February 2003. The policy procedures are the same for both Agency and City

AGENCY OF THE CITY OF GRAND TERRACE,
CALIFORNIA,ADOPTING AN INVESTMENT POLICY FOR
THE AGENCY
WHEREAS, California Government Code 53646 (2) requires that the Treasurer or Chief
Fiscal Officer shall annually render to the governing legislative body a Statement of lnvestment
Policy, which the governing body shall consider at a public meeting;
NOW,THEREFORE,The Board of Directors of the Community Redevelopment Agency_
does hereby resolve, declare, determine, and order as follows:
Section I. The Board has reviewed and considered the Statement of Investment Policy in
a public meeting.
Section 2. That the statement of Investment Policy attached hereto and incorporated herein
by reference is the adopted Investment Policy for the Agency.
Section 3. The appropriate officers, agents and employees of the Agency are hereby
authorized and directed, on behalf of the Agency, to invest available funds, from time to tune, in
accordance with the Statement of Investment Policy.

INVESTMENT POLICY
1 . 0 POLICY
It is the policy of the CRA of Grand Terrace to invest
funds in a manner which will provide the highest investment
return with the maximum security while meeting the daily
cash flow demands of the CRA and conforming to all statutes
governing the investment of CRA funds .
2 . 0 SCOPE
This investment policy applies to all financial assets of
the CRA. These funds are audited annually and accounted for
in the Comprehensive Annual Report . Funds include the
Capital Project Fund, Debt Service Fund and Low-Moderate
Income Housing Fund.
3 . 0 PRUDENCE
Investments shall be made with judgment and care, under
circumstances then prevailing which persons of prudence,
discretion and intelligence exercise in the management of
their own affairs, not for speculation, but for investment,
considering the probable safety of their capital as well
as the probable income to be derived. The standard of
prudence to be used shall be the "prudent person" standard
and shall be applied in the context of managing an overall
portfolio . Investment officers acting in accordance with
written procedures and the investment policy and exercising
due diligence shall be relieved of personal responsibility
and/or liability for an individual security ' s credit risk or
market price changes .
4 . 0 OBJECTIVE
The primary objectives, in order of priority, of the
investment activities shall be :
1 . SAFETY : Safety of principal is the foremost objective of
the investment program. Investments of the CPA shall
be undertaken in a manner that seeks to ensure the
preservation of capital in the overall portfolio. To
attain this obDective, diversification is required in
order that potential losses in individual securities do
not exceed the income generated from the remainder of
the portfolio.

INVESTMENT POLICY
2 . LIQUIDITY: The investment portfolio will remain
sufficiently liquid to enable the CPA to meet all
operating requirements which might be reasonably
anticipated.
3 . YIELD: The investment portfolio shall be designed with
the objective of attaining a market rate of return
throughout budgetary and economic cycles, taking into
account the investment risk constraints and the cash flow
characteristics of the portfolio.
5 . 0 DELEGATION OF AUTHORITY
Authority to manage the investment of surplus funds is
derived from California Government Code Section 53600 , et
seq. , and this policy .
Management of Bond Funds is controlled be Government Code
5922 (d) and such investments must conform to the
requirements of the bond indenture . In some cases, it may be
appropriate for investment of bond proceeds to cover a
longer duration than those limits established for
surplus (operating) funds . Management responsibility for
the investment program is hereby delegated to the
Treasurer, who shall establish procedures and operate the
investment program consistent with' this investment policy .
Procedures may include, but not be limited to, references
to : safekeeping, PSA repurchase agreements, wire transfer
agreements, collateral/depository agreements and banking
services contracts, as appropriate . Treasurer may delegate
authority to subordinates for day to day investment
transactions . No person may engage in an investment
transaction except as provided under the terms of this
policy and the procedures established by the Treasurer .
6 . 0 ETHICS AND CONFLICTS OF INTEREST
Officers and employees involved in the investment process
shall refrain from personal business that could conflict
with the proper execution of the investment program, or
which could impair their ability to make impartial
investment decisions .

7 . 0 AUTHORIZED FINANCIAL INSTITUTIONS AND DEALERS
The Agency will prohibit the utilization of outside
investment advisors .
The Treasurer may select any financial institution/
broker/dealer, selected by credit worthiness , who are
authorized to provide investment services in the State of
California .
No public deposit shall be made except in a qualified public
depository as established by State laws . For broker/dealers
of government securities and other investments, the
Treasurer shall select only broker/dealers who are licensed
and in good standing with the California Department of
Securities, the Securities and Exchange Commission and the
National Association of Securities Dealers .
8 . 0 AUTHORIZED INVESTMENTS :
The CRA of Grand Terrace is empowered by statute and
authorized by Agency Board to invest in the following :
A. U. S . TREASURY OBLIGATIONS (TREASURY BILLS, TREASURY
NOTES) .
B. REPURCHASE AGREEMENTS .
C. CERTIFICATES OF DEPOSIT WITH STATE BANKS, NATIONAL BANKS,
STATE OR FEDERAL SAVINGS ASSOCIATIONS, STATE AND
FEDERAL CREDIT UNIONS IN CALIFORNIA, that are fully
insured by federal or State deposit insurance . The
Treasurer may waive collateralization in lieu of
deposit insurance .
D. NEGOTIABLE CERTIFICATES OF DEPOSIT, COLLATERALIZED WITH
U. S . TREASURY OBLIGATIONS HAVING A MARKET VALUE OF
110% .
The Treasurer may, at his discretion, waive security
for that portion of a deposit that already is covered
by federal or State deposit insurance .

E. PASSBOOK SAVINGS ACCOUNTS PLACED WITH FEDERAL OR STATE
BANKS OR CREDIT UNIONS, that are fully insured by

waive collateralization in lieu of deposit insurance .
F. SECURITIES ISSUED BY FEDERAL AGENCIES .
G. LOCAL AGENCY INVESTMENT FUND (LAIF) ,
Special Fund of ' the State Treasury in which local.
agencies are allowed to pool their funds for investment
purposes up to a maximum of $40 Million. LAIF will
have its own investment policy that will differ from
the CRA.
H. MUTUAL FUNDS, issued by diversified management companies
as defined by Section 23701m of the Revenue and
Taxation Code, provided that the portfolio of such
investment company or investment trust is limited to
U. S . government obligations or agencies of the federal
government and repurchase agreements fully
collateralized by such securities .
I . POOLS AND OTHER INVESTMENT STRUCTURES INCORPORATING
INVESTMENTS PERMITTED IN CALIFORNIA GOVERNMENT CODE
SECTIONS 53601 AND 53635,
such as Local Government Investment Pools sponsored by
counties and point powers authorities . These entities
may have their own investment policy that will
differ from that of the CRA of the City of Grand
Terrace .
9 . 0 COLLATERALIZATION:
All certificates of deposit must be collateralized by U . S .
Treasury obligations held by a third party . The Treasurer
may waive this requirement up to the amount already insured
by federal or State deposit insurance .
10 . SAFEKEEPING AND CUSTODY :
All securities purchased from broker/dealers shall be
conducted on a delivery VS . payment (DVP) basis and
shall be held by a third party custodian designated by the

Treasurer and evidenced by safekeeping receipts . This would
not apply to any book-entry direct purchases from the U. S .
Government .
11 . DIVERSIFICATION:
The CRA will diversify its investments by security type
and institution.
12 . INVESTMENT POLICY ADOPTION
The Investment Policy shall be approved by Agency Board and
adopted by resolution of the CRA.
This policy has been reviewed and amended by the CRA
Board on June 24 , 2004 .

SUBJECT: Short Term Land Lease With Victoria Homes, Inc.
RECOMMENDATION: Authorize the Redevelopment Agency to enter into a
short-term land lease with Victoria Homes, Inc.
Background: On June 3, 2004, the Community Redevelopment Agency (CRA) received
a request from Victoria Homes. Inc to enter into a short-term lease for property owned by the
CRA. The site is Assessor's Parcel # 1]67-151-024 located immediately north of the Hiehgrove
'Power Plant. The site is currently vacant with a perimeter chain link fence and locked gates.
The site is zoned for industrial land uses. The storage of building materials is an approved use
within this zone.
Victoria Homes has requested a short-term lease of up to six months to store metal building studs
used in the construction of their single family homes. Thev .are in the process of moving their
assembly plant from Bawling to Victorville and require a short-term storage site for metal
products while the new facility is constructed.
A draft lease agreement has been prepared and reviewed by the City Attorney. Highlights of the
agreement include:
l. A month to month term of up to six months.
2. A monthly lease of$1.000 per months with first and last month paid in advance.
3. Liability insurance and hold harmless clause protecting the Agency.
4. A termination clause that either party may terminate the agreement with 30 days written
notice.
Staff recommends that the CRA hoard authorize the Cite Manager to execute the attached
short-term month-to-month lease with Victoria Homes,Inc.

