The CRA and City are required to present quarterly investment reports to their governing boards
in accordance with Government Code Section 53646 (b)(1)...(3). The report would include all
moneys held by the Agency or City;and all moneys held by third-parties that belong to the
Agency or City with the exception of any pension or deferred compensation moneys.
This code section requires that:
1) Report must be produced;N days after end of quarter,
2)Report must comment oii compliance with investment policy,
4;.
3) Report must comment if agency has ability to meet expenditures for next six months,
4)Report must include a description of the investment, type of investment, issuer,
investment pool onprogram information, date of maturity and amount invested,

The CRA and City have engaged the consulting division of Vavrinek, Trine, Day',and
Company, Certified Public Accountants and Consultants (VTD), to assist the agencies in
preparation of a combined investment report. The scope of their work will'entail a review of
the quarterly investment statements and bank statements, a compliance review with the
investment policy and government code, obtaining market valuations and preparing the report. -�

The Treasury Report for the Quarter ended December 31, 2000 has been resubmitted because_ the
pie chart from the previous quarter was inadvertently included and it did not represent total
investments by type accurately. In addition to this convection, I have requested that Vavrinek,
Trine, Day and Company provide a separate pie chart for funds with fiscal jagent. These are now
shown by fund type on the graph on page 1, and by investment type on the�table on page 6. The
Financial Investors Trust and ML Stern money market funds have been reclassified as Individual
Investment Instruments, rather than Funds in Investment Pools. Total Investment Instruments on
page 4 is comprised of federal agency paper and money market funds, shown separately on pages
1 and 2.

Staff has been negotiating with the owner of 22524 Barton Rd., site of the former GTI Market, to
enhance the asthetics of that comer until such time a development will take place. The owner
has agreed that the Redevelopment Agency, in exchange for a lien agreement and promise to pay,
will have the chain link fence removed from all but the northern boundary, will grade and level
the site, creating earthern berms to prevent vehicular access. The owner, at his expense,has
agreed to erect a wooden fence on the northerly property line within 6 months should a tenant not
be secured by then.
The total cost for the clean up is estimated to be less than$5,000. The owner has agreed to re-
pay the Redevelopment Agency at the time of issuance for a building permit.
STAFF RECOMMENDATION:
STAFF RECOMMENDS COUNCIL AUTHORIZE THE REDEVELOPMENT AGENCY TO
APPROPRIATE $5,000 FOR THE CLEAN UP AND GRADING OF 22524 BARTON ROAD
AND AUTHORIZE THE MAYOR TO ENTER INTO A LIEN AGREEMENT AND FOR
STAFF TO RECORD THE LIEN AS APPROPRIATE.

This letter is to confirm our telephone conversation and agreements_made as follows:
The City will.,
• Draft an agreement for your signature to be included in the City Council Packet
for the meeting of May 10, 2001.
• Select Contractor and commence clean up and grading/leveling of property as
soon as the agreement is executed and the City Council has approved it.
• The City will call you within three (3) days before commencement of grading.

• The City will provide for earthen berms at both east and west entries to the sit,.
from Mount Vernon Avenue and Arliss Street respectively, in order to avoid
vehicular entry.

The Property Owner will: {
• Sign the agreement as it is received and fax it back as soon as possible, so that
a fully executed copy can be placed in the City Council's Meeting packet.
• Upon a telephone call from the City, informing that the grading will commence,
the Property Owner will call the fencing company and order the fence to be taken
down on three sides with the exception of the northern bounldary of the site.

• Post a Real Estate sign on the site with applicable site information to make the
site clearly available in the market place.

unsightly condition of the above referenced property.

Fax (909) 825-7506 Several ideas have been discussed by staff including grading and building the
block retaining wall per the existing plans. However,this would be a sizable
expense at this time as proposed future development needs may not fit the
existing plan. As a result we have pursued the least expensive solution to
mitigate this situation.This can be resolved by knocking down the stock piled
dirt and grading the lot to drain to the northwest corner of the property, then
construct a six foot wood fence along the north property line.This would
relieve you of the ongoing rental and maintenance of the temporary fencing. -
We have obtained bids from two grading contractors and two bids on the
fencing.The low bid for grading is$1,700 and$4,650 for the fencing with
wood posts,and$4,950 with steel posts. Copies of both bids are enclosed.
If you agree with the above it would simplify matters if you dealt directly with
the contractors. If you can obtain a better price elsewhere That would be fine
with the city.

LIEN AGREEMENT
THIS AGREEMENT is hereby made and entered into by and between the City of Grand
Terrace (hereinafter"City") and Val Clemens(hereinafter the"Owner"), as follows:
RECITALS
WHEREAS, Owner is the owner in fee of certain real property located at 22524 Barton
Road, Grand Terrace, California, more particularly described as Assessor's Parcel Number
(the"Subject Property"); and,
WHEREAS,the Subject Property is presently maintained in an unsightly and potentially
unsafe condition, so as to constitute a nuisance; and

WHEREAS,the City and Owner desire to enter into an Agreement providing for the
cleaning up and securing of the Subject Property and providing for a lien of the Subject Property
in the amount of the costs incurred by the City related thereto.
NOW,THEREFORE, IT IS HEREBY AGREED by and between the Parties as
follows:
Section 1. The foregoing recitals are true and correct and are incorporated herein.
Section 2. Owner grants City the right to enter upon the Subject Property and to
perform clean up and grading and leveling of the Subject Property.
Section 3. City shall enter into a third-party contract to provide for clean up and
grading and leveling of the Subject Property and the installation of earthen berms at the east and
west entrance to the Subject Property from Mt. Vernon Avenue and Arliss Street respectively, in
order to prevent vehicular entry.
Section 4. City shall remove the existing chain link,fence and install a cedar wooden
fence on the northern Property line within six(6) months from the execution of this Agreement
or not later than November 10, 2001, should Owner not have secured a tenant by said date.

