WHEREAS, not only do crime victims and their loved ones often face physical or financial

sense of violation, and

C. WHEREAS, it is important that the rights of victims are protected and given equal
- - 1 consideration with the rights of the accused, and this can only be achieved by insisting that our
k criminal justice system and entire society are fair and understanding in helping crime victims to

WHEREAS, victim/witness assistance programs serving every county of the state are
designed to guide Californians through understanding to California's victims, and
WHEREAS, during the observance of Victims' Rights Week, it is appropi iate that every
" - - Californian recognize the rights of victims, while becoming more aware of the safeguards and
-- ' , prevention techniques which they can observe to help ensure that they will not become victims,

A regular meeting of the City Council of the City of Grand Terrace was called
to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton
Road, Grand Terrace, California, on March 28, 1991 at 6 00 p.m.

2A. Mayor Matteson presented a Certificate of Service to former
Councilmember Barbara Pfennighausen.

of May 5-11, 1991 as "Victims of Pornography Week."
2C. Councilmember Hilkey read a Proclamation designating the month of
April 1991 as "California Earthquake Preparedness Month."
2D. Daniel Santo gave a presentation on financing land banking, which
is a concept whereby land is set aside in a trust for future use,
and the City of Chino Stadium Authority method of defraying
construction costs by charging admission to the newly-built
facility.

Subject Recycling program for Grand Terrace
The attached copy (Sun , March 11, 91) delineates Redlands somewhat
disappointing experience with a curbside recycling program. Redlands
experience is typical for most communities that attempt to capture and
recycle certain beverage containers, plastics and newsprint by curbside
collection.
Grand Terrace has the opportunity to be a pace-setter rather then a
lemming in the residential waste stream reduction task by initiating a
yard waste collection and composting process. As you are aware, yard
waste is seldom co-mingled with other domestic refuse, therefore, the

separation and storage of this material will have a minimal impact on
the generating resident. This is a major factor in the success of any
curbside recycling program.
Implementing a yard waste composting program would be mainly an
administrative process as the material is normally separated and the
equipment used by the current collecting contractor is suitable for the
task and an operating composting facility is located adjacent to the
San Timoteo landfill .
We urge you to implement a true recycling program for Grand Terrace-
COMPOSTING YARD WASTES- all will be winners
1- Landfill - A significant reduction in the volume of waste entering
landfill .
2- Collection Contractor- Savings of approximately $19.00 per ton
tipping fee.
3- City- Grand Terrace will have made a positive move towards
compliance with AB 939 mandated waste stream reduction
task.
4- Resident- Composting practically eliminates the need for additional
source separation and storage of yard waste.
Mr. O'Neal also stated that on Tuesday, April 2, 1991 he will tour the
Marysville Recycling Facility and offered to assist with transportation
for the Council and any persons who want to attend the tour. He
expressed his dissatisfaction with curbside recycling but expressed his
wish that the City continue to use the services of BFI.
Barbara Pfennighausen, 22111 Ladera, Grand Terrace, expressed
dissatisfaction with the sound system in the Council Chambers and
announced that she attended the Riverside Highland Water Company's
Shareholders Meeting, which was held in the morning of March 28, 1991.
She stated that the meeting reviewed rate increases and other matters
of interest to Grand Terrace residents but indicated dismay that there
were few in attendance at the meeting. She felt that a representative
from the City should have attended the meeting since the City is a
shareholder in the water company. She indicated that she received her
quarterly copy of the City of Colton Community Newsletter and expressed
her satisfaction with the information contained in it. She questioned
when the public would be informed of the low interest loans that the
City of Grand Terrace has available for home improvement projects
within the City, citing her belief that no one was aware of the City's
project to establish uniform walls along Barton Road. She added that
she attended the Disaster Council meeting on Wednesday, March 20, 1991,
commenting that the Council adopted a Resolution regarding Earthquake
Preparedness Month. She referenced flyers that announce the Safety
Fair, which is being presented in conjunction with Earthquake

Preparedness Month, that were given to Council , stating that extra
flyers will be placed in public locations. She added that the Fair
will be held on April 13, 1991 from 10 00 a.m. to 3 00 p.m. , indicating
that it will be a funfilled and informative event.