1.1 The Landlord the City of Grand Terrace leases to Tenant Victoria Homes the real estate located
immediately north of the Htghgrove Power Plant(Assessor's Parcel 1167-151-024
1.2 The Landlord acknowledges receipt of$ 2,000.00 to be applied as follows.

4. OPERATING EXPENSES:

5. POSSESSION:
5.1 If Landlord is unable to deliver possession of the premises, Landlord will not be liable for any

6.1 The Tenant's use of the premises shall be: for storage of metal components and residential
construction materials for residential housing
6.2 No other use of the premises is permitted. Tenant may not conduct any activity which increases
Landlord's insurance premiums
6.3 Tenant will not use the premises for any unlawful purpose.violate any government ordinance or
building and tenant association rules, or create any nuisance.
6.4 Tenant shall deliver up the premises together with all keys to the premises on expiration of the
lease in as good condition as when Tenant took possession. except for reasonable wear and tear.
7. APPURTENANCES:
7.1 Tenant shall have the right to use Landlord's access of ingress and egress

10. REPAIR AND MAINTENANCE:

11. RIGHT TO ENTER:
11.1 Tenant agrees to make the premises available on 24 hours notice for entry by Landlord for
necessary repairs, alterations. or inspection of the premises
12. WASTE:
12.1 Tenant will not destroy, damage, or remove any part of the premises or equipment, or commit
.waste, or permit any person to do so.
13. LIABILITY INSURANCE:
13.1 Tenant shall obtain and maintain commercial general liability insurance covering both personal
injury and property damage to cover Tenant's use of the premises insuring Tenant and Landlord
13.2 Tenant shall obtain insurance for this purpose in the minimum amount of$ 500,000.00
13.3 Tenant shall provide Landlord with a Certificate of Insurance naming the Landlord as an
additional insured. The Certificate shall provide for written nonce to Landlord should a change or
cancellation of the policy occur
13.4 Each party waives all insurance subrogation rights it may have
14. FIRE INSURANCE:
14.1 Tenant shall obtain and maintain a standard fire insurance policy Nwith extended coverage for
theft and vandalism to the extent of 100% of the replacement value of all personal property and
the restoration of Tenant improvements
15. HOLD HARMLESS:
15.1 Tenant shall hold Landlord harmless for all claims. damages or liability arising out of the
premises caused by Tenant or its employees or patrons.
16. DESTRUCTION:
16.1 In the event the premises are totally_ or partially destroyed, Tenant agrees to repair the
premises if the destruction is caused by Tenant or covered by its insurance
16.2 The lease shall not be terminated due to any destruction

19.1 Tenant may not assign this lease or sublet any part of the premises, or further encumber the
leasehold.
20. SURRENDER:
20.1 Tenant may surrender this lease only by a written cancellation and waiver agreement with
Landlord.
21. EMINENT DOMAIN:
21.1 Should a portion or all of the premises be condemned for public use, Landlord may terminate the
lease and Tenant's possession. If the lease is not terminated.
21.3 Any Tenant's damages shall come solely from the condemning authority
22. WAIVER:
22.1 Waiver of a breach of any provision in this lease shall not constitute a waiver of any subsequent
breach. Landlord's receipt of rent with knowledge of Tenant's breach does not waive Landlord's
right to enforce the breach.
23. DEFAULT REMEDIES:
23.1 If Tenant breaches any provision of this lease. Landlord may exercise its rights, including the
right to collect future rental losses after forfeiture of possession
24. BROKERAGE FEES:
24.1 Landlord. Tenant have represented themselves and there are no brokerage fees.
25. MISCELLANEOUS:
25.1 Items left blank or unchecked are not applicable.

PUBLIC COMMENT
City_Attorney Harper,reminded everyone that Public Conmment is the time when the public
has the opportunity to conmrment on items which are not on the Agenda. The Brown Act
requires that members of the Council not discuss the items or make comment and that the,,,-
can refer items to staff members for future comment or place it on a future Agenda.
Hank Ramey, 21845 Grand Ten-ace Road #23. indicated that he is opposed to the Outdoor
Adventure Center and feels that this is an item that could be voted upon at the next election
Patricia Farley, 12513 Michigan Street.she expressed her disappointment with the members
of the Plarmmg Commission. She feels that the community input was not considered when
the Plarmmng Commission voted on the Outdoor Adventure Center and questioned what the
Conmmrssion certified. She indicated that there were changes to the final EIR that the
Community has not seen and feels that those who paid the money for a copy of the EIR
should get all updates. She would like a complete final copy. She stated that if the Council
certifies the EIR she wants to know exactly what they approve. She feels that the City
Council Minutes that were approved are sparce and incomplete. She feels that evervthing
that members of the Public say should be reported. She would like to see complete minutes
of everything that is on the tape. She feels that the Agenda is confusing and is concerned that
items are going to be slipped in and approved without her knowledge. She demanded that
she receive exact copies of everything and notification immediately when a Notice of
Determination is filed. She also would like more than one copy of the packet available. She
expressed her concern with the confusion of the Outdoor Adventure Center Project and the
documentation. She feels that the community would like to know}mow City money is being

Vagina Harford, 11825 Arliss Way, questioned what investigation has taken place with
retards to the Outdoor Adventure Center and the affects that it will have on the community
She suggested that they look at other pro_lects of this type to see what type of impact they
have had on the communities in which they were built. She questioned if this park is a done
deal or will the Council consider input from the community. She also indicated that she is
opposed to the building of a new high school and questioned what the impact will be in
regards to the high school and the OAC.
Bill Hays. 22114 De Berry Street, indicated that Gary Koontz. Community and Economic
Development Director works two days a week while at the same time he is employed by
Nolte and Associates Inc.,which is the same company that is listed in the EIR Specific Plan
of the Outdoor Adventure Center and questioned if that is a conflict. He questioned who Mr.
Koontz is working for when he gives the presentations to the Council. Be indicated that this
City has never had a budget over 4 million dollars and by accepting the Outdoor Adventure
Center this will put the power of 60 to 70 million dollars in the hands of the Council and he

would like to know when the Council goes to change the developer will this be in public or
will they go into executive session like all other real estate deals.
City Manager Schwab,indicated that he will send a letter to Mr.Hays to respond to all of Ills
questions
Dave Gorman,21860 Grand Terrace Road,thanked Assistant City Manager Berry for getting
someone from code enforcement to come out to the property that is next to Ills and having
some type of investigation take place as to whether or not there are contaminating
components being stored on that property. To his knowledge something has been done with
regards to that. He questioned whether or not that individual is operating a business at that
location and does he have a license to do so in a residentially zoned piece of property. Be
would like to know what can be done to ensure that he does follow the proper procedures to
do so
Richard Rollins. 22797 Barton Road, talked about when he first moved to Grand Terrace.
He expressed how proud he is to be a member of Grand Terrace and what a great City it is

Councilmember Larkin. he felt that Grand Terrace Days was great. Be felt that everything
was outstanding. Be stated that awhile back he proposed that the Council not name any City
facilities after a living person. He indicated that he rescinds and that if there is anyone that
ever deserves having something named after them it is Mr. Rollins. It was great to see him

as the Grand Marshal of the Grand Terrace Days Parade. Be indicated that Friday, June 13
will be a National Day of Mourning for the late President Ronald Reagan. Be feels that
Ronald Reagan was a great president and will be missed. Be feels that we were lucky to
have hire as a'President.
Mavor Pro Tem Fen•6, feels that this was the best Grand Terrace Days ever. There was a
great turnout. She reported that she attended the San Bernardino County Wide Gang and
Drug Task Force Meeting and although Grand Terrace doesn't have the problems that many
of our neighboring communities do with gangs and drugs, it still has an affect on our City.
A budget impact update was given by Dr. Fisher,the Suprmtendent of County Schools and
Robert Peppler,theUnder Sheriffforthe San Bernardino County Sheriff's Department,.levy
Harper,ChiefProbation Officerfor San Bernardino CountyProbatron Department and James
Hackleman the Assistant District Attorney for San Bernardino County Office of the District
Attorney. There are some budget impacts that are defrnately going to make a difference.
They are committed to continue to make our envirorunent a safe place and our cities a safe
place to live. She enjoys berm on this committee and feels that she learns a great deal
Councilmember Garcia, indicated that she too enjoyed Grand Terrace Days. She feels that
the diversity in the community is tremendous and it makes her happy and proud. She
reported that her and Dallas won the 1960's quilt that was raffled at the Fair.
Mavor Hilkey, indicated that the Govenor's Office sent a remembrance sheet for everyone
to sign for the City of Grand Terrace which will go to the Ronald Reagan Library. He
encouraged everyone to sign it
Councilmember Garcia, she reported that on June 17°i from 3:30 to 4:30 pm the League of
California Cities Inland Empire Legislative Action Task Force will be meeting and the goal
of that meeting is to talk about the State Budget. A Special News Conference relating to the
State Budget with the Governor will be held at the State Capital on June 17°i and
representatives from the Cities are encouraged to attend. Sipe reported that SCAG is working
on the COMPAS Project with regards to land use. She \vants to make sure that all of the
residents are well informed and if there is any member of the public that has any questions
or needs information they should contact City Staff. Council wants to work with residents
to come up with the best solution for the community. Blessings to all families that are
having voung ones graduate this year.

