Grand Terrace Elementary School Water Awareness Poster Contest Winners Don Hough,Riverside Highland Water Co. introduced Jim Marshall, Principal of Grand Terrace Elementary School. Jim Marshall, Principal of Grand Terrace Elementary School, thanked Riverside Highland Water Company. He introduced the winners of the Water Awareness Poster Contest. He announced that Erica Pena was the Grand Prize Winner. He introduced some of the teachers that were in attendance. He thanked the teachers and parents for their support. Proclamation-Richard Rollins, Grand Terrace Grand Marshal Grand Terrace Days Parade Mayor Hilkey read a Proclamation, proclaiming Richard Rollins as the Grand Marshal of the 2004 Grand Terrace Days Parade and honor his lifetime of dedication to our Country and our City. He presented the proclamation to Richard Rollins. Richard Rollins, expressed his gratitude and thanked the Council for the Proclamation. Resolution Expressing the City Council's Support for Senate Bill 1397 (Escutia), Which Would Enact the Locomotive Emissions Reduction and Mitigation Program PUBLIC COMMENT Mamie Burket, stated that she was given a 1960's quilt from a friend. She indicated that the quilt will be raffled at Grand Terrace Days. All proceeds will go to the Grand Terrace Library. Patricia Farley, 12513 Michigan Street,expressed her concerns with the Outdoor Adventures Center project and the reports that have been done on it. She is adamantly opposed to the project. Virginia Harford, 11825 Arliss Way, indicated that although she supports the Outdoor Adventures Center project, she has some concerns. Bill Hays, 22114 De Berry Street, indicated that he is opposed to the Outdoor Adventures Center Project and expressed his concerns. Larry Leathers, 12269 Michigan Street, expressed his concerns with the many projects that Council Minutes May 27,2004 Page 3 are being proposed in the City and the effects that they will have on the community. He indicated that traffic is currently terrible on Michigan. Mike Shaw, 12286 Michigan, expressed his concern with the Outdoor Adventures Center project. He stated that the traffic on Michigan is terrible. Frank Guzman, 23202 Glendora Drive, stated that if the Council is truly representing the \ residents of Grand Terrace, he suggests that they survey the Citizens of Grand Terrace on what their thoughts are with regards to the proposed Outdoor Adventures Center project. COUNCIL REPORTS Councilmember Larkin,reported that he is looking forward to Grand Terrace Days that will be held on Saturday, June 5, 2004. Mayor Pro Tem Ferr6,requested that Assistant City Manager Berry tell everyone about the upcoming Grand Terrace Days Event. Assistant City Manager Berry, gave a brief overview on the events that will take place at Grand Terrace Days. Mayor Pro Tern Ferr6, reported that she attended the Community Foundation reception on Wednesday,May 19`h at the March Field Museum, which was very nice. She attended the Council Minutes May 27,2004 Page 4 Measure B Citizens Oversight Committee Meeting that was held. The Committee received the consolidated expenditure report using bond funds as well as a facilities planning and construction report from the facilities director for the Colton School District. The High School is still on schedule with the target date being 2007 for opening. The next meeting of the Measure B Committee is August 181h at 4:30 p.m. at the School District Board of Education Board Room. Councilmember Garcia, indicated that she will be at Grand Terrace Days. She encouraged everyone to attend. On July 31st The Foundation will be painting the gage canal wall. She indicated that the Senior Newsletter is an excellent source ofinformation. On September l0h there is an event called Celebrating Seniors Day that will be held at the National Orange Show. She thanked the residents for coming out and letting the Council know how they feel and appreciates all of their comments. She truly wants to do what is in the best interest of the Community and to maintain the excellent quality of life here and in order to do that we need to bring in additional revenue sources. Mayor Hilkey, stated that he'mails the Grand Terrace Senior Newsletter regularly to his mom. He reported that he and Assistant City Manager Berry attended a clean air awards that was put on by the American Lung Association. Grand Terrace received a Clean Air Award from the American Lung Association for endorsing Clean Air and for buying vehicles that are good for clean air. He reported that Grand Terrace Days is the day for Grand Terrace. It was almost lost a few years ago due to budget cuts and it is good to see it come back bigger and better than ever. He stated that the people of Grand Terrace need to differentiate the things that they will hear over the next few months. The community needs to sort out whether or not the things that they hear are truly directed towards the good of the community or they are