Section 5. City shall bear the initial cost of clean up and grading and leveling of the
Property and the installation of the wooden fence. It is anticipated that the total cost of such will
not exceed five thousand ($5,000) dollars. f
Section 6. Upon the completion of the clean up and grading and leveling of the
Subject Property, Owner agrees the City may place a lien on the Subject Property in the amount
of the actual cost of such clean up and grading and leveling performed on the Subject Property.
Upon installation of the wooden fence, if necessary, Owner agrees that City may place a lien on ,
the Subject Property in the actual amount of the wooden fence installation.
Section 7. All amounts subject to the aforesaid lien(s) shall be due and payable by
Owner to the City at the time of'the issuance of a building permit for a new tenant on the Subject
Property, or by May 10, 2006, which ever is later. Failure to timely make,such payment to
foreclose upon said lien(s). City shall be entitled, in addition to the lien amount plus interest at
the maximum legal rate commencing on payment due date, reasonable attorneys fees.

Section 8. Each Party agrees to indemnify, defend and hold harmless the other, its
officers, agents and employees, from any and all claims, damages,or liability arising out of 0:
performance of each Party's respective duties under this Agreement.

A special meeting of the City Council of the City of Grand Terrace was called to order in the City
Manager's Conference Room, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace,
California, on April 6, 2001, at 8:00 a.m.

The meeting was called to order at 8:05 a.m. by Mayor Pro Tem Garcia.
The City Council met with the representatives from the Spring Mountain Ranch Development
Project in Riverside County to discuss the two outstanding issues that the City has with regards to
the project, i.e., drainage and traffic. There was some discussion and suggestions regarding the
language that should be added to the Specific Plan with regards to the drainage and traffic issues.
Assistant City Manager Donlevy prepared some suggested conditions and submitted them to the
developer for their review. The developer indicated that he would respond to Assistant City
Manager Donlevy's suggested conditions once his attorney had a chance to review them.
It was the consensus of the City Council to appoint Assistant City Manager Donlevy as the
designated staff member to be the contact person for the City of Grand Terrace with regards to the
Spring Mountain Ranch project.

Lt. Carr, Sheriff's Department, responded that the event is scheduled to take place on June
2, 2001 and that Tanya Cahill, SSSO is working on the parade route and that she has been
getting some responses from the local businesses indicating their interest in participating in
the event.
Councilmember Hilkey, reported that he attended a musical on Lewis Armstrong that was
put on by the first grade students at Terrace View. He indicated that he attended the Solid
Waste Task Force meeting. There is a new environmental issue with regards to Capital Ray
Tubes, which are now considered hazardous waste. CRT's must be recycled.
Mayor Buchanan, requested staff to review the contract with Waste Management to see if
they provide services of recycling CRT's and if not negotiate some type of an agreement to
do so.
Councilmember Hilkey,indicated that Burtech Industries now has the contract to handle the
solid waste for the County of San Bernardino and requested staff to explain the special
package for tipping fees.
City Manager Schwab,indicated that there are some cities in the West End(Ontario;Upland,
Chino)that did not join the waste stream agreement and they are currently taking their waste
to a landfill in Orange County. In an effort the entice those cities that abandoned the system
four years ago, they have offered a rate of$20.00 per ton. This is unfair to those cities that
have stuck with the system, however to maintain the integrity of the system, cities have
signed a fifteen year contract that indicates that they will only allow those few communities
that have to process their waste through transfer stations to get the$20.00 tipping fee. City
Managers from the Cities that signed the agreement are meeting1with the County of San
Bernardino to discuss their concerns.

Councilmember Hilkey,reported that he attended a SANBAG and RCTC meeting to discuss
the 215 Freeway. They both have committed to coordinate their efforts with regards to the
improvements of the 215 freeway. He attended an IEEP meeting and expressed his
satisfaction with the program and felt that it was very interesting.
Councilmember Ferre,thanked Councilmember Larkin for putting;together the spreadsheet
for the workshop.

in accordance with Government Code Section 53646 (b)(1)...(3). The report would include all

This code section requires that:
1)Report must be produced 30 days after end of quarter,
2) Report must comment on compliance with investment policy,
3) Report must comment if agency has ability to meet expenditures for next six months,
4) Report must include a description of the investment, type of investment, issuer,
investment pool or program information, date of maturity and amount invested,
5) Report must include book value and current market value of each investment,

The CRA and City have engaged the consulting division of Vavrinek, Trine, Day and
Company, Certified Public Accountants and Consultants (VTD), to assist the agencies in
preparation of a combined investment report. The scope of their work will entail'a review of
the quarterly investment statements and bank statements, a compliance review with the
investment policy and government code, obtaining market valuations and preparing,the report.
The Treasury Report for the Quarter ending December 31, 2000 has been resubmitted because
the pie chart from the previous quarter was inadvertently included and it did not represent total
investments by type accurately. In addition to this correction, I have requested that-Vavrinek,
Trine, Day and Company provide a separate pie chart for funds with fiscal;agent. These are now
shown by fund type on the graph on page 1, and by investment type on the table on page 6. The
Financial Investors Trust and ML Stern money market funds have been reclassified as Individual
Investment Instruments,,rather than Funds in Investment Pools. Total Investment Instruments on
page 4 is comprised of federal agency paper and money market funds, shown separately on
pages 1 and 2. } ;

