Jeffrey McConnell, 21758 Walnut, stated=that.the residents plan to appeal the Planning Commission's decision on the Manhole Builders Project due to the fact that there was a lack of Commissioners at the meeting on Monday. He stated that large trucks utilize and abuse the roads in his neighborhood,which are inferior and have been ignored for years.�He stated that he would like to see the end of Terrace Road swept.He also indicated that the roads are used not only for the large'trucks from the plumbing company but also for those who choose them as short cuts during high traffic times on the-freeways. Juanita Odenbaush,21811 Vivienda Avenue, stated that although she has only lived in her home for two weeks she grew up in Grand Terrace. She indicated that with people using her , street as a short cut and with the traveling trucks she would like to see speed humps and signage installed on her street.for the safety of her small children. He stated that money has been budgeted in the new fiscal year for street signs. He agreed that there is a problem with truck parking in the area and that he is working with the property owners. He stated that most people don't read the signs, however, staff will be placing large signs in the area which say no commercial truck parking. He indicated that this is an issue that staff is aware of and that they are working on it. ; Councilmember Garcia,questioned if it is possible for the deputies to ticket trucks when they are parked.in a residential area. The new street cut policy and ordinance was a cuhnination of the following: • Researching other city's street-cut specifications • Meetings with utility officials • Working with paving contractors • Combining the "Best Management Practices" for a new street-cut policy I Highlights of the new street cut policy and ordinance: • Failure to obtain a permit will result in a $1,000 fine with the exception of emergency situations for public utilities and their contractors • Contractors that perform sub-standard patching will be subject to $1,000 fine per occurrence and be responsible for correcting the patch per the street-cut specifications. Public utilities and their contractors will not be exempt. • Jagged cuts will no longer be acceptable and all patches must be squared off • All patches must ground a minimum of 1 foot outside each edge of the trench j and overlaid flush with the existing surface. • The city will notify all utilities of any major street work at least six months in advance. No street cuts by the utilities (other than for emergencies) will be allowed for two years. If a non-emergency street cut is made by a utility in the notified area, the utility will responsible for replacement of a portion or the entire area--- to be determined by the City Engineer. Contractor shall notify Engineering Inspector 24 hours prior to construction of permanent paving or concrete placement. 3. Contractors performing street cuts and resulting patching that are not performed correctly in accordance with the corresponding specifications described in this document shall be subject to a fine of$1,000 and will be required to re-patch the street section per the specifications,outlined in this document,for each occurrence. 4. Removal of asphalt and concrete shall be per standard specifications described within this document. Asphalt shall be saw cut a minimum of 75%of total depth. Limit of concrete removal and replacement shall be determined in the field by the Engineering Inspector prior to construction:• 5. All joint lines shall be saw cut on a neat, straight line parallel with the joint.The cut edge shall be . protected from crushing, and all broken edges shall be re-cut prior to paving. 6. No open trenches will be permitted.All trenches are to be backfilled and covered with'a minimum of two inches (2")of temporary A.C. paving or trench plates.When steel-plates are used they shall be used per Caltrans Standards 602.1.The City Engineer may recommend additional safety measures if he deems it necessary. " i 7. The City encourages the use of tunneling or boring to transverse the streets. Mid-block crossings may be installed by jacking conduit under street. Crossing shall be spaced at least 150 feet apart for mainline construction. . 8. Sidewalk cuts--removal and replacement--need to be cut back to the nearest joint and filled. 9. Curb and Gutter removals need to be cut back a minimum of 12 inches of asphalt for a clean edge. 10. If existing curb and gutter lip, EP,AC Berm, etc., is within 2'of the edge of trench, remove existing AC within this area and include in repair,as described in Figure A Construction Notes. - 11. Temporary and permanent resurfacing shall be per specifications put forth in this document.All temporary and base course paving shall be installed to the finished surface of the existing pavement. For longitudinal trenches less than 3 feet in width and greater than 20 feet in length, or transverse trenches.less than Veet in width and 8 feet in length, the total surface area of the finish course of asphalt concrete pavement shall be.24 inches wider.than the nominal dimension of,the trench.This shall be achieved by cold-milling the base course asphalt concrete and the existing asphalt concrete to a depth of 11/2-inch.minimum below the existing finished surface, and 12 inches beyond the edge of trench in-all directions. Cold milling of PCC (Portland cement concrete) improvements, such as gutters and spandrels, is not allowed.All trench repairs will be consistent with the above description and/or the Construction Notes in Figure-A unless otherwise determined by the City Engineer. 