minutes of February 20, 1991.
5B. Council Reports
Mayor Matteson, announced that Free Refuse Disposal Day will be
held on Saturday, April 13, 1991 and read from the letter from the
Solid Waste Management Department, stating that "Only refuse from
family residential units may be disposed of free of charge. This
is the first of two free residential landfill use days being
offered to residents of the valley area this year. We ask that
residents comply with the following automobiles, station wagons,
cars with trailers, and pickups to 3/4 ton will be admitted free
upon presentation of a valid driver's license showing residence
within" the community. He added that the next Free Refuse
Disposal Day will be Saturday, October 12, 1991, stating that
household hazardous waste is prohibited at the dump site. He
indicated that those waste products can be disposed of at the
Redlands City Yard, 500 Kansas Ave. , Redlands, on Saturdays from
9 30 a.m. to 12 30 p.m. and at 777 E. Rialto Ave. , San Bernardino,
from 9 00 a.m. to 4 00 p.m. Monday-Friday. He indicated
further that used motor oil can be disposed of free of charge at
the Chevron Station , 1241 Washington St. , Colton , and at Jerry's
Union 76 Station , Grand Terrace.
Councilmember Hilkey, remarked that Comcast is currently
televising notices of public meetings and community interest
announcements free of charge and indicated that citizens can call
the City Clerk's Department or take their announcements directly to
Comcast to be aired. He stated that business ads cost $10.00 per

week, commenting that ads can be changed weekly and are run
continuously every ten minutes, 24 hours per day. He expressed his
thanks to Mike Marron of Comcast for his efforts in implementing
the advertising project. He indicated that his child attends a day
care program and stated that he wrote down the times that children
were delivered to the site, explaining that the times ranged from
6 50 a.m. to 8 50 a.m. He commented that there were usually no
more than three or four parents at that site at any one time and
r surmised that parking will not be a problem at the City's proposed
Day Care facility.
Councilmember Christianson, mentioned that he saw articles in the
Press Enterprise and the Sun on the City's low-interest, home
improvement loans and expressed his belief that the City would
benefit by placing an article in the Chamber of Commerce
newsletter. He announced that the Annual Easter Egg Hunt will be
held on Saturday, March 30, 1991, at 10 00 a.m. at Terrace Hills
Community Park.
It was the concensus of Council to cancel the April 11, 1991 City
Council meeting after learning that two Councilmembers will be
unable to attend.

improvements as the number one priority of the City of Grand
Terrace for the 1991/92 CDBG project year.

of Lots 1 and 2 shall be preserved unless written approval is
given by the Planning Department prior to the removal of said
trees or any other action which would result in substantial
damage to said trees.
11. As to the remaining mature and healthy trees within the
project, they should be preserved where feasible consistent
with the nesessary grading requirements.
12. Consideration of alternative street lighting, with a focus
toward rural atmosphere lighting, if possible

accept the third alternative proposed by B F.I. whereby the
contractor will receive 100% of the revenue from the recycled
materials which will result in a net increase to single-family
homeowners of $1. 15 per month and .05c per month to senior citizens
60 years of age or older and to adopt the recycling rate

Staff is in the process of putting its pool personnel together
for the City ' s Summer Pool Program. These positions will be
filled with a combination of staff that we have used in previous
summers and some new personnel . The attached resolution
establishes the salary range for these positions. Our salaries
have been the same for the past two years , and they were in line
with other city programs . Staff is recommending that we
increase these salaries to ensure that we keep qualified
personnel , and remain competitive in the recruitment process.

WHEREAS, the City Council of the City of Grand Terrace has determined
the need to adjust the salary ranges for the positions contained in this

SECTION 1. Rescission - That Resolution No. 91-01 is hereby rescinded
in its entirety.