The City of Grand Terrace currently utilizes older doppler radar technology for radar speed
enforcement,however,new technology currently exists to upgrade to laser speed control
technology which is much more accurate. The City currently borrows, when available, Loma
Linda's laser unit but that borrowing is limited as.it is utilized by Loma Linda's full time traffic
car. The City of Grand Terrace along with other cities in California each received a California
Law Enforcement Equipment Program High Technology Grant. Our grant was for$104,684.
The Sheriffs Dept. is requesting an appropriation of$9,000 for the purchase of 2 units and the
necessary accessories. This will allow the Grand Terrace cars to carry the new laser units for
l traffic speed control on all of our radar certified,streets but particularly Barton Road and Mt.
Vernon Avenue.

Attached are the product specifications for the Ultra-Lyte 200LR 'Laser. I have
reviewed the information and feel that use of such a laser would be a great
benefit t6the City of Grand Terrace.
The Laser would primarily be used for speed-control enforcement in the City of
Grand Terrace. Current traffic trends show that use of Barton Road as a
thoroughfare between the cities of Colton and Loma Linda is increasing, and so
are the speeds. Unfortunately, many of the accidents along Barton Road are due
to driver unfamiliarity with the posted speed limits. Speed-control needs to be a
priority and accurate readings provided by the Ultra-Lyte-1!200LR laser would
certainly warrant the citations issued.

In addition to this basic function, the laser could be enhanced for use in other
policing activities. Its built-in module, MapStar Digital Compass, coupled with
QuickMap 3D, allows electronic collision scene recreation. The laser's ability to
plot the crash scene from as far away as 3,280 feet, promotes a safer working
environment to the investigating personnel.
Traffic statistics could be compiled using SpeedStat. SpeedStat's more accurate
figures can be used in submitting grant proposals and also serve to highlight
problem areas within the City of Grand Terrace.
Use of these lasers in contract cities from the low-dessert 'to the high-dessert
have effectively reduced the previously faced excessive speed-control problems.
In addition, the contract cities have received a return o In their investment.
Through enforcement of the problem areas, increased revenues have been
generated.

sources of funds. Some of these candidate projects are from the City's Bicycle Master
Plan adopted in 1999; others are priority improvements listed in the Circulation Element
of the City General Plan. Bicycle lanes and related improvements provide an alternative
mode of transportation, help improve safety and pedestrian circulation, and entrance
aesthetics of our corridors. Priority improvements listed in our Circulation Element also
improve safety and help maintain circulation Levels of Severe (LOS) "C", thus reducing
congestion and pollution. (See attached Table of Candidate Projects per Fund
Source).
The projects that scored higher in meeting grant requirements are as follows:
1. DeBerry signal at Mount Vernon.
2. Michigan sidewalk on the west side.
3. Bikelane, Class II along Mount Vernon from Barton to Grand Terrace Road and
from Pico to Raven Street on the east side. (Please note that letters were sent to
each property owner along the proposed route to inform them about the potential
availability of funds and to measure their interest. Should feedback from the
residents be good, Staff recommends this grant be pursued).

4. Traffic signal at Honey Hill.
The Bikelane funding sources.are statewide and are extremely competitive. The CMAQ
Funds are local; however, criteria relates to traffic congestion and are not easy to meet.
Should the City Council support these grant applications, staff will'proceed and prepare
applications.
Recommendation:
Staff recommends the City Council give staff the go ahead by approving the four (4)
attached resolutions. Staff will bring back a listing of co-funding amounts at a later date
for approval. Most co-funding can be done from the Air Quality. Fund and/or
Redevelopment Funds.

WHEREAS, in 1999, the state of California enacted into law Assembly; Bill (AB) 1475 that calls for
Caltrans to establish and administer a "Safe Routes to School" construction;program and, to us'
federal transportation funds for construction of bicycle, pedestrian safety,j and traffic calming

WHEREAS, AB 1475 mandates that Caltrans shall make grants available to local governmental
agencies under the program based,on the results of a statewide competition, and

WHEREAS, California faces unprecedented energy challenges and severe
electricity supply shortages; and
WHEREAS, the importance of immediate energy conservation efforts cannot be
overstated; and
WHEREAS, Governor Gray Davis has asked all Californians to reduce electricity
use by 7%; and
WHEREAS, to demonstrate California's commitment to conserve electricity, the
Governor has directed state agencies to reduce electricity use in state facilities by 5% by
January 16, and has asked cities to do the same; and
WHEREAS, the City of Grand Terrace has already implemented the following
projects to conserve energy: Civic Center HVAC Controller retrofit, LED traffic light retrofit,
Civic Center flourescent lighting retrofit, reduced ballfield lighting andlelimination of ballfield
lighting during Stage 3 alerts.
NOW, THEREFORE, BE IT RESOLVED, that the City of Grand Terrace has taken
actions to immediately reduce electricity use by 5%; is committed to reducing its ongoing
electricity use by 7%; urges its residents and businesses to also reduce ongoing electricity
use by 7%.