involvement.
Councilmember Cortes, suggested that Councilmember Garcia represent the City of Grand

Manager Berry for a wonderful Grand Terrace Days. She thanked Assistant City Manager
Berry for doing a great job while the City Manager was on vacation. On May 27`h she
attended a meeting with Congressman Jerry Lewis. She personally thanked him for
providing funding through the 2004 Omnibus Appropriation Bill. She especi ally thanked his
staff member Elizabeth Lewis for the work she has provided for staff. She reminded
everyone that on June 17`h the Grand Terrace Area Chamber of Commerce will hold their
Installation Dinner at the Victoria Country Club in Riverside.
Mayor Hilkey, Councilmember Garcia.Cortes and himself attended a meeting put on by the
President of California State San Bernardino where they all spoke to Jerry Lewis and thanked
him for the money to help design the off-ramp into Grand Terrace. He attended a meeting
on group homes along with City Manager Schwab. County Supervisor Hannsberger wants
to talk about legislature for group homes and is spear heading the efforts. Omnitrans will be
approving their budget,which means the Omnilink in Grand Terrace will remain the same.
He feels that Grand Terrace Days was by far the best he has ever seen. This shows what a
little bit of business in town and a staff that hussies can do. Terrace Hills Middles School
Marching Band Received I" place. He received a letter fi-om San Bernardino County
indicating that most of the County offices will be open, Administrative Offices and the
Libraries will,be closed in observance of Ronald Reagan's funeral. Be received a notice on
the Measure I renewal in the mail at home. He encouraged everyone to look at it. Colton
High School will hold their graduation on Tuesday. June 15°i and the Chamber Installation
will be held on Thursday. June 171h.
Councilmember Garcia; Indicated that she is interested in the legislation that Hannsberger
is spear heading.

NAIHEREAS, California Government Code 53646 (2) requires that the Treasurer or Chief
Fiscal Officer shall armually render to the governing legislative body a Statement of Investment
Policy, which the governing body shall consider at a public meeting;

1 .'0 POLICY
It is the policy of the City of Grand Terrace to invest
funds in a manner which will provide the highest investment
return with the maximum security while meeting the daily
cash flow demands of the City and conforming to all statutes
governing the investment of City funds .
2 . 0 SCOPE
This investment policy applies to all financial assets of
the City . These funds are audited annually and accounted for
in the Comprehensive Annual Report . Funds include the
General Fund, Special Revenue Funds, Trust Funds, Deb:
Service Funds and any other City funds .
3 . 0 PRUDENCE
Investments shall be made with judgment and care , unde2-
circumstances then prevailing which persons of prudence ,
discretion and intelligence exercise in the management of
their own affairs, not for speculation, but for investment ,
considering the probable safety of their capital as well
as the probable income to be derives . The standard of
prudence to be used shall be the "prudent person" standard
and shall be applied in the context of managing an overalls
portfolio. investment officers acting in accordance with
written procedures and the investment policy and exercising
due diligence shall be relieved of personal responsibility
and/or liability for an individual security ' s credit risk or
market price chances .
4 . 0 OBJECTIVE `
The primary objectives, in order of priority, of thF
investment activities shall be :
1 . SAFETY: Safety of principal is the foremost objective of
the investment program. Investments of the Citv shall
be undertaken in - a manner that seeks to ensure the
preservation of capital in the overall portfolic . To
attain this objective , diversification is required in
order that potential losses in individual securities do
not exceed the income generated from the remainder of
the portfolio ,

INVESTMENT POLICY
2 . LIQUIDITY° The investment portfolio will remain
sufficiently liquid to enable the City to meet all
operating requirements which might be reasonably
anticipated .
YIELD° The investment portfolio shall be designed with
the ob ective of attaining a market rate of return
throughout budgetary and economic cycles, taking into
account the investment risk constraints and the cash flow
characteristics of the portfolio .
5 . 0 DELEGATION OF AUTHORITY
Authority to manage the investment of surplus funds is
derived from California Government Code Section 53600 , et
seq . , and this policy .
Management of Bond Funds is controlled be Government Code
5922 (d) and such investments must conform to the
requirements of the bond indenture . In some cases, it may be
appropriate for investment of bond proceeds to cover a
longer duration than those limits established for
surplus (operating) funds . Management responsibility for
the investment program is hereby delegated to the
Treasurer, who shall establish procedures and operate the
investment program consistent with this investment policy .
Procedures may include, but not be limited tc, references
to : safekeeping, PSA repurchase agreements, wire transfer
agreements, collateral/depository agreements and banking
services contracts , as appropriate . Treasurer may delegate
authority to subordinates for day to day investment
•transactions . No person may engaae in an investment
transaction except as provided under the terms of this
policy and the procedures established by the Treasurer .
6 . 0 ETHICS AND CONFLICTS OF INTEREST
Officers and employees involved in the investment process
shall refrain from personal business that could conflict
with the proper execution of the investment program, or
which could impair their, ability to make impartial
investment decisions .

The City will prohibit the utilization of outside
investment advisors .
The Treasurer may select any financial institution/
broker/dealer, selected by credit worthiness , who are
authorized to provide investment services in the State of
California .
No public deposit shall be made except in a qualified public
depository as established by State laws . For broker/dealers
of government securities and other investments , the
Treasurer shall select only broker/dealers who are licensed
and in good standing with the California Department of
Securities, the Securities and Exchange Commission and the
National Association of Securities Dealers .
8 . 0 AUTHORIZED INVESTMENTS :
The Citv of Grand Terrace is empowered by statute and
authorized by Council to invest in the following :
A. U.S . TREASURY OBLIGATIONS (TREASURY BILLS, TREASURY
NOTES) .
B . REPURCHASE AGREEMENTS .
C. CERTIFICATES OF DEPOSIT WITH. STATE BANKS, NATIONAL BANKS,
STATE OR FEDERAL SAVINGS ASSOCIATIONS, STATE AND
FEDERAL CREDIT UNIONS IN CALIFORNIA, that are fully
insured by federal or state deposit insurance . The
Treasurer may waive co'llateralization in lieu of
deposit deposit insurance .
D. NEGOTIABLE CERTIFICATES OF DEPOSIT, COLLATERALIZED WITH
U. S . TREASURY OBLIGATIONS HAVING A MARKET VALUE OF
110% .
The Treasurer may, at his discretion, waive security
for that portion of a deposit that already is covered
by federal or State deposit insurance .
E. PASSBOOK SAVINGS ACCOUNTS PLACED WITH FEDERAL OR STATE
BANKS OR CREDIT UNIONS, that are fully insured by

agencies are allowed to pool their funds for investment
purposes up to a maximum of $40 Million . LAIF will
have its own investment policy that will differ from
the City .
H. MUTUAL FUNDS, issued by diversified management companies
as defined by Section 23701m of the Revenue and
Taxation Code, provided that the portfolio of such
investment company or investment trust is limited to
U . S . government obligations or agencies of the federal
government and repurchase agreements fully
collateralized by such securities .
I . POOLS AND OTHER INVESTMENT STRUCTURES INCORPORATING
INVESTMENTS PERMITTED IN CALIFORNIA GOVERNMENT CODE
SECTIONS 53601 AND 53635,
such as local government investment pools sponsored by
counties and joint powers authorities . These entities
may have their own investment policy that wile
differ from that of the City of Grand Terrace .
9 . 0 COLLATERALIZATION:
All certificates of1deposit must be collateralized by U. S .
Treasury obligations held by a third party . The Treasurer
may waive this requirement up to the amount already insured
by federal or State deposit insurance .
10 . SAFEKEEPING AND CUSTODY:
All securities purchased from broker/dealers shall be
conducted on a delivery VS . payment (DVP) basis and
shall be held by a third party custodian designated by the
Treasurer and evidenced by safekeeping_, receipts . This would
not apply to any book-entry direct purchases from the U. S .
Government .

