AGENCY OF THE CITY OF GRAND TERRACE,
CALIFORNIA, ADOPTING A BUDGET OF ESTIMATED
REVENUES AND EXPENDITURES FOR FISCAL YEAR 2001-
2002
WHEREAS, the Community Redevelopment Agency of the City of Grand Terrace is
required to adopt a budget for the subsequent fiscal year for estimated revenues and expenditures;
and
WHEREAS,the members of said Community Redevelopment Agency and staff members
have thoroughly reviewed and analyzed the proposed budget in order to determine the needs of the
City of Grand Terrace;
NOW,THEREFORE,THE COMMUNITY REDEVELOPMENT AGENCY OF THE
CITY OF GRAND TERRACE DOES HEREBY RESOLVE,that a budget for Fiscal Year 2001-
2002,a copy of which is on file in the City Clerk's office,is hereby adopted with estimated revenues

A special meeting of the Community Redevelopment Agency and the City Council of the City of
Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 2279J

City Manager Schwab gave an overview of the 2001-2002 Fiscal Year Budget.
Finance Director Ronnow gave a financial review of revenues and expenditures for the 2001-
2002 fiscal year budget.
Assistant City Manager Donlevy gave a presentation of the program review process.
Council went through the Budget Program Reviews and made comments and asked questions
to the appropriate departments. The following are changes and directions to staff w101
regards to the 2001-2002 Fiscal Year Budget:
Council discussed Council benefits at length and directed staff to bring back an amendment
to the personnel policy that reflects the Council's consensus to eliminate post service lifetime
insurance benefits for those council members who have not already retired with three
consecutive terms or is not already in their third consecutive full term.
CC-2001-54 MOTION BY COUNCILMEMBER LARKIN, SECOND BY MAYOR
BUCHANAN, FAILED 2-3 (COUNCH_MEMBER LARKIN AND MAYOR
BUCHANAN VOTED YES), that any current Council Member that is not in t!

Projects (32)Expenditures Department:Economic Development(370), line
item 250-Professional/Special Services,for initial development expenses of
a Comprehensive Economic Development Plan and direct staff to prepare a
request for proposal to bring back to Council for input.
Council directed staff not to do anything with the General Plan Update until a Comprehensive

Councilmember Larkin read a Commendation for the Grand Ten ace Child Care Center Staff
for their commitment,caring and professionalism provided to the families of the community.
Mayor Buchanan presented the commendation to the staff of the Grand Terrace Child Care

2B. School Presentation - Grand Terrace Elementary School
Marilynn Jordan, Principal, Grand Terrace Elementary.announcedthat she will be retiring
after this school year and introduced the Assistant Principal,Den Marshall who will be the
Principal next year and Michael Beck, who will be the Assistant Principal next year.
Den Marshall, Assistant Principal introduced, Scott Noble who won first place in the
Regional Science Fair and also received a community award from the Forest Service South

West Regional Research Station. He introduced Andrew McClure who came in second place
in the Regional Science Fair and Garrett who came in third Place at the Regional Science

Terrace Elementary School. He indicated that Mrs. Ruggles' and Ms. Johnson's class will
be performing for the City Council.
2C. Presentation on DSL- Pacific Bell Representative Shanna Valentine
Shanna Valentine, representative from Pacific Bell gave a presentation on DSL and what
Pacific Bell has to offer the residents of the City of Grand Terrace.
2D. Proclamation-Blood Bank San Bernardino and Riverside Counties Celebrating"50
Years Sharing Life" '
Mayor Pro Tem Garcia read a Proclamation proclaiming support of the Blood Bank of San