BERNARDINO COUNTY ' S ILLEGAL OFFSET OF COUNTY
BOOKING FEE CHARGES AGAINST CITY PROPERTY TAX
AND OTHER REVENUES
WHEREAS , the State Legislature , in the late hours of
the 1990 legislative session , approved SB2557 allowing Counties
to charge cities booking fees pitting cities against counties ,
and
WHEREAS , San Bernardino County adopted booking fees in
January 1991 over the protests of all the cities and law
enforcement agencies of the County , including the Sheriff , and
WHEREAS , all 22 cities in the County filed suit against
San Bernardino County in Superior Court , Case #262309 , and
WHEREAS , the County began billing cities for booking
fee charges retroactive to July 1 , 1990 , and
WHEREAS , the cities dutifully protested such charges
pursuant to Government Code Section 907 , and
WHEREAS , in April 1991 , the County began offsetting
such booking fee charges against property tax and other revenues
legally obligated to the cities in contravention to State law ,
NOW, THEREFORE BE IT RESOLVED that the City of Grand
Terrace hereby officially protests San Bernardino County ' s
illegal offset of County booking fee charges against City
property tax and other revenues The City Clerk is hereby
directed to have a copy of this Resolution sent to the San
Bernardino County Board of Supervisors

made in reference to Neighborhood Watch and other pro-
grams in Crime Prevention She stated that it was
becoming imperative that new programs be orchestrated
within the city and that public awareness must become
the Committee ' s fiscal Year priority Discussion in
regard to increasing crime statistics and traffic prob-
lems was the focal point in publicizing for citizen
awareness
#3 Howard Panek announced that Thursday , March 14 , 1991
new members of the Citiren Patrol Unit were to graduate
having attended the prescribed training program given
by the Sheriff ' s Department The ceremony was scheduled
for 1600 hours at the Library in Yucaipa All members
were urged to attend
#4 Debra Mueller reported to the Committee regarding her
presentation to the City Council regular meeting date
of February 28 , 1991 She outlined her report in efforts

graffiti within the city limits the addressed the
fact that she would need volunteers to assist where
graffiti was to be removed from private property

#5 JoAnn Johnson indicated the need for better marked
handicapped spaces at the Community Center on Barton
Road She reported of frequent abuses and violators
whose illegal parking made it often impossible for
handicapped people to park conveniently She also
added„Chat one or two 5-minute loading zone spaces
adiacent to the handicapped area would eliminate some
of the violators from parking within the handicapped
zones to load and unload Upright signs on the handi-
capped spaces would add emphasis It was suggested
that the Lions Club representative be contacted in
reference to this problem
#6 Sharon Korgan updated the Committee on the up-coming
program in June formerly called "The Safety Fair" but
now more accurately identified as "Grand Terrace Dav
She displayed a variety of promotional materials for
sale aria distribution for the event
#7 A motion was made by Dick Rollins to obtain $2500 00
out of the budget to purchase various items of promo-
tional materials as requested by the Committee Bea
Gigandet made the second and it carried unanimously
#8 A motion was made also to obtain $200 00 for certain
trophy for winners in planned catagories for the parade
participants during Grand Terrace Day The motion
carried It was pointed out that there was sufficient
funds currently in the Budget available for such pur-
chases
There being no further business to discuss , the meeting
was adjourned at 2045 hours

Minutes of April 1, 1991 Meeting
The meeting was called to order at 7 PM by Chairman Vi Gratson.
Those present were VI, Irene Mason, Marie Schmidt, Pauline Grant,
Hannah Laister, Randy Anstine and special guest Vi' s sister
Edna from New York.
The minutes of the march meeting were repa ana api,roved, motion
made by Marie, seconded by Pauline, all in favor.
CiTreasurer' s report $1, 329.94 balance.
Old Business Art Show Irene reported that she had given
publicity article to Lhe Chamber of Commerce newsletter . Also
had given an item to Virginia llarford for ner column, plus the
Sun, PressEnterprise, and Colton Courier. Item will be on
Coble TV. Ann reported by phone that she has 14 participants,
has mailed out 30 applications. Randy will replace the wire
on the walls in the Community Room. There will be a special
meeting to finalize plans on Wednesday, April 17th at Viola' s
home. Flyers are done, posters will be ready by Lhe middle
of the month.
Workshop March 12th Pictures are in order to be put in albums
and marked. Additional supplies have been purchasea. There will
De another workshop after the Art Show.