RECOMMENDATION: Approval of the project, specifically the Ordinance for zone
change amendment of the Barton Road Specific Plan and
Negative Declaration
Background:
Preliminary discussions were held with Camden Development Ltd., who is now the property
owner, regarding the above referenced project as early as August 29, 2000. The project
applicant, G&M Oil Company (dba Chevron) who will be a tenant of the site, came on board in
November of 2000. The formal applications for the project were submitted on February 5, 2001.
The Planning Commission voted unanimously at their April 19, 2001 regular meeting to approve
all above referenced applications pertaining to the proposed Chevron service station/food
market project.
Following an approval of the project by the City Council, construction plans for the development
could be reviewed and approved early this summer, with construction activities potentially
beginning shortly thereafter.
The attached Planning Commission staff report provides the.details of the project.

Discussion:
One issue remains to be fully resolved regarding the monument sign with automated message
board at the street corner. As presented in the Building Official's comments on the project,
originally a sign of the same size and scale as the one designed for the Rite Aid site was
required. The Rite Aid sign is nearly twenty feet long, and over !six feet in height with
approximately 120 square feet of sign area. After consideration-of this sign by staff and working
with the applicant, it was determined that the size of the sign would be out of scale and
inappropriate for this small of a-site.
Further, it was determined that this large sign would conflict with and probably obscure the
proposed monument sign for the-site. The proposed monument sign':combines the Chevron
logo with the price signs for the gasoline sales required by State Law, into one sign visible form
both streets, and that complies with the standards of the BRSP. State Law requires prices of
gasoline to be clearly displayed such that they are easily viewable from both streets. With the
City monument sign as proposed, the price signs would have to be ;displayed in a manner
unacceptable per the standards of the Barton Road Specific,Plan. Staff informed the applicants,
who had originally proposed a pole sign, that the BRSP does allow pole type signs.
Staff suggested a potential compromise. A low retaining wall incorporated into the landscape of
the site at the corner could function as a City identity sign. The wall would stand only 18 to 24
inches tall, composed of the same river rock material used elsewhere on the project, and would
bear the words 'City of Grand Terrace'with the City logo perhaps as welC A reader board would
not be practical with this concept. However, the low monument identity statement would not
conflict with the project monument/price sign. The applicant is agreeable to this design solution,
and is agreeing to build the wall. However, the City would need to contribute funds for the City
identification sign component to the wall. A cost estimate was not available as of this writing.
The Planning Commission reviewed the subject issue and recommended that Staff and
applicant work together to submit a proposal to the City Council in line 'with the staff proposed
low monument sign, a copy of which is attached as Exhibit 5. Staff is;presently working with
the applicant and additional sign sketches will be available at the meeting for review.

recommend the City Council approve, subject to conditions, File Nos. SA-01-03, CUP-01-01, V-
01-01, V-01-02, V-01-03, V-01-04, SGN-01-03, and approve the Negative Declaration (E-01-

BACKGROUND AND DISCUSSION:
G & M Oil Company submitted a formal application on February 5, 2001 to construct a self-
service gasoline fuel station with convenience food store at the site of the former Union 76
(Unocal) service station located at the southwest comer of Barton Road and Mount Vernon
Avenue. The existing building and canopy are obsolete and will be removed, as well as all
paving and a completely new facility would be constructed in its place. The site has been vacant
since 1999 and the fuel tanks were removed in 1999 as well.
The property is now owned by Camden Development Limited, the owner of the Hollywood
Video site immediately to the west. Camden Development has brought in G& M Oil as a tenant
for the corner site. G&M Oil is a large independent regional distributor of Chevron brand
gasoline, with numerous service station facilities in Southern California. As a large distributor
with multiple stations, G&M Oil is able to sell Chevron gasoline at competitive prices. There
will be no automobile servicing or service bays associated with the proposed use. Staff is of the
opinion that the Chevron corporate.brand will add to the economic vitality of the Barton Road
commercial core.
There are a number of applications associated with this project, as there are a number of issues
regarding land use regulations and development standards that adversely affect this particular
property because of its unique size and configuration. These have to be dealt with in-order to
allow the proposed use within the context of the existing standards of the Barton Road Specific
Plan (BRSP). Among these is a zoning change within the Barton Road Specific Plan(BRSP-01-
01) to allow a self-service gas station/food market at this site only within the Village r '
Commercial land use designation. There are also four variances associated with specific
development regulations of the Specific Plan (detailed later in this report)'.
The small size of this commercial site, approximately 12,414 square feet, is a severe handicap to
its development. There are very few modern uses that could effectively. and profitably develop
such a small commercial site. A gasoline station/convenience market may, if appropriately
designed with the right balance between aesthetics and function, be the best use of the site at this
time. The many upgraded architectural and site features presented by this project compensate for
the several code amendments and variances. Staff is bringing to the Planning Commission a
development package that is feasible to the developer and an asset to the City.
SA-01-03: Site and Architectural review— Staff has been working with Camden Development
and various designers since August of last year on how the site could be conceptually developed.
Initially, staff was requesting a reverse corner design with the food market/cashier located at the
street corner to be in conformance with the Specific Plan. However, it was indicated by Camden
Development that the proposed franchise, Chevron, would veto the reverse corner configuration
on a small site such as this; one with an anticipated low volume of sales compared with other
Chevron stations.
Site Design — The site design reflects a conventional layout with a 1,348 square foot
convenience market/cashier building at the back corner of the site and a pump island/canopy
occupying the center of the site. There are four double-sided fuel pumps that can accommodate