12. Where a series of cuts are made, a series being defined as two or more cuts that are.within 15'or less of each other,the series shall be treated as a continuous open trench and the pavement repair ` shall be accomplished as herein specified'for open trenches. 13. When patching a street cut made on a street with Petromat overlay, The Contractor will be required to grind 1'wider than the existing patch on all sides at a depth of 2". Replace the Pet_romat over grinded surface with AR4000 oil and repave.with 2"of AC. 14. The city'will notify all public utilities at least six months in advance of any major street overlays. No street cuts,other than emergency street cuts,will be allowed for two years in the area as described if-- the notification to the public utilities. If a street cut occurs by a public utility within the area described in the notification,the public utility will be responsible for replacement of a portion or the entire area as described in the notification. On average, these owners tend to maintain their properties better and respond more quickly on requests from Code Enforcement than residential rental property owners. Our records indicate that code enforcement cases that involve non-owner occupied /rental homes take on average 70% more time to resolve and consume 35% of our one code enforcement officer's time. With the growing caseload of complaints,-the enactment of the RV j ordinance, the enforcement of street sweeping and the recent spike in commercial truck icomplaints, our one code enforcement officer's caseload is reaching capacity. There was a time when a majority of residential rental properties in Grand Terrace were owned by Grand Terrace citizens. The owners would take pride in their rentals, they were often community leaders involved with organizations such as the Lion's Club, Woman's Club and Chambers of Commerce. i Property records indicate that only 21% of the single family homes identified as rentals are owned by citizens living in Grand Terrace (71 homes). Over 75% of all rental I homes are owned by out of city owners primarily living in Riverside, Redlands, and Orange County (256 homes). The County of San Bernardino, Department of Public Health, Division of Environmental Health Services has been under contract with the City of Grand Terrace since the incorporation of the city to perform rental inspections of apartments. Staff has been working with Terri Smith, Community Environmental Health Program Manager on this issue. Currently the County provides a rental inspection program for apartments/multi-family only. There is an annual cost of$134 for the base fee, $7 per unit, and a one time $55 Certificate of Use document fee. So a new owner of a duplex in Grand Terrace with two units would pay $203 to the County. Grand"Terrace and Chino Hills are the only cities remaining with the County on this type of program. C According to Terri Smith, all other cities have taken control of their own inspection programs either through their Code Enforcement Departments or Fire Departments. -The County is on a 30-day notice contract with the city and according to Ms. Smith, would be very amenable in working with the city should the 30-day notice be given on the contract. At the request of the Apartment Association (AAGIE), Greater Inland Empire Division, the City of Grand Terrace staff held a meeting on March 29, 2005, with members of the community, The Grand Terrace Chamber of Commerce, rental owners, and staff of AAGIE. Karen Fricke, Executive Director expressed her concerns that such an ordinance is unjustly leveled to both the good rental property owners along with those owners which are in violation. There was also concern that the added cost of the program would passed on to the renters in the form of rent increases. i I I i i Intent It is the intent of this Program to address conditions that pose immediate hazards or which clearly present a threat to human life, health or safety and will require full and rapid compliance. Significant Code violations that do not pose immediate hazards to human life, health or safety will be subject to full compliance proceedings. However reasonable time periods shall be established for achieving compliance. "Minor Code violations that relate primarily to superficial or preventative, property maintenance may be cited, but primarily will be noted and transmitted to the property owner.. In accordance with the provisions of Health and Safety Codes, City of Grand Terrace Codes, and various other Housing and Building Codes, it is not the intent of this Program to require mandatory retrofits of existing structures that were built