13404 COUNCIL AGENDA ITEM# 3 D Council Minutes - 2/14/91 Page 2 PUBLIC COMMENT Harry Roussos, 153 San Vicente Blvd , Santa Monica, requested that Council reconsider the Planning Commission ' s decision regarding remodeling at 22053 Grand Terrace Road He indicated that the property at that location required major renovation , commenting that upon purchasing the property, he began remodeling the existing kitchens and bathrooms He stated that he was informed by a City inspector that he needed to re-draw the plans and present them to the City for review by -z Planning and Engineering and for approval by the Planning Commission He expressed dissatisfaction with the amount of time that has elasped since he began the project , stating that he has lost funding and , due to a recent burglary, building materials He indicated that he believed his appeal was to be heard before Council on the meeting of February 14, 1991 and expressed chagrin with the delay City Manager Schwab, indicated that Mr Roussos ' project was reviewed by the Planning Commission and was conditionally denied. He stated that the formal appeal will go before Council on February 28, 1991 and extended an apology to Mr Roussos for the miscommunication regarding the date of the meeting for the appeal Mayor Matteson , added that the project could not be reviewed at the time since Council did not have any of the material relevant to the appeal Barbara Pfennighausen , 22111 Ladera St. , Grand Terrace , expressed sympathy for Mr Roussos ' situation and stated her understanding of the Council 's position , adding that everyone must abide by the system of laws under which we function She stated that she has been riding as an observer in the Citizen 's Patrol vehicle throughout the community and expressed concern regarding the number of open garages she observed in the City She emphasized that an open garage is an invitation for crime, adding that home burglaries are prevalent in the area. Eugene McMeans, 1450 Washington St , Colton , introduced himself as the General Manager of the Riverside Highland Water Company and expressed appreciation for the efforts of the Sheriff' s Department in Grand Terrace in investigating vandalism at a reservoir site ORAL REPORTS 5B Council Reports Councilmember Carlstrom, indicated that he attended the monthly meeting of both SANBAG and Omnitrans He stated that the topic of the SANBAG meeting was the Commuter Rail System which will traverse the area from Los Angeles to San Bernardino and into Riverside and Orange County He commented that he received an artist ' s rendering of the new overcrossing that will be built on the Santa Fe line in 'the center of Colton where it crosses the Southern Pacific Council Minutes - 2/14/91 Page 3 Railroad , indicating that this project is part of the $48 million right-of-way payment to Santa Fe for co-rights to the right-of-way through that area He added that there will probably be a railway station in the southern part of Colton in the future. He indicated that the Commuter Rail System will be completed in the latter part of 1992 Councilmember Hilkey, stated that he attended the Chamber of r , Commerce meeting on Saturday, February 2, 1991 , declaring that `� A membership in the Chamber previously totalled 240 but has declined to 125. He indicated his anticipation to learn the results of the recommendations for increasing membership that were presented at the meeting. He expressed satisfaction with the attendance at the February 14, 1991 ground breaking ceremony for the Grand Terrace Senior Center Councilmember Grant, queried the City Manager regarding the graffiti issue. He expressed his wish that the ground breaking ceremony had been scheduled at an hour that would have allowed more f Councilmembers to attend He commented further that even more American flags are in evidence in the City, adding that he is proud that the City is showing support for our President and our troops City Manager Schwab, stated that he had indicated that he would get y information from Ms Mueller, review it, and recommend to Council a t._ policy for graffiti removal He stated that the City is in the process of completing that task He stated that Ms. Mueller has provided the information to the Assistant City Manager and it will be presented to Council at a future meeting. After review, take no action BACKGROUND Staff was directed by Council to review, material from other municipalities regarding graffiti abatement procedures, and compare with existing Grand Terrace procedures Staff reviewed material that was presented to the City for review Said material was provided by the cities of San Bernardino, Fontana, Rancho Cucamonga and Colton All programs in place within these municipalities appear to be adequate for said jurisdictions When these programs ai e compared with the Grand Terrace "Nuisance Abatement" ordinance, the Grand Terrace ordinance is all encompassing, while the others are more problem specific The State of California Civic Code Section 3479 defines a "nuisance" as anything which is injurious to the health, or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property Further, section 3480 defines a "public nuisance" as one which affects at the same time an entu e community or neighborhood, or