RESOLUTION No. 2004- A RESOLUTION OF THE CITY COUNCIL .OF THE CITY OF GRAND TERRACE, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD � ON NOV,EMBER,2,2004,DECLARING THE RESULTAND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in. the City of Grand Terrace, California, on Tuesday, November 2, 2004, as required by law; and , WHEREAS, notice of the election was given in time,form and mariner as provided by law; that voting precincts were properly established; that -election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California;for the holding of elections in general law cities; and WHEREAS, pursuant to Resolution No. 2004-13 adopted July 8, 2004,the County Registrar of Voters canvassed the returns of the election and,has certified-the-results to this City Council, the results are received, attached and made a part hereof as "ExhibitA." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, ;,CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: Section 1. That the whole number of ballots cast in the precincts except absent voter ballots was 3,364. That the whole number of absent voter ballots cast in the-City was 1,294., making a total of 4,658 ballots cast in the city. Section 2. That the names of the persons voted for at the election for Member of the City Council are as follows: Jim T. Miller Henry "Hank" F. Ramey, Jr. Frank H. Guzman Lee Ann Garcia Lloyd H. Dodd, III Maryetta Ferre That the Measure voted upon at the election is as follows: Shall the City of Grand Terrace establish the office of Elective Mayor for a 4 year Term? That the number of votes given at each precinct and the number of votes given in the City to each of the persons named above for the respective offices for which the persons were candidates and for and against the measure were as listed in Exhibit"A" attached. Section 4. The City Council does declare and determine that Maryetta Ferre, Lee Ann Garcia and Jim T. Miller were each elected as Member of the City Council for the full term of four years. That as a result of the election, a majority of the voters voting on the measure relating to the establishment of the office of a directly elected mayor did vote in favor-of it, and that the measure was carried, and shall be deemed adopted and ratified. Section 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1)The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) The measure voted upon; (4) For what office each person was voted for;.(5)The number of votes given at each precinct to each person, and for and against the measure; (6)The total number of votes given to each person, and for and against each measure. Section 6. That the City Clerk shall immediately make and deliver to each bf the persons so elected a Certificate-of Election signed bythe City Clerk and authenticated;that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. Section 7. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions. PASSED, APPROVED AND ADOPTED this 91h day of December, 2004. The audited report was prepared by the firm of Rogers, Anderson, Malody & Scott, LLP, Certified Public Accountants, with whom the Agency contracts to perform the financial and compliance audit. The CRA of the City of Grand Terrace continues to receive an unqualified opinion on its financial report. The auditor has rendered an opinion`that the financial statements, present fairly,-in all material, respects, the financial position of the CRA of the City of Grand Terrace, as of June 30, 2004 and the results of its operations for the year then ended in conformity with generally accepted accounting principles. This report will be submitted to the State Controller's Office as required by the Single Audit Act of 1984 and OMB Circular A-128 and A-133. This is the first year of the newly required GASBS (Governmental Accounting Standards Board Statement) 34 presentation, and it also incorporates GASBS 37 and 38 as mentioned in the Independent Auditor's Report section. A copy of the CRA financial statements is available to the general public in the reference section of the Grand Terrace Library. Mr. Terry Shea of Rogers Anderson will be present at the December 9 meeting to answer questions. He feels that it is very important for the residents to be informed on what is going on in the community and indicated that he would like to see the Crime Statistics in the Blue Mountain Outlook. MayorHilkey,responded that the Seniors have the statistics in their newsletter and suggested placing the information on the webpage. Mr.Youngman,indicated that in order to get the senior newsletter you have to pay for it and not everyone may be able to do that. He also indicated that not everyone has access to the internet. He feels that the Blue Mountain Outlook would be the best place for that information because everyone receives one in the mail. Patricia Farley, 12513 Michigan Street, indicated that with all of the new development that is planned for Grand Terrace the City should require Mello roos funds to fund the schools and she feels that it is irresponsible to.allow the development without planning ahead. Mayor Hilkey, indicated that the School District does collect builders fees that do apply to all construction in the City. They are guaranteed it by law. Angelina Perez, 11691 Mt.Vernon Avenue,indicated that theyhave problems getting in and out of their driveway since the City constructed the island on Mt. Vernon in front of their house. Raymond Perez, 11691 Mt. Vernon Avenue, also indicated that when leaving their home they can only exit one way. Patty Kane and Sally Garcia,21845 Grand Terrace Road Space 7 &6,indicated that they are having problems with semis parking on Barton Road at Grand Terrace Road. She was told that they were going to have a bike lane and a no parking lane, which to date has not taken place. She