Staff is proposing two amendments to the City's Zoning Ordinance
Setbacks, Section 18 10 040
This proposed amendment (Attachment A's Exhibit A) allows 10 feet of the required
35 foot rearyard setback for R1-20 zoned properties to have a slope greater than 5%,
currently no part of the required 35 feet may have a slope greater than 5% The

with less than 500 square feet
c) Ground floor additions to existing residential structures located in an

Section 18 63 010 Purpose
The purpose of this chapter is to empower the Planning Commission to sit as the City's Site
1 and Architectural Review Board with the responsibility for comprehensive site plan and
architectural review in order to achieve the following
A To ensure that new development and the alteration or enlargement of existing
development occurs in a manner that is consistent with the intent of this title
and the General Plan,
B To ensure that the location and configuration of structures are visually
harmomous with their sites and surrounding sites and structures, that they do
not unnecessarily block scenic views from other structures and/or public
areas, and is in scale with the townscape and natural landscape of the area,
C To ensure that the architectural design of structures and their materials and
colors are visually harmonious with surrounding development, natural
landforms, is functional for the proposed project and is consistent with this
title,
D To ensure that plans for landscaping and open spaces provide a functional
and visually pleasing setting for the structures on the site and is harmonious
with the natural landscape of the area and nearby developments,
H To ensure the preservation of the natural beauty of the city and its setting, to
prevent the indiscriminate clearing of property, the destruction of trees and
natural vegetation and the excessive and unsightly grading of hillsides, and to
preserve the natural landforms,
F To ensure that the design and location of signs are consistent with the scale
and character of the building to which they are attached or otherwise
associated with and are consistent with this title
Section 18 63 020 Application
A Site and architectural review shall be required in the event any of the
following actions occur
1 Any new construction (other than patio covers under ten feet in height
and detached accessory structures under ten feet in height with less
than 200 square feet of floor area and are located in an R1 District)
2 Any remodeling or renovation of a structure which results in
a) A change of use (includes any proposed use of a structure
which has been vacant for a period of six months or more), or
b) An increase in building size (including bulk area and floor
area), or
c) Increased capacity, or
d) Additional street access
3 Any conversion of a single ownership property to a condominium
ownership or stock cooperative project
4 Any placement of a modular structure in any district in accordance
with this title
B The following items may be approved by the Planning Director without going
to the Site and Architectural Review Board
1 Patio covers in an R1 District under 10' in height
2 Accessory structures located in an R1 District under 10' in height with
less than 500 sq ft
3 Ground floor additions to existing residential structures located in an
R1 Distnct where the addition is less than 500 sq ft gross floor area
and the exterior design and materials of the addition matches the
exterior design and materials of the existing structure
Section 18 63 030 Scope
Where site and architectural review is required the Site and Architectural Review Board
shall consider the following issues (the Site and Architectural Review Board may also
consider other relevant issues not listed below)
A The proposed siteplan for the property shall be reviewed taking into
consideration the following
y 1 Placement of all structures and improvements (including
adherence to setback requirements)
2 Vehicular ingress and egress
3 Internal vehicular circulation and parking lot design
4 Pedestrian and vehicular safety
5 Landscaping
6 Pedestrian amenities
7 Lighting
8 Location of all service facilities
9 Walls and fences
10 Police and fire protection
11 Relationship to adjoining properties, structures and the site's
and surrounding area's natural topography
12 Relationship to existing and/or the planned use of adjoining
properties and within the general area
13 Consistency with this title and the General Plan
B The proposed architecture of all structures shall be reviewed taking into
consideration the following
1 Architectural style and building design
2 Proposed building materials and colors
3 Height of structures
4 Design and location of all signs
5 Size and bulk of the structures in relation to existing and/or
planned structures on the subject site, adjoining properties and
within the general area
6 Consistency with this title and the General Plan
Section 18 63 040 Submittal Process
Applications for site and architectural review shall be submitted to the Planning
Department The Planning Director shall review each application and determine its
completeness in accordance with planning department policy Upon determination that an
application is complete, the application shall be scheduled for review by the Site and
Architectural Review Board
An application for site and architectural review shall contain the following
A Completed application form
B Site plan, twenty-five (25) blueline copies plus one (1) blueline copy colored
for presentation purposes The site plan shall be a fully dimensioned drawing
clearly showing
1 All buildings, property lines and easements
2 All parking spaces, driveways and drive aisles
3 All landscaped areas
4 All walls and fences
5 Location of all signs
6 Public improvements to the street centerline
7 Site address and assessor's parcel number
8 Property owner name and address
9 Number of lots and their sizes (in square feet)
10 North arrow, graphic and numeric scales
C Elevations, twenty-five (25) blueline copies plus one (1) blueline copy colored
for presentation purposes The elevations shall be scaled, dimensioned
drawings of each side of each building and/or sign
D Landscape plan, twenty-five (25) blueline copies plus one (1) blueline copy
colored for presentation purposes The landscape plan shall show the location
of all proposed plant material, common and botanical names, quantities and
sizes,paved areas and paving materials and property lines
E Grading Plan, twenty-five (25) blueline_ copies plus one (1) blueline copy
colored for presentation purposes Ile grading plan shall show existing and
proposed topography for the site and within 100 feet of the property lines
The plan shall also show all trees with a trunk diameter greater than four
inches
F Material Board, one (1) 8 1/2" by 11" mounting board showing samples of
exterior design elements such as roofing material, paint chips, brick, stone or
other accent features
G 300 foot radius map, property owner mailing list keyed to the radius map and
a signed mailing list affidavit
H Application fee
The Planning Director may require additional information or delete certain requirements
from an application depending on the specific situation