up to eight vehicles. The trash enclosure, air/water dispenser and related fueling station
equipment are all located close to the building and away from the streets.
Parking& Circulation - As proposed, the facility will have two driveways: one on Barton Road
and one on Mount Vernon Avenue (the site currently has four driveways). Both driveways are
located as far away from the street intersection as is practical. Furthermore, both driveway
entries to the site, .as well as the pedestrian areas adjacent to the building- will have special
stamped and colored concrete paving. Special`pavement treatment in these locations adds to the
aesthetic appearance of the site, and enhances public safety by helping define pedestrian and
vehicular paths.
The City's Transportation'Consultant has recommended prohibiting left turn maneuvers from the
site to westbound Barton Road. Therefore,'staff is recommending a condition of approval that
the Barton Road driveway be posted with a no left turn sign.
The site plan indicates the path of travel for fuel delivery trucks, as well as the proposed location
of new double walled underground fuel tanks-ion the site. Camden Development, as the recent
purchaser of the site, has provided a letter (Exhibit G) explaining that they are in possession of
records indicating that all old fuel tanks were:removed and the site received clearance from the
San Bernardino County Department of Environmental Health.
The municipal code requires three parking spaces for service stations, plus one additional for
each service bay. This standard is based on,.the old concept of a service station. The City
currently does not have a standard specificallyZor the gasoline sales/convenience market type of
use. The closest other parking standard from the municipal code would be retail at one space per
200 square feet of gross floor area. Applying this standard to the 1,348 square foot convenience
market would result in a parking requirement of seven stalls. The site plan indicates six parking
stalls. However, there are eight stations at the, fueling pumps. Staff islof the opinion that this
parking configuration should prove adequate; as fuel sales will be 'the primary use and the
convenience market is a secondary use. . Most customers of this type of operation visit the
market/cashier while their car is parked at the fuel pumps.'
Architecture — The Architectural Guidelines contained in the Barton Road Specific Plan
recommend a `rural rustic' or `Cape Cod' architectural style as it has been interpreted over the
years. The initial submittal of this project was'of a plain generic stucco box with a Spanish tile
type roof. Staff has worked diligently with the'applicants to guide the design of the project into a
form more compatible with the Barton Road Specific Plan. This includes the incorporation of
high quality finish materials and superior details, as well as the overall proportions of such a
small building.
The design presented to the Planning Commission uses real river rock at the base of the building
with a pre-cast bull-nose detail cap. The roof is composed of dark gray concrete tiles with a low
pitch and exposed rafter tails. There is a small:tower element incorporated into the roof to break
up the roofline, and to serve as the focal point of the building.
To add further interest and mass to this small•building, wood trellis structures are incorporated
over the front entrance, and on both sides. The wood trellis on the east side covers and disguises

the trash enclosure. Pre-cast concrete columns with a simple classic design support these wood
trellis structures.
Although discouraged as a dominant exterior material by the Barton Road Specific Plan, stucco
is still used extensively because of its low cost and durability. However, various detail elements
and accent materials break up what would otherwise be large expanses of stucco. Dark blue
accent tiles are used in a diamond pattern, as are reveal lines inset into the stucco.
Windows are inset deep in the openings rather than flush with the exterior, giving the building
the appearance of being more substantial. Decorative wood lentils are used over the windows as
well. All of these detail elements and enhanced high-quality material are harmonious with the
Barton Road Specific Plan architectural design guidelines.
Because the building will be located immediately adjacent to the south and west property lines,
the Uniform Building Code and fire codes require flat parapet walls with no openings and no
roof overhangs. Staff asked the applicant to repeat the river rock base treatment, the stucco
reveals and tile inserts on the south elevation, as this wall will be viewable from the adjacent
parking lot to the south. The west wall will not be visible because the Hollywood Video building
will hide it. Thus, no special treatment is needed on this side. However, both parapet walls will
be topped by a simple stucco cap treatment. All rooftop mechanical equipment wi11 be screened
from view by the mansard roofs and parapet walls.
The gas pump island canopy repeats the roofing tile and the stucco from the building. Further,
the base of the columns will be encased in same river rock material used on the building as well.
The fascia of the canopy is a color and material determined by the Chevron franchise.
Landscaping - Existing retaining walls along the south and west property lines will be faced
with the same river rock used on the building. Mature landscaping will be installed. The use of
tropical plants (palm trees, etc...) has been discouraged in keeping with the Inland Empire Film
Commission goals for our city. Landscaping in the parkways will be' incorporated into the
overall design of the site. Also, the landscape areas fronting Barton Road and Mount Vernon
Avenue will be mounded and planted in such a way to reduce visibility of fueling activities on
the site. Generally, all landscaped areas have been maximized to the extent feasible without
adversely impacting the operation and circulation of the proposed project.
Street Dedications
Although both Barton Rd. and Mt. Vernon Avenues are fully dedicated to their ultimate width
per the Grand Terrace General Plan Circulation Element, additional radius dedications are
needed to accommodate a wider turning radius for larger vehicles such as delivery trucks,
moving vans, and fire trucks, etc... However, staff is recommending, that only the radius
dedication be required at this time and that actual radius improvements not be required. This is
because doing so would disrupt the existing decorative intersection improvements. The building
at the northwest corner was required to dedicate the corner radius in 1990, but the street
improvements were left as is. Additional radius dedication was not required for the Rite-Aide
project.

