08/02/1982 GRAND TERRACE PLANNING COMMISSION MINUTES OF REGULAR MEETING AUGUST 2 , 1982 The Grand Terrace Planning Commission regular meeting of August 2 , 1982 was called to order at 7 : 10 P . M . in the Terrace View Elementary School Multi - Purpose Room , 22731 Grand Terrace Road , Grand Terrace , California by Vice Chairman Sanford L . Collins . PLEDGE OF ALLEGIANCE : Led by Commissioner McDowell ROLL CALL : Commissioners Present : Cole , Collins , DeBenedet , McDowell , Munson and Smith Commissioners Absent : Andress (excused ) , Erway ( excused ) , and Bartel Others Present : Virginia Farmer , Director Planning Department Tom Coyle , Administrative Assistant Gloria J . Flood , Planning Secretary MINUTES : The minutes of the regular meeting of July 12 , 1982 were approved as submitted . PCM 82-48 MOTION by Commissioner DeBenedet , seconded by Commissioner McDowell and passed by a 6-0 VOTE TO APPROVE THE MINUTES OF JULY 12 , 1982 AS SUBMITTED . NEW BUSINESS : ITEM #1 Virginia Farmer , Planning Director , introduced Ray Munson as new Planning Commissioner to fill the vacancy left by the resignation of Chairman Frank 0 . Tetley . Ray Munson took the Oath of Office administered by Mrs . Farmer . -- ------ -- --- -- -- ------ ---- -- -------------------- ---- -- --- ------ --- ---- - ITEM #2 SITE PLAN AND ARCHITECTURAL PUBLIC HEARING REVIEW NO . SA 82- 11 JOE L . AND RUTH PORTILLO Virginia Farmer , Planning Director , presented the staff report . The project is a Site Plan and Architectural Review for a single family dwelling unit located 296 feet North of Barton Road on the West side of La Cadena . Grand Terrace Planning Commission Page 1 of 4 August 2 , 1982 The property is zoned for R 1- 20 and proposed house is to be placed on lot sideways . The proposed dwelling unit will be 1700 square feet with Mission Clay tile on the roof. Commissioner McDowell stated the side of the house seen from La Cadena is very barn like . Mrs . Farmer stated the house is set far back and with landscaping it will not look that stark . Commissioner DeBenedet asked why the Commission did not receive a set of plans for the house . Mrs . Farmer stated the Ordinance does not require a set of building plans only elevations . Commissioner DeBenedet stated fascia board with this heavy style roofing should be a minimum of 2" x 8" . Mrs . Farmer replied that the Commission could add a condition to this effect . Commissioner McDowell expressed concern for the driveway which he feels interfers with the porch . Mrs . Farmer stated it was a small entry patio . PCM 82-49 MOTION by Commissioner McDowell , seconded by Commissioner DeBenedet and passed by a 6-0 VOTE TO ADD CONDITIONS REQUIRING A DECREASED PATIO AREA IF NECESSARY FOR A TURNAROUND AREA AND 2 " x 8" FASCIA BOARDS . Commissioner Cole asked if it was customary to approve a project without the applicant being present . Mrs . Farmer stated applicant was given proper notification and did not choose to attend the meeting . Vice Chairman Collins stated for the record that since applicant and public were not present the public hearing was waived . COMMISSION ACTION : PCM 82-50 MOTION by Commissioner Cole , seconded by Commissioner DeBenedet and passed by a 6-0 VOTE TO ADOPT THE NEGATIVE DECLARATION AND BASED ON THE MATERIAL IN THE STAFF PRESENTATION , REPORT AND LACK OF TESTIMONY RECEIVED , MOVED TO APPROVE SA 82- 11 , INCLUDING THE FINDINGS AS WRITTEN IN THE STAFF REPORT AND SUBJECT TO THE CONDITIONS RECOMMENDED BY STAFF AND AS AMENDED BY PLANNING COMMISSION . -- ------------------ ---------------------------------------------------- ITEM #3 RESOLUTION OF INTENT PC NO . 