A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council

The meeting was opened with invocation by Councilman Herman Hilkey, followed by the Pledge
of Allegiance led by Mayor Pro Tern Lee Ann Garcia.
SPECIAL PRESENTATIONS
2A. School District Presentation- Colton High School
Dennis Byas, Superintendent Colton Joint Unified School District,.introduced the staff and
students that were in attendance.
Dr.Pat Gopperton,Assistant Superintendent of Curriculum and Instruction,reported that the
high school exit exam results and the API scores are not where they expect them to be and
in their opinion are not indicative of what the students are capable of doing. They are
addressing the issue and have begun implementing their plan.
Jerry Alm-endarez,Principal,Colton High School,thanked the parents of the students for all
of their support. He gave a presentation on the programs that they have created and
implemented at Colton High School for their teachers.
Diana Carreon, Assistant Principal, Colton High School, reported that they have begun

providing as much information as possible for Senior Students and their families in an effort
to keep parents informed on costs and procedures.
Kent Taylor, Head Counselor Colton High School, gave a presentation on the application
process for college admission and the programs that are offered through the School District.
Sharon Halter-pay, Counselor Colton High School, gave a presentation on the Senior
Portfolio which is a requirement,which includes their accomplishments throughout their life.
She gave an overview of SAT preparation,scholarship opportunities and PSAT testing at the
11 1h grade level. She also gave an overview on the National Honor Society and the programs
that they participate in.
Ken Clark, Counselor Colton High School, gave an overview on financial aid available,
transcript service. He indicated that Colton High School has a website that will have a lot
of information available for parents and students.
Eileen Pottertori, AVID Coordinator, acknowledged the students that participate in the
program and gave an overview of the program.

Bill Webb, Chairman of the Math Department at Colton High School, gave an overview of
their curriculum.
Harmony McMelon, Senior Colton High School gave an overview on the Academic
Competition Program.

Bob DeGroff, Academic Decathlon Advisor, indicated that Colton High School has one of
the most successful Academic Decathlon Programs in the County of San Bernardino. He
indicated that he is proud to be associated with the Colton Joint Unified School District.. j
Eileen Potterton, gave an overview on the DECA program.
Erin Rendelmari, Pep Commissioner of ASB, gave an overview of the improvements that
have been taking place as part of campus beautification.
Sandra Pearson, ASB Vice-President, talked about the Pride of the.City of Colton and the
High School.

Alan Conrad, ASB-President, talked about the special bonds with students, administration
and staff at Colton High School.
Bob Mitchell, Site Council Chairperson for Colton High School, expressed his satisfaction
with the willingness for staff and administration listening and working with the parents and

commended Colton High School for the excellence that they are accomplishing and is proud
to be a parent of a student that is currently attending Colton High School.

Dick Rollins, 22797 Barton Road indicated that the Crime Prevention Committee has
discussed at length the.problem with 18 wheelers parking on Newport Avenue in the evening
causing a traffic hazard.
It-was the consensus of the Council,to direct staff-to investigate the parking,on Newport
Avenue.

Mayor Pro Tern Garcia,reminded everyone to have a safe Halloween. The Library will be
holding the pre-school Halloween party.

Councilmember Hilkev, reported that SANBAG staff recommended a 104 million'dollar
allocation for the 215 South Freeway through Grand Terrace and CALTrans recently came
up with a billing that took approximately 50 million of that money. iHe indicated that they are looking for a commitment from SANBAG and the members to do the environmental,to
design the freeway and to do the right-of-way in order to complete the San-Bernardino side
of the freeway. Riverside County will be asked to do the same. They are also encouraging
SANBAG Staff tIo look at mitigation. He expressed his concern with the impact on Grand
Terrace due to an increased traffic amount over the next fifteen yea�s.
Councilmember Larkin,he requested that staff look into the no parking on the overlook at
Mt.Vernon and Grand Terrace,Road.,He reported that Sunbridge hosted a Law Enforcement
Officers and Firefighters appreciation get-together. He reported that the Lions will be doing
the white cane day at Stater Brothers on Friday,Saturday and Sunday. He invited everyone
to attend the Halloween Haunt on October 31,2001 at Pico Park from.5:00 p.m.to 8:3'0 p.m.

Councilmember Ferre, also reminded everyone about the Halloween Haunt and that it was
a great event for the Community. He commended Sunbridge on their appreciation get-
together as well as the firefighters and law enforcement officers.for the job that they do.

Mayor Buchanan,indicated that Sunbridge is a model of how a business in a community can

seize the opportunity to become active. He requested that Assistant Cty Manager Berry give
an update on thgvideo project that he is working on.

Enterprise on Friday about the commemorative video project. He indicated that several civic
leaders and members of the community will be reading the names of those who lost their
lives and are sill missing as a result of the September 11,2001 tragedy. He reported that the
video will be aired on November I Vh beginning at 5:48 a.m.

BACKGROUN'D:
The Grand Terrace Redevelopment Agency has invested in the California Asset Management
Program(CAMP) since 1997. CAMP is very similar to the State Treasurer's Local Agency
Investment Fund (LAIF) in terms of liquidity and yield. To give us more flexibility in our
investments, we should also have the option to invest City funds in CAMP. To do so we need a
separate resolution for the City.
DISCUSSION:
CAMP was established in 1989 as a Joint Powers Authority to,provide to local California
governments with investment management services for the proceeds of debt issues and related
administrative services to ensure compliance with all arbitrage rebate regulations of the Treasury
Department. In 1997, at the request of participants, CAMP began managing general funds for
California public entities as well. CAMP currently has $680 million in public agency assets
under management.
RECOMMENDATION: _. -
To approve resolution authorizing the City of Grand Terrace to join with other public agencies as
a participant of the California Asset Management Program (CAMP).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, ICALIFORNIA, AUTHORIZING THE "PUBLIC AGENCY"
TO JOIN WITH OTHER PUBLIC AGENCIES AS A PARTICIPANT OF
THE CALIFORNIA ASSET MANAGEMENT TRUST AND TO INVEST
IN SHARES�OF THE TRUST AND IN INDIVIDUAL PORTFOLIOS.
WHEREAS„Section 6502 of Title 1, Division 7, Chapter 5 of the Government
Code of the Sate of California (the "Joint Exercise of Powers Act") provides that, if
authorized by their legislative or other governing bodies, two or more public agencies by
agreement may jointly exercise any power common to the contracting parties; and

WHEREAS, under Section 6500 of the Joint Exercise of Powers Act, a "public
agency" include but'is not limited to any California county, county board of education,
county superintendent of schools, city, city and county,public corporation, public district,
regional transportation commission or state department or agency; and

WHEREAS; public agencies which constitute local agencies, as that term is
defined in Section 53630 of Title 5, Division 2, Part 1, Chapter 4; Article 2 of the
Government Code of the State of California (the "California Government Code") are
authorized pursuant to Section 53601 and/or 53635 thereof to invest all money belonging
to, or in the custody of, the local agency in certain specified investments; and
WHEREAS; the California Asset Management Trust (the "Trust") was
established, pursuant to and in accordance with the Joint Exercise of Powers Act, by a
Declaration of Trust, made as of December 15, 1989 and as subsequently amended (the
"Declaration of Trust"), as a vehicle for public agencies to jointly exercise their common
power to invest bond proceeds and other funds; and
WHEREAS,' pursuant to and in accordance with the Joint Exercise of Power Act,
the Public Agency' desires to join the other public agencies which are or will be
Participants of the !Trust by adopting and executing the Declaration of Trust, a form
which has been presented to this meeting; and
WHEREAS, the Public Agency is a public agency as that term is defined in the
Joint Exercise of Powers Act and a local agency as that term is defined in Section 53630 j
of The California G'overmnent Code; and
WHEREAS, the Public Agency is otherwise permitted to be 'a participant of the
Trust and to invest',funds in the Trust and in the Individual Portfolios to be managed by
the Investment Adviser to the,Trust("Individual Portfolios"); and

describing the Trust and the Individual Portfolios (the Information Statement");

NOW, THEREFORE, THE CITY COUNCIL of the. City of Grand
Terrace does hereby resolve the following:
SECTION 1. The Public Agency shall join with other public agencies pursuant
to and in accordance with the Joint Exercise of Powers Act by executing the Declaration
Lf of Trust and thereby becoming a Participant in the Trust, which Declaration of Trust is
hereby approved and adopted. A copy of the Declaration of Trust shall be filed with the
minutes of the meeting at which this Resolution was adopted. The Mayor of the City of
Grand Terrace is hereby authorized to execute, and the City Clerk is hereby authorized to
attest and deliver, the Declaration of Trust, in substantially the form presented at this
meeting.
SECTION 2. The Public Agency is{hereby authorized to purchase"shares in the
Trust from time to time with available funds of the Public Agency, and to redeem some
or all of those shares from time to time as such funds are needed.
SECTION 3. The Public Agency is hereby authorized to invest available funds
time in one or more Individual Portfolios managed by
of the Public Agency from time to
the Investment Adviser to the trust and described in the Information Statement.
SECTION 4. The appropriate officers, agents and employees of the Public
Agency are hereby authorized and directed in the name and on behalf'of the Public
Agency to take all actions and to make and execute any and all certificates, requisitions,
agreements, notices, consents, warrants and other documents,which they, or any of them,
might. deem necessary or appropriate in order to accomplish the purpose of this
Resolution.
SECTION 5. This Resolution shall take effect upon adoption.