Zone ChangeBRSP-01-01 - Land Use: The project site is designated.`Village Commercial",
and the Barton Road Specific Plan does not allow Auto Service Stations as a permitted or
conditionally permitted land use. Because of site's physical development hardships due to its
small size, staff is recommending a zone change amendment to the Barton Road Specific Plan to
allow a gasoline sales/convenience market, excluding automobile service and/or washing. This
zone change would be on this particular site only, with the approval of a Conditional Use Permit
by the Planning Commission. This zone change would not apply generally to the Village
Commercial area.
CUP-01-01: Conditional Use Permit — It should be noted that this proposed use is generally
compatible with land uses and development patterns in the immediate vicinity.)Furthermore, a
service station has been a long-term use of this site. However, a Conditional Use Permit will
help the City manage/control future changes in the use of this site. It is difficult to anticipate
how the economy will change land use patterns in the hear future, much less in the long term.
Staff is recommending conditions of approval that will limit the use of the site to what is
currently proposed. Any substantial changes or additions to the use will require review by the
Planning Commission.
V-01-01: Variance - Setbacks: The Barton Road Specific Plan has no required building
setbacks in the Village Commercial area. However,the Barton Road Specific Plan requires a 30-
foot front setback for parking areas (including vehicle maneuvering and access). The Barton
Road Specific Plan also requires a 5-foot street side yard setback for parking. Strictly applying
these parking setbacks makes development of such a small site very difficult, as the lot depth
from Barton Road is only 100 feet.

V-01-02: Variance—Landscape: The Barton Road Specific Plan requires 25% of the site to be
landscaped. This landscape standard is difficult to achieve again due to the size of the property.
The proposed site plan has approximately 12.4% of the site as landscape. Staff has worked with
the applicant to have the sidewalks reconstructed in a manner similar to the meandering
sidewalks at the northwest comer of Barton Road and Mount Vernon. The concept here is to
have the sidewalk and'landscape parkway integrated with the landscape of the project. The
existing twelve-foot wide sidewalks would be reduced to six foot wide meandering. The
applicant would be responsible for the reconstruction of the sidewalks, installation of the
parkway landscape, as well as the continuing maintenance of the parkway. The net effect will be
a dramatic improvement in the overall landscape coverage compared to the current site '
conditions.
V-01-03: Variance - Vehicle access: The Barton Road Specific Plan requires vehicle access
points to public streets to be located at least 100 feet from=lthe nearest intersection (per Master
Plan Area No. 4). While the driveways for this proposal have been moved as far as is practical
from the intersection, neither driveway can meet this requirement. Because the lot is only 100'
X 125', the proposed site plan will require a variance from this standard.
V-01-04: Variance— Building location The Barton Road Specific Plan requires all buildings in
Master Plan Area No. 4 to be `street adjacent' located no more than five feet from the street. The

proposed site plan places the building at the back comer of the site. The BRSP envisioned the
consolidation and redevelopment of parcels into cohesive projects that allow for appropriate
shared circulation and parking layouts to facilitate street adjacent buildings. This has not
occurred because there are differing property owners of adjacent parcels that are already
substantially improved. If the Stater Brothers shopping center, the Hollywood Video building,
and-this site were all under the same ownership, and the entire area was to be redeveloped as one
cohesive project, perhaps then the reverse corner building orientation would be feasible.
Because of the physical constraints imposed by the small size of this site, it is staff s opinion that
the required findings in support of the approval of all four variances can be made. The findings
are as follows:
A. A special circumstance regarding the size, shape, topography, location or
surroundings of the subject property exists. The small size of this property constitutes
a special circumstance.
B. Because of the special circumstance, the strict application of the zoning ordinance
deprives the subject property of privileges enjoyed by other property in the vicinity
and under identical zoning classification. Strict application of the development
standards of the Barton Road Specific Plan greatly restricts the development
potential of this small site, relative to other sites in the vicinity.;
C. The granting of the variance will not constitute the grant of special privileges
inconsistent with the limitations upon other properties in the vicinity and district in
which the property is situated. Other properties in the vicinity are not similarly small
in size and could easily accommodate the development standards of the Barton Road
Specific Plan.
D. The granting of the variance will not authorize a use or 'activity which is not
otherwise expressly authorized by the district governing the parcel of property. The
variances are for relief from specified development standards!which would apply to
any use of this property. ,
E. The granting of the variance will not result in a situation inconsistent with the latest
adopted General Plan. The proposed development is consistent with the General
Commercial land use designation as well as other provisions'of the Grand Terrace
General Plan.
SGN-01-03: Signs — As with any corporate franchise, there is a standard package of signs that
are required by the franchise. These include standard internally illuminated corporate logo signs
on two sides of the pump island canopy with the word `Chevron' in illuminated channel letters
on the other two sides. The `Chevron' logo appears as a decal on the `spanners' located above
the fuel pumps. A `Food Mart' sign in internally illuminated channel letters is the only sign
proposed on the building. One internally illuminated ground-mounted monument sign is
proposed to be located at the street corner with the `Chevron' logo and fuel prices displayed per
state law. The monument sign will have a base composed of the same river rock used on the
building and the column bases of the pump island canopy.