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, CALLING AND GIVING
NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL
ELECTION TO BE HELD ON TUESDAY, NOVEMBER 2,
2004, FOR THE ELECTION OF CERTAIN OFFICERS AS
REQUIRED BY THE PROVISIONS OF THE LAWS OF THE
STATE OF CALIFORNIA RELATING TO GENERAL LAW
CITIES
WHEREAS, under the provisions of the laws relating to general law cities in the
State of California, a General Municipal Election shall be held on November 2, 2004, for
the election of Municipal Officers;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,'
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS.
SECTION 1. That pursuant to the requirements of the laws of the State of California
relating to General Law Cities, there is called and ordered to be held in the City of Grand
Terrace, California, on Tuesday, November 2, 2004, a General Municipal Election for the

as required by law.
SECTION 3. That the City Clerk is authorized, instructed and directed to procure
and furnish any and all official ballots, notices, printed matter and all supplies, equipment
and paraphernalia that may be necessary in order to properly and lawfully conduct the

SECTION 4. That the polls for the election shall be open at seven o'clock a.m. of
the day of the election and shall remain open continuously from that time until 8 o'clock
p.m. of the same day when the polls shall be closed, except as provided in Section 14401
of the Elections Code of the State of California.
Section 5. That in all particulars not recited in this resolution, the election shall be
held and conducted as provided by law for holding municipal elections.
Section 6. That notice of the time and place of holding the election is given and the
City Clerk is authorized, instructed and directed to give further or additional notice of the
election, in time, form and manner as required by law.
Section 7. That the City Clerk shall certify to the passage and adoption of this

Background: On May 18, 2004, the City of Grand Terrace Community Development
Department released a Request For Proposals (RFP) for consulting services associated with the
K&J Plating Remediation Project. RFPs were sent to five pre-qualified firms located within
Southern California. The requested scope of services focused upon a review of existmL)
environmental data compiled for the site, development of a remediation plan to efficiently and
economically clean up hazardous materials on the site, and negotiation with the State Department
of Toxic Substance Control to acquire a "No Further Action" Letter from DTSC
On June 8, 2004, four proposals ,,vere received in response to the RFP. A review of the
proposals indicated that all four firms were well qualified to perform the requested services.
Each firm had extensive experience in working with hexavalent chromium and other toxic
substances identified at the subject site. The firms also had extensive experience in working with
the local offices of DTSC to negotiate remediation programs. Since all four firms appeared to be
well qualified, the selection was based upon a review of schedules and fees. Proposed fees were
submitted as follows:

Arcadis GM proposed a schedule of no more than three weeks from award of contract to
complete their review and schedule a meeting with DTSC. City staff will take an active role in
negotiations with DTSC.
The City Council has allocated up to S15,000 of Community Development Block Grant (CDBG)
funds for this consulting work. A total of S120,000 in CDBG funds has been budgeted by the
City Council for consultation, testing, and remediat�on. If additional funds are required, Federal
"Brownfields" grants will be sought
Staff recommends that the Citv Council authorize the City Manager to execute a consulting
agreement with Arcadis GINJ to perform environmental consultation for the K&J Plating
Remediation Project.

CONSULTING AGREEMENT
This CONSULTING AGREEMENT("Agreement") is made as of June 17. 2004, 2004 between
ARCADIS G&M,Inc.,a Delaware corporation ("Consultant"), and The City of Grand Terrace("Client"),
hereinafter sometimes referred as the "Parties." The Parties anticipate the issuance of Work Authorizations
under which Consultant will provide Client with specified technical, engineering, and consulting services,
as set forth in the Work Authorizations.
NOW THEREFORE, in consideration of the mutual covenants and promises and other good and valuable
consideration contained herein,the receipt and adequacy of which are hereby acknowledged. the Parties
agree as follows.
1. The Consulting Agreement Documents
This Agreement between the Consultant and Client (hereinafter"Agreement") consists of this fully executed
Consulting Agreement.which includes and incorporates the following
"Exhibit A" -Work Authorization and any documents incorporated therein;
Anv other Exhibits listed in Paragraph 25 of this Agreement
The foregomg documents are intended to be construed consistently and as a whole, and anything that is
required by one document shall be deemed to be required by all
2. Definitions
As used in this Agreement,identified terms shall have following meaning
"Change Order"means a writien agreement executed by Client and Consultant, express]-
designated as such.revising the scope of services under this Agreement and/or the time for
performance of such Services
"Fee Schedule"means Consultant's unit rates or charges for labor,materials, other services, and
reimbursable expenses. A Fee Schedule shall be included and/or incorporated into each Wort.
Authorization issued pursuant to this Agreement. All Fee Schedules will be subject to periodic
update
"Services"means those tasks to be performed and materials to be delivered by Consultant.
Services shall also mean: (i) all of the Services described in Exhibit A; (ii) all other work and
services identified in this Agreement; (iii) all work identified in a fully executed Worl,
Authorization incorporating this Agreement; and (iv) such additional services as may be provided
pursuant to a written change order.
"Site"means the propeny(s) or locauon(s) with respect to which Services are to be performed.
"Work Authorization" means a document_. in the form of Exhibit A.which identifies the Site;
details the specific scope of services. and includes, as appropnate, any cost estimates,plans,
schedule specifications.and drawings describing the work

3. Term of Agreement
This Agreement will be effective upon the date a fully executed copy of this Agreement is delivered to
Consultant or the Consultant is authorized to begin work. Unless terminated,this Agreement shall remain
in effect until the scope of services defined in this Agreement and/or any Work Authorization issued by
Client have been fully performed.
4. Services To Be Performed
Services performed under this Agreement shall be detailed in and determined by a Work Authorization in
the form attached hereto as Exhibit A. A fully executed Work Authorization incorporating this Agreement
shall be binding upon the Parties. Consultant shall have no obligation to commence the Services as
stipulated in this Agreement and/or any associated Work Authorization until both this Agreement and the
applicable Work Authorization are fully executed and delivered to Consultant. Any schedule requirements
applicable to Consultant's Services will be set forth in Exhibit A
5. Payment for Services
Consultant shall invoice Client for Services in accordance with Consultant's standard invoicing practices.
The amount billed will be calculated on the basis set forth in Exhibit A. Invoices are due and payable on
receipt. Consultant shall separately invoice Client for services performed under multiple Work
Authorizations. Each Work Authorization shall be considered to be a separate Agreement. and Client shall
not offset amounts due Consultant under a Work Authorization for any disputes arising under a different
Work Authorization
The Client shall, at the request of the Consultant prior to execution of this Agreement and promptly from
time to time thereafter, furnish to Consultant reasonable evidence that financial arrangements have been
made to fulfill the Client's obligations under this Agreement
If Client reasonably oUlecis to any portion of an invoice, Client shall provide written notification to
Consultant of Client's objection and the basis for such objection within fifteen 15 days of the date of receipt
of the invoice, and the Parties immediately shall make every effort to settle the disputed portion of the
invoice. Client shall waive anv objections to Consultant's invoice if it fails to timely provide such vmtten
notice to Consultant
In the event of litigation or other proceeding to enforce performiance of this Agreement or any payment
obligation under this Agreement. the prevailing Party shall be entitled to recover from the other Party
artomeys' fees and costs as may be reasonably incurred by reason of the litigation.
6. Suspension of Work
If payment of invoices by Client is not maintained on a current basis. Consultant may, after giving three (3)
days'written notice to Client. suspend further performance until such payment is restored to a currern
basis.
7. Chanaes in the Work
At any time after execution of this Agreement, Client may order changes in the Consultant's Services
consisting of additions, deletions, and revisions within the general scope of services being performed by