22795 Barton Road In February of 2001 it was brought to the attention of the Assistant City Manager by
Suite B the Riverside Highland Water Company that a failure in the storm drain on Palm
Grand Terrace Avenue had occurred. The lower end of this drainage course has been filled with mud
California 92313-5295 from above causing a blockage in the pipe crossing Westwood Street. the city forces
Civic Center, have excavated the existing drainage structure exposing the blockage of the pipe.

The city is now faced with the reconstruction of the failed storm drain which left
unrepaired could cause an undermining on Palm Avenue.
At the council meeting of August 23, 2001 the council appropriated$35,000.00 to
repair the storm drain below Palm Avenue.
The Department of Public Works has prepared bid documents and specifications for
the reconstruction of the storm drain with a bid opening date of November 6,2001.
Due to council meeting scheduling the Public Works Department will review the bids
and make recommendations to the council at the November 8, 2001.

SUBJECT: Public Hearing to divide a vacant 2.5 acre site under Tentative Parcel
Map No.01-02(TPM 15780)into two separate parcels of 1.1 acres and
1.4 acres located at the end of Palm Avenue(immediately south and
west of the end of Palm)in the City of Grand Terrace.
RECOMMENDATION: Open the Public Hearing,receive testimony,close the public hearing
and approve the Resolution calling for the approval of Tentative Parcel
Map No. 01-02 (TPM No. 15780)
Background:
The applicant,on behalf of the owner,is requesting approval of the proposed tentative parcel map to divide
Jthe subject site-into two parcels,a westerly parcel of 1.1 acres and an easterly parcel of 1.4 acres. Exhibit
1,the"blue-line"tentative parcel map,shows the proposed lot division dividing the 2.5 acre site into the two
parcels. Each new parcel will exceed the minimum required area of the underlying R1-20 Zone,which is
20,000 square feet,by 240% for the westerly parcel and 305% for the easterly Tarcel. The.site is a vacant
parcel located at the end of Palm(immediately south and west of Palm) in Grand Terrace. There is a small
"locality map"on Exhibit 1 that shows the location of the subject site.
The proposed parcels will meet all of the development standards of the underlying zone with the exception
of the westerly parcel which,will not meet the minimum street frontage requirement of 50 feet. It will have
no frontage on a dedicated street; however, adequate access to the public street will be provided by means
of a private drive from the end of Palm. It should be noted that this private drive presently provides access
to three existing residences to the immediate north of the subject site and also to a Riverside Highland Water
District tank site. (Please refer to the aerial phot,Exhibit 7) The Planning Commission on October 18,2001
tentatively approved the variance request to modify this standard contingent on the Council's approval of
the requested parcel map.
In addition, the applicant has requested authority to construct a two story,2,406 square foot home on the
westerly parcel under SA-01-09; no construction is proposed at this time for the easterly parcel. The.;
applicant is proposing to purchase the westerly parcel from the current owner, if the tentative parcel map is
approved;the owner will retain ownership of the easterly parcel. The site plan marked Exhibit 2 shows the
location of the proposed residence on the westerly parcel, The location of the proposed structure will meet
all of the setback requirements of the R 1-20 zone with the exception of the rear yard where the code requires
that the distance to the edge of pad be at least 25 feet. The second story of the proposed house,which will
project over the fast floor patio area,will be within 14 feet-of the edge of pad. The Planning Commission
on October 18,2001 tentatively approved this modification,also contingent on the Council's approval of the

requested parcel map.
The site plan,floor plans,proposed elevations and preliminary landscaping plans for the proposed residence
are shown on Exhibits 2 through 6. The proposed residence will be a Spanish mediterranean style house with
a red the roof with additional design features to make it an asset to the neighborhood. The Planning
Commission on October 10 tentative approved the Site and Architectural Review,SA-01-09,contingent on
the Council's approval of the tentative parcel map.

The Planning Commission,�and Staff believe that this is a reasonable proposal. The proposed parcel will be
similar in size and shape to the existing parcels to the immediate north and west. Exhibit 7, the aerial
photograph, includes information on the size of those adjacent, existing parcels. The variance for the
modification of the 50 foot street frontage for the westerly parcel is appropriate. The purpose of this standard
is to insure that each parcel will have adequate access to a public street. This will be accomplished in this '
case by requiring, as a condition of approval, that the applicant provide proof of-access rights from Palm
Avenue. Therefore, eachjparcel will have access to a public street and meet the spirit of this standard.
Without this modification of the street frontage requirement,it would be impossible'to divide the subject site,
and the property owner would not be able to enjoy the same rights and privileges of other property owners
in the area by not being able to create parcels similar in size to others in the immediate area.
The future home will meet all of the City's development standards with the exception that the rear slope on
the westerly parcel will b'e closer than the required 25 from the rear of the house. The purpose of this
requirement in the code is that there be an adequate amount of usable, level area for each residence in a
hillside area. The site plan(Exhibit 2)or the preliminary landscaping plan(Exhibit 6)shows that there will
be large, level and usable open pad areas to the north and south of the proposed home. The proposed
residence will be a an asset to the City of Grand Terrace. The proposed Spanish:mediterranean style will ;
complement the existing residential development in the Honey Hills area. The applicant and his designer
are taking care to build a home that will fit into this existing, upscale neighborhood.
Recommendation:
The staff recommends that the City Council open the public hearing, receive testimony, close the public
hearing and approve the Resolution(Attachment 1)calling for the approval of TPM-01-02(Tentative Parcel
Map No. 15780).

WHEREAS,the Planning Commission recommended approval of TPM-01-02 to the,City Council
and approved Site and Architectural Review No.01-09 and Variance No.01-06 contingent on the Council's
approval of the tentative parcel map; and
WHEREAS,a properly noticed public hearing was held by the City Council on

NOW THEREFORE, 11CHE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY RESOLVE AS FOLLOWS:
1. That the site is physically suitable for R1-20(Single Family Residential District-minimum
required,area 20,000 square feet)development. {�
2. That the design of the subdivision and the proposed improvements are not likely to cause
substantial environmental damage.
3. That the design of the subdivision or type of improvements are not likely to cause serious
public health problems or cause a threat to life and property.
4. That the proposed subdivision,together with the provisions for itsJ design and improvements
are consistent with the'General Plan.
5. That the accompanying variance to modify the requirement for 50�foot of street frontage will 1
not result in any aesthetic impacts to the neighborhood and the!westerly parcel,requiring
this modification,.will have adequate access to a public street as a condition of approval.
6. That the proposed subdivision, its design, density and type of development and
improvements conform to the conditions imposed by the regulations of the Ci tys�
Development Code and the regulations of the City of Grand Tei ace.

BE IT FURTHER RESOLVED THAT TPM-01-02 is hereby approved subject to the following
conditions:
Conditions Prior to Final Parcel Map Approval:
1. Upon approval of these conditions and prior to becoming final and binding, the
applicant must agree to and sign the "Acceptance of Conditions" letter. The letter
form and content to be prepared by the Community and Economic Development
Department.
2. Provide a"will serve" letter from the Riverside Highland Water Company.
3. The development shall conform to all requirements of the Grand Terrace Municipal
Code and the State of California Subdivision Map Act.
4. Provide that all utilities shall be rununderground or bond for same as required by the
Director of Building and Safety/public Works in his memorandum dated September
12, 2001.
5. Comply with Condition F2PC of the County Fire Department in their letter dated
June 20, 2001 regarding fire flow in the letter dated September 25,2001.
6. The final map shall-be properly prepared by a licensed land surveyor or registered
civil engineer authorized to practice land surveying and based on a field survey.
7. The applicant shall provide proof of access rights from Palm Avenue direct to Parcels
1 and 2. The proof of access rights shall be in the form of an access easement,a title
"Guarantee of Ingress and Egress" or any other method available to prove legal
access.
8. The City Engineer of the City of Grand Terrace shall receive all required clearances,
tax clearances and certificates before forwarding the final parcel map to the City
Council for approval
9. The applicant or developer shall- submit a "Geotechnical and Geology" study to
recommend the work necessary to stabilize the existing building pads. Said study
shall address any,!building setbacks required to protect from rock fall hazard,
especially from the vertical rock faces above Parcel-1.
10. The San Bernardino County Fire Department shall determine the required width for
the driveway serving Parcels 1,and 2.
11. The private street/drive,from Palm to the northerly boundary of Parcel 1,serving the
two proposed lots shall be improved at a minimum to the standards for hillside,
private streets as adopted by San Bernardino County. If improvements are required,

the street✓driveway shall be improved as required prior to the final parcel map
approval or bonds shall be posted with the City to ensure that the improvements will ;
be completed.
12. The City Engineer of the City of Grand Terrace shall approve a' detailed drainage plan
that addresses the increase and change of delivery for drainage.. Notarized letters of
acceptance shall identify the parcel accepting the runoff by legal description,the date
of the plan reviewed by the adjoining property owner and that they accept the
propose drainage improvements.
13. If improvements are required for water service and fire flow;the water lines shall be
extended to serve the properties, as required by the Riverside Highland Water
Company and the County Fire Department or bonds shall be posted with the City to
ensure that the improvements will be completed and shall be constructed to the
standards of the Uniform Plumbing Code.
Conditions Prior to Grading:

14. Provide grading and drainage plans memorandum from the City's Building and
Safety/Public Works Department). j

15. The grad ing plan shall conform to the requirements of the Uniform Building Code.
15. A detailed grading plan shall be prepared for the development of Parcel 1 addressing
the rock fall hazard posed by the near vertical rock faces north of the proposed home,
the rock projecting from the pad and its impact on the home and the corrective
grading that is necessary to create a safe building site.
16. The grading plan for Parcel 1 shall detail the proposed drainage pattern and any
improvements proposed to carry the drainage from the pad to the adjoining property.
Once the drainage plan is detailed the affected neighbor or neighbors shall review the
plan and accept the drainage as noted under the parcel map.
17. If the proposed grading occurs in an area off-site to the south, permission from the
adjoining neighbor or neighbors will be required in written form which shall be j
submitted to the City,and said written permission shall be recorded with the County's
Recorder's Office prior to the issuance of a grading permit. '
18. The laid subdivider,shall accept and properly dispose of all on and off site drainage
flowing onto or through the site.
Conditions at the Time of Development of the Parcels:
19. The proposed project of a single family residence shall be constructed in accordance;
with the Site and Architectural Review Board's approval on October 18,2001,minor!

changes and/or clarification may be made by the Community and Economic
Development Director. The design,materials and colors shall match those-approved
by the Site and Architectural Review Board.
20. Any roof-top mechanical equipment shall be located at a distance from the edge of
the building or shielded by means of a lattice or similar material or parapet so as not
to be visible from pedestrian level, adjacent roads or adjacent properties.
21. The applicant or developer install sewer laterals to connect both parcels to the public
sewer to the standards of the Uniform Plumbing Code and to the satisfaction of the
Director of Building and Safety/Public Works.
22. ,Comply with all requirements of Director of Building and Safety/Public Works in his
memorandum dated September 12, 2001.
23. Full compliance with the recommendations of the County of San Bernardino Fire
Department - Community Safety Division-in-the letter dated September 25, 2001.
24. Payment of applicable school fees to the Colton Unified School District with
submittal of the proof of said payment to the City of Grand_Terrace prior to the
issuance of building permits.
25. Prior to the issuance of building permits, submit a work plan to the Community and
Economic Development Department with the hours of construction and measures to
minimize any impacts resulting from noise, dust or construction traffic.
26. All construction debris shall be collected and placed in appropriate containers on a
daily basis and the construction site shall be maintained in a neat and orderly manner.
27. Comply with the requirements of the Riverside Highland Water Company set out in
the letter from that agency dated September 7, 2001.
28. All plans shall be designed and improvements performed by person registered and
licensed to perform such work pursuant to the State-of California Business and
Professions Code,which shall comply with the requirements of the Americans with
Disabilities Act, 1997 U.B.C. and the Grand Terrace Municipal Code.
29. Comply with -all recommendations listed in the County of San Bernardino Fire
Department's letter dated June 20,2001.
30. Pay all required fees, obtain all permits, inspections and,approval on all work to be
done. .
31. Three copies of a 'landscaping and irrigation plan shall be submitted to the
Community and Economic Development _Department prior to the issuance of

building permits. All ,manufactured slopes shall be appropriately planted to the
satisfaction of the City. Said landscaping to be installed in the front yard area prior
to issuance of occupancy for the proposed residence.

2. The location and configuration of the proposed single family residence is visually

scenic views from other residences and/or public areas and the project is in scale
with the townscape and natural landscape of the area.
3. The architectural design of proposed residence, its materials and colors,with a
Spanish Mediterranean motif, is visually harmonious with surrounding
development, natural landforms, is functional for the proposed project and is
consistent with the Grand Terrace Municipal Code.
4. The plan for landscaping and open spaces'as shown on the preliminary
landscaping plan for the residence provides a functional and visually pleasing
setting for the proposed residence on this site and is harmonious with the natural
landscape of the'area and nearby developments.

vegetation or the excessive and unsightly grading of hillsides as proposed for this
project; thus the natural beauty of the City, its setting and natural landforms, are

6. Conditions of approval for this residential project necessary!to secure the purposes
of the Grand Terrace Municipal code and General Plan are made a part of this
approval.
7. A special circumstance regarding the size, shape, topography, location or
surroundings of the subject property exists. The size and shape of the subject site
is such that the only way to divide the parcel so as to develop the property with
parcels consistent with the neighborhood pattern is to modify the 50 foot required-
street frontage. In addition, the size and shape of the existing pad is such that it is
difficult to locate the proposed house on the,pad without modifying the required
distance to the existing rear slope or edge of'pad.

8. Because of the special circumstance,the strict application of the zoning ordinance i
deprives the subject property of privileges enjoyed by other!property in the
vicinity and under identical zoning classification. The majority of lots in the
immediate vicinity to the north and west are one acre or slightly more. Without
the variance to modify'the street frontage requirement for the westerly parcel,the,
applicant would not be able to create the two new lots which are consistent with
the lot attern in the nei borhood. In addition,the topography of the site makes
it diffi ult to grade a pad that would allow a proposed residence to-meet the
requirement to the distance to the edge of pad and the rear slope.
3. The granting of the variance will not constitute the grant of special privileges
inconsistent with.the limitations upon other properties in the vicinity and district
in which the property is situated. Even with the modification of the street frontage
requirement for the westerly parcel,both parcels will still have access to a public
street. In addition,the usable, level yard area as proposed will more than meet the
recreational and open space needs of future residents of the proposed residence
which is the intent of requiring a minimum distance to slopes on the site.
4. The gran ting of this variance will not authorized a use or activity which is not
otherwise expressly authorized by the district governing the parcel of property.
The proposed uses for both parcels will be single family residential which is
compatible with the surrounding area which is also single family residential.
5. The granting of the variance will not result in a situation i i consistent with the ,
adopted1 General Plan of the City of Grand Terrace.
6. That conditions necessary to secure the above findings arei made a part of the 1
approval of the variance.
BE IT FURTHER RESOLVED that SA-01-09, V-01-05 and E=01-05-are hereby,
approved subject to the following conditions _
1. The proposed project shall be maintained in substantial conformance with the
plans and drawings submitted,to,the Community and Economic Development
Department and approved by the Planning Commission as Exhibit Ithrough
Exhibit 6 except as modified herein. All plans shall be consistent in°terms of
property lines and other measurements. Minor changes or clarifications may be
made by the Community and Economic Development-Director.
2. All of the Conditions of Tentative Parcel-Map No. 01-02,shall apply.
3. This approval for SA-01-09 and V;01-05 shall not become effective unless and/or

As requested I have reviewed the proposed tentative Parcel Map and the
proposed building plans for issues that must be addressed in.the conditions of
approval. There is no objection to the approval of.the tentative map and the
proposed building as long as the following conditions are included in-the project
approval.
For Tentative Parcel Map 01-02
1. A final Parcel Map shall be prepared by a Registered Civil Engineer or
Licensed Land Surveyor-and presented to the City for review as required
by State Law. The final map may be compiled from record data, if
sufficient record information exists, or may be based on a field survey.
The Engineer or Surveyor shall submit copies of all record documents,
centerline tie notes, Deeds, Title Reports and maps used to establish the
property boundary.
2. When the final parcel map is submitted for checking the,applicant shall
provide proof of access rights from Palm Avenue direct to both Parcels 1
and 2. The proof of access rights shall be in the form of an access
easement, a title Guarantee of Ingress and egress or any other method
available to prove legal access,
3. The.City Engineer shall receive all required clearances, tax clearances
and Certificates before forwarding the final parcel map to the local agency
for,approval.
4. The tentative approval is recommended based on the connection of these
two parcels to the existing Sanitary Sewers that front parcels. Contact
the City of Colton for connection requirements.