COUNCIL REPORTS
Councilmember Larkin, indicated that it is Fag Day on June 14, 2001. Expressed his
appreciation for all of the work that went into Grand Terrace Days and felt that it went well.
He commended the Child Care Center. He attended the San Bernardino County State of the
County luncheon on Monday and felt that they put on an excellent presentation.
Mayor Pro Tern Garcia, indicated that she is excited about Mr. Beck coming to Grand
Terrace Elementary School due to his technology background and requested that staff keep
him in mind if'a technology group is put together. She thanked Tanya Cahill and the
Sheriff's Department for doing a great job on Grand Terrace Days. Councilmember Larkin
will be the MC at the Chamber of Commerce Installation Dinner. She commended the Child
Care Center. She indicated that she is looking forward to the 4' of July this year. She
encouraged residents to park their cars in their garages due to a higher number of automobile
thefts in the area.
Mavor Buchanan,thanked the staff for all of the work and preparation that went into putting
the budget together. He thanked the Sheriff's Department for the outstanding job that they
do in providing the City with Law Enforcement using grants and creative techniques to
leverage the little bit of dollars that can be contributed to the process. He indicated that he
is looking forward to the Chamber of Commerce Installation Dinner.

GRAND TERRACE, CALIFORNIA, ADOPTING A BUDGET
OF ESTIMATED REVENUES AND EXPENDITURES FOR
FISCAL YEAR 2001-2002
WHEREAS, local agency is required to adopt a budget for the subsequent fiscal year for
estimated revenues and expenditures; and
WHEREAS, every local governmental agency shall file with the county auditor of the
county in which the agency conducts its principal operations, a budget for the fiscal year then in
progress; and
WHEREAS, the City Council and Staff members have thoroughly reviewed and analyzed
the proposed budget in order to determine the needs of the City of Grand Terrace;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
DOES HEREBY RESOLVE, DECLARE, AND ORDER AS FOLLOWS:
Section 1. That a budget for Fiscal Year 2001-2002,a copy of which is on file in the City
Clerk's Office, is hereby adopted for the City of Grand Terrace with estimated revenues of
4,8 27,437,use of available fund balance of$280,102,interfund transfers-in of$227,366,for a total

Article XIII-B of the California Constitution was adopted as
Proposition 4 in the November 1979 General Election. Proposition 4
established an appropriations limit from proceeds of taxes for each
governmental entity in the, State of California. The appropriations
limit is unique to each governmental entity and must be determined
annually. Redevelopment is not subject to appropriations limit
The intent is to provide certain limitations and controls on
government spending at all levels of government in the. State, but
these restrictions are intended by legislature -to be applied in a
reasonable and practical manner so as to allow some flexibility to
meet constantly changing conditions and needs of the citizens for
governmental services . The appropriation limit of the City is the
"proceeds from taxes", as defined, adjusted annually by changes to the
population and the cost of living.
The Department of Finance shall notify 'each local. agency, no later
than May 1st of each year, of the change in cost of living or change
in California per capita personal income, whichever is less, and the
population for each local agency for the prior calendar year.
Proposition 111, passed in June 1990, made several changes to the
method to be used in calculating the limit . These changes allow that
the Population Factor may be the change in population of the City or
the change in population of the County. Proposition 111 also changed
the Price Factor to be a choice of the change in California per capita
income or the change in the local assessment roll due to the addition
of local nonresidential new construction. The latter percentage will
have to be provided by the County and will not be available for
several months .

Even though the Census figures showed Grand Terrace losing population,
the Department of Finance compensated by lowering the prior year
population accordingly, so that a positive growth percentage was still
maintained. The issue is moot since County population growth is
greater.
The appropriations limit can be adjusted at a later date. Council
must make their selection annually on each option by recorded vote.
At present, an appropriation cushion of $4, 960, 247 exists bef
ore the
limitation would impact the City. This is an increase ;of 12 .0% over
last year.

calculations for the City of Grand Terrace with supporting
documentation.