Consultant under this Agreement and/or any applicable Work Authorizations. Whenever a change in the
scope and/or time for performance of services occurs, or if Client has notified Consultant of a change;
Consultant shall submit to Client within a reasonable time an estimate of the changes in cost and/or
schedule,with supporting calculations and pricing. Pricing shall be in accordance with the pricing
structure of this Agreement
Notwithstanding the above; Client may direct Consultant in writing to perform the change prior to approval
of price and schedule adlustinents by Client. If so directed. Consultant shall not suspend performance of
this Agreement during the review and negotiation of such change, as long as the change is a reasonably
foreseeable alteration of the Services originally contemplated. In the event Client and Consultant are
unable to reach agreement regarding changes in price and/or time associated with a change order..the
matter shall be submitted to mediation as provided in Paragraph 32 of this Agreement
8. Termination for Convenience
Either Parry may terminate this Agreement and any associated Work Authorizations without cause and/or
for convenience after giving five(5) days',,vmtten notice to the other Party. However.Consultant shall not
have the right to terminate this Agreement;without cause,prior to completion by Consultant of all Services
required under then outstanding Work Authorizations. In the event Client terminates Consultant's services
without cause and/or for Client's convenience.Client shall be liable to promptly pay Consultant for all
work performed through the date of termination, all of Consultant's expenses directly attributable to the
termination. including fait-and reasonable sums for overhead and profit. and costs incurred by Consultant
in tern inatmg any contracts entered into in connection with the performance of its Services.
9. Termination for Cause
Either Parry may terminate this Agreement for cause. Tennmation for cause shall be by wntien notice
("Tennmation Notice")from the terminating Parry, delivered to the allegedly defaulting Party at least thim
(30) days prior to the proposed iermmation date("Termination Date"). The allegedly defaultme Pam,,shall
have thirty(30) days from receipt of the Termination Notice within which to cure the alleged default. Any
iermnation for cause shall be without prgludice to any claims which either Parry may have against the
other Party, its agents or subcontractors.
10. Access to Premises
During the term of this Agreement. Client shall grant, to Consultant and its personnel. access to the Site(s)
as necessary to allow Consultant to perform the Services under this Agreement and any Worh
Authonzation(s) Consultant shall comply with generally accepted safety procedures and all other safety
procedures which may from time to time be communicated to Consultant by Client.
11. Conflicts of Interest
Consultant shall not perform. or enter into any agreement for, services for any other person, corporation or
entity, except with prior written consent of Client.if. in the sole discretion of Consultant, the performance
of the services could result in a conflict with Consultant's obhgations under this Agreement. Consultant
represents that it has reasonably evaluated potential conflicts and has disclosed to Client in writing any
prior or existing relationships which present. or could appear to present. a conflict with the Services to be
performed.

12. Use of Documents
All documents provided by Consultant pursuant to this Agreement are instruments of service of Consultant,
and Consultant shall retain an ownership and property interest therein (including the right of reuse)until
Client has made full payment to Consultant for such documents pursuant to this Agreement.
13. Proprietary Rights of Consultant
Client acknowledges that Consultant has developed systems,processes, apparatus, analytical tools and
methods which are proprietary to Consultant and which are used in its business. Such systems, processes,
apparatus, analytical tools and methods(including software,patents, copyrights and other intellectual
property), and all derivations, enhancements or modifications thereof made by Consultant, including those
as a result of work performed by Consultant for Client hereunder, shall be and remain the property of
Consultant.
14. Standard of Care
Consultant represents that it is knowledgeable and experienced in providing technical.engineering and
consulting services comparable to the services provided by firms in good standing under similar
circumstances. Consultant represents to Client that the Services shall be performed in a manner consistent
with the standard of care. Consultant agrees to correct, at its own expense, any services provided under
this Agreement which do not conform to this standard of care. No other guarantee or warranty. express or
implied,is intended by this Agreement.
15. Indemnification
The Parties shall at all tunes remain entirely responsible for the results and consequences of their sole
negligence and agree to mdeninifir and hold harmless the other Party from and against any and all claims,
losses, damages, costs and expenses, including attorney's fees, which may arise or result from such sole
negligence.
16. Limitation of Liability
The total liability, in the aggregate, of Consultant and Consultant's directors, officers, employees, agents,
associates or subcontractors. and any of them,to Client or anyone claiming by,under or through you as
Client,for any and all mluries. claims,losses,expenses, including attorneys' fees. expert fees or court costs
and damages whatsoever arising out of or in any way related to Consultant's Services under this
Agreement,from any cause or causes whatsoever. including but not limited to,negligent acts or omissions,
professional negheence,breach of contract.strict liability. errors or omissions of Consultant, or the
employees, directors. officers, agents, associates or subcontractors of Consultant,or any of them,will be
limited to Consultant's fee (including changes).
The Parties waive incidental, indirect.or consequential damages for claims, disputes,or other matters in
question arising out of or relating to this Agreement. This warver is applicable,without limitation, to all
consequential damages due to either Party's tennination in accordance with Paragraphs 8 and 9 above.

17. Site Conditions
Consultant shall not be liable for: (i) concealed conditions encountered in the perfonmance of the Services;
(ii)concealed or unknown conditions in an existing structure at variance with the conditions indicated by
the Scope of Services or Work Authonzation; or(iii)unknown physical conditions below the surface of the
ground that differ materially from those ordinarily encountered and are generally recognized as inherent in
work of the character provided under this Agreement.
18. Materials and Equipment Handling and Retention
In the event that Client desires to dispose of materials on the Site, such materials will be transported to a
location selected by Client for final disposal. If a manifest is required for such disposal, such manifest
shall be signed by Client
19. Force Majeure
Except for the payment of money for Services already completed.. each Party shall not be liable to the other
for failure to perform its obligations hereunder if and to the extent that such failure to perform is caused by
or results from causes beyond its control, including without limitation, strikes, lockouts, or other industrial
disturbances, civil disturbances, fires. acts of God, acts of a public enemy, acts or omissions of
subcontractors; compliance with any regulations, orders or requirements of any govermnental body or
agency, or inability to obtain transportation or necessary materials in the open market.
20. Confidentiality; Reports
The Services are undertaken as an integral and necessary pan of Client's activities at the Site. In order to
protect the confidentiality of Clients business, communications and materials (as defined below), the
Services shall be conducted in accordance with the following. (1) Consultant shall not in any mannei
reveal, disclose or publish the fact that Client has contracted for the Services of Consultant, without
Clients prior written consent: and (ii)no records shall be delivered to any person unless specifically
directed by Client.
21. Regulatory Matters
Except as otherwise required or provided in the Scope of Services. Consultant will not meet or confer with
any member of any federal,state or local regulatory agency concerning the Services without obtammg the
prior consent of Client
22. Compliance With Law
Consultant and Client will use reasonable care to comply with applicable laws in effect at the time the
Services are perfonmed hereunder,which to the best of their knowledge,information and belief, apply to
their respective obligations under this Agreement. Client shall cooperate with Consultant in obtaining any
permits or licenses required for the performance of the Services.

23. Delegation and Assignment
Either Parry may at any time delegate, orally or in writing,this Agreement, or any portion thereof, with the
prior written consent of the other Party No such delegation shall operate to relieve the Party of its

All notices required or permitted hereunder shall be in writing and shall be served on the Parties at the

25. Entire Agreement
This Agreement constitutes the entire agreement between the Parties with respect to the Services, and
supersedes all prior negotiations.representations or agreements relating thereto,written or oral, except to
the extent they are expressly incorporated herein. Unless otherwise provided for herein,no amendments,
changes, alterations or modifications of this Agreement shall be effective unless in ,vritine. executed by
Client and Consultant There are no third parry rights or benefits under this Apre.ement
26. Budgetary Limitations
The Client shall advise Consultant in writing before design commencement of any budgetary limitations for
the overall cost of the services. Consultant will endeavor to work within such limitations and will, if
requested and included within the scope of services, submit to Client an opinion of probable cost. Opinions
of probable cost will represent Consultant's best-ludgrment as a professional familiar with such costs,but
does not represent that bids or negotiated prices will not vary from budgets or opinions of probable cost.

GRAND TERRACE CONFIRMING A DIAGRAM AND
ASSESSMENT AND PROVIDING FOR ANNUAL
ASSESSMENT LEVY FOR A LANDSCAPING AND STREET
LIGHTING DISTRICT
WHEREAS, the City Council has initiated proceedings for the annual levy of the
assessments for a landscaping and street lighting district pursuant to the terms and provisions of
the "Landscaping and Street Lighting Act of 1972", being Part 2 of Division 15 of the Streets and
Highways Code of the State of California. in a district known and designated as
CITY OF GRAND TERRACE
LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1
WHEREAS, the City Council has ordered the preparation of a report and the City
Engineer has prepared and filed with this City Council a report pursuant to law for its
consideration and subsequently thereto this City Council did adopt its Resolution of Intention to
levv and collect assessments for the next ensuing fiscal year relating to the above-referenced
District, and further did proceed to give notice of the time and place for a Public Hearing on all
matters relating thereto: and.
WHEREAS, at this time, this City Council has heard all testimony and evidence and is.
desirous of proceeding with the annual levy of assessments.
NOW, THEREFORE, IT IS HEREBY RESOLVED'BY THE CITY COUNCIL OF
THE CITY OF GRAND TERRACE, CALIFORNIA AS FOLLOWS.
SECTION I. That the above-recitals are all true and correct.
SECTION 2 That upon the conclusion of the Public Hearing, protests filed and not
withdrawn, did not represent property owners being obligated for more than fifty percent (50%)
of the total assessments within the District
SECTION 3 That this City Council hereby confirms the diagram and assessment as
submitted and orders the annual levy of the assessment for the fiscal year and in the amounts as
set forth in the Engineer's Report and as referred to in the Resolution of Intention as previously
adopted relating to said annual assessment levy.
SECTION 4. That the diagram and assessment as set forth and contained in said Report
are hereby confirmed and adopted by this City Council.
SECTION 5. That the adoption of this Resolution constitutes the levy of the assessment
for the fiscal near.
SECTION 6. That the estimates of costs. the assessment diagram, the assessments and
all other matters, as set forth in Engineer's "Report", pursuant to said "Landscaping and Street
Lighting Act of 1972", as submitted, are hereby approved, adopted by this City Council and
hereby confirmed.
SECTION 7. That the maintenance works of improvements contemplated by the
Resolution of Intention shall be performed pursuant to law and the County Auditor shall enter on
the County Assessment Roll the amount of the Assessment and said assessment shall then be
collected at the same time and in the same manner as the County taxes are collected. After
collection by said County, the net amount of the assessment shall be paid to the City Treasurer of
said City
SECTION S. That the City Treasurer has previously established a special fund known as
the