Conclusions
The City Transportation consultant has reviewed the proposed site plan and determined it will
have no significant traffic or parking impacts. However, the project is required to pay a traffic
signal improvement fee to mitigate cumulative impacts, in the amount of $202.20 and a
circulation improvement fee of $1,199.72 within District `B' as stipulated by Ordinance 190
adopted by the City Council on 2-20-2000. The applicant has accepted the conditions of
approval as drafted.
Unresolved Issues:
There is one item unresolved regarding the City entry and message sign mentioned in the
Building and Safety/Public Works report. CEDD staff is recommending 'against requiring this
sign at this location, because the scale of the sign, at 18' long and over 6' high, is out of
proportion with the size of the site, and will overwhelm the landscape area it would be located in.
Also, it would conflict with the proposed monument sign, as well as the fuel price sign required
by California State law. On a larger site with a larger scale project, the size of the sign would
have less of an impact. This would be the case with the Rite Aid site where the City monument
sign was incorporated into a bicycle staging area.
As of this writing, there are no other unresolved issues with-this project. However, there will be
many small details regarding the construction of the project that will have to be carefully
monitored during the plan check review and construction process to assure the quality comes
through.

Conditions of Approval:
Upon approval of the Planning Commission, the proposed project is subject to the following
conditions of approval:
1. The project shall be constructed in accordance with Site and' Architecture design as
approved by the Site and Architectural Review Board On;April 19, 2001, or as
amended by the City Council. All plans shall be consistent idterms of property lines,
easements locations and dimensions, and other measurements. Minor changes or
clarifications may be approved by the Community Development Department. All
building materials to match submitted materials board, and as approved by the Site
and Architectural Review Board.
2. Any significant expansion or changes to the design and/or configuration of the site
and or structures shall be reviewed -by the appropriate City agencies. Additional
permits or amendments to the Site and Architectural Review Conditions may be
necessary.
3. The Conditional Use Permit (File No. CUP-01-01) authorizes the use of the site as a
self-service gasoline fueling station with convenience food market. Any substantial
changes or additions to the use may require review by the Planning Commission.
4. All aspects of the proposed project including the building and landscaping/irrigation
shall be completed prior to building occupancy and shall be maintained in a clean and
functional manner in accordance with this approval and the overall goals and
objectives of the City of Grand Terrace.
5. Compliance with all recommendations listed in the Building and Safety/Public Works
memorandum dated February 22, 2001 (Attachment- A).
6. Compliance with all recommendations listed in the City Engineer's memorandum to
the City dated April 2, 2001 (Attachment- B)
7. Compliance with San Bernardino County Fire Department,; Hazardous Materials

shall be submitted for Building and Safety, and Community Development approval.
16. Applicant shall provide a lighting plan for Community Development Department and
Building and Safety approval prior to issuance of any building permits (around
proposed building and parking lot).
17. All Utilities to be underground or screened from public view.
18. All Mechanical Equipment shall be screened from public view, and all rooftop
mechanical equipment will be screened from view by the mansard roofs and parapet
walls.
19. Landscape areas fronting Barton Road and Mount Vernon Avenue will be mounded

5. That the architectural design of structures,their materials and colors are visually harmonious
with surrounding development,natural landforms,are functional for the proposed project and
are consistent with the Barton road Specific Plan;
6. That the plan for landscaping provides a functional and visually pleasing setting for the
structures on this site and is a harmonious addition to the landscape of the area and nearby
developments;
7. The design and location of all signs associated with this project are consistent with the scale
and character of the building(s)to which they are attached or otherwise associated with and
are consistent with the BRSP;
8. That the conditions of approval for this project necessary to secure the purposes of the Barton
Road Specific Plan,the Grand Terrace Municipal Code and the General Plan are made a part
of this approval.
BE IT FURTHER RESOLVED,that the proposed project is hereby approved subject to the
following conditions of approval:
1. The project shall be constructed in accordance with Site_and Architecture design as approved
by the Site and Architectural Review Board On April 19, 2001, or as amended by the City
Council. All plans shall be consistent in terms of property lines, easements locations and
dimensions,and other measurements. Minor changes or clarifications may be approved by
the Community Development Department. All building materials to match submitted
materials board, and as approved by the Site and Architectural Review Board.
2. Any significant expansion or changes to the design and/or configuration of the site and or
structures shall be reviewed by the appropriate City agencies. Additional permits or
amendments to the Site and Architectural Review Conditions may be necessary.
3. The Conditional Use Permit (File No. CUP-01-01) authorizes the use of the site as a self-
service gasoline fueling station with convenience food market. Any substantial changes or