APPROPRIATIONS LIMIT
The California Revenue and Taxation Code, Section 2227, mandates the Department of Finance to
transmit an estimate of the percentage change in population to local governments. Each local
jurisdiction uses their percentage change in population factor for January 1, 2001, in conjunction
with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year
2001-2002. Enclosure I provides the change in California's per capita personal income and an
example for utilizing the price factor and population percentage change factor to calculate the 2001-
2002 appropriations limit. Enclosure II provides city and unincorporated county population
percentage changes, and Enclosure IIA provides county and_ incorporated areas population
percentage changes. The population percentage change, data excludes federal and state
institutionalized populations and military populations, as noted.
POPULATION PERCENTAGE CHANGE FOR SPECIAL DISTRICTS
Some special districts must, establish an annual appropriations limit. Consult the Revenue and
Taxation Code, Section 2228, for the various population options available to special districts to
assess population change in their district. Article XIII B, Section 9 of the State Constitution exempts
certain special districts from the appropriations limit calculation mandate. Special districts required
by law to calculate their appropriations limit must, present the calculation as part of their annual
audit. No State agency reviews the appropriations limit.
POPULATION CERTIFICATION
The population certification program applies only to cities and counties. Revenue and Taxation
Code 11005.6 mandates the Department of Finance to automatically certify any population
estimate that exceeds the current certified population with the State Controller's Office. The
Department of Finance will certify the higher estimate to the Controller by June 1, 2001.

ry' SUBJECT: ANIMAL CARE AND CONTROL SERVICES AGREEMENT
FUNDING REQUIRED
BACKGROUND:
Since 1982, the City,of Grand Terrace has contracted with the County of San Bernardino
Animal Services Department for the provision of Animal Care and Control Services. Services
provided include:
• Enforcement of all ordinances related to animal issues
• Impound and Sheltering '
• Quarantine and health enforcement
• Licensing and Canvassing
;' • Vaccination Clinics
• Public Education
• Dead Animal Removal
• 24 hour call services.
Animal-Services also assists the City Management and Code Enforcement in investigations and
coordinated actions related to animals.
DISCUSSION:
The Animal Services Contract with the County is now due for renewal. This year has seen a
significant increase in costs caused by a re-evaluation of cost structures by the County.
Under the Agreement, the County is compensated a sum of$35,800. The estimated revenue
from licensing is approximately $20,000, for a net cost of$15,800. The City paid
approximately $4,000 in 2000-01, for a total increase of$11,800.
Staff is recommending adoption of the agreement. In an analysis of the past,agreements with
the County, the last increase in the contract cost was 1988, or 13 years ago. Given cost of
living,and increases in overall expenditures, a net cost of$15,800 for total services is not seen

I. CITY RESPONSIBILITIES,
A. The City shall compensate the County as set forth in Article III below.
B. To facilitate the performance of functions as provided-for in this agreement, it is hereby agreed that
the County shall have full cooperation and assistance from the City, its officers, agents, and
employees.
C. Notwithstanding anything herein stated, it is agreed that in all-instances wherein special supplies,
stationery, notices:, forms, and the` like must be issued in the name of the City, the same shall be
supplied by said City at its own cost and expense.
D. The City shall not ;be called upon .to assume any liability for the direct payment of any salary,
wages, or other compensation to any County officer or-employee performing-services hereunder for
the City. Except as herein otherwise specified, the'City shall not be liable ,for compensation or
indemnity to any County officer or employee for injury or+sickness arising out of his employment
E. The City will indemnify, defend and hold harmless the County and its authorized officers,
employees, agents and volunteers from any and all claims, actions, losses, damages, and/or
liability arising out of this contract from any cause whatsoever, including the errors or omissions of
any person and for any costs or expenses incurred by the County on account of any claim
therefore, except where such indemnification is prohibited by law.
F. In the performance of this Contract, City, its agents and employees, shall act in an independent
capacity and not as officers, employees, or agents of the County of San Bernardino.
G. City understands and agrees that any and all legal fees or+'costs associated with lawsuits concerning
`ter this Contract against the County shall be the City's sole expense'and-shall not be-charged as a cost.-
under this Contract. In the event of any contract dispute hereunder, each Party to this Contract shall
bear its own attorney's fees and costs regardless of who prevails in the outcome of the dispute.
II. COUNTY RESPONSIBILITIES =
A. Through its Public Health Department, or such other agency as the Board of Supervisors may
designate, County shall provide the City with animal control services normally provided by the
Department to the unincorporated area of the County. Such services may include, but not be
limited to, those services and functions performed under Chapters'l and 2 of Division 2 of Title 3 of
the County Code.
B. The County hereby agrees to,provide the following specific functions:
a. Enforce all County ordinances pertaining to animals, including the issuing of citations as
necessary for violations of said ordinance.
b. Impound all animals caught at large, including cats, and provide for the return of all licensed.
dogs whenever possible. Should the City or its agent order or cause any animal to be sheltered
for more than ten days, the City will be charged $6.00 per day,per animal. This charge will be
billed separately and is an addition to the usual quarterly billing.
c. Quarantine as prescribed by law all animals suspected to be rabid.
d. Investigate complaints of nuisance by animals upon request during routine patrol.
e. Remove dead animals on the public right-of-way.