into which the City Treasurer shall place all monies collected by the Tax Collector pursuant to the
provisions of this Resolution and law and including any surplus amounts in those funds established

have been made available to said City Treasurer.
SECTION 9. That the City Clerk is hereby ordered and directed to file a certified copy
of the diagram and assessment roll with the County Auditor, together with a certified copy of this
Resolution upon its adoption
SECTION 10. That a certified copy of the assessment and diagram shall be filed in the
office of the City Engineer, with a duplicate copy on file in the Office of the City Clerk and open
for public inspection

INTRODUCTION
The City Council of the City of Grand Terrace adopted it's General Plan with various elements to
provide guidelines for orderly development within the community. The City Council further
adopted ordinances and regulations governing the development of land providing for the
installation and construction of certain landscaping, lighting and appurtenant facilities to enhance
the quality of life and to benefit the value of property.
The requirement for the construction and installation of landscaping, lighting and appurtenant
facilities is a condition of approval for development and is a requirement of issuance of a permit
for the construction of any residential, commercial, industrial and planned unit development.
Landscaping and appurtenant facilities generally include trees, shrubs, plants, turf, irrigation
systems, and necessary appurtenances including curbs, hardscape, monumentations, fencing
located in public right-of-ways, medians, parkways, and/or easements adjacent to public right-of-
ways, in and along public thoroughfares and certain designated primary and secondary arterials.
Lighting and appurtenant facilities includes poles, lighting fixtures, conduits and the necessary -
equipment to maintain, operate and replace a lighting system at designated intersections, in
medians, parkways and adjacent to certain public facilities in and along certain streets, right-of-
ways and designated lots.
The installation of landscaping and lighting systems and the construction of the necessary
appurtenant facilities is the responsibility of the property owner/applicant, as conditions of
approval of a development application.
The City may cause the installation by property owners directly, or accept financial arrangements
for installation of these facilities.
The cost of servicing, operation, maintenance, repair and replacement of the landscaping, lighting
and appurtenant facilities in turn becomes the responsibility of the benefitting properties.
The owners/applicants petitioned for formation of the Landscaping Lighting Assessment District
and/or annexation. These have been completed, and will increase the City's obligation for
maintenance and servicing.
The City of Grand Terrace is administering a lighting system for the benefit of all parcels of land
within the City.
The lighting benefit is directly related to public safety and property protection. These benefits
have been studied widely, locally, regionally and nationally.

The City has formed Landscaping and Lighting Assessment District 89-1 and subsequently
annexed other parcels as Annexation No. 1 to said District to insure a fair and equitable levying
of the necessary costs of servicing and maintenance of the respective facilities, which in turn will
enhance the value of each and every parcel in the District directly and collectively.
The 89-1 District Boundaries of the Landscaping and Lighting Assessment District are the
boundaries of Tract 13364 filed in Map Book 203, Pages 89 through 92, Records of San
Bernardino County. The boundaries of Annexation No. 1 are the boundaries of Tracts 14264 and
14471, filed in Map Book 242, Pages 17 and 18, and Map Book 237, Pages 41 and 42,
respectively, of said County.
Servicing and administration of the City's landscape maintenance program shall be according to
the provisions of the Landscaping and Lighting Act of 1972, Part 2,Division 15 of the Streets
and Highways Code of the State of California.
This report is being prepared to provide for the annual assessment within these boundaries.
Payment for the assessment for each parcel will be made in the same manner and at the same
time as payments are made for property taxes for each Property.
The proceedings will be conducted under the Landscaping and Lighting Act of 1972, Part 2,
Division 15, Sections 22500 through 22679, of the Streets and Highways Code of the State of
California.
This annual Report is presented for the purpose of levy of annual assessment to the above
described properties for the purpose of maintaining the lighting and landscaping during the fiscal
year 2004 - 200.5
This report contains the necessary data required to conduct the proceedings and is submitted to
the Clerk of the City for filing.

and to accordance with the Resolution of Intention, being Resolution No. , adopted by the
City of Grand Ten-ace, State of California, in connection with the proceedings for:

AND ANNEXATION NO. 1 TO SAID DISTRICT, hereinafter referred to as the "Assessment
District", 1, Elroy Kiepke, the duly appointed ENGINEER OF WORK, submit herewith the
"Report" consisting of six (6) parts as follows.
PART A
Plans and Specifications for the proposed improvements are filed herewith and made a part
hereof. Said plans and specifications are on file to the Office of the Clerk of the City.
PART B
An estimate of the cost of the proposed improvements, including incidental costs and expenses in
connection therewith, is as set forth on the lists thereof, attached hereto, and are on file in the
Office of the Clerk of the City.
PART C
An assessment of the estimated costs of the improvements on each benefitted lot or parcel of land
within the Assessment District.
PART D
A proposed assessment of the total amount of the costs and expenses of the improvements upon
the several lots and parcels of land within the Assessment District, in proportion to the estimated
benefits to be received by such lots and parcels, is set forth upon the assessment roll filed
herewith and made part hereof.
Description of the work for the proposed improvements and description of all right-of-way,
easements and lands to be acquired, if necessary.

PLANS AND SPECIFICATIONS
The installation of planting, landscaping, iri7gation systems, lighting and the construction of
appurtenant facilities to be operated.'serviced and maintained, is more specifically described
herein whereas, the landscaping and lighting facilities have been or will be provided by
developers as a condition of subdivision of land, on pan of the Conditional Use review and
approval process. The facilities to be maintained and serviced are generally described as follows:

The improvements are the operation, maintenance and servicing of landscaping, lighting and
appurtenant facilities described as follows:
1. Tract 13364
(a) Landscaping
Landscaping, planting, shrubbery, trees, turf, irrigation systems,
monuments, hardscapes, walls, fencing and appurtenant facilities in
public right-of-ways and easements within the proposed boundary of said
Assessment District.
The locations of landscaping and appurtenant facilities are depicted on the
Assessment Diagram as shown in Pan F, herein.
(b) Li ghtm o
Poles, fixtures, bulbs, conduits, equipment posts and pedestals, metering
devices and appurtenant facilities as required to provide lighting in public
right-of-ways and easements within the proposed boundaries of said
Assessment District.
2. Tract 14264
(a) Landscaping
Landscaping, planting, shrubbery, trees, turf, irrigation system and
appurtenant facilities within the Gage Canal right-of-ways. During the
fiscal year 2004-2005, responsibility for the maintenance of these facilities
shall remain with the developer. Water shall be supplied by and paid for
through developer's meter and no costs shall be shown on the tax rolls as
assessments for the landscape maintenance during fiscal year
2004-2005.

(b) Lighting
Poles, fixtures, bulbs, conduits, equipment,posts, pedestals, metering
devices and appurtenant facilities as required to provide lighting in public
right-of-ways and easements within the proposed boundaries of the
District. A total of 7 street lights are included in the boundaries of this
development.
3. Tract 14471
(a) Landscaping
Landscaping, planting shrubbery, trees, and vines with Lot "A" of said
Tract 14471, along with irrigation system for the improvements within Lot
«A".
(b) Lighting
Poles, fixtures, conduits, equipment, posts, pedestals, metering devices
and appurtenant facilities as required to provide lighting in public
right-of-ways and easements within the boundaries of the District. A total
of 6 street lights are maintained within the boundaries of this development.

No. 1" to said District for Fiscal Year 2004-2005.
The description of each lot or parcel is part of the records of the Assessor of the County of San
Bernardino and these records are, by reference, made part of this Report.
The total proposed assessment for the 2004-2005 Fiscal Year is $12,121.44.

PART D
METHOD OF APPORTIONMENT OF ASSESSMENT
The method of apportionment will be in accordance with benefit received. The benefit is
increased in property values received. The benefit is based on increase in property values derived
from the facilities provided by the District.
In each of the three areas, the benefit is based on the total cost of maintenance within that area;
with the total cost for area being assessed equally among the lots within these areas.