self-serving for a specific individual. Proposition 4 established an appropriations limit from proceeds of taxes for each governmental entity in the State of California. The appropriations limit is unique to each governmental entity and must be determined annually. Redevelopment is not subject to appropriations limit. The intent is to provide certain limitations and controls on government spending at all levels of government in the State, but these restrictions are intended by legislature to be applied in a reasonable and practical manner so as to allow some flexibility to meet constantly changing conditions and needs of the citizens for governmental services . The appropriation limit of the City is the "proceeds from taxes", as defined, adjusted annually by changes to the population, cost of living, or nonresidential new construction. The Department of Finance shall notify each local agency, no later than May 1st of each year, of the change in cost of living or change in California per capita personal income, whichever is less, and the population for each local agency for the prior calendar year. Proposition 111, passed in June 1990, made several changes to the method to be used in calculating the limit. These changes allow that the Population Factor may be the change in population of the City or the change in population of the County. Payment for the-assessment for each parcel will be made in the same manner and at the same time as payments are made for property taxes for each Property. The annual report takes into consideration the costs of operation and maintenance for the previous year, amount assessed for that year and projects costs of operation and maintenance for the coming fiscal year. These costs are then spread to the benefitting properties. Staff has reviewed the expenditures for fiscal (2004-2005) year, and based on our best estimate this time, the costs of operation and maintenance should approximately equal the assessment levied and collected. That the public interest and convenience requires, and it is the intention of this City Council, to undertake proceedings for the annual levy and collection of special assessments for the continual maintenance of certain improvements, all to serve and benefit said District as said area is shown and delineated on a map as previously approved by this City Council and on file in"the Office of the City Clerk, open to public inspection, and herein so referenced and made a part hereof, and proposed changes thereto are set forth in the "Report" of the Engineer, incorporated herein as a part hereof. REPORT SECTION 3. The assessments levied and collected shall be for the maintenance of certain landscaping and street lighting improvements, as set forth in the Engineer's "Report," referenced and so incorporated herein. COUNTY AUDITOR SECTION 6. The County Auditor shall enter on the County Assessment Roll the amount of the assessments, and shall collect said assessments at the time and in the same manner as County taxes are collected. After collection by the County, the net amount of the assessments, after the deduction of any compensation due to the County for collection, shall be paid to the Treasurer for purposes of paying for the costs and expenses of said District. SPECIAL FUND SECTION 7. That all monies collected shall be deposited in a special fund known as "SPECIAL FUND, CITY OF GRAND TERRACE LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1 Payment shall be made out of said fund only for the purpose provided for in this Resolution, and in order to expedite the making of this maintenance and improvement, the City Council may transfer into said funds as it may deem necessary to expedite the proceedings. Any funds shall be repaid out of the proceeds of the assessments provided for in this Resolution. BOUNDARIES OF DISTRICT SECTION 8. Said contemplated maintenance work is, in the opinion of this City Council, of direct benefit to the properties within the boundaries of the District, and this City Council makes the costs and expenses of said maintenance chargeable upon a district, which district said City Council hereby declares to be the district benefitted by said improvement and maintenance, and to be further assessed to pay the costs and expenses thereof. The City Council further adopted ordinances and regulations governing the development of land providing for the installation.and construction of certain landscaping, lighting and appurtenant.facilities to enhance the quality of life,and to benefit the value of property. The requirement for the construction and.installation of landscaping, lighting and appurtenant facilities is a condition of approval for development and'is a requirement of issuance of a permit for the construction of any residential, commercial, industrial and planned unit development. Landscaping and appurtenant facilities generally include trees, shrubs,plants, turf, irrigation, systems, and necessary