or installed in accordance with building standards in effect at the time of construction or installation and which have been maintained in a good and safe condition, unless the retrofitting is required by ordinance as adopted by.the city of Grand Terrace, or by State law. Scope The provisions of this Program shall apply only to non-owner occupied, residential- rental properties. Mobile,home-rental units located within mobile home parks,.nursing, convalescent or retirement home which are otherwise subject to inspections by other agencies including but not limited to the County Environmental Health Services, the State Department of and Community Development, or the State Department of Social'. Services, are exempt from this Program. Authority of Community Service Director The Community Service Director is charged with the implementation and administration of the Non-Owner Occupied/Rental Property Program. The Community Services Director shall ensure that owners of residential rental property are provided with reasonable notice of the initial inspection of their property. Residential Rental Unit Inspection Certificate All residential rental properties shall be subject to inspection and shall be issued a Residential Rental Unit Inspection certificate after satisfactorily passing the required inspection. The certificate shall be renewed annually. Inspection The property owner shall be notified of the date and.time of the inspection and.shall be responsible to make best efforts within the law for making the property accessible for inspection-by the City. i Exterior and common areas of the property will be the primary focus of the initial inspection. This inspection shall be done in accordance with a uniform procedure and shall involve a standardized checklist of those items that will be evaluated on each property. However, if the inspector determines based on the condition of the property that interior inspections may,be necessary, then the inspector may request, or otherwise obtain authorization for entry. Code Enforcement has an interior inspection goal to inspect at least 10% of the non- owner-occupied/rental properties annually and a goal of 100% of the exteriors of such i properties. I The Community Services Director shall be responsible for establishing uniform rules and procedures for all inspections performed under this Program so as to maximize the consistency and fairness of the inspection process. Owner Opportunity to Abate Violation I Under the Non-Owner Occupied/Rental Property Program, property owners will be given the maximum possible flexibility with the City's established code compliance procedures. Emphasis will be placed on building a cooperative relationship that will achieve compliance and abate existing violations. With this in mind, the Code Enforcement Officer is given flexibility to extend time frames for compliance for property,owners who are working cooperatively with the City in a good faith effort to achieve compliance. Notice on Inspection For all initial inspections and annual re-inspections to be performed under this Program, The City shall mail to the property owner a notice of pending inspection at least fourteen (14) days prior to the inspection; it shall be the responsibility of the owner to notify any individual tenants of the inspection. Should an inspection need to C be canceled or re-scheduled, a notice shall be mailed to the owner at least three days prior to the scheduled inspection date. The date of any follow up inspection shall be as determined by the City Inspector.- However, no written notice shall be provided for a follow up or reinspection. l I i Notification of Inspection Results I I Within fifteen (15) working days following an initial inspection or annual reinspection performed under this Program, the City shall send to the property owner, by first class mail, a notice of the result of such inspection. If any violations are found during an inspection or annual reinspection, the property owner may receive a "notice of violation" listing all violations found (if any). If no violations are found on a particular property during inspection or annual reinspection, then the property owner shall receive a written notice stating such. I I - I I I I i I i Compliance A property owner who has received a "notice of violation" must correct'a1I reportable violations within ninety (90) days from the date that the`"notice of violation" is received by the property owner or upon a specific date agreed upon by both the City Inspector and the property owner. If the severity of certain violations are found to be significant enough as to warrant a more rapid compliance, the City Inspector may shorten the ninety (90) days compliance period to expedite the correction of the severe violations. Failure to Comply ( When a property owner receives a "notice of violation" he/she is required to make all necessary repairs outlined in such notice in a timely manner.as specified by the City Inspector. Additionally, all other significant and minor code violations must be corrected within the time frame established by the City Inspector. If a property owner