82-02 Virginia Farmer , Planning Director , presented the staff report . The land was under study by the ad hoc Economic Development Committee . The City Council requested the Planning Commission to consider a town center overlay on the C-2 land so that orderly development might take place . Mrs . Farmer further stated that a Resolution of Intent must Grand Terrace Planning Commission Page 2 of 4 August 2 , 1982 be passed and the people notified by mail pursuant to the Zone Ordinance requirements before the Planning Commission holds a public hearing. Commissioner Collins asked what an overlay zone meant . Mrs . Farmer stated the overlay provided for the orderly phasing and development criteria similar to a PUD . Commissioner Smith asked if the individual property owners could develop their property . Mrs . Farmer stated it could be done if it were in parcels of 30 acres or more . COMMISSION ACTION : PCM 82 -51 MOTION by Vice Chairman Collins , seconded by Commissioner Cole and passed by a 6-0 VOTE TO ADOPT RESOLUTION NO . PC . 82-02 . - --- -- ---- -- -- -- ---- ---- ---------- ------ ---- ------ ---- -- ---- -- -- -------- ITEMS #4 & #5 PROPOSED MINIMUM HOUSING STANDARDS ORDINANCE AND PROPOSED NUISANCE ABATEMENT ORDINANCE Virginia Farmer , Planning Director , presented the staff reports for the proposed ordinances concurrently . Mrs . Farmer stated the City Council has authorized codification of all the City ' s Ordinances . By codifying , the City will then sort out any duplications that appear . There are many duplications within the San Bernardino County Code and the City ' s Ordinances . In addition , codification requires inclusion of certain ordinances ordered by the State for General Law Cities . Mrs . Farmer further stated that many duplications of the provisions in the model ordinances and that a contract City had minimal staff for enforcing ordinances that already exit . She therefore , recommended denial of the proposed ordinances . Mrs . Farmer stated that some sections of these ordinances may infringe on civil rights and/or property rights and they could be brought to court . The maximum fine on Zoning violations is $500 . Commissioner DeBenedet asked how other cities enforce their laws and ordinances . Mrs . Farmer stated most zoning is enforced by complaints . Tom Coyle , Administrative Assistant and Code Enforcement Officer , stated that other cities enforce their ordinances on a complaint basis such as our City . A complaint is made and then the City Enforcement Officer checks the complaint out . Code Enforcement is a difficult area to enforce where a public nuisance is concerned . Judges trying public nuisance and housing standards cases have been found to be very lenient with violators . If private property is involved and one is trying to put his City ' s standards to their use of property , one must have a reason to show that it does affect the Grand Terrace Planning Commission Page 3 of 4 August 2 , 1982 health and general well -being of the neighborhood . Mr . Coyle further stated these laws or ordinances are contained in most part by either the State codes or the County codes . Commissioner DeBenedet stated something should be done as far as having ordinances to protect the rest of the citizens . Mrs . Farmer stated codification should be completed sometime around the first of the year and maybe we could defer these ordinances and find out what has been left out and study the subject at that time . COMMISSION ACTION : PCM 82-52 MOTION by Commissioner Smith , seconded by Vice Chairman Collins and failed by a 3-3 VOTE TO CONTINUE THE PROPOSED ORDINANCES UNTIL FEBRUARY 15 , 1983 . Vice Chairman Collins , Commissioner Munson and Smith voting aye . Commissioners Cole , DeBenedet and McDowell voting noe . PCM 82-53 MOTION by Commissioner Munson , seconded by Commissioner Smith and passed by a 4-2 VOTE TO POSTPONE DECISION OR DISCUSSION UNTIL FEBRUARY 15 , 1983 ON THE PROPOSED MINIMUM HOUSING STANDARDS ORDINANCE OR WHENEVER THE CODIFICATION IS COMPLETED. Commissioners DeBenedet and McDowell voted in opposition to this motion . PCM 82-54 MOTION by Commissioner DeBenedet , seconded by Commissioner Munson and passed by a 6-0 VOTE TO POSTPONE DECISION AND/OR DISCUSSION UNTIL OCTOBER ON THE PROPOSED NUISANCE ABATEMENT ORDINANCE AT WHICH STAFF WILL BRING BACK COMPARISONS BETWEEN THIS ORDINANCE AND COUNTY CODES . -- ---------- ---- -- ---- ----------------------------------------------- -- - The meeting was adjourned at 8 : 45 P .