appurtenances including curbs, hardscape, monumentations, fencing located in public right-of-ways, medians, parkways, and/or easements adjacent to public right-of- ways, in and along public thoroughfares and certain designated primary and secondary arterials. Lighting and appurtenant facilities includes poles, lighting fixtures, conduits and the necessary equipment to maintain, operate and replace a lighting system at designated intersections, in medians,parkways and adjacent to certain public facilities in and along certain streets, right-of- ways and designated lots. The installation of landscaping and lighting systems and the construction of the necessary appurtenant facilities is the responsibility of the property owner/applicant, as conditions of approval of a development application. ` The City may cause the installation by property owners directly, or accept financial arrangements for installation of these facilities. The cost of servicing, operation, maintenance, repair and replacement of the landscaping, lighting and appurtenant facilities in turn becomes the responsibility of the benefitting properties. The owners/applicants petitioned for formation of the Landscaping Lighting Assessment District and/or annexation. These have been completed, and will increase the City's obligation for maintenance,and servicing. The City of Grand Terrace is administering a lighting system for the benefit of all parcels of land within the City.' The lighting benefit is directly related to public safety and property protection. These benefits have been studied widely, locally,regionally and nationally. Page-2 The City has formed Landscaping and Lighting Assessment District 89-1 and subsequently annexed other parcels as Annexation No. 1 to said District to insure a fair and equitable levying of the necessary costs of servicing-and maintenance of the respective facilities, which in turn will enhance the value of each and every parcel in the District directly and collectively. The 89-1 District Boundaries of the Landscaping and Lighting Assessment District are the boundaries of Tract 13364 filed in Map Book 203,Pages 89 through 92,Records of'San Bernardino`County. The boundaries of Annexation No. 1 are the boundaries of Tracts 14264 and 14471, filed in Map Book 242,Pages 17 and 18, and Map Book 237,Pages 41 and 42, respectively, of said County. ; Servicing and administration of the City's landscape maintenance program shall be according to the provisions of the'Landscaping and Lighting Act of 1972,Part 2,Division 15 of the Streets and Highways Code of the State of California. This report is being prepared to provide for the annual assessment within these boundaries. Payment for the assessment for each parcel will be made in the same manner and at the same time as payments are made for property taxes for each Property. STATE OF CALIFORNIA ✓ Page 21 Mr C,T Y RAND TER C Community Services Department Staff Report CRA ITEM O COUNCIL ITEM (X ) MEETING DATE: June 10, 2004 FUNDING REQUIRED NO FUNDING REQUIRED X SUBJECT: Two Requests for"ABC" Off-sale General Liquor Licenses RECOMMENDATION: Review and consider requests by two businesses for City approval and support of Alcoholic Beverage Control ("ABC") General Liquor Licenses. No recommendation by staff as to approval or denial of these requests. Background: Please note that this matter was presented to the City Council on January 22"d , April 22"d and May 27th of this year. On January 22"d a motion to support the applications by writing letters of"Public Convenience and Necessity" failed on a 2 to 2 vote On April 22"d members of the Council asked for additional information regarding these two requests. At the May 27th meeting, the businesses requested the item be delayed until the June 10th meeting. The two businesses are the "E-Z Mart" next to Demitris and the "Smart Time Food Store" next to Pasta Italia. They are both convenience markets with existing Type 20 licenses which allows for the off-sale (no on-site consumption) of beer and wine. They are both requesting upgrading their license to a Type 21 which allows, besides beer and wine; the sale of liquor or spirits. The State's Alcoholic Beverage Control Board has determined in both instances that there is an "over-concentration" of such licenses for each census tract where the individual business is located. Under these circumstances, ABC has requested that each business obtain a letter of"Public Convenience and Necessity" from the City. More detail on the 'background of this requirement was discussed in the report to the City Council on April 22"d. We have attached a copy of that earlier report for the Council's information and-review. On April 22"d Councilman Larkin wanted copies of the census maps used by ABC in determining the "over-concentration" issue. Staff obtained copies of the two census tracts in question (Census Tract No.'s 71.02 and 71.07) from the Census Bureau's web site. These two maps