has failed to make the necessary corrections within the time frame as required by the City Inspector, the City may take any actions deemed necessary to achieve compliance including, but not limited to, prosecution by the City Attorney. Appeal Process Any person aggrieved by a determination of the inspector may appeal in writing to the City Clerk's office, 22795 Barton Road, Grand Terrace, CA_92313 within 10 calendar days from the date the citation was mailed. An appeal will result in'an administrative hearing. Staffmg and Program Costs The actual costs to implement this program are-unknown, the following is an overview of the potential costs and manpower needs. Staff anticipates the,annual inspections would require 415 hours to perform all of the exterior inspections at full implementation based upon 30 minutes per home and 15 minutes per apartment. Interior inspections are targeted at 10% of the total non-owner occupied/rentals and would require 102 hours to perform based upon 45 minutes per inspection. Staff would consider hiring a part-time Code Enforcement officer at an annual cost of $25,000 including benefits and a full time clerk at a cost of$25,000 including benefits. Training costs are expected to be,$3,000 annually along with one time expenses such as $18,000- $25,000 for a vehicle, computer and office set-up costs of$4,000. Revenue, excluding fines and re-inspection fees, would is expected to be approximately $70,000 based upon the following fee amounts: _ r I The proposed fees are only for non-owner occupied/rental properties. Condominiums will be charged only if they are a non-owner occupied/rental. Fines are $100 for the first citation, $200 for the second citation, and $500 for the third citation and any subsequent,citation within 12 months. A second or subsequent citation will not be written until 10,days (appeal period),after the last citation. Example: Rental Property A has an engine block on the driveway. During the annual exterior inspection, the violation is noted and the owner is issued a Notice of Violation and given two weeks to correct the situation—there is no fine at this point. After two weeks, a re-inspection noted that the engine block is still there. A citation is issued and a fine of$100 is imposed along with a re-inspection fee of$47.50. After a deadline of two more weeks, a re-inspection notes the engine block is removed. There is no additional fine or re-inspection fee. I 1 Cities that have enacted similar ordinances I . Grand Terrace would be the first city in the Inland Empire to enact such an ordinance for non-owner occupied/rental properties that include single-family homes. The City of San Bernardino last year passed a multi-family rental inspection program that is similar in the inspection process and charges-from $24 per unit to $33 per unit depending,on the size of the complex. Their inspection work is done by the fire department. Other cities that have,passed similar inspection program include: Pasadena, San Jose, Montclair, Azusa, Sacramento, San Francisco, Hayward, and Berkely. RECOMMENDATION Staff is seeking direction from council and authorization to proceed with the Non- Owner Occupied/Rental Property Program. I - I DRAFT Model Non-Owner Occupied/Rental Property Inspection Ordinance Ordinance No.- Adopted by the Grand Terrace City Council ON date AN ORDINANCE AMENDING CHAPTER XXX BY ADDING SECTIONS XXX RELATING TO THE INSPECTION OF NON-OWNER OCCUPIED/RENTAL PROPERTY BE IT ENACTED BY THE COUNCIL OF THE CITY OF GRAND TERRACE: Chapter XXX is added to the Grand Terrace City Code to read,as follows: Non-Owner Occupied/Rental Properties Inspection Ordinance Purpose The purpose of this ordinance is to identify substandard non-owner occupied/rental property stock and to ensure rehabilitation or elimination of non-owner occupied/rental properties that do not meet minimum building and housing code standards and exterior' maintenance standards or is not safe to occupy. The City does hereby declare that there are approximately 327 non-owner occupied/residential housing units within the City of Grand Terrace and 1009 multi-family non-owner occupied/rental properties—not including mobile homes. It is the intention of the City Council to establish a program whereby non-owner occupied/rental housing units can be inspected on a regular basis and certified as meeting minimum standards. The City endeavors to target its efforts to properties where violations exist and are a habitual condition of the property without unduly burdening responsible-and prudent property owners. Definitions For purposes of this chapter, the following terms, phrases and words shall have.the meanings given herein. Unless otherwise expressly stated, words not defined herein shall be given their common and.ordinary meaning. Apartment House—means any dwelling, which is designed, built, rented, leased, let or hired out to be occupied, or which is occupied as the home residence of three or more families living independently of each other in dwelling units. l Applicable Codes and Standards - means those minimum standards governing residential rental property as contained in the State Housing, Building Fire and Civil' Codes. Approved — means performe6in a manner and/or materials consistent with the California Building Code in effect at the time of construction or substantial renovation unless otherwise provided. Basement - means a story having clear a clear height of-at least seven-feet from finished floor to finished ceiling, the floor level of which is below finished grade but not less than four feet below the average finished grade, having-floor and walls of approved construction. 