOTION was made by Commissioner Andress, seconded by Commissioner Smith, and carried unanimously to approve Tentative Tract 11450 for one year, as delineated on the map, subject to the attached conditions, as well as the addition of Condition No. 5A, and to approve the large scale Page four - PC-8/25/80 housing project for one year, subject to the attached conditions and the conditions of Tentative Tract 11450; that the Negative Declaration be adopted and the City Clerk be instructed to file a Notice of Determination.