are consistent with the scale and character of the building to
which they are attached or otherwise associated with and are _
consistent with the Grand Terrace Municipal Code
7 Conditions of approval for this project necessary to secure the
purposes of the Grand Terrace Municipal Code and General
Plan are made a part of this approval
Section 18 63 070 Appeal Process
The decision of the Site and Architectural Review Board shall be final unless appealed to
the City Council v.ithin ten (10) calendar days Such an appeal may be made by the
applicant, any member of the City Council or any other interested person
A An appeal of a Site and Architectural Review Board decision shall be made
in the following manner
1 Filing with the City Clerk's Office a completed Application for
Appeal
2 Payment of the appropriate appeal fee
B After accepting an application for appeal, the City Clerk shall set a date for
the City Council to hear the appeal Notices of the appeal shall be given to
the applicant, the Site and Architectural Review Board and the appellant
C The Site and Architectural Review Board shall submit a report to the City
Council containing the reasons for the Board's decision and the minutes of its
meeting regarding the appealed decision
D The City Council shall hear the appeal and make its own determination
regarding the application and its consistency with this title and the General
Plan Upon such determination, the City Council shall uphold, modify or
reverse the Site and Architectural Review Board's decision If during the City
Council's hearing of the appeal, new information is provided that was not
considered by the Site and Architectural Review Board, the City Council may
refer the application back to the Site and Architectural Review Board for
reconsideration of the application with the new information
Section 18 63 080 Building Permit Process
After the appropriate appeal period has ended or after a final determination is made by the
City Council, the applicant may submit for building permits
The application shall include three (3) sets of the approved siteplan, elevations, landscape
plan and grading plan, each set shall be approved and signed by the Planning Director and
shall have attached to it a copy of any conditions of approval required by the Site and
Architectural Review Board or the City Council Two of the required sets of plans shall be
submitted to the Department of Building and Safety along with the appropriate construction
specification plans for the approved project The third set shall be kept on file in the
Planning Department The Department of Building and Safety shall then prepare the
appropriate permits in accordance with all applicable state and local codes
Section 18 63 090 Minor altei ations and Revisions
An applicant may request minor alterations or revisions to approved plans after the initial
approval of the plans as follows
A. Minor alterations to the approved plans which result in a change to the
extenor facade of a structure, any element of the landscaping plan or the
design of the siteplan may be approved by the Planning Director Other
rrunor alterations may be approved by the Building and Safety Director All
n) approved minor alterations shall not result in a substantial change from the
approved plans
B A- proposed revisions which result in a substantial change to the approved
plans shall be submitted to the Site and Architectural Review Board for
consideration pursuant to the procedures set forth in this chapter for initial
application
Section 18 63 No Expiration and Extensions
The approval o site and architectural review application shall expire one (1) year from
the date of its approval unless one of the following actions occur
A Tt-e applicant applies for a building permit in accordance with the approved
plans prior to the expiration date
B The applicant applies to the Planning Department for an extension of the
approval prior to the expiration date
The Planning Director may upon application by the applicant, extend the period of approval
for a length of time up to one year No approval shall be extended to a date beyond two
(2) years from the date of the initial approval