1 Code Enforcement— City personnel responsible for enforcement of applicable building codes and standards Habitually Substandard—rental property with code or standards violations that persist for 6-months or more after notice of violation has been given and where there has been no attempt to abate the problem. Inspection Fee—a fee set by the City to cover the cost of administering this program Landscape - areas defined as the general landscape area, rights-of-way and detention or pond areas. Maintenance Standards—standards, which govern the physical appearance and condition of both the,exterior and interior areas of an apartment house. ` Notification of Inspection—notice from the City to the property owner/agent that the_ City will be conducting an inspection. Such notice shall be provided to the property owner/agent no less than 14 days in advance of the planned inspection. Non-Owner Occupied/Rental Property—a residential dwelling wherein the owner/landlord gives to another the temporary possession and use of property in exchange for consideration and the latter agrees-to return the property to the owner/landlord: Well=maintained Properties— properties with no existing violations of the California Housing Code, California Building,Code, California Fire Code or the California Civil Code. Scope The provisions of this chapter shall apply to all existing non-owner occupied/rental property, including parking"lots, driveways, landscaping, assessory structures,fences, walls, swimming pools, hot tubs,and spas. Hotels, motels, mobile home parks, bed and- breakfasts, and similar occupancies are specifically excluded from the provisions of this chapter. The City seeks to work within its existing departmental structure to conduct the initial.and subsequent inspections'using Code Enforcement personnel. Exemptions (a) Newly Constructed Buildings. Newly constructed buildings shall be exempt from this Article for a period of one (1)year. The.exemption period shall begin on the date a certificate of occupancy is issued. r' Inspections authorized; compliance with applicable codes and standards. (a) Inspections; conformance with standards. (1) Under the direction of the Community Services Director, the Code Enforcement Department shall conduct an annual exterior inspection of all non-owner occupied/rental properties located within the City. If at the time of the exterior inspection, violations are found or there is reasonable cause to believe there may be violations within the interior of the property, the Code Enforcement Department may request to the owner that an-interior inspection be completed. (2) Interior inspections will be voluntary with consent of the owner or the tenant unless there is reasonable cause to believe that there may be violations within the interior of the property. (a) Code Enforcement has an-interior inspection goal to inspect at least 10% of the non-owner occupied/rental properties every year. (3)When inspections are made, buildings shall be-required to be in conformance and maintained in,accordance with the code standard that was in effect at the time the building was constructed, except.for any additional requirements mandated by the Municipal Code or state law. (b,) Non-complying structures. Structures and premises that do not comply with the provisions of this code and the codes listed above must be altered or repaired to obtain the required level of compliance or demolished. Exterior maintenance standards., In addition to the California Model Building Codes, residential non-owner occupied/rental buildings shall meet the-following exterior maintenance standards: (a) Buildings, or portions thereof, shall have exterior walls that are weather tight and watertight, and kept free of deterioration, holes, breaks, or loose boards or coverings. Roof surfaces shall be watertight and not have any defects that will allow water to enter into the structure; ' (b)The exterior finish of all structures shall be maintained. If the exterior finish of�a structure is paint or stain, the structure shall be painted or stained prior to a time when the exterior finish has substantially deteriorated; (c)All architectural projections such as cornices, moldings, lintels, sills and similar projections shall be maintained in good repair and free of defects; (d)All chimneys, antennas, vents, gutters and downspouts and similar projections or building accessories shall be structurally sound and in good repair. Such projections shall be properly secured, when applicable, to an exterior wall or roof; (e)Windows and exterior glazing shall be soundly and adequately