5. The tentative approval is recommended based on the requirement that a
Geotechnical and Geology Study be conducted to recommend the work
necessary to stabilize the existing building pads. The applicant shall file
reports with the City of Grand Terrace for review by the'public. Due to the

Engineer shall address any setback required to protect from rock fall
hazard.
6. Phor to the approval of the final map, the City Engineer;shall approve a

I have reviewed the CHJ Report Dated August 23, 2001 to determine if it will suffice for satisfying condition 5 of my
memo dated September 10, 2001. The report addresses all issues necessary to confirm that the property
contains safe stable building sites for two-homes. The exhibit at the rear of the document appe�rs to show three
building sites, however the report reflects the final proposal of two building sites. The report do s mention loose
fill and does not specify any corrective work to stabilize this material. The homes will be built independent of this
fill material so there will not be a negative affect on the proposed buildings. The assumption is that the area to the
south of this fill is"open space"thus there will be no damage if this material does slide at some future date. As
long as the area downhill from this fill will never be improved this assumption is reasonable.

The location of the property 'is at the end of the Palm Avenue cul-de-sac. This project site is
Iodated in the R-120 zoning district, which is single-family residential with a minimum required
area of 20,000 square feet. Properties to the immediate north of the subject site are also
zoned R-120. The area to the south and southeast of the subject site is zoned RH, which is
hillside residential.
The Grand Terrace General Plan designates the subject property as well as the surrounding
properties to the northwest and east of the subject site is low density residential, with a
density range of 1 to 5 units per acres. The properties to the south and southeast are hillside
low density residential. The proposed request is consistent with the General Plan.
The westerly parcel of the proposed two new parcels will consist of 1.1 acres in size and the
easterly parcel will be 1.4 acres in size. Both parcels will more than exceed the minimum
required area for the underlying R-120 zone, with parcel 1 (the westerly parcel) equaling
240% of the minimum. Parcel two (the easterly parcel) is 304% of the minimum. Access to
the parcels will be provided by the existing private streets off of Palm Avenue. This_private
drive also provides access to three other residences to the immediate-north of the subject
site together with the Riverside Highland Water Tank, which is visible from City Hall.
These proposed parcels will meet all .of the development standards.for the underlying R-120
zone with the exception of the westerly parcel, (parcel 1) which, will not meet the minimum
street frontage requirement. The zone does,require a 50-foot frontage on a dedicated street.
The easterly parcel does meet this requirement.
The tentative parcel map illustrates the preliminary,grading plan for both parcels. As noted
before, the pads were created a number of years ago. The westerly parcel where the new
home is proposed will be modified to some extent, but not to a great deal. The pad on the
easterly parcel will not be modified in the preliminary grading plan. ,
A geotechnical report was submitted by the Applicant was reviewed by the City Engineer,
who concluded that the site does contain safe, stable building sites. Drainage for both pads
will be to the south off of the subject site, the adjacent parcel to the immediate south. A letter
is on file from the property owner in his willingness to accept drainage from this project.
Prior to issuance of building permits to construct any residential,structures on'this property, a
formal grading plan will have to be:submitted, so that the city could formally review and
approved prior to the issuance of building permits.

The applicant has also filed a request for a site and architectural review case. The applicant!
is requesting permission to construct a 2,400 square foot two-story Home on the westerly;
parcel. (1.1 acre parcel) The applicant will be purchasing the westerly parcel from the current
owner if the tentative map is approved by the City Council. It is the applicant's intent to build,
the home for the applicant to live in. In addition, the proposed home will meet all of thel
standards of the R-120 zone. The,second story will project over a covered patio will be within
14 feet of the edge. The first and,second story floor plans that was included in the conditions!
packet shows that the residence will have a family, dining room. sitting ,room, one bedroom,;
one full bath, an office, and a workshop on the first floor. A master bath, bedroom, dressing
room, a third bedroom and a covered deck area on the second floor.-
The appearance of the pjroposed residence is a Spanish Mediterranean style home with a red,
the roof. Walls would be stucco with the use of various architectural features to enhance the
appearance of the new home.

Staff believes that this is a reasonable request to divide this property. The proposed new,
parcels will be similar in..size and shape to existing parcels to the i i mediate north of the
subject site. r

Commissioner' Addington asked Associate Planner Lampe when the aerial photo of the
subject site that was presented before the Commission was taken.
Planning Associate Lampe anticipated Commissioner Addington question by answering that
the picture was taken foir years prior. The photograph shows that the!pads were overgrown,
and since that time, the vegetation that was growing in the pads has been cleared.

Commissioner Addington asked if the gradingr was done with a permit from the City,-and was
the grading done in a cut situation or,a filled situation. j
Planning Associate Lampe replied that to his knowledge, there were no permits issued for the
grading that has been Zone to the area, and a geotechnical report that concluded that each
pad represents a build able location, but there is no illustration as to which part was filled and
which part was cut.

-Mr. King reported that he had first looked at the property about 20 years ago with Mr. Sharp,
the current owner. Mr. Sharp was thinking about building on the property over the years, and
had finally made a decision not to. When Mr. King had first visited the property, it was grown
over, but it had been graded. There is very little fill on the property, so it looks to be that it
has been cut. Mr. King feels that the property was graded'around 1969, but there is no proof
to support that speculation.
Commissioner Addington asked Mr. King if the slope showing on the tentative map if the
slope 'was proposed showing on the property' to the south? If so, has there been any
discussion with the property owners.that there are plans to grade on their property? .
Mr. King replied that the slope showing on the south is a proposed slope and also that Mr.
Sigestadt is aware of the grading plans on. his property, and has no objections to'the slope
easements. Mr. Sigestadt has already given a drainage acceptance letter and has been very
,cooperative.
Chair Van Gelder closed the public hearing and brought the items back to-the Commission-
for discussion and action.
Chair Van Gelder discussed the condition on page 6, the conditions prior to final parcel map
approval. Chair Van Gelder asked if there were any conditions that the Commission would
like to discuss.
Commissioner Addington wanted. to add to Condition Number 13, that the water service and
fire flow should be constructed with a Uniform 'Plumbing Code, as well as the Riverside
Highland Water Company and the-County Fire Department.
Chair Van Gelder asked if the Commission had any changes to-the Conditions prior to
grading.
Planning Associate Lampe reported to the Chair that Condition 17 eludes to the question
about the off-site grading.
Commissioner-Addington felt that.-Condition 17 should be written and recorded.
Associate Planner Lampe replied that staff had no objection to the suggestion of

ENVIRONMENTAL REVIEW:
It has been determined by staff that this project for the parcel map qualifies for a Class 15
Categorical Exemption as allowed by the California Environmental Quality Act(CEQA)Guidelines
in that the subject site is located in an urban setting;has had building pads already graded on the site;
and is adequately served or can be served by public utilities and services. ' For the single family
residence,it qualifies for a Class 3 Categorical Exemption as the construction of a limited,small new
facility.
ZONING AND LAND USE: �
The project is located in the RI -20(Single Family Residential Zoning District-minimum required
area of 20,000 square feet). Properties to the north are similarly zoned. Properties to the south and
southeast are zoned RH (Hillside Residential District - minimum required area one acre). The
subject site is vacant as are properties to the south and southeast. Properties to the north,west and
east are developed with single family residential uses. Please see Exhibit 7 which is an aerial
photograph of the subject site and the surrounding area.