The City of Grand Terrace budgeted $ 100 , 000 for the upgrade and
beautification of the Barton Road/ I215 interchange This project
was difficult to get under way , as it was not clear what property
we could potentially irrigate and landscape The rights -of-way
for the property nad to be clarified between the City of Grand
Terrace and Cal Trans We have developed a preliminary map of
the scope of work

U The City has been working with Randolph Hlubik Associates , Inc
( R H A ) for this project Council may recall R H A as the firm
the City utilized for the Barton Road specific plan Landscape
design and installation estimates for the total cost of design
and construction will be approximately $ 150 , 000 Therefore , we
will need to budget additional funds in fiscal year 1991 /92 to
cover the balance of the project
The scope of the project includes design specifications , plans ,
bid packages and installation specifications for landscape
improvements with irrigation This also includes a decorative
brick wall along the frontage of Grand Terrace Elementary School ,
as well as a subcontract to design a "City of Grand Terrace"
entrance monument , which will be incorporated into the
construction project
The estimated contract cost for the work is detailed on the
attached proposal as follows

In its Agreement for the purchase of real property at 22400
Barton Road for the purpose of constructing a Chid Care Center ,
the City agreed to deposit $227 , 000 into escrow , subject to four
conditions
1 Acceptance of a Title Report
2 Receipt of a M A I appraisal of subject property
with confirmation of value of at least ,
excluding improvement costs $454 , 000 ,
3 Written confirmation from existing First , Second and
Third Trust Deed holders to release property from
liens at close of escrow
4 Financing acceptable to Buyer
The first , second and third conditions have been met We are in
receipt of the Title Report , M A I appraisal of a value of
$575 , 000 00 , and confirmation of existing lien holders consent to
release property The City is currently structuring our tax-
exempt financing , and expects that certificates will be sold and
funds available by June 1 , 1991
Once financing has been structured and accepted , we will release
the $227 , 000 deposited into escrow In an additional term under
section 3 ( ii ) , the City agreed to deposit an additional $227 , 000
into escrow , to be released to New West Savings & Loan
Association upon notification that Seller has deposited into
escrow a copy of Seller ' s Building Permit for the Child Care
Center , indicating governmental approval for Seller to commence
construction This $227 , 000 will be secured by a note and
amended Fourth Trust Deed , acceptable in form to the City
Attorney The balance of our purchase price is due at the close
of escrow

In order to keep our project on schedule , funds will need to be
advanced from the General Fund Unappropriated Fund balance This
will be reoayed when certificates are sold , an approximate
advance period of one month ,-
In addition to the advance escrow deposit , the City needs to
appropriate $25 , 000 for the purpose of architectural and
engineering design services , which will also be reimbursed to the
General Fund at the time of sale of the certificates
STAFF RECOMMENDS
1 COUNCIL AUTHORIZE AN APPROPRIATION OF $479 , 000 FROM THE
GENERAL FUND UNAPPROPRIATED FUND BALANCE FOR THE GRAND
TERRACE CHILD CARE BUILDING PURCHASE
2 COUNCIL AUTHORIZE THE GENERAL FUND TO BE REIMBURSED FOR THE
LOAN AMOUNT OF $479 , 000 WHEN CERTIFICATES ARE SOLD AT THE END

EMPLOYMENT AGREEMENT
THIS AGREEMENT , made and entered into this day of
, 1991, by and between rHE CITY OF GRAND
TERRACE , hereinafter CALLED "EMPLOYER" and THOMAS J SCHWAB, 7- _
hereinafter called "EMPLOYEE , " both of whom understand and agree
as follows
WITNESSETH
WHEREAS EMPLOYER desires to continue to employ the services
of EMPLOYEE as City Manager of the CITY OF GRAND TERRACE as
provided by Chapter 2 08 of the Municipal Code and other
ordinances and resolutions applicable to employees , and
WHEREAS , it is the desire of the Governing Board , i~ 1
hereinafter called "COUNCIL , " to establish certain conditions of
employment and to set working conditions of said EMPLOYEE , and
WHEREAS , it is the desire of the COUNCIL to ( 1) retain the
services of EMPLOYEE and to provide inducement for him to remain
in such employment , ( 2) to make possible full work productivity
by assuring EMPLOYEE ' S morale and peace of mind with respect to
future security , ( 3) to act as a deterrent against malfeasance ,
dishonesty for personal gain , or willful misconduct in office on
the part of EMPLOYEE , and ( 4) to provide a just means for
terminating EMPLOYEE ' S services at such time as he may be unable
fully to discharge his duties due to age or disability or when
Employer may otherwise desire to terminate his employ, and