glazed, free from loose and broken glass and cracks that could cause physical injury or allow the elements to enter the structure. Exterior doors shall be maintained weather tight, watertight and rodent proof. Exterior doors of rental dwelling units shall be solid core or equivalent and be provided with a deadbolt-locking device that tightly secures the door; (f)All structures and exterior property shall be maintained free of rodent, insect or vermin infestation, which creates an unsafe or unsanitary environment on the ` subject, or adjacent buildings or properties; and (g)All accessory structures shall be maintained in a state of-good repair or i removed from the site. Such structures shall include, but not be limited to, clubhouses, offices, maintenance buildings,,carports, retaining walls, fences, garages, swimming pools, spas, hot tubs, and miscellaneous sheds or structures. t Interior Maintenance Standards In addition to the California Model Building Codes, residential non-owner occupied/rental buildings shall meet the following interior maintenance standards as defined in California Code of Regulations (CCR)Title 24 definition of.a "habitable" rental unit: , (a) Effective waterproofing and weather protection of roof and exterior walls including unbroken windows and doors. (b) Plumbing facilities in good working order, including hot and cold running water, connected to a sewage disposal system. '(c) Gas facilities in good working order. (d) Heating facilities in good working order. (e) An electric�system, including lighting, wiring, and equipment, in good working order. (f) Clean and sanitary buildings, grounds, and appurtenances (detached garage, garden, etc.)free from debris, filth, rubbish, garbage, rodents, and vermin. (g) Adequate trash receptacles in good repair (h) Floors, stairways, and railings in good repair (i) A working toilet, wash basin, and bathtub or shower. Q) A kitchen with a sink that cannot be made•of absorbent material such as wood (k) Natural light in every room through windows or skylights. Windows in each room must be able to open at least halfway for ventilation, unless a fan provides mechanical ventilation (1) Safe fire or emergency exits leading to a street or hallway. Stairs, hallways, and exits must be kept litter-free. Storage areas, garages, and basements must be kept free of combustible materials. (m)Operable-dead bolt locks on the main entry doors of rental units, and operable .locking or security devices on windows. (n) Working smoke detectors in all units,of multi-unit buildings, such as duplexes and apartment complexes. Apartment complexes also must have smoke detectors in common stairwells. Site maintenance standards. Residential rental buildings shall meet the following site maintenance standards: (a)There shall be no accumulation of weeds, vegetation,junk (to include, but not be limited to, abandoned, unused or non-operational appliances; equipment, vehicles, machinery, or-household furnishings),,dead organic matter, debris, garbage, stagnant water, combustible materials or similar materials or conditions; (b)All parking areas shall be kept free of potholes, cracks or other deterioration. No dirt, grass or sod parking areas ar&allowed. All striping and signage, including parking signage and fire lane or access signage, shall be maintained in good condition and clearly legible; (c)All landscaped areas shall be maintained.so as not to constitute a public safety -- hazard and all dead or severely damaged plant materials shall be removed. �i Driveways, hardscape parking areas, patios or walks are not included as landscape areas; and (d) Refuse enclosures shall be installed and maintained. All refuse shall be kept inside the enclosure. Oversized trash that will not fit within the refuse enclosure shall be removed from the property. Notification of inspection; inspection procedure. (a)A letter of intent to inspect the property shall be mailed to the owner of the property stating an approximate date and time of inspection. Such notification shall give a minimum of 14 days'.notice. (b) It shall be the responsibility of the owner to notify any individual tenants of the inspection. (c) Should an inspection need to be canceled or rescheduled, a notice shall be mailed to the owner at least three days prior to the scheduled inspection.date. (d) In the event a tenant in possession of the property to be inspected refuses access to said property, the City Attorney is authorized to obtain from a court of competent jurisdiction any warrant necessary to cause the inspection to take place. i I i Annual inspection fee. Owners of all buildings subject to inspection shall pay a fee in the amount set forth in the Resolution Establishing Fees and Charges for Various Municipal Services. The fee ` will only be used to finance the cost of inspection and enforcement of this.program. Should-the owner fail to pay the required fee, the city will recover.it, plus accrued interest and penalties, utilizing any remedies provided by law including nuisance abatement or municipal tax lien procedures established by ordinance or state law. This fee shall be known as