are attached to this report for the Council's review. Staff has modified both maps to show the location.of all of the current ABC licenses in' each census tract. The solid "dots" are the existing "off-sale" type licenses where alcohol can be sold but not consumed on site. Of the eleven "off-sale" licenses in Census Tract No. 71.02, only three have a Type 21 general license allowing for the sale of liquor or spirits; the remainder of the"off-sale" licenses are restricted to only beer and wine. Each "off-sale" liquor license in Census Tract No. 71.02 has been indicated with the number "21." Almost all of the "off-sale" licenses are located outside of the City along Washington Street in Colton and along Redlands Boulevard in both Colton and San Bernardino. There are no Type.21 licenses in the other census tract which is Census Tract No.. 71.07 located west of the freeway. Based on the number of existing "off-sale" licenses and the population of each census tract(Census Tract No. 71.02 - pop. 2,516; & Census Tract No. 71.07 - pop. 10,567), ABC has determined that there is an "over-concentration" of"off-sale" licenses in each tract. This, therefore, requires the "Public Convenience and Necessity" (PC & N) letter for each business. Mayor Hilkey wanted to know if the approval of the liquor license for the "Smart Time Food Store" would adversely effect the existing post office that operates out of that store. Staff contacted Mr. Jim Merry of the Postal Service who indicated that the Postal Service would not have a problem with liquor/spirits being AGENDA ITEM NO.i ..d sold in the "Smart Time Food" market so long'as such products were not displayed-next to the postal counter. Councilpersons Garcia and Cortes requested information on,the number of accidents in Grand Terrace involving alcohol. The Sheriff has provided staff with a report on the number of accidents involving alcohol for last year. A copy of his report is attached. While there were 20 arrests for "D.U.I."; there was only one traffic collision involving alcohol. Please note the Sheriffs observation that the majority of these arrests were "non-residents" who "therefore consumed the alcohol somewhere other than within the City." The Sheriff also notes in the last paragraph of his report that "D.U.I. related crimes are affected by the increase of businesses licensed for the sale of alcohol to be consumed on the premises such as a bar or restaurant" not the type requested by the two applicants. The last issue involved future signage for the two businesses. Following the meeting on April 22nd, staff contacted both business owners and discussed the proposal to exclude the word "liquor" from the future signs of both businesses. Both owners have told staff that in order to receive the City's support, they would agree not to include the word "liquor" in any future signs for their businesses. Staff hopes that this information answers all of the questions and issues raised by members of the City Council when this matter was last discussed on April 22nd. Conclusion: The staff suggests the City Council again review and consider the requests by the two businesses for the City's approval and support of the "ABC" liquor license requests. If the Council feels that one or both of these requests should be approved and supported, Council should authorize staff to prepare and send to the Alcoholic Beverage Control Board the requested "Letters of Public Convenience and Necessity" for each approved request. The staff, however, takes no position on these requests. (E-Z Mart) I.have attached a previous letter explaining the reasoning in why we wish to upgrade our ABC license from a type 20 to a type 21 This letter is intended to answer some of your concerns if a new type 21 license is issued to E-Z Mart within the city limits of Grand Terrace. One of the concerns we have been presented with is the fear that children will have easy access to alcohol beverages. We have been in this location for more than seven years. Because we are located away from schools and residential areas we experience a very small amount of unsupervised children that patronize our store. When we do have unsupervised children it has always been our policy to allow only one or two at a time so our attention will not be compromised. This allows our staff to watch out for the young people. I have children and grand children and I understand your concerns,but I take pride in our ability to make sure that children are safe when they enter our store We will keep all non-beer and wine alcohol behind the counter at all times. That area does not have a clear access from the entrance To walk behind the counter you have to walk completely around the counter and enter from the other side. We take pride in having that area always manned by compenent employees. Another one of your concerns are with the displaying of signs advertising alcohol beverages. E-Z Mart agrees 100%to abstain from any