f. Investigate reported'dog bites.
g. Conduct clinics for the vaccination of dogs during the months of May, June and July.
h. Develop a plan and conduct a house-to-house canvass within the City for the purpose of
ascertaining the number of unlicensed dogs and to license such dogs during the actual
canvass. The County shall give notice of the requirements of existing ordinances and laws with
respect to the licensing of such dogs and the obligation of the owner(s) or other responsible
persons to apply for and obtain such licenses. A written citation will ,be issued at the time of
canvass to any person required to purchase a dog license and who fails to purchase said
license at the time of canvass. The County agrees during the canvassing period of August
through April to attempt to make 100% total canvassing coverage of the entire City area. -
i. Provide an average of eighteen hours of usual service in the City Sunday through Saturday.
Emergency calls only will be handled Sunday, holidays, and after hours. Should the City's
demand for service exceed the allotted number of contract hours (2700) then upon direction of
the City, each additional hour of service will be charged to the City at the rate of $52.00 per
hour.
j. Provide a night mechanism to answer the telephones from 1700 hours to 0800 hours Sunday
through Saturday and an Officer after regular hours to offer limited special and emergency
service to the public in the field seven days a week. Special and emergency service includes,
but is not limited to, responding to either a citizen's request or request from the Sheriff's office
to aid an injured animal(s), or to impound a dangerous, sick or injured animal, or attempt to
locate a stray biting.animal.
C. The County Health Officer with the concurrence of the City Manager shall determine any other level
of service provided within the City.
D. The County shall use County Code Section 16.0213A(b)-specifying fees, for the animal control
program. All revenues collected from City residents shall be retained by the.County to offset costs
associated with the veterinary care and management of injured animals and special enforcement
and investigatory actions mandated by State Penal Code 597. - - -
E. The County will indemnify and hold harmless the County-and its authorized officers, employees,
agents and volunteers from any and all claims, actions losses, damages, and/or liability arising out
of this contract from any cause whatsoever, including the errors or omissions of any person and for
any costs or expenses incurred by the City on account of any claim therefore, except where such
indemnification is prohibited by law.
F. All work performed by County shall be performed in County offices or at such locations as
designated by the County Health Officer.
III. FISCAL PROVISIONS
A.- City shall compensate County the sum of $35,800, plus other amounts asi provided for during FY
2001-2002 for services provided in this agreement. Licensing revenue will be deducted from the
total annual amount. Such compensation shall constitute full payment, including reimbursement for
supervision, clerical assistance, and other overhead costs. City shall be billed quarterly and
provided a monthly report consisting of the number and types of calls received. It is understood
that the determination of compensation is based upon recorded data provided and that revisions
may be warranted upon.City-and/or County review.