NOW, ThEREFORE in corsideration of the mutual covenants
herein contained, the parties agree as follows
SECTION 1 DUTIES
EMPLOYER hereby agrees =c employ said Thomas J. Schwab as
City Manager of said EMPLOYER :o perform the functions and duties

specified in Section 2 08 of the Municipal Code and to perform
other legall' permissible and groper duties and functions as the
COUNCIL shal _ from t i ie to ti-e assign
SECTION 2 fERI INATION - D SEVERANCE PROVISIONS
(A ) EMPLOYEE , in the event COUNCIL should terminate
EMPLOYEE witnout cause , EMP_� EE shall receive six ( 6) months '
severance pay at full salary a ,d fringe benefits
( B) If EMPLOYEE volunta=_ iy resigns his position , he shall
give at least thirty ( 30) days 'ritten notice to EMPLOYER
( c) COUNCIL may terminate the employment of EMPLOYEE at any
time for cause based on any ground or grounds listed in Exhibit
"A " nereto EMPLOYEE shall lot be entitled to any severance
payment whatsoever in the even: of his termination for cause
SECTION 3 FRINGE BENEFITS
EMPLOYEE shall continue to receive vacation leave ,
administrative leave , sick lea 'e , holiday leave , administrative
leave , retirement , auto allowance and other fringe benefits and
working conditions in accordance with that provided to other
employees

SECTION L OTHER TERMS AND CONDIIIONS OF EMPLOYMENT
(A ) The COUNCIL , in consultation with the Manager , shall
fix any such ether terms and conditions of employment , as it may
determine from time to time , relating to the performance of ,

EMPLOYEE , prc ided such terms and conditions are not inconsistent
with or in conflict il.th the provisions of this agreement , City
Ordinances o_ esolut±ons .
( B) A_ _ provisions of City Ordinances , Resolutions and
regulations a,-Id rules of the EMPLOYER relating to vacation and
sick leave , :eo rement and pension system contributions , holidays
and other =_ _nge benefits and working conditions as they now
exist or hereafter ma / be amended , also shall apply to EMPLOYEE
as they woula to other employees of EMPLOYER , in addition to said
benefits enumerated specifically for the benefit of EMPLOYEE
except as herein provided
(C) EMPLOYEE shall be entitled to receive the same vacation
and sick leave benefits as are accorded employees including
provisions governing accrual and payment therefor on termination
of employment
SECTION 3 NO REDUCTION OF BENEFITS
EMPLOYER shall not , at any time during the term of this
agreement , reduce the salary, compensation or other financial
benefits of EMPLOYEE , except to the degree of such a reduction
across-the-board for all employees of the EMPLOYER

SECTION 6 COMMUNICATION WITH CITY COUNCIL
To the -aximum extent possible , Manager shall provide his
input to anc communicate with all members of City ' s City Council
simultaneous In any instance where such simultaneous
communication is not feasible , EMPLOYEE shall communicate with
City ' s Mayor Mayor Pro lem and other members of the City ' s City
Council in tra : order but , in any event , with all Council Members
as soon as pc= ible
SECTION ^ GENERAL PROVISIONS
A The next herein shall constitute the entire Agreement
betveen the tia_ ties
B Th±s Agreement shall be binding upon and inure to the
benefit of the heirs at law and executors of EMPLOYEE.

C This -agreement shall become effective commencing
, 1:91, and shall terminate upon EMPLOYEE ' S resignation
or COUNCIL ' S termination of EMPLOYEE If COUNCIL should
terminate EMP_TYEE , severance pay and benefits shall be paid as
referenced in Section 2
D If any provision , or any portion thereof , contained in
this Agreerre lt is held unconsi-] tutional , invalid , or
unenforceable the remainder of this agreement , or portion
thereof , sha_ _ be deemed severable , shall not be affected and
shall remain _n full force and effect .
IN WITNESS WHEREOF, the City of Grand Terrace has caused
this agreement to be signed and executed in its behalf by its