The subject site containis fairly steep slopes dropping off both to the west and the east. As noted
above, two pads have already been graded on the site. According to the applicant's engineer, this
grading occurred many years ago. Access to the two pads is provided by the existing private
drive/stre'et serving the three houses on the hill to the immediate north. For a view of the site from
the south showing the two pads and existing private drive/street, please see Exhibit 8.
The Grand Terrace General Plan designates the subject property and surrounding properties to the
north,west and east as Low Density Residential (LDR) which is a residential classification with a
density range of 1 to 5 units per net acre and properties to the south and southeast as Hillside-Low
Density Residential (HI-LDR), which is the same as LDR but with a "Hillside" designation for
development standards.
REQUEST:
The applicant is requesting approval of the proposed tentative parcel map to divide the,subject site
of 2.5 acres into two parcels; the westerly parcel will be 1.1 acres in size; the easterly parcel, 1.4
acres in size. Exhibit 1 (the blue line copy of the tentative parcel map)shows the proposed division.
Both parcels will more than exceed the minimum required area of the R'1-20 zone; the westerly
parcel will equal 240%� of the minimum required area; and the easterly parcel, 304%. ;
Both parcels will be irregularly shaped. The westerly parcel will have an average width of 250 feet
and an average depth of 180 feet; the easterly parcel will have an average width of 340 feet and
maximum depth of 230 feet. Access for both parcels will be provided by an existing private
drive/street off of Palm Avenue. The final width and design of this drive:is subject to review and
approval by.the Fire Department. It should be noted that this private drive presently provides access
to three existing residences to the immediate north of the subject site 'and also to a Riverside
Highland Water District tank site. (Please refer to the aerial photo, Exhibit 7)

The proposed parcels will meet all of the'development standards of the underlying 91-20 zone with
the exception that the proposed westerly parcel will not meet the minimum street frontage
requirement of 50 feet;it will have no frontage on a dedicated-street as shown on the tentative parcel
map,Exhibit 1. The code requires that each lot have a minimum 50 foot frontage on'a public street.
The proposed easterly parcel,however,-will meet this requirement. It should be pointed out that one
of the existing parcels to the immediate north of the subject site also does not meet this requirement,
having a 20 foot street frontage on Palm Avenue.
Also, shown on the proposed tentative map is the preliminary grading plan for both parcels. Both
parcels have existing building pads which were created several years ago, long before this
application as noted above., As shown on the preliminary grading plan, the pad on the westerly
parcel will be modified a limited amount; the pad on the easterly parcel will not be modified. A
geotechnical report for the property was submitted to the City for review; the engineer for the City
reviewing this document concluded that the subject site contains"safe stable building sites for two
homes." (Please see Attachment 3.) Drainage for both pads is shown to be onto the property to the-
immediate south; the applicant has submitted a letter from the adjacent property owner agreeing to
accept drainage from the site. In addition, it should be noted that before construction of any
residential structure can take place on either of these proposed parcels, a grading plan will have to,
be submitted and approved by Building and Safety prior to the issuance of building 'permits for
residential construction.
Under SA-01-09,the applicant is seeking approval from the Commission to construct a two story,
2,406 square foot home on the westerly parcel;-no construction is proposed at this time.for the
easterly parcel. The applicant is proposing to purchase the westerly parcel from the current owner
_- if the tentative parcel map is approved;the owner will retain ownership of the easterly parcel. The
site plan marked Exhibit 2 shows the location of'the proposed residence on the pad of the westerly
parcel. The location of the proposed structure will meet all of the setbacks requirements for the RI-
20 zone with the exception of.the rear yard where the code requires that the distance to the edge of
the pad, where the slope exceeds 5%, be at least 25 feet. The second-story of the proposed house,
which will project over the first floor patio area, will be within 14 feet of the edge of pad. Access
to the proposed two car garage will be by means of a J 2 foot wide paved driveway off of the private
drive/street which, as noted above, serves three existing residences to the'immediate north.
The first floor and second floor plans as drawn on Exhibit 3'show that the,proposed residence will
have a family room, dining room, sitting room, one bedroom, a full bath, office and workshop on
the first floor together with a covered patio area on the rear of the house. On the-second floor will
be located a master bath, dress ing_room, master bedroom, a third,bedroom and a covered deck area
which will be located over.the covered.patio area on the first floor.
The appearance of the.proposed residence is shown on the north,east,west and.south elevations,as
'drawn on Exhibits 4 and 5. The residence will be,according to the applicant''s designer,a Spanish
lO�Iediterranean style house with a cement, red tile roof. Walls will be stuccoed.with.the use of
various architectural features to enhance the appearance of the new home including the use of
cornice molding,dual glazed windows with divided lights(panes), a decorative entry door,section
roll-up door for the garage,and the use of"plant-ons"for wall treatment.A color and materials board

was submitted.with the application showing that the stucco treatment will be a"Spanish style finish"
having a sandstone color. As noted above,roofing will consist of cement tile with a"mediterranean"
red, color. Fencing and balconies will consist of black wrought iron. The driveway, exterior
walkways and pool deci will be natural concrete in style and color. Please note that the"color and '
materials board" will be exhibited at the public hearing for the Commission's review.
The proposed landscaping for the new home is shown on Exhibit 6. The applicant is proposing to
plant queen palms, saco palms,bird of paradise, and with grass/turf areas to the north of the house.
This landscaping will c i mplement the proposed mediterranean style of the residence. Fencing will
consist of stuccoed walls having the same color and texture as the house and of wrought iron
matching that used on the house.

ISSUES UNRESOLVED:
There are no unresolved issues regarding this proposal at this time.
STAFF ANALYSIS:
Staff believes that this is a reasonable request. The proposed parcels will be similar in size and shape
to the existing parcels to the immediate north and west. Exhibit 7, the aerial photograph, includes
information on the size of those adjacent, existing parcels. In addition, the proposed parcels will
exceed more than twice the minimum lot area requirement of the underlying R1-20 zone. The
easterly parcel will be larger than any of the existing parcels to the north and west as shown on
Exhibit 7.
The variance for the modification of the requirement of a minimum 50 foot street footage for the
westerly parcel is appropriate. The purpose of this standard is to insure that each parcel will have
adequate access to a public street. However,this will be accomplished in this case by requiring,as
a condition of approval,that the applicant provide proof of access rights from Palm Avenue for both
parcels.Therefore,each parcel will have access to a public street and meet the spirit of this standard.
Without this modification or some version of it,it would be impossible to divide the subject site and
the property owner would not be able to enjoy the same rights and privileges of other property
owners in the area by not being able to create parcels similar in size to others in the immediate area.
The proposed residence will be an asset to the City of Grand Terrace. - The proposed Spanish
mediterranean style will complement the existing residential development in the Honey Hills area.
The applicant and his designer are taking care to build a home that will fit into this existing,upscale
neighborhood.
The future residence will meet all of the City's development standards with the exception that the
westerly slope on the westerly parcel will be closer than 25 feet to the rear of the house. The
purpose of this requirement in the code is that there be an adequate amount of usable,level area for
each residence in a hillside areas. In looking at either the site plan (Exhibit 2) or the landscaping
plan(Exhibit 6),it is clear that there will be large level areas on the pad to both the north and south
of the proposed residence. Adequate level, open space area will be provided. Also,requiring that
the 25 foot standard to the edge of the pad be observed would most like result in less landscaping
in front of the house and less area for maneuvering in and out of the garage which would not be
desirable. The intent of this requirement has been met.
CONDITIONS OF APPROVAL:
The following conditions, based on input from City departments and other agencies, have been
prepared to be included in the Resolution calling for the City Council to approve the proposed
tentative parcel map and for the Planning Commission to approve the site and architectural review
and variance contingent on the Council's approval of the tentative parcel map:

Conditions Prior to Final Parcel Map Approval:
1. Upon approval of these conditions and prior to becoming final and binding, the
applicant;must agree to and sign the "Acceptance of Conditions" letter. The letter
form and content to be prepared by the Community and Economic Development
Department.

2. Provide a"will serve" letter from the Riverside Highland Water Company.
3. The development shall conform to all requirements of the Grand Terrace Municipal
Code and the State of California Subdivision Map Act.
4. Provide that all utilities shall be run underground or bond for same as required by the
Director'of Building and Safety/Public Works in his memorandum dated September
12, 2001;.
5. Comply, with Condition F2PC of the County Fire Department in their letter dated
June 20J2001 regarding fire flow in the letter dated September 25, 2001.

6. The final map shall be properly prepared by a licensed land surveyor or registered
civil engineer authorized to practice land surveying and based on a field survey.
7. The applicant shall provide proof of access rights from Palm Avenue direct to Parcels
1 and 2. The proof of access rights shall be in the form of an access easement,a title
"Guarantee of Ingress and Egress" or any other method available to prove legal
access. '
8. The City Engineer of the City of Grand Terrace shall receive all required clearances,
tax clearances and certificates before forwarding the final parcel map to the City
Council!for approval
9. The applicant or developer shall submit a "Geotechnical -and Geology" study to
recommend the work necessary to stabilize the existing building pads. Said study
shall address any building setbacks required to protect .from rock fall hazard,
especially from the vertical rock faces above Parcel 1.
10. The San Bernardino County Fire Department shall determine the required width for
the driveway serving Parcels 1 and 2.