additions to the use may require review by the Planning Commission.
4. All aspects of the proposed project including the building and landscaping/irrigation shall be
completed prior to building occupancy and shall be maintained in a clean and functional
manner in accordance with this approval and the overall goals and,objectives of the City of
Grand Terrace.
5. Compliance with all recommendations listed in the Building and Safety/Public Works
memorandum dated February 22, 2001 (Attachment- A).
6. Compliance with all recommendations listed in the City Engineer's memorandum to the City
dated April 2, 2001 (Attachment- B)
7. Compliance with San Bernardino County Fire Department, Hazardous Materials Division,
requirements in letter dated February 22, 2001 (Attachment D).
8. Compliance with San Bernardino County Environmental Health requirements in
memorandum dated February 20, 2001 (Attachment E).
9. This project is required to pay a traffic signal improvement fee to mitigate cumulative
impacts in the amount of$202.20 and a circulation improvement fee of$1,199.72 within
District`B'as stipulated by Ordinance 190 adopted by the Grand Terrace City Council on 2-
20-2000.
10. Per Trip Reduction Ordinance Number 147 - Code Section 16.04.040 (B)(I), the applicant
shall install a three (3) bike bike-rack.
11. Additional corner radius dedication to 35 feet is required to be recorded prior to occupancy
of the project. Street corner radius improvements are not required.
12. The Barton Road driveway shall be posted with a no left turn sign.
13. Signs shall comply with sign regulations of the Barton Road Specific Plan.
14. Both driveway entries to the site,as well as the pedestrian areas adjacent to the building shall
have special distinguished pavement treatment to add to the aesthetic appearance of the site,
and to enhance public safety by helping define pedestrian and vehicular paths.
15. All trash containers shall be enclosed within a 6-foot high solid wall. Detail plans shall be
submitted for Building and Safety, and Community Development approval.
16. Applicant shall provide a lighting plan for Community Development Department and
Building and Safety approval prior to issuance of any building permits (around proposed
building and parking lot).
17. All Utilities to be underground or screened from public view.
18. All Mechanical Equipment shall be screened from public view,and all rooftop mechanical
equipment will be screened from view by the mansard roofs and parapet walls.
19. Landscape areas fronting Barton Road and Mount Vernon Avenue will be mounded and
planted in such a way to reduce visibility of fueling activities on the site.
20. It shall be the responsibility of the property owner and/or tenant to maintain the landscape
parkways in the public right-of-way.
21. All retaining walls shall be faced with river rock to match that used on the building. This
includes new and/or existing retaining walls.
22. Windows shall be mounted recessed into their openings, not flush with the exterior walls.
23. Digital media for GIS data collection/update and archival purposes: after approval of
construction plans by the City,provide full-scale high resolution TIFF images and/or CAD
drawings of all plan sheets in digital format on digital recording media as determined by City
Staff.
24. The four (4') foot public utility easement behind the building shall be landscaped and
permanently maintained.

service station/food market is not consistent with the Barton Road Specific Plan land use
designation of village commercial. An amendment to the specific plan is a component of
this project: It has been determined that development of the site per the Barton Road
Specific Plan would decrease property values significantly,and that a land use
amendment to the specific plan will have a positive impact on the area.

10. Per Trip Reduction Ordinance Number 147 - Code Section 16.04.040 (13)(I), the applicant shall
install a three (3) bike bike-rack.
11. Additional corner radius dedication to 35 feet is required to be recorded prior to occupancy of
the project.,- Street corner radius improvements are not required.
12. The Barton Road driveway shall be posted with a no left turn sign.
13. Signs shall comply with sign'regulations of the Barton Road Specific Plan.
14. Both driveway entries to.the site, as well as the pedestrian areas adjacent to the building shall
have special stamped and colored concrete paving to add to the aesthetic appearance of the site,
and to enhance public safety by helping define pedestrian and vehicular paths.
15. All trash containers shall be enclosed within a 6-foot high solid wall. Detail plans shall be
submitted for Building and Safety, and Community Development approval.
16. Applicant shall provide a lighting plan for Community Development Department and Building
and Safety approval prior to issuance of any building permits (around proposed building and
parking lot).
17. All Utilities to be underground or screened from public view.
18. All Mechanical Equipment shall be screened from public view, and all rooftop mechanical
equipment will be screened from view by the mansard roofs and parapet walls:
19. Landscape areas fronting Barton Road and Mount Vernon Avenue will be mounded and
planted in such a way to reduce visibility of fueling activities on the site.
20. It shall be the responsibility, of the property owner and/or tenant to maintain the landscape
parkways in the public right-of-way.
21. All retaining walls should be faced with river rock to match that used on the building. This
includes new and/or existing retaining walls.
22. Windows should be mounted recessed into their openings, not flush with the exterior walls.
23. Digital media for GIS data collection/update and archival purposes: after approval of
construction plans by the City, provide full-scale high resolution TIFF images and/or CAD
drawings of all plan sheets in digital format on digital recording media as determined by City
Staff.

3) The project does not exceed the SANBAG CMP trip generation threshold. A
TIA report should not be required.

SUBJECT: LEGISLATIVE UPDATE
The League of California Cities Inland Empire Division Legislative Task Force met on April 26, 2001.
Following is an update on the activities from that meeting.
League of California Cities Legislative Action Days
The State League will hold its annual Legislative Action Days conference May 23 and 24 in Sacramento. This
two-day meeting of city officials in the state capitol will consist of a series of briefing sessions to provide you
with tools to improve your advocacy for city issues. Additionally,you will have the opportunity during this time
to meet with your Legislators to discuss your own city's legislative agenda.
May 23 Dinner Honoring State Legislators
In conjunction with these meetings,the Legislative Task Force has arranged a dinner to honor our legislators
on May 23 at 6:00 p.m.in Old Sacramento. We encourage all who are attending the conference to be there.

Fiscal Reform Initiative
Based on extensive voter research,the League Fiscal Reform Initiative Steering Committee recommended
to the Board that an initiative for-fiscal reform focus on: reform of the unfunded mandate reimbursement
process,protection of existing local revenue sources and accountability by local governments for expenditure
of public funds. The Committee also recommended working with legislators to develop a legislative proposal
that will accomplish the same objective.
Energy Task Force
The Energy Task Force made several recommendations to the Board, including: retaid a special consultant
to monitor the activities of the PUC,,retain a special consultant to analyst the energy crisis and proposed
legislative and regulatory alternatives, take a position on energy rate issues.