any considerable number of persons, although the extent of the annoyance or damage inflicted upon individuals my be unequal Within this conte\t and under the existing Grand Terrace Municipal Code section 8 04 020 - Nuisance Abatement, the following sub-sections address the issue of graffiti 8 04 020(6) - Building exteriois, walls, fences, driveways, sidewalks, and walkways which ate maintained in such condition as to become so defective, unsightly, or in such condition of deterioration or disrepair that the same causes depreciation of the values of sun ounding pi opei ty of is materially detrimental to nearby properties and improvements, (13) - Maintenance of property so out of harmony or conformity with the maintenance standards of adjacent properties as to cause substantial diminution of the enjoyment, use or property values of such adjacent properties, (15) - Property maintained in relation to others so as to establish a prevalence of depreciated values, impaired investments, and social and economic maladjustments to such extent that the capacity to pay taxes is reduced and tax receipts from such particular ateas are inadequate for the cost of public services rendered therein, (19) - Any wall, fence, or hedge maintained in such condition of deterioration or disrepair as to constitute a hazard to persons or property or to cause depreciation in the value of any adjacent or neighboring property All of the aforementioned are currently abated under the COUNCIL AGENDA ITEM # $►� existing ordinance Though not mentioned specifically, staff interprets graffiti to fall within this area, and is so abated as such ANALYSIS Thus far, staff has experienced no difficultly in obtaining compliance from the property owners The existing procedure sometimes may take a little longer than those of other communities The reason being, within the other municipal programs, city staff performs the actual abatement In Grand Terrace, staff will only take a proactive abatement posture if the graffiti is within the public right-of-way All areas outside the public right-of-way are handled through the normal abatement procedure which protects the Due Process mandate If after due process, the City is required to handle the abatement of the graffiti, the abatement action would consist of either City staff or a private contractor removing said graffiti, then the cost of the actual abatement would be assessed on the actual property in the form of a lien ACTION Staff would recommend that Council encourage all residents to continue to call 824-6621, Community Services Department to report all graffiti, whether on public or private property, and have the graffiti abated under the existing Municipal Code Once received, staff will take immediate action to abate said nuisance DATE Feb 19 , 1991 STAFF REPORT CRA ITEM ( ) COUNCIL ITEM ( xx) MEETING DATE February 28 , 1991 SUBJECT JOINT LAWSUIT REGARDING BOOKING FEES FUNDING REQUIRED X NO FUNDING REQUIRED The City of Grand Terrace has been requested by the City of _ Highland (organizer of the suit) to join in a lawsuit that will attempt to accomplish two things . for a conditional use permit to alloys operation of an outdoor remote control race car track within the Village Commercial Sub-zone of the Barton Road Specific Plan to be located at 22474A Barton Road, and WHEREAS, a properly noticed public hearing was held before the Planning Commission on August 7, 1990, to hear this application, and WHEREAS, the Planning Commission Hearing was continued to September 4, 1990, to continue consideration of this application and WHEREAS, the Planning Commission Hearing was again continued to October 2, 1990 to continue consideration of this application, and WHEREAS, the Planning Commission denied CUP-90-06 based on inadequate plans and proposed parking improvements, and WHEREAS, the Planning Commission denial of CUP-90-06 was appealed by the applicant, and WHEREAS, a properly noticed public hearing was held by the City Council on October 25, 1990 to hear said appeal, and WHEREAS, the apphcant shall sign an agreement stating that he will abide by the conditions of approval ATTACHMENT A NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Grand Terrace, California, that the following findings have been made in accordance with the approval of CUP-90-06, 1 As conditioned, and operated accordingly, the project will not be detrimental to the general health, safety, morals, comfort or general welfare of the persons residing or working within the neighborhood or proposed use or within the City 2 The occupation of this site subject to the conditions listed below will not be injurious to the property or improvements in the track shall be secured and locked 11 A detailed planting and irrigation plan shall be submitted to the Planning Department 12 The proposed project shall be constructed in accordance with the approval by the City Council on October 25, 1990 Minor changes and/or clarification may be made by the Planning Department 13 All aspects of the proposed project including landscaping, irrigation systems, building maintenance and operations shall be maintained in a clean and functional manner and operated in accordance with this approval and the overall goals and objectives of the City of Grand Terrace