the.residential rental inspection program and maintenance fee. I Re-inspection fee. Upon inspection, the inspector may instruct the owner of the facility to perform work, take action, or refrain from action to ensure compliance with said codes. If the inspector discovers upon re-inspection that the work, action, or inaction requested was not performed, the owner of the rental property shall be charged a re-inspection fee to the i extent set forth in the Resolution Establishing Fees and Charges for Various Municipal Services. Should.the owner fail to pay the required fee, the city will recover it, plus accrued interest and penalties, utilizing any remedies provided by law including nuisance abatement or municipal tax lien procedures established by ordinance or state law. f Violations. j (a) Notice of Violation. Whenever the inspector determines that a violation of this article exists,the inspector shall give notice of violation and an order to correct to j the owner. The notice shall be in writing and shall describe the violation in sufficient detail so that a reasonable owner would understand the violation have the opportunity to correct said violation. i (b.) Time for Correction. The notice shall provide a reasonable time for correction, ranging from 24 hours to up to 90 days, depending upon the severity of the violation. The owner may request an extension of time, which may be granted if the inspector determines that substantial progress is being made to correct the violation. c Service of Notice. Notice shall be served personally to the owner, or if the O P Y owner is not present, notice shall be posted on the property and mailed to the owner at the address shown on county records. Such notice shall be effective three days after mailing. (d) Report of Inspection. Upon completion of the property inspection the inspector shall leave written notice of results of the inspection on site with the owner and/or manager, or tenant, or post such notice on the property. The notice shall contain an itemization of any violation(s) and set a period of,time for correction ranging from 24 hours to up to 90 days. t � � i (e) Formal Notice of Noncompliance. A formal report of the inspection results shall be mailed to the property owner and/or manager within ten days of the completion. of an inspection. Such a formal report shall include the results of the previous inspection, the period of time for correction, and the scheduled re-inspection.date and time. (f) Building Permits. Building permits for the correction of violations shall be issued as required by the California Building Code. (g) Re-inspections. Re-inspections will be conducted to verify that the violations identified on the initial inspection have been corrected. The City shall be . �- responsible for scheduling required re-inspections on or after the date for completion of any necessary repairs. Violations that were not noted on the initial inspection report, but are discovered on the re-inspection due to subsequent damage or deterioration, shall be subject to correction.. Enforcement. If, after notice and order to correct, an owner fails to correct the violation substantial fees shall result. Each violation that continues after the set date of correction with no attempt to abate the violation(s) shall be subject to a $ 106 fine, $200 for the second citation, and $500 for the third and subsequent citation per violation. The failure of any person to pay the fine assessed by the administrative citation within -- . the specified time will result in a property tax assessment against the subject property in the amount of the fine and penalty. The City also has the authority to collect all costs associated with the fine in civil court actions., Further, the city intends to utilize the provisions of Revenue and Taxation Code § 24436.5 to encourage the elimination of substandard conditions in non-owner occupied/rental property. Said section provides for the disatowance for state income tax purposes of interest, depreciation, taxes, or amortization deductions that are derived from the ownership of rental housing that is not in compliance. The city is also authorized to use the remedies set forth in the Uniform Building Code and Uniform Housing Code. The City'shall work with rental housing professionals to remedy habitually substandard properties. Responsible owners shall be requested by the City to provide peer-to-peer review of substandard properties and encourage non-complaint owners to bring their - properties into full compliance. If after the City has pursued all available options under the law and the property still has not been brought into full compliance with applicable codes and standards, the City will use reasonable means to abate the nuisance and seek 'recovery from the property owner.. Such steps shall be taken no later than 12 months after the initial violation is found. 0 I I Appeal Process PP • Any person aggrieved by a determination of the inspector may appeal in writing to the City Clerk's office, 22795 Barton Road, Grand Terrace, CA 92313 within ten (10) I calendar days from the date the citation was mailed.