signs on the outside of our building depicting any alcohol advertising. The mall we are in has retail and professional businesses. The less storefront advertising the better our mall keeps its family appeal. Another of you concerns may be over saturation of ABC licenses. We are not purchasing a new license, we are just upgrading our current license When and if we have a type 21 license we will relinquish our type 20 license. One of our arguments in being able to obtain a type 21 license has been that we are on the other side of the freeway, which gives us a market for all customers here to be able to purchase alcohol beverages closer to their homes instead of traveling across town. We strongly believe we will be serving the public in a positive way by having a more full service market. If you have any other concerns we gladly answer them at your convenience. Even though the first hearing we had in front of the city counsel did not go positively for our corporation, we nevertheless applaud you for your continued positive direction for our great city Having stated that,we would like you to indulge us in the following positive reasons why you should take a second look at our proposal. 1 If approved,we would not bring a new ABC license into Grand Terrace we would be just upgrading i our current type 20 license. 2. (Driving Under the Influence) Statistics As per your request, I have researched all D.U.I. related reports taken by the Sheriff's Department in the City of Grand Terrace for the calendar year 2003. The following is a summary of my findings; • 20 arrests were made for D.U.I. • 1 of the 20,arrests was as a result of a traffic collision. • 80% of those arrested for D.U.I. were non-residents of Grand Terrace. Since a majority of those arrested for D.U.I. were non-residents of the city, the statistics tend to indicate that these people were more than likely just passing through the city and therefore consumed the alcohol somewhere other than within the city. It is my opinion that the above information does not support any correlation between "on-sale" alcohol sales (such as at a liquor store) and D.U.I. related crimes. Generally D.U.I. related crimes are affected by the increase of businesses licensed-for the sale of alcohol to-be consumed on the premises such as a bar or restaurant. No recommendation by staff as to approval or denial of these requests. • Background: Please.note that this matter was presented to the City Council on Thursday, January 22, 2004. A motion to instruct staff to write the "Letter of Public Convenience and Necessity" requested by the State Alcohol Beverage Control Board failed to carry on a 2 to 2 vote by the City Council for both businesses, the"E-Z Mart" next to Dimitris and "Smart Time Food Store" next to Pasta Italia. (One member of the City Council was not present.) A copy of the Council minutes for that date on this matter is attached. Both businesses have requested another opportunity to present their requests to the City Council when all 5 members are present. Each business wrote a new, additional letter describing their requests; copies of each letter are attached. I ' The following is the report presented to the City Council in January, no substantial facts have changed in the interim: We have two requests for Type 21 Alcoholic Beverage Control ("ABC') licenses before the City. A Type 21 license is an off-sale general license which allows for the sale of beer,. wine and spirits (hard liquor). This is the type of license for a liquor store. Presently, both applicants have Type 20 licenses which allows only the off-sale of beer and wine but not hard liquor or spirits. The first received request was from new owners of the "Smart Time Food Store" at 22310 22795 Barton Road a Grand Terrace, California 923 i 3-5295 e 909/ 824-662 i Imo' �I;( f'^a P1 ` QE��.D� [ IE_I r ���# ��.-f'����L��'•�L_ f-�:`F�:Is:�E`z��c-t F � Ls:k4k ���� 111 Barton Road (next to ,Pasta Italia); and the second request was from the existing owners of the"E-Z Mart"at 21900 Barton Road (next to Dimitri's). Both applicants have been told by"ABC"that there is an "over concentration" of off-sale licenses in the respective census tracts for each of these requests. In order for-''ABC" to issue the requested Type 21 license, each.applicant is required to submit a letter from the City,of Grand Terrace in support of the requested license: This letter, in "ABC"jargon, is called a "Letter of Public Convenience and Necessity or'PC&N',letter." The letter must indicate thatthe City"agrees that issuance of the applied for license will meet the public convenience and- necessity standards for their community." Please see the attached letters from the-two businesses requesting the City's support and approval of the Type 21 license. Liquor stores are a permitted use under the Barton Road Specific Plan—General Commercial category where the"Smart Time Food Store"is located(although a-conditional use permit