also indicated that residents are having problems with management and asked for help from the City. City Manager Schwab,responded that the City has identified that location as a problem and that area will be signed no parking and the deputies will be enforcing it. He indicated that Council Minutes November 17,2004 Page 3 mobile home parks are not regulated by the City.they are regulated by the County. He stated that the City is limited on what they can do but will help them as much as he can. Bill Hays, 22114 De Berry Street, indicated that he again is going to ask Council three questions. He stated that over the last year it has been stated that Richard Rollins is a volunteer yet the City pays him. He stated that City Manager Schwab purchased a home through the Redevelopment Agency without qualifying for the program and he questioned the 2.2 million dollars that are-in reserves and why the City didn't use those funds when the Richard Rollins park was renovated instead of taking out a loan. He questioned whether or not he would get answers to his questions. City Manager Schwab,responded that Mr.Rollins is a volunteer and a contract worker. He is paid for opening and closing the parks and for cleaning them as well. He stated that the City has over 2 million dollars in the General Fund Reserve. The Loan was made with Zion's bank because we financed the park in part with a pledge of Redevelopment Agency Tax Increment from the Colton Joint Unified School'District. That money comes in as a stream of dollars over a period of time, which is approximately $200,000.00 per yedr that we receive from the District so the City did a financing to borrow money which is being paid back from money that we receive from the School District. It is Tax Increment money that belongs to them that they have pledged to us. He stated there is no reason to use the General Fund reserve money for the rehabilitation of the Park when the money is coming from the Redevelopment Agency not the general fund. If the City chose to borrow the money from the reserve we could have,however we chose not to. With regards to the home that the City sold to him. The house was owned through the general fund and it was purchase by him at either the higher of the appraisal or the amount of money that the City had in the house at that time. Five years ago the City had$142,000.00 in the home,which is what the City sold it to him for as part of his employment agreement. It had nothing to do with the Low Mod Program. Barney Karger,11688 Bernardo W ay,feels that when the City discusses purchasing property that it should be discussed in public not in closed session. Ann also donated a brochure on a house at Vivienda and Barton-Road,and brochures from the Cape Terrace development. Country Fair:Ann reported 35 Arts and Crafts,36 cooking contest,including 6 chili. Square dancers will be at 2 p.m. inside the building. Judges are Lois Hansen, Seniors, Scott Robb, Lions, Joe Ramos, Toastmasters, Ted Hall, Assisted Living and Edna Best, Woman's Club. A re-score inspection shall be conducted by the health official and be subject to 25 a re-score inspection fee as provided in the Code, Schedule of Fees. The health 26, official will complete the re-score inspection within ten ,(10)' County business days of 27 food establishment's filing of a written request for a re-score inspection. A food 28 establishment failing to comply with the OIR, or failing to attain at least a "B"•grade on #242326 SMR 10/22/2004 .5 1 the re-score inspection, may be immediately closed by the health official and remain 2 ' closed until at least a "B" grade is achieved on a re-score inspection. Nothing in this 3 provision shall prohibit the health official from immediately closing any food 4 establishment if, at his discretion, immediate closure is necessary to protect the public 5 � health. 6 (d) The letter grade shall be based upon the final numerical percentage, 7 score set forth in the OIR as follows: 8 (1) '' A grade of "A" shall indicate a final score of ninety percent (90%) 9 ' or higher, as determined by the health official; 10 (2) A grade of "B" shall indicated a final score of eighty-nine percent 11 (89%) but not less than eighty percent (80%), as determined by the health official; 12 (3) A grade of "C" shall indicate a final score of seventy-nine percent 13 (79%) but not less than seventy percent (70%), as determined by the health official. 14 15 33.1404 Notice of Closure. ;,. 16 "Notice of Closure'' means a public notice that shall be posted by the-health 17 official at a food establishment upon suspension or revocation of the food 18 establishment's public health permit and that results in the closure of the food 19 establishment and the discontinuance of all operations of the food establishment, by 20 order of the health official, because of violations of applicable federal, state, and local 21 laws and regulations relating to the protection of public health. The Notice of Closure 22 shall remain posted until removed by the health official. Removal of the Notice of 23 Closure by any person other than the health official or the refusal of a food 24 establishment to close upon issuance of the written notice of suspension of the-public 25 health permit is a violation of this Chapter and may result in the revocation of the food 26 establishment's public health permit and shall be punishable as specified in section 27 33.0112 of this Code. 28 k42326 SMR 10/22/2004 6 33.1405 Routine Inspection. 2 "Routine Inspection" means an- unannounced inspection of any food 3 establishment to determine compliance with all applicable federal, state, and local laws .and .regulations relating to the protection of public health., A Routine Inspection 5 shall not mean an inspection conducted by the health official to determine compliancd 6 with a previously issued OIR or any interim inspection conducted to determine 7 compliance with specific regulations or legal requirements. 