11. The private street/drive.from Palm to the northerly boundary of Parcel 1,serving the
two proposed lots shall be improved at a minimum to the standards;,for hillside,
- private I streets as adopted by San Bernardino County. If improvements are required,
the street/driveway shall be improved as required prior to the final parcel map
approval or bonds shall be posted with the City to ensure that the improvements will
be completed.
12. The City Engineer of the City of Grand Terrace shall approve a detailed drainage plan

that addresses the increase and change of delivery for drainage. Notarized letters of
acceptance shall identify the parcel accepting the runoff by legal description,the date
of the plan reviewed by the adjoining property owner and that they accept the
proposed drainage improvements.
13. If improvements are required for water service and fire flow;the water lines shall be
extended to serve the properties, as required by the Riverside Highland Water
Company and the County Fire Department or bonds shall be posted with the City to
ensure that the improvements will be completed.
` Conditions Prior to Grading:
14. Provide grading and drainage plans memorandum from the City's Building and
Safety/Public Works Department).
15. The grading plan shall conform to the requirements of the Uniform Building Code.
15. A detailed grading plan shall be.prepared for the development of Parcel 1 addressing
the rock fall hazard posed by the near vertical rock faces.north of the proposed home,
the rock .projecting from the pad and its impact on the home and the corrective
grading that is necessary to create a safe building site.
16'. The grading plan for Parcel 1 shall detail the proposed drainage pattern and any
} improvements proposed to carry the drainage from the pad to,the adjoining property.
Once the drainage plan is detailed the affected neighbor or neighbors shall review the
plan and accept the drainage as noted under the parcel map.
17. If the proposed grading occurs in an area off-site to the south, permission from the
adjoining neighbor or neighbors will be required in written form which shall be
submitted to the City prior to the issuance of a grading permit.
18. The land subdivider shall accept and properly dispose of all on and off site drainage
flowing onto or through the site.
Conditions at the Time of Development of the Parcels:
19. The proposed project of a single family residence shall be constructed in accordance
with the Site and Architectural Review Board',s approval on October 18,2001,minor
changes and/or clarification may be made by the Community and Economic
Development Director. The design,materials and colors shall match those approved
by the Site and Architectural-Review Board.
20. Any roof-top mechanical equipment shall be located at a distance from the edge of
the building or shielded by means of a lattice or similar material or parapet so as not
to be visible from pedestrian level,adjacent roads or adjacent properties.
21. The applicant or developer install sewer laterals to connect both parcels to the public

sewer to the satisfaction of the Director of Building and Safety/Public Works.
22. Comply,with all requirements of Director of Building and Safety/Public Works in his
memorandum dated September 12, 2001.

23. Full compliance with.the recommendations of the County of San Bernardino Fire
Department - Community Safety Division- in the letter dated September 25,2001.
24. Payment of applicable school fees to the Colton Unified School District with

31. Three copies of a landscaping and irrigation plan shall be submitted to the
community and Economic Development Department prior to the issuance of
building"permits. All manufactured slopes shall be appropriately planted to the 1
satisfaction of the City. Said landscaping to be installed in Ithe front yard area prior
to issuance of occupancy for the proposed residence. .
32. It is strongly recommended that the landscaping plans'include shade bearing trees to
shade the southwest exposure of the proposed"residential structure to help with
energy conservation.
33. The developer shall comply with the requirements of the Gas Company in its letter
to the City dated September 19, 2001.
34. Payment of the Traffic Signal and Circulation Improvement fees as established by r
Ordinance No. 190 of the City of Grand Terrace prior'to the issuance of building

RECOMMENDATION:
The staff of the Community and Economic Development Department recommends that the Planning
Commission recommend that the City Council adopt the attached Resolution (Attachment 13) to
approve Tentative Parcel Map, TPM-01-02 and that the Planning Commission approve the second
Resolution (Attachment 14) for the accompanying Site and Architectural Review Case, S.A.-01-0
and Variance Case,V-01-05 subject to the Council's approving the tentative parcel map, together
with the Environmental Review Case No. 01-05.

KEEP Program: "Keep Existing Employers Prosperous"
RECOMMENDATION: Approval
"Grants for local Businesses" of one of the activities of our Retention & Expansion
program named KEEP — "Keep Existing Employers-Prosperous". The KEEP Program
includes, but will not be limited to the following activities:
• Visiting local businesses on an on-going,basis;
• Helping "Gazelles" to thrive. (Gazelles are existing 'businesses that are
L f,. growing fast, have the potential for further growth and/or are interested in
expanding their business);
• Sending welcome letters and economic development packets to all new
businesses;
• Communicating via e-letters;
• Upgrading the economic development section of our City web page and
making it interactive for the benefit of our businesses; ,
• Conduct "supplier surveys" to recruit businesses that compliment our local
businesses and help them to grow;
• "Grants for local businesses"; etc.
The first three activities listed are currently taking place as we prepare to accomplish all
the others.
"Grants for local businesses" is a program which will utilize the San Bernardino County
EDA Funds ($50,000.00) to help local -businesses to- improve the appearance and
functionality of their leasable space. Please refer to -the draft Flyer, Program Grant
Guidelines and Reimbursement Agreement attached. CEDD Staff strongly supports the
program and is in the process of organizing .a large-scale advertisement campaign.

FACADE REMODEU/TENANT IMPROVEMENT GUIDELINES
The Faeade Remodel/Tenant Improvement Program will provide to eligible property owners a grant,
up to $7,500, in the form of a reimbursement for costs incurred .for the improvements of their
commercial. business/structure(s)/parking lots within the Project Area. All applications are to be
submitted to the Community and Economic Development Department for approval. The following
conditions apply:
General
1. The maximum amount the City may approve for the grant program is $7,500. This funding
shall be for eligible improvements and related costs only.
2. All plans for renovation will be reviewed in accordance with the City's Zoning Ordinance and
the guidelines established for this Program, in conformance with Chapter 18.63 —Site and
Architectural Review.

3. Businesses located within the "Barton Road Specific Plan" area and C2 Zoning District are
eligible.
4.- Only the owner or owner's representative may submit plans for review under this Program.
Owner's representatives must have written authorization from the owner prior to submittal of
plans to the Community and Economic Development Department.
5. Previous grant recipients may be eligible to receive one (1) additional grant if the owner
t` 1 provides a cash match of 100% for the new grant amount and has not received a grant for a
period of three (3) years.
Project Related
1. Cost Estimates: Owner or Owner's representative shall submit an itemized estimate of the
cost of labor and materials and a proposed work schedule. Note that the estimate shall be
limited to the eligible costs.only.
2. Eligible cost for reimbursement are:
• Parking lot and building night lighting.
• Parking lot and sidewalk cleanup, refurbish, reseal, and/or re-stripe.
• Landscaping enhancements and outdoor pots of plants.
• Fagade remodels, repainting and installation of awnings.
• Certain tenant improvements to bring spaces up to code beyond safety requirements
• High tech wiring of tenant spaces, etc.
3. Submittal of incurred costs by owner: to receive reimbursement for eligible costs
associated with the project the applicant must submit the following: a) receipts/invoices and
canceled checks for the completion of eligible work; b) documentation of the mitigation of code
violations; c) labor and/or material lien release(s); d) reimbursement may be distributed once
an inspection has been made to determine that all improvements, pursuant to the approved
plans, have been properly made and are in place.

4. Hiring of Contractor: Owner shall have the sole responsibility jonce the plans have ;been
approved, of hiring a licensed contractor to perform the agreed ,upon work. To the extent
possible all labor, materials and supervisory services devoted to his project under the Program
should be procured from suppliers and contractors themselves doing business from premises
within the City of Grand Terrace. Contractor must have a valid Grand Terrace business
license. f

5. Work Completion: Upon completion of the work to be reimbursed, owner shall deliver to the
Community and Economic Development Department original invoices or suitable vouchers
showing that payment for the work has been paid in full--and any required lien releases.; Thc_-
Community and Economic Development Department shall verify the completion and quality c_
the work and if acceptable shall pay over to the owner, by way of,reimbursement, the cost of
the work as approved.

6. Exclusions to Progiram: a) projects and project improvements started or completed prior to
the implementation of the program; b) exterior improvements not approved by the Community
and Economic Development Department; and c) improvements installed without proper
documentation, invoices, receipts, etc.
7. Documentation required for receipt of grant funds: a) Reimbursement Agreement and
recording document submitted to the CEDD; b) documentation of Ifinal labor and material lien
release(s) from all contractors; subcontractors and suppliers must be submitted to the
Community and Economic Development Department; and c) finail inspection or certificate of
occupancy. _
8. Program Stipulations: a) applicant agrees to install all improvements as specified in this-
application, approved and/or stamped plans and Community and Economic Development
Department recomrr1endations; b) all work will conform to the design guidelines established for
the program; c) applicant may be required to submit additional drawings or other submittals
that further illustrate the improvements as proposed-. These additional items may include, but
be limited to the following: paint'chips, color charts, palette of materials to be used, additional
drawings that more fully illustrate or support the proposed facade improvement, and d)
completion of all required program work pursuant to and consistent with ;the agreed± upon
deadlines. j
The above requirements are designed to assist the applicant in understanding ;the nature of the
Facade Remodel/Tenant Improvement Program and to assure that the project is completed In a
timely manner. j

REIMBURSEMENT AGREEMENT
Fargade Remodel/Tenant Improvement Program
The Parties to this Agreement made at Grand Terrace, California, are the City of Grand Terrace
hereinafter as the "The City" and a person engaged in business at
Grand Terrace hereinafter"Merchant".
This Agreement is made in contemplation of the following facts:
The City Council of the City of Grand Terrace, has authorized a program for the application of
"City" Economic Development funds provided -by the San Bernardino County Economic
Development Agency, to the improvement of business premises along Barton Road and
businesses in the C2 District.
The Program is intended to improve building exteriors and parking lots within the Barton Road
Specific Plan and "C2" areas, improve the functionality and to modernize tenant retail space,
as the "City" shall deem helpful to allow the expansion of current and recruitment of new
retailers for our commercial corridors.
The proposals are subject to the City Design Review Process per Zoning Code Chapter 18.63-
Site and Architectural Review.