B. The annual submission of the County invoice (Attachment "B") shall be for the flat rate of $35,800
less licensing revenue.
C. County is not liable for the payment of any taxes, other.than applicable sales or use tax, resulting
from this Contract, however designated, levied or imposed, unless County would otherwise be
liable for the payment of such taxes in the course of its normal business operations.
IV. CORRECTION OF PERFORMANCE DEFICIENCIES
A. Failure by City to comply with any of the provisions, covenants, requirements or conditions of this
Contract shall be a material breach of this Contract.
B. In the event of a non-cured breach, County may, at its sole discretion and in addition to immediate
termination and any other remedies available at law, in equity, or otherwise specified in this Contract:
1. Afford City thereafter a time period within which to cure the breach, which period shall be
established at sole discretion of County; and/or
2. Terminate this Contract.
V. TERM
This Contract is effective as of July 1, 2001 and expires June 30, 2002, but shall automatically be renewed on
an annual basis thereafter unless terminated or amended.
VI. EARLY TERMINATION
A. The County may terminate the Contract immediately under the provisions of Article IV of the Contract.
In addition, the Contract may be terminated without cause by the County or the City by serving a
written notice thirty (30) days in advance of termination. The Public Health Programs Administrator
is authorized to exercise the County's rights with respect to any termination of this Contract.
VII. GENERAL PROVISIONS
A. When notices are required to be given pursuant to this Contract, the notices shall be in writing and
mailed to the following respective addresses listed below.

B. Nothing contained in this Contract shall be construed as creating a joint venture, partnership or
employment arrangement between the Parties hereto, nor shall either Party have the right, power or
authority to create an obligation or duty, expressed or implied, on behalf of the Party hereto.
C. Any alterations, variations, modifications, or waivers of provisions of the Contract, unless
specifically allowed in the Contract, shall be valid only when they have,been reduced to writing, duly
signed and approved by the Authorized Representatives of both parties as an amendment to this

Contract. No oral understanding or agreement not incorporated herein,shall be binding on any of
the Parties hereto.
D. If any provision of the Contract is held by a court of competent jurisdiction to be .unenforceable or
contrary to law, it shall be modified where practicable to the extent necessary so as to be enforceable
(giving effect to the intention of the Parties) and the remaining provisions of the Contract shall not be
affected.
E. This Contract shall be governed by and construed in all aspects in accordance with the laws of the
State of California without regard to principles of conflicts of laws. The Parties agree to the exclusive
jurisdiction of the federal court located in the County of Riverside and state courts located in the
County of San Bernardino, for any and all disputes arising under this,Contract, to the exclusion of all
other federal and state courts.
F. City agrees to provide or has already provided information on former County of San Bernardino
administrative officials (as defined below) who are employed by or represent City. The information
provided includes a list of former county administrative officials who terminated county.employment
within the last five years and who are now officers, principals, partners, associates or members of
the City. The information also includes the 'employment with or representation of City. For
purposes of this provision, "county administrative official" is defined,as a member of the Board of
Supervisors or such officer's staff, County Administrative Officer or 'member of such officer's staff,
county department or group head, assistant department or group head, or any employee in the
Exempt Group, Management Unit or Safety Management Unit. I If during the course of the
administration of this Agreement, the County determines that the City, has made a material
misstatement or misrepresentation or that materially inaccurate information has been provided to
'the City, this Contract may be immediately terminated. If this Contract is terminated according to
this provision, the County is entitled to pursue any available legal remedies.
Vill. CONCLUSION
A. This-Contract, consisting of seven pages is the full and complete document describing services to
be rendered by the County for the City including all covenants, conditions and benefits.
B. The signatures of the Parties affixed to this Contract affirm that they are duly authorized to commit
and bind their respective institutions to the terms and conditions set forth in this document.

applications for new memberships.
NEW BUSINESS There was information submitted by Tanya Cahill as to the new routing of the
,parade for Grand'Terrace Days and the planning being made.
The Committee was advised of no new information on the one-year planning for
the upcoming fiscal year but it was assumed that the Council will continue to
fund"the Committee.
Lewis Neeb reported that 260 hours of patrol duty had been completed by the
Citizen'Patrol during the month of April.
There being no further business to discuss the meeting was adjourned at 1915 hours.