The City of Grand Terrace in cooperation with the County of San Bernardino and the City of Colton have
been working together for some time to create a cooperative agreement for the construction of a signalized
intersection at La Cadena. Barton. and Palm. At the site location one corner is controlled by the City of
Grand Terrace,one corner is controlled by the County of San Bernardino and two corners are controlled by
the City of Colton
As the Council is aware the intersection at La Cadena. Barton and Palm is a two lane divided highway on
La Cadena and an off-set East/West intersection with Palm and Barton With the current level of traffic in
the area and adding the truck movements from Stater's warehouses this intersection has been very difficult
to make safe turning movements and is in much need for a signal Under the current proposal the signal is
projected to have a total cost of construction of S380.000. the break down would be as follows
County of San Bernardino S150.000
Citv of Colton $160.000 -
Citv of Grand Terrace S 70.000
Total S380.000
The City of Grand Terrace does not have this currently programmed into the Measure-1 capital
improvement plan. Staff will recommend at mid-year an appropriate funding source to pay for
this contract. however. there are street fiends available
STAFF RECOMMENDATION:
Council authorize the Mavor of the Cite of Grand Terrace to enter into a contract vvith the
Count, of San Bernardino and the Cite of Colton to construct a signalized intersection at
Barton Rd, and LaCadena Dr. Appropriation for the contract will be recommended at
mid-vear from a combination of Measure-] and gas tax funds.

INITIATIVE PETITION FOR THE ESTABLISHMENT OF THE OFFICE OF
ELECTIVE MAYOR FOR THE CITY OF GRAND TERRACE
On May 4. 2004, an initiative petition was filed with the City for the establishment of the office of
elective Mayor for the City of Grand Terrace.
The signature examination of the initiative petition was completed by the San Bernardino County
Registrar- of Voters on June 15, 2004. Pursuant to Electrons Code section 9115 the Registrar- of
Voters used the random sampling teclvlidues and reviewed 500 randomly selected sigiratwes
Following is the results of the examination.

the order of the legislative body.
The total voter registration as of January 2004 was 5,356. Therefore the petition is sufficient.

Acknowledge the certification of the results of the examination of the initiative petition for the
establishment of the office of elective Mayor for the City of Grand Terrace and submit the initiative
to the voters on the November 2, 2004 general municipal electron ballot

SUBJECT: Request for "PC or N" Letter for .Type 21 General Liquor License for
Sav•on Drug Store
RECOMMENDATION: Review, consider and approve request by the developer of
the Sav•on Drug Store for a "Public Convenience or
Necessity" Letter from the City in support of an Alcoholic
Beverage Control ("ABC") General Liquor License, Type
21.
Background:
We have received a letter from the representative of the developer of the new Sav•on Drug
Store, which is to be constructed on the northeast corner of Barton Road and Mt. Vernon
Avenue, asking the City of Grand Terrace to issue a "Letter of Public Convenience or
Necessity" in support of a Type 21, General Liquor License for the new Sav•on Drug Store
(Please see the attached letter from Mr. Jeff Timbers received on May 19, 2004.)This type
of license will allow for the off-sale of alcoholic beverages including beer, wine and liquor
(The "off-sale" allows for the package sale of alcoholic beverages which must be
consumed off the premises while "on-sale" refers to the sale for on-site consumption such
as in a restaurant or bar.)
The Sav•on representative has been told by the State Alcoholic Beverage Control Board,
"ABC,"that there is an "over-concentration"of off-sale licenses in the census tract(Census
Tract No. 71.02) where the new Sav•on Drug Store will be located. In order for "ABC" to
issue the requested Type 21 license, the applicant must obtain a letter from the City of
Grand Terrace in support of the requested license. This letter, in "ABC"jargon, is called
a "Letter of Public Convenience or Necessity or 'PC or N' letter " The letter must indicate
that the City "agrees that issuance of the applied for license will meet the public

convenience or necessity standards for their community "
Liquor stores are a permitted use underthe Barton Road Specific Plan—Village.Commercial
category where the new Sav•on store will be located, which is the old Rite Aid site, on the
northeast corner of Barton and Mt. Vernon
The "ABC" finding of "over-concentration" is based on the number of off-sale licenses
within the census tract, not the City as a whole. The City of Grand Terrace is divided into
a number of census tracts, some of which take in portions of adjacent cities. The Sav-on
store will be located in Census Tract 71.02 (pop. 10,567) "ABC" has found that there is
an "over-concentration" of off-sale licenses in this census tract; however, a large portion
of this census tract lies in both the City of Colton and City of San Bernardino. Most of the
"ABC" licenses in this census tract, in fact, are located outside of Grand Terrace. (Please
note this is the same census tract and situation that included the "Smart Time Food
Market" whose requested "PC or N" letter was authorized by the City Council on June 10,
2004.)
A copy of the Census Tract No. 71 02 map, showing the location of its "ABC" licenses, is
attached to this report. The off-sale licenses are indicated as solid circles; the on-sale as
open circles. In addition, those stores with a General Liquor License are indicated with a
number "21 " The total number of existing "ABC" licenses in this tract is 27 of which there
are a total of four (4) Type 21 licenses (sell liquor). However, only one of these Type 21's
is in the City of Grand Terrace
According to the "ABC" web page and what the local "ABC" office told staff, "ABC" uses a
standard of one off-sale license per 1,250 persons in determining whether there is an
"over-concentration"of off-sale licenses They do not include on-sale type licenses for bars
and restaurants in making this determination. The staff has prepared a list of existing
"ABC" licenses in the City of Grand Terrace from the "ABC" web page. A copy of that list
is attached There are a total of 12 "ABC" licenses of which 8 are off-sale (Type 20 and
21). According to the latest estimates, the population of Grand Terrace is slightly over
12,000 persons. Using the standard cited,above, 9 off-sale licenses could be permitted
without a determination of"over-concentration" if it were applied to the City as a whole. If
this requests is approved,the number of businesses with off-sale licenses in the Citywould
increase from 8 to 9. So if one were to use the "ABC" standard of one off-sale license per
1,250 persons to the City as a whole, a finding of"over-concentration" could not be made
But this is not how "ABC" makes this determination.
Other factors the City Council may wish to consider include the fact that liquor sales were
part of the described uses of the site when the Sav-on project was approved by the
Planning Commission last year and were part of the original approval. (Please see a copy
of the proposed sales areas within the new Sav•on store in a letter from the original Sav-on
applicant, attached to this report.) The Rite Aid project for this same location was granted
a Type 21 license by "ABC" but the license was withdrawn when the project was not built.
Also, for the two earlier requests considered by the Council earlier this month, the Sheriff's
office provided staff with a report on the number of accidents involving alcohol for last year
A copy of his report is also attached to this report. While there were 20 arrests for"D.U.I,"
there was only one traffic collision involving alcohol. Please note the Sheriff's observation
that the majority of these arrests were "non-residents" who "therefore consumed the
alcohol somewhere other than with the City." The Sheriff also notes in his last paragraph
the "D.U.I. related crimes are affected by the increase of businesses licensed for the sale
of alcohol to be consumed on the premises such as a bar or restaurant" not the type
proposed for the new Sav•on Drug Store
Lastly, the developer's representative has provided the City with a copy of the
Albertson's/Sav•on "Policy Information On the Sale of Alcoholic Beverages" including a
detailed list of Sav•on's liquor"policies and procedures"from their Compliance Coordinator,
Paulette Dewire. From looking at this document, one could conclude that this corporation
has very strict and complete policies and procedures on the sale of alcohol.
Conclusion:
This request is consistent with the earlier "ABC" Type 21 license granted to the Rite Aid
project; it was part of the original description of uses when the Sav•on project was
approved last year; there is no "over-concentration" if the City as a whole is considered;
the Sheriff does not have a problem; and last, the Albertons/Sav•on corporation has a very
detailed and strict set of policies and procedures to sell alcohol For these reasons, the
staff recommends that the City Council review, consider and approve this request by
Sav•on for the City to prepare a "Public Convenience or Necessity" letter in support of the
"ABC" General Liquor license, Type 21 . In approving this request, the Council is
authorizing staff to prepare and send to the Alcoholic Beverage Control Board the
requested "Public Convenience or Necessity" letter.