'The parties hereby agree:
"Merchant' represents that he is the sole owner of the premises at the above address, or, if not
the sole owner, a person who has the full authority from all the owners to carry out the work
and the improvements to be accomplished under this Agreement.
"Merchant" shall propose to the "City" a plan and an itemized estimate of the cost of labor and
materials for the improvement of the premises and a proposed work schedule. The "Merchant"
must supply drawings, design renderings and other supporting materials describing the
proposal, per the City Design Review Process, all in sufficient detail to allow a ready
verification of the estimates.
The "City" shall review the proposal, as submitted, and any other information or materials
- requested by the "City" to assist its evaluation of the proposal. The staff, (and/or Planning
Commission) of the "City" shall confer with the "Merchant" as necessary and shall approve,
conditionally approve-or disapprove the proposal. If the proposal is approved or conditionally
approved, the "City" shall establish the amount of cash reimbursement to be paid to the
"Merchant" for work done according to the approved proposal.
The cash reimbursement from the "City" to the "Merchant" shall be limited to that part of the
work consistent with eligible costs.
A second grant may be approved for a property after a three-year period with 100% recipient
matching funds. '

The total of such reimbursement shall not exceed $7,500.

To the extent reasonably possible, all labor and supervisory services and materials devoted to
any project under this Agreement shall be procured from suppliersland contractors themselves
doing business from premises within the City of Grand Terrace. ;
At the conclusion of the work to, be reimbursed for, the "Merchant" shall deliver to they "City"
original invoices, or other suitable vouchers, showing that payment for the work has been
made in full, and that all liens arising from the project have been released.
The "City" shall, following receipt of such vouchers, verify the completion and the quality ;
work and, if satisfactory as determined by the "City in exercise of,its sole discretion, shall pay
over to the "Merchant", by way of reimbursement, the cost of the work as-approved.
The "City" shall not be deemed to have engaged in any other particular work of improvement
under this Agreement, and is acting solely as a source of funding for the purpose of this
"Merchant".
If "Merchant" has not completed the work within 120 days 1following .;date hereof, the
Community and Economic Development Department Director{ may approve a one-time
extension of sixty (60) days Aue to unforeseen circumstances inhibiting improvement
completion. Both the parties in writing must agree to this extension. -

If the work has not I been completed by "Merchant" within the agreed upon time limit, this
Reimbursement Agreement shall be deemed to be void and have no further effect. Neitl
party shall thereafter have any right against the other, for a failure of performance hereun6ur
either in law or in eq!ity.

Background:
Measure I Funds come from a one-half of 1% retail transactions and use tax applicable
to transportation improvement and traffic management programs.
In October of every year, the City is required to update our Measure I CIP in order to
continue receiving- Measure I Funds. (Please refer to Attachment B memo from
SANBAG). The program at this time includes 3 projects under development. One
project from the six top City Council priorities and all maintenance projects due within
the next five years. City CounciI's 'options are, a). keep the program "as-is" and have a
remaining balance of approximately $600,000; b). add transportation/circulation
project(s); or c). add maintenance project(s). Please refer to Attachment C: 1999-2011
Street Rehabilitation Program Spreadsheet
Proposal:
This year, staff proposes that the program be the same as last year's with the addition
of one Transportation Project. City Council prioritization so far established several top
.projects-in different categories as follows:
• Traffic signal at Barton Road and Grand Terrace Road — ($150,0.00)
• Barton-Road Over crossing — ($1.8 Million Dollars)
• Mount Vernon Road hillside rehabilitation — (To Be Determined) -
• Commerce Way from 900 ft. north of De Berry to Pico— ($1,000,000)
• Commerce Way, Pico to Main — ($1,731,000)
• Video Detection at Barton Road and Mount Vernon —To Be Determined
• Traffic Calming at Pico and Mount Vernon —To Be Determined

All of these projects are eligible for Measure I, and are also eligible for many other !
sources of funding, with the exception of Commerce Way.
Commerce Way is not eligible for any other known funding sourcemith the exception of
very competitive low interest loans by the State Infrastructure Bank. These loans have ;
a lot of red tape and may take years for approval, and need to be in connection with the
developer.
HES Safe Funds,
Most other projects may be eligible for funding from CMAQ, Safety TEA-21
funds, Safe Routes to School Funds, Surface Street Mitigation Funds, and many other
funds. Commerce Way is not eligible. Most funding available is for Air Quality,
congestion relief, o ! traffic safety improvements. Construction of, new streets, usually
involves city's or developer's monies. The total cost for Commerce Way would be
$2,731,000 Dollars. We need to start soon. As other projects, eventually;the Traffic
Mitigation Fee will reimburse us for a small percentage of the cost.;

While we have a preliminary alignment for Commerce Way sets by the City General
Plan, we still need to: i
1. Evaluate different alignment alternatives for cost efficiency and implementation
factors.
2. Determine the precise alignment of Commerce Way, which! would allow the area
to be developed; and
3. Proceed to b l ild Commerce Way i 1
Once the area close to the freeway has proper access, other infrastructure will come
along with it, and f the land will become attractive to retailers and to "end user"
construction material suppliers. Economist John Husing stated, "This area has the;
potential to forever alter the makeup of Grand Terrace." Therefore, due to all of these
factors and the City's economic development priority of recruiting businesses for the;
area adjacent to the freeway in order to increase retail tax revenue, staff suggests the,
new project considered be Commerce Way.

Staff requests the !City Council to evaluate, prioritize proje{cts in relation to thisf
funding source, and complete the Measure I CIP. Please referIit the Grand Terrace
Measure I CIP in Attachment A. The Measure I CIP needs to be'submitted to SANBAGI

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY'OF GRAND TERRACE, STATE OF CALIFORNIA,'
ADOPTING THE MEASURE "I" FIVE-YEAR
CAPITAL IMPROVEMENT PROGRAM
WHEREAS, San Bernard ino°County voters approved passage of Measure I in
November, 1989, authorizing San Bernardino Associated Governments, acting as the
San Bernardino County Transportation Authority, to impose a one=half of one percent
retail transactions and use tax applicable in the incorporated and unincorporated
territory of the County of an Bernardino, and
WHEREAS, revenue from the tax can only be used for transportation ,
improvement and traffic management programs authorized in the Expenditure Plans set
forth in Ordinance No. 89-1 of the Authority, and
WHEREAS; Expenditure Plans of the Ordinance require each local jurisdiction
receiving revenue from the tax to expend those funds pursuant to to Five-Year Capital
Improvement Program and a Twenty-Year Transportation Plan adopted by resolution of
the local jurisdiction, and

WHEREAS, the Twenty-Year Transportation Plan has been previously adopted,
and is on file with the Sam Bernardino Association of Governments (SANBAG), and

NOW, THEREFORE, BE IT RESOLVED that:
1) The City Council of the City of Grand Terrace, State of California, hereby adopts
the Measure I Five-Year Capital Improvement Program, a copy of which is
attached to this resolution.
2) In case of an emergency, such as flooding or other major necessary goad
expenses, these funds could be reallocated. j

This memorandum is notification of the annual requirement for each city and the County to
adopt the Five Year Capital Improvement Plan for expenditure of Measure I Local Pass-Through
Funds. It is requested that the updated Measure I Five Year Capital Improvement Plan be
adopted by your governing body and forwarded to SANBAG by October,31, 2001.
Measure I requires that�each local jurisdiction receiving program revenues annually adopt a Five , -
Year Capital Improver ent Plan and a Twenty Year Transportation Plan which outlines the
specific projects upon which those funds shall be expended. This package is provided to assist
you in the annual review and adoption of the plans.
Copies of the Measure I Policies relative to Local Pass-Through Funds can be obtained on the
SANBAG Web Site at jwww.sanbag.ca.gov/measure_ipolicy.htm. Please refer to these policies
in the preparation of your plan. In review of the most recent Measure I audits, it was noted that
several findings were commonly identified. Please note the following precautions to minimize
the opportunity for audit findings in your jurisdiction:
• There is a maximum expenditure limit for categorical expenditures. The total amount of
planned and actual expenditures by category (citywide overlay, citywide signal
maintenance, pavement management plans, etc.) cannot exceed 50 percent of the annual
Measure I revenue forecasted by SANBAG.