8 9 - 33.1406 Posting Requirements — Penalty for Non-Compliance — Documents 10 Available for Public Review. 11 (a) Upon completion of the Routine Inspection, the health official shall post 12 at every food establishment the Letter Grade Card, so as to be clearly visible to the 13 general public and to patrons entering the food-establishment. "Clearly visible to the 14 general public and to patrons" shall mean: 15 (1) Posted in the front window of the food'establishment within five 16 (5) feet of the front door; 17 (2) Posted in a display case mounted on the outside front wall of the 18 food establishment within five (5) feet of the front door; or 9 (3) Posted in a location approved by the health official to ensure 20 proper notice to the general public and to patrons. 21 (b) In the event that a food establishment is operated in the same building 22 or space-as a separately licensed or permitted business, or in the event that a food 23 establishment shares a common patron entrance with a separately licensed or 24 permitted business, or in the event of both, the health official shall post the Letter 25 Grade Card, in the initial patron contact area, or in a location approved by the health 26 official. 27 (c) The Letter Grade. Removal of the Letter Grade Card is a violation of this 2 Chapter and may result in the suspension or revocation of the public health permit 3 and shall be punishable as specified in section 33.0112 of this Code. 4 (d) The OIR upon which the Letter Grade-Card. is based shall be maintained 5 at the food establishment and shall be available to the general public and to patrons '6 for review upon request. The food establishment shall keep the OIR until such time. 7 as the health official completes the next Routine Inspection of the food establishment 8 and issues a new OIR. 9 10 33.1407 Letter Grade Card — Period of Validity. 11 A Letter Grade Card shall remain valid until the health official completes the 12 . next Routine Inspection of the food establishment. The Animal Control ' Contract cost was projected to increase from$35,800 to$62,702---a 75% increase in billing. Staff - began to look elsewhere.for animal control services: The City of Colton was contacted-and the timing, ' was right for a for a potential joint city venture. The Colton Police Department, which administers animal control, was preparing their budget and adding a second animal control officer. By sharing 30% of their time with the City of Grand Terrace this would afford Colton the ability to increase staffing., The City of Colton proposed an annual fee.of$39,500 per year for basic•animal control services. The initial term of the agreement was for three (3)years with one(1)year renewal terms. General Services Proposed by Colton Animal Control: • 24/7 coverage o 7a.m. to 5`30p.m. seven days per week o After-hours emergency on-call service • Patrolling for loose dogs • Collecting dead animals during the regular work day • Rabies Clinics, • . Staff projected that an active licensing program would bring the licensing revenue back up to the 2001-02 levels. **Shelter revenues are from adoption, impound, and apprehension fees. ***San Bernardino City charges a flat fee for disposal of dead animals ****San Bernardino City Shelter would be the designated shelter. They charge$30 per dog and$20 per cat to impound. The statistics were based off of data-collected by the County using 10 month average of stray animal pickup calls.' The 2003-04 budget allocated$15,800 for Animal Control services. If the city was to continue using the County of San Bernardino, staff would have to come back to council for a mid-year adjustment.. Decision on Changing Contractors Staff recommended contracting with the City of Colton for Animal Control Services. At the July 22, 2003 Council meeting, the City Council approved the contract with Colton Animal Control Services. Steps to the Contract Conversion: • Staff implemented a new software program to track all pet licenses in the city and make it easier for the residents to license their pets at City Hall. • Letters were sent out to all registered pet owners (both current and expired)informing them of the new pet licensing program. - • Two shot and licensing clinic were held in January 2004. • A deal was negotiated with AVID Microchip to lower the cost of the.implant to$20 each—which includes the lifetime database registry(regularly$15)and the implant cost(around$25). • Information articles were-places"in the Blue Mountain.Outlook in several editions outlining the new program and introducing Colton Animal Control Officers to the public." DISCUSSION/ANALYSIS It has been one year since the Animal Control Contract has been awarded to the City of Colton and,the shelter contract with the City of San Bernardino. Staff has done an analysis on the program, the licensing :1 totals, and a cost analysis. Below are the highlights: , • Total dog licenses in 2003 with the County of;San Bernardino = 898(and decreasing) • Current dog licenses to,date with'the City of,Colton = 1,446 • Staff projected-licensing revenue's at$26,874 for the first year • Actual licensing revenue was$32;484 • A three-year projection of the Colton contract shows an overall deficit of$5,077 due to lower than expected shelter fees. This can be explained since more dogs are licensed, there are fewer trips to the shelter for found dogs. In addition, the shelter was not charging a license deposit fee up until September 2004. • Should the city have continued the contract with the County of San Bernardino,the best ' projection for a three-year deficit would have been$13,065. This projection surmises that licensing activity would be back to the 2002 level-of 1,100 licenses.