is required if the business is within 500 feet of a school) and under the C2 Zone where the "E-Z Mart" is located. We havetold both business owners that one-of the prerequisites to getting the City's zoning approval of their request was to comply with the City's sign code. To do this, both businesses had to remove a great number of window and other signs from their premises. This was done in early December and was done before the issue of the "Letter of Public Convenience and Necessity" came up. The "ABC"finding of over concentration is based on the number of off-sale licenses within a census tract, not the City as a whole. The City of Grand,Terrace is divided into a number of census tracts, some of which take in parts of the City of Colton. "Smart Time" is located in Census Tract 71.02 and "E-Z Mart" is located in Census Tract 71.07. I.n both cases, "ABC" has found there to be an "over concentration" of off-sale licenses. Copies of the -maps of both census tracts are attached. According to the "ABC" web page and what the local "ABC" office told me, "ABC" uses a standard of one off-sale license per 1,250 persons in determining whether there is an over- concentration of off-sale licenses. They do not include on-sale type licenses for bars and restaurants in making this determination. The staff has prepared a list of existing "ABC" licenses in the City of Grand Terrace from the "ABC" web page. A copy of that list is attached. There are a total of 12 "ABC" licenses of which 8 are off-sale (Type 20 and 21). According to the 2000 Census,the population of Grand Terrace is 11,626 persons. Using the standard cited above, 9 off-sale licenses could be permitted without a determination of over concentration if it were applied to the City as a whole. If these requests are approved, the number of businesses with off-sale licenses in the City would not increase because the two exiting businesses already have an off-sale license (Type 20). Once they obtain the Type 21 licences, according to "ABC" staff, each business can sell its existing Type 20 license to another party. Any such party would have to go through the same local approval process and would not necessarily be located in Grand Terrace. As noted above, each applicant has submitted a letter requesting the City's approval of their request for a Type 21 license. The "Smart Time" letter was received by the City in early December; the "E-Z Mart" on January 8', last. There are no Type 21 licenses in Grand Terrace west of the Freeway; while east of the Freeway, there are three: the Arco Station (the owner has chosen not to sell hard liquor out of this site even though he has the license); Stater Bros and the Grand Terrace Liquor store in the Stater Bros center. The letter from the "E-Z Mart" owners indicates they have operated their business since 1997. Again, the owners of the "Smart,Time Food Store"just recently purchased their business. Conclusion: The staff suggests the City Council review and consider the requests by the two businesses for the City's approval and support of the "ABC" liquor license requests. -If the Council feels that one or both of these requests should be approved and supported, Council should authorize staff to prepare and send to the Alcoholic Beverage Control Board the requested "Letters of Public Convenience and Necessity" for each approved request. We have been operating our convenience store at this location continuously since May of 1997(almost seven years. Since our inception we have had a beer and wine license. Today our license is current and is in compliance with all the governing laws associated with its use. We have never had a violation relating to the sell of beer and wine. The following items are just a few of the positive developments that will take place with the new license. 1. The hiring of new employees because of the increase in volume. 2. The only locations with a liquor license at this time are right next to each other. By having a license on this side of the freeway will be an advantage for the city. It will bring customers that currently shop in others areas. 3. We are not bordering housing or schools, Our location is primarily a business district. 4. More customers at our location can only help the other and often struggling businesses that are located in our complex and the surrounding area. We are currently displaying the sign that states our intention to sell alcoholic beverages. We have complied with all of the proper paper work and background checks and our awaiting the final okay from the city We do understand that another store has also applied for this license in the City of Grand Terrace. To our understanding the other location applying for this license has just changed ownership.. We believe that if the city has intentions of allowing a new license.that it should strongly consider ours because of the many years we have been doing business in this city and our proven track record.