• Expenditure of,Measure I funds must be on projects identified in the Five Year Capital
Improvement Plan adopted by the governing body. The Plan can be modified by action
of the governing body throughout the year, if necessary or beneficial. A copy of the
modified plan should be sent to SANBAG.

• Measure I Plans must be in the established format. Plans that were in unique formats,
budget documents, and general capital improvement plans have lead to interpretive
difference during the audit process. Should you like to have a copy of the established
format for the Measure I Plans, provided in electronic form, please email the request to
barm_de@sanbag.ca.gov. We will be happy to provide it.
Your 2001-2006 Measure I Five Year Capital Improvement Plan transmittal should be forwarded
to SANBAG including the following:
1. A signed copy of the resolution of your governing body adopting the 2001-20056
Measure I Five Year Capital Improvement Program. A sample resolution is enclosed as
Attachment A for your convenience.
2. A copy of the adopted Five Year Capital Improvement Program. A sample format for
both the Valley and the Mountain/Desert regions is enclosed as Attachment B. Plans
must be submitted in the established format. Please remember to include in your Plan
all projects upon which Measure I revenue will be expended, including projects from the
prior year that may not be completed, pavement management programs, and congestion
_ management program costs. Also remember that all of the projects funded with
Measure I funds which were submitted for the Regional Transportation Improvement
Plan (RTIP) should also be included in the Measure I Five Year Capital Improvement
Plan.
3. A copy of the adopted Twenty Year Transportation Plan. The twenty year plan should
necessarily contain some fluidity but must be consistent with the general plan circulation
element and other jurisdictional and regional plans. The twenty year plan may consist of
either:
A. A continued list of projects which your jurisdiction anticipates to be completed
during the remaining term of the Measure I program, using the same format as the
Five Year Capital Improvement Program, or
B. A narrative policy statement which will guide your jurisdiction in its continued
programming of funds for the remaining term of the Measure I program.
If your jurisdiction has previously provided SANBAG with a copy of the Twenty Year
7 Transportation Plan which has not been amended, it is not necessary to forward another
copy to SANBAG. Please indicate that the prior submittal should remain in effect.
A Measure I Revenue Estimate for Local Pass-Through Funds (Attachment C) is enclosed for
planning purposes and provides estimates of the revenue your jurisdiction may receive in the

five-year planning period. Over programming of projects in the Measure I plans is permissible;
however, the plan should not exceed 150% of revenue projected during the planning period plus
fund balances.

SUBJECT: Regional Transportation,Improvement Program - RTIP
RECOMMENDATION: Approval
Background:
The Regional Transportation Improvement Plan is a project list. Projects listed on this
plan are eligible for special State and Federal funding. However, it is understood that
projects in the list are either 1) Almost completely paid for by the jurisdiction, which will
be applying for minor co-funding, or 2) The project has the approval of SANBAG to be
funded or likely to be funded within the next 3 years.' The RTIP is prepared in five-year
cycles with intermediate amendment cycles. We can ad projects in every cycle as we
apply for funding. The County RTIP is prepared by SANBAG, and then forwarded to
SCAG; and eventually becomes part of the STI.P, or the State Transportation
Improvement Plan.
The STIP needs to meet Air Quality regulations for air emissions in order to allow
release of federal funds. More and more projects that assist in lowering vehicle
emissions will be required in Southern California, if Southern California is to continue
receiving transportation funds. This is beneficial to us because it helps to clean the air
we breathe.
We are currently in the process of revising our RTIP for resubmission. SANBAG is
forwarding the SB-RTIP to SCAG this month. It is important for us to participate so that
our funding for the Mount Vernon/De Berry signal can be released/cleared.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
CERTIFYING THAT THE CITY OF GRAND TERRACE HAS THE RESOURCES TO
FUND THE PROJECTS SUBMITTED FOR INCLUSION IN THE FY 2002/2003-
2007/2008 TRANSPORTATION IMPROVEMENT PROGRAM AND AFFIRMING ITS
COMMITMENT TO IMPLEMENT ALL OF THE PROJECTS SUBMITTED-IN THE
PROGRAM
WHEREAS, the City of Grand Terrace desires to include the submitted projects
in the San Bernardino County Transportation Improvement Program; and
WHEREAS, the City of Grand Terrace warrants that full funding is committed
and available for projects submitted for programming in the first three years (FY
2002/03, 2003/04, 2004/05) of the Regional Transportation Improvement Program; and
that the City of Grand Terrace accepts responsibility for full funding of said projects and
warrants that no additional funding allocations are required of SANBAG for the City of
Grand Terrace to fully implement said projects therefore committing that the first three
Jyears of the RTIP are financially constrained; and
WHEREAS, projects programmed in years 2005/06-2007/08 are projects
expected receive future funding through anticipated revenues, therefore all projects
submitted for inclusion in the 2002/03-2007/08 RTIP are financially constrained; and
WHEREAS, the San Bernardino Associated Governments (SANBAG), as
agency responsible for short-range capital and service planning and programming for
the San Bernardino County area, requires an approved Resolution from the governing
body of the Lead Agency for all projects included in the Transportation Improvement
Program; and
WHEREAS, SANBAG also requires that the Lead Agency include a financial
plan that demonstrates how the projects submitted for inclusion in the Transportation
Improvement Program can be implemented; and
WHEREAS, the City of Grand Terrace, as the Lead Agency, possesses the legal
authority to submit the project for inclusion in the Transportation Improvement Program
and to finance, acquire, and construct the project.
Attachment A
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Grand
Terrace does hereby:
1) Affirm its continuing commitment to the projects submitted for inclusion in the
2002/2003-2007/2008 Transportation Improvement Program including three
projects: SB6 31850 — Barton Road Over crossing with ;revised schedule of
2006; and SBD 31791 — Barton Road Bridge with revised schedule of December
30, 2004 and Traffic Signal at Barton Road and Grand Terrace Road and Honey
Hills with revised schedule of December 31, 2002; and
2) Certify that the City of Grand Terrace will allocate the necessary local match
funds contained within the projects to carry out any federally approved project;
and 1
3). Certify that the City of Grand Terrace, as the Lead Agency, will comply with
applicable provisions of the California Environmental Quality Act, the National
Environmenta Policy Act, the Americans with Disabilities Act, the Secretary of
the Interior's Standards and Guidelines for Archaeology and Historic
Preservation, and any other Federal, State, and/or local laws, rules and
regulations.

SUBJECT: ' CITY COUNCIL POLICY REGARDING PROVIDING A DEFENSE IN
CRIMINAL ACTIONS

The City Council directed staff to look into establishing a policy to address whether the City will
provide a defense for employees or officials in a criminal action or proceeding.
Staff and the City Attorney have reviewed the,action taken by the City of Colton,which indicates
that it is the,City's general policy not to provide a defense in a criminal action or proceeding'against
an official or employee.
The City Attorney has determined that the City Council may certainly adopt such a policy.
Recommendation:
City Council consider adopting a Resolution establishing a policy for providing for the defense of
an employee or official or former employee or official in a criminal action or proceeding.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE,.CALIFORNIA, ESTABLISHING A POLICY
FOR PROVIDING FOR THE DEFENSE OF AN EMPLOYEE i
OR A FORMER EMPLOYEE IN A CRIMINAL ACTION OR
PROCEEDING
WHEREAS, Section 995.8 of the California Government Code gives public entities 1
the discretion to provide for the defense of a criminal action or proceeding brought.against j
an employee or official or former employee or official; and
WHEREAS„ the City Council of the City of Grand Terrace desires to establish a
policy to address when the City will provide for the defense of an employee or official or j
former employee or official in a criminal action or proceeding;
NOW, THEREFORE; THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
does hereby resolve declare determine, and order as follows:

SECTION 1. Except as provided for herein in the most rare of cases, it is the policy i
of the City of Grand Terrace not to provide for the defense of, a criminal action or
proceeding brought against an employee or official or former emplyee or official.
SECTION 2. The City will only provide for the defense of a criminal action or
proceeding brought against an employee or official or former employee or official if all of
the following conditions are satisfied:
I
a. The criminal action or proceeding is brought on account of an act oromission j
in the course and scope of employment as,a City employee or official.
b. The City Council has determined that providing such defense would be in the
best interests of the City.
C. The enl ployee or official or former employee or offi.cialjacted, or failed to act,
in good faith, without actual malice and in the appareit interests;of the City. i
d. The employee or official or former employee or official has been,found by a
court or jury to be not guilty of all charges in the criminal action or
proceeding.