The City has been experiencing over the past few years, a consistent increase in the number of
lots and vacant properties where vehicles are being parked for sale by private persc• S. In most
cases, the parking on the lot is without the permission of the property owners. The tuation
has created both visual and safety nuisances around the City. The City Code Enforcement
Division is constantly receiving complaints from residents who are concerned about the
blighting of many of our main thoroughfares, which become mini-used care lots.
Examples of-locations where vehicles have consistently displayed vehicles include Barton
Rd./Preston St., Mt. Vernon/Grand Terrace Rd., Barton/Mt. Vernon and City Center Ct/Mt.
Vernon.
DISCUSSION:
The proposed Ordinance would prohibit the sale of motor vehicles by non-propert, owners on
properties which are either vacant and/or unimproved properties. Under the p� t I code
section,' persons would be prohibited from displaying vehicles for sale on pror not zoned
for that purpose.
Violators would be subject to a citation of$25.

FUTURE PROCEEDINGS
Be advised that it is necessary, each year, to update the Engineer's "Report" and approve
said "Report" for the ensuing,fiscal year. We should all probably mark our calendars for some
time after the first of the year to begin the process.
CHANGES AND MODIFICATIONS AT HEARING
During the course of the Public Hearing, or upon the conclusion of said hearing, the
legislative body may order changes in the improvements, the boundaries of the District, or any
zones thereof. The legislative body may, without further notice, order the exclusion of territory
from the.District, but no property-shall be added to said District except upon the following terms
and conditions:
a. Upon written request by a property owner for the inclusion of his property;
b. Upon the legislative body declaring its intention to add additional property and
directing that mailed notice be given to the property owners within the area
proposed-to be annexed.
I would recommend that if any changes are to be considered, the matter be continued so
that the proper documentation can be drafted.

WHEREAS, the City Council has initiated proceedings for Ithe� annual levy of the
assessments for a landscaping and 'street lighting district pursuant to thel terms and provisions of
the Landscaping and Street Lighting Act of 1972", being Part 2 of Division 15 of-the Streets and
Highways Code of the State of California, in a district known and designated as

WHEREAS, the City Council has ordered the preparation of a report and the City
Engineer has prepared and filed with this City Council a report pursuant to law for its
consideration and subsequently thereto this City Council did adopt its Resolution of Intention to
le and collect assessments for ,the next ensuing fiscal year relating to the above-referenced
Di tric , and further did proceed to give notice of the time and place for a Public Hearing on all '
matter relating thereto; and,
WHEREAS, at this time,!this City Council-has heard all testimony and evidence and is
desirous s of proceeding with the annual levy of assessments. 4

NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF GRAND TERRACE, CALIFORNIA AS FOLLOWS:
SECTION 1. That the above-recitals are all true and correct.

SECTION 4. That the diagram and assessment as set forth and contained in said Report
are hereby confirmed and adopted by this City Council.

SECTION 5. That the adoption of this Resolution constitutes the levy of the assessment
for the fiscal year.
r SECTION 6. That the estimates of,costs, the assessment diagram, the assessments and
all other matters, as set forth in Engineer's "Report", pursuant to said "Landscaping and Street
Lighting Act of 1972", as submitted, are hereby approved, adopted by this City Council and
hereby confirmed.
�._ SECTION 7. That the maintenance works of improvements contemplated by the
Resolution of Intention shall be performed pursuant to law and the County Auditor shall enter on
the County Assessment Roll the amount .of the Assessment and said assessment shall then be
collected at the same time and in the same manner as the County taxes are collected. After
collection by said County, the net amount of the assessment shall be paid to the City Treasurer
of said City.
SECTION 8. That the City Treasurer has previously established a special fund known as
the
SPECIAL FUND
CITY_ OF GRAND TERRACE
LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1
into which the City Treasurer shall place all monies collected by the Tax Collector pursuant to the
provisions of this Resolution and law and including any surplus amounts in those funds established
for the existing Districts and said transfer shall be made and accomplished as soon as said monies
have been made available to said City Treasurer.
SECTION 9. That the City Clerk is hereby ordered and directed to file a certified copy
of the diagram and assessment roll with the County Auditor, together with a certified copy of this
Resolution upon its adoption.
SECTION 10. That a certified copy of the assessment and diagram shall be filed in the
office of the City Engineer, with a duplicate copy on file in the Office of the City Clerk and open
for public inspection.
