Action Item_GP Conformance Finding_3.4General Plan Consistency Determination Land Acquisition -Donation of Land March 3, 2022 BACKGROUND •On February 22, 2022, the City Council approved a Resolution accepting the donation of real property from the Family Trust of Anthony Petta and Angeline Petta (“Petta Family Trust”) contingent upon the Planning Commission/Site and Architectural Review Board finding the donation and acceptance to be consistent with the General Plan. 1167-231-10 1167-231-22 •0276-213-47-0000 Assessor Parcel Number •76,665 square feet (1.76-acres) Lot size •Office Commercial General Plan Land Use Designation •Barton Road Specific Plan, Office Professional Zoning GT Pit Stop 22115 Barton Road Proposed Land Acquisition California Government Code Section 65402(a) •Requires a finding of consistency with the General Plan prior to the sale, lease or acquisition of real property General Plan Land Use Designation –Office Commercial •Intended for office commercial uses to serve as a buffer between residential areas and commercial areas Proposal •The acquisition of the Property would benefit the City to be utilize for future public uses, such a library, police substation, performing arts center, or other allowable use. General Plan Consistency •The Barton Road Specific Plan –Office Professional designation supports the General Plan Public Services and Facilities Element. •Goal 7.1 to coordinate and balance the provisions of public services with existing and planned development to eliminate service gaps, maximize the use of existing public facilities and services, and provide a high level of quality public services. •The acquisition of the property conforms with the BRSP-OP zoning designation, it is in accordance with California Government Code Section 65402, and it is consistent with the intent of the General Plan land use designation, goals and policies.