SUBJECT 2003 D.U.I. (Driving Under the Influence) Statistics
As per your request; I have researched all D U.I. related reports taken by the Sheriffs Department
in the City of Grand Terrace for the calendar year 200; The following is a summary of my
findings.
• 20 arrests were made for D.U.]
• I of the 20 arrests was as a result of a traffic collision
• 80% of those arrested for D.U.I. were non-residents of Grand Terrace
Since a majority of those arrested for D.U.1 were non-residents of the city, the statistics tend to
indicate that these people were more than likely just passing through the city and therefore
consumed the alcohol somewhere other than within the city.
It is my opinion that the above information does not support any correlation between "on-sale'
alcohol sales (such as at a liquor store) and D.1J.1. related crimes Generally D.U.I. related crime
are affected by the increase of businesses licensed for the sale of alcohol to be consumed oil the
premises such as a bar or restaurant

This store will be well-lit facility with ample parking that will provide a variety of Qoods and
services. including prescription drugs, a complete line of health care and beauty aid items,
school supplies, greeting cards. and an alcoholic beverage department.
The Sav-on pharmacy offers their customers the ability to have their prescriptions filled at
any of the 340 Sav-on pharmacy locations_ 40 of these locations are open 24 hours. Our
pharmacies accept over 500 third-party insurance plans.

• The health care and beauty aid department offers a wide variety of products, including
economically priced private label items.
• The alcoholic beverage department will provide the convenience of one-stop shopping.
• As a responsible seller of alcoholic beverages. Sav-on's liquor policies and procedures
include•
1. Internal decoy-type , checks conducted by the Loss Prevention Department.
2. Installation of prograiminable cash registers that loci tip when a liquor or tobacco item
is scanned, requinng the entry of a birth date to continue the transaction.
3. All associates sign off on Liquor Policy Statement. This form is reviewed and signed

4. All associates read and sign the State of California Clerks Affidavit. form ABC-299.
5. Sav-on Drugs has participated in "Don-"i Drink And Drive" public service
announcements on KABC. Channel 7.
6. Our policy is to check ID on anyone who appears to be under 30 years old.

multi-unit quantities.
2. No wine shall be'sold with an alcoholic content of greater than 15% by volume, except for
"dessert wines."
Beer and malt beverages in containers of 16 oz. or less cannot be sold by single
containers, but must be sold in manufacturer-pre-packaged multi-unn quantities.
4. No single cigarettes shall be sold
5 No ice to quantities of less than five (5) pounds shall be sold. furnished or given away.
6. There shall be no coin-operated games maintained upon the premises at any time.
7. All cups or containers will be sold in their original multi-container packages.

INTERNAL DECOY PROGRAM
SAV-ON DRUGS HAS ITS OWN DECOY PROGRAM for the sale of alcoholic beverages
Every store is audited on a quarterly basis A decoy over the age of 21 attempts to
purchase an alcoholic beverage. The checker should check the ID of anyone who
appears to be under thirty years of age. If the cashier follows policy and checks the
decoy's ID, we give the cashier a framed commendation which is placed on the wall in-the
associate lounge. If the cashier fails to check the ID, the cashier is taken off the register
and is taken to the office, where a disciplinary meeting is held with the store manager and
the District Loss Prevention Manager. A written warning with a 3-day suspension without
pay is issued and the associate is required to review all liquor policy and procedures and
re-sign all appropriate policies The associate is also informed that a second violation may
result in disciplinary action up to and including termination
The associate is then checked again within a 30-day period to assure compliance with our
policies and the law

PROCEDURES
® DLPM will accompany the Decoy to the store
TIME afternoon and evenings
PRODUCT any liquor item, preferably beer or wine coolers.
Decoy - must be at least 21 years old, however, young looking
1. Decoy will enter the store and select a liquor item (wine cooler or beer).
2. The merchandise will be brought to the normal liquor register for purchase.
IF THE DECOY WAS CARDED DURING THE TRANSACTION:
Assuming the Decoy was successfully carded, the Decoy would leave with the product
and give it to the DLPM.
2. The DLPM would meet with the manager on duty and inform him that a Decoy shop had
just been conducted on register and the checker had correctly followed procedure and
carded the Decoy.
IF THE DECOY WAS NOT CARDED:
1. If the Decoy was not carded, the Decoy would leave with the product and give it to the
,DLPM
2. The DLPM would meet with the manager on duty and inform him that a Decoy shop had
just been conducted on register and the checker failed to card the Decoy according to
policy
3. The manager should take the checker off the register and bring him/her to the office for
proper disciplinary action.
• A write-up and a 3-day suspension without pay will be given to the checker, indicating the
seriousness of the violation and noting that a second violation within a year would lead to
further disciplinary action up to and including termination
• The checker will be required to again sign all policies regarding the sale of alcoholic
beverages
AFTER COMPLETION OF THE "SHOP", THE DLPM WILL:
1. Fill out the form indicating the date and time of the shop and indicate whether the checker

AGE VERIFICATION FOR LIQUOR PURCHASES
All store cash register programs include Age Verification on liquor purchases. Age
verification will allow the register to restrict the sale of liquor items, based on the
customer's birth date
Following is a list of requirements for Age Verification, and a description of how the
feature operates
All liquor UPC's or PLU entered In a transaction that Is in Report Code 7 or b will
cause the terminal to prompt the operator to "ENTER BDATE". The operator then
enters the customer's birth date (N=DYY). if the customer is over 21, the item will
be rung up; any remaining restricted items can be entered without the need to re-enter
the birth date. If the customer's age is under 21, the Item will be reiected and the
terminal will display 'AGE RESTRICTION" press "CLEAR'. After pressing the
CLEAR key, the operator can continue the transaction with any remaining unrestricted
items. The birth date and/or age restriction message will be printed on the journal tape,
but will not appear on the customers receipt.

Sales Restrictions on Alcohol
No person under the legal age 21 may buy alcoholic beverages under any circumstance. Prior to
making a sale of any alcoholic beverage, you should make a determination whether the customer is of
legal age. If the customer does not appear to be 30 years old or older, you must always demand
and inspect proper identification prior to completing the sale. Proper identification means a valid
picture drivers license or DMV (state identification) card If the slightest doubt remains that the
customer is not at least 21 years old after having seen his identification, do not make the sale. Any
doubt must be completely resolved before a sale is made, notwithstanding the age indicated byl.D.'s.
We are under no obligation to sell alcoholic beverages to any customer where there is reason to
believe that the purchaser is under legal age 21, regardless of the number and type of identification
the purchaser produces to substantiate his age
In addition to the penalties imposed upon the company, the person making the sale is customarily
cited and fined for selling liquor to a minor To protect yourself and the company, check the
customer's identification If there is still reasonable doubt that the person is of sufficient age to

Selling, Handling and Stocking of Alcoholic Beverages
Company policy and law requires an Sav-on associate to be at least 18 years of age tosell alcoholic
beverages with the condition that the transaction be approved by an employee who is at least 21
years of age 16 year olds with 21-year-old continuous supervision can handle and stock alcoholic
beverages
It is the responsibility of the General Manager to assure that his store is operating within the legal
restrictions of all local regulations governing the sale and display of alcoholic beverages. Every
General Manager must be continually on the alert to ensure that the sale and handling of alcoholic
beverages conforms with the law and company policy

Federal law prohibits retailers from selling tobacco products to anyone under the age of 18.
(Local laws may supersede this age if they are more restrictive. It is the General Manager's
responsibility to call his local government agency to confirm age restrictions in his
municipality.) The law also requires all retail sales clerks to check photo I.D.'s of certain-
aged individuals attempting to purchase tobacco products Company policy requires all
retail sales clerks to check photo I.D.°s of anyone who is 30 years old or under

This procedure is not optional. It must be completed before the sale is made. Store
management must take steps to ensure compliance with this policy. We are under no

or give any alcoholic beverage to an underage, obviously intoxicated person, you may be sued in
civil court. (Sections 25602(a). 25617 and 25602.1 Business and Professions Code)
(7) ABC License Privileges
You or your customers may not drink alcoholic beverages in your store or an adjacent properii
irinnediaiety outside your store. This includes before, during or after your shift. All alcoholic
beverages you sell must be in sealed. unopened bottles, packages or containers. You may not sell an
alcoholic beverage to a person if you know that they are going to re-sell the alcoholic beverage to
someone else You may not sell more than 52 gallons of wine to any one customer at any one time
If you break these laws. the ABC license at your store may be taken away (Sections 23360. 23355_
23393, 23394 and 23402 Business and Professions Code and Rule 27, California Code of
Regulations)
(8) Beer Keg Sales (applies if your store sells kegs, six-gallon size or larger)
(a) You must place a Beer Aeg Identification Tag (Form ABC-287K) on each beer keg at the tune
of sale; (b) You must have the customer sign a Beer Keg Registration Receipt (Form ABC-286K),
which includes the name and address of the purchaser and the purchaser's driver's license number of
similar form of I.D. number; (c) Your store must keep the Beer Keg Registration Receipts at your
store for six months and make them available upon request to peace officers (local law enforcement
or ABC investigators); (d) You may only return a beer keg deposit to a customer if the keg still has
