Mayor Matteson presented San Bernardino County Sheriff's Captain Ernie Reynosa with a plaque in appreciation of his many years of service to the City of Grand Terrace. City of Grand Terrace Community Service Officer, Sharon Korgan, gave a presentation on Red Ribbon Week and Neighborhood Watch in honor of Crime Prevention Month, October 1991. City Manager Schwab introduced Captain Tom Denham as the new San Bernardino County Sheriff's Captain for Grand Terrace. RESCIND REFUSE EXEMPTION (MAZEN YASIN) ` , PUBLIC COMMENT Barbara Pfennighausen, 22111 Ladera St. , Grand Terrace, thanked the City Council and Staff on behalf of the Citizen 's Patrol and all of the City's volunteers for the picnic that the City gave to honor the volunteers on September 21, 1991. ORAL REPORTS 5A. Committee Reports 1. Crime Prevention Committee (a) Minutes of 8/12/91 CC-91-146 MOTION BY MAYOR PRO TEM GRANT, SECOND BY COUNCILMEMBER CHRISTIANSON, CARRIED 5-0, to approve the Crime Prevention Committee Minutes of August 12, 1991. 5B. Council Reports Mayor Matteson, recited an article about graffiti that appeared in the National Graffiti Information Network newsletter. Commenting that there is a language of graffiti which can serve to direct people to a location of illicit drug sales, he stressed the need to remove graffiti promptly. He stated that he has scheduled a meeting on Monday, September 30, 1991 with Dr. Fischer, Superintendent of the Colton Joint Unified School District, who is presently conducting study sessions regarding the Grand Terrace School District issue. He announced that Free Dump Day will be October 12, 1991 and read an article printed in the High Desert Star that compliments the City of Grand Terrace's financial stability. He expressed delight that the City is gaining a reputation as a well-operated City. He announced that Carol Beswick, Mayor Pro Tem of the City of Redlands, resigned her position as a Board member of the South Coast Air Quality Management District and added that the City Selection Committee will assign a replacement on November 6, 1991. He stated that Milford Harrison, Mayor of Loma Linda, requested the City of Grand Terrace's support as a candidate for that position. Council Minutes - 9/26/91 Page 3 Council concurred to support Milford Harrison 's candidacy for membership on the Board of the South Coast Air Quality Management District. Mayor Matteson, remarked that the City of Grand Terrace has also received a request to support San Bernardino Community College District ballot Measure L, commenting that the $60 million bond issue will initially raise property taxes $3.00 per year and will increase to $8.00 annually. Emphasizing that the City has a policy to avoid involvement in political issues, he polled the Council for their opinions. It was the consensus of Council that the City should remain neutral on Measure L. Mayor Matteson, announced that the City/Council Conference will be held at the Lake Arrowhead Hilton on November 7 - 8, 1991 and requested that Council attend the meeting. He recited a letter from the Department of Public Health regardig the impending flu season which indicates that from October through December, the San Bernardino County Department of Public Health will sponsor its annual comapign to innoculate children, adults with chronic illnesses, and seniors over the age of 55 years against flu and other illnesses. He commented that the letter indicates that there will be a $3.00 charge for each immunization and information can be obtained by calling 387-6788. He commented that the clinic which will be held on Thursday, November 21, 1991 from 2 00 p.m. to 4 00 p.m. at the Hutton Center will be the closest immunization site to Grand Terrace. He stated further that a copy of the health department letter will be forwarded to the Senior Citizen 's group and added that another copy of the letter will be available in the City Manager's office. Mayor Pro Tem Grant, expressed satisfaction with the success of the Volunteer picnic and commended the volunteers. He invited the public to the Grand Opening of the Child Care Center and revealed that the building will be dedicated to Grand Terrace's first City Manager, Seth Armstead. Mayor Matteson, remarked that due to the closing of the Grand Terrace Pharmacy on Friday, September 27, 1991, the Grand Terrace postal service contract will be open for bids. He stated that once the bid is awarded, the post office substation will re-open in another location in the City. City Manager Schwab, indicated that since the arrival and subsequent installation of certain plumbing fixtures, the Child Care Center is now ready for the October 4, 1991 opening ceremonies that will be held at 6 00 p.m. He commented further that there are still openings in the Child Care Program, which is open to all communities. He encouraged parents to register their children for Council Minutes - 9/26/91 Page 4 the child care program and remarked that the Child Care Center will open for business on October 7, 1991. Councilmember Hilkey, announced that the Friends of the Library will be holding their annual Book Sale from 4 00 p.m. to 7 00 p.m. on Friday, September 27, 1991 and on Saturday, September 28, 1991 from 10 00 a.m. to 3 00 p.m. He expressed delight with the Volunteer picnic and complimented the structure and setting of the Child Care Center. He mentioned further that on Sunday, September 29, 1991 the First Baptist Church of Grand Terrace will be presenting Grand Terrace Days. He commended the City Manager for attending City events and praised the City Manager's involvement with the community. Revealing the disparity between effort and profit, he remarked that he recycled 570 pounds of newspapers, 115 pounds of aluminum, 163 pounds of glass, and 110 pounds of cardboard and gained only $22.40. He expressed his opinion that recycling is expensive and indicated that recyclers do not recycle kitchen glass or used motor oil . He explained that the City's curbside recycling program is inexpensive and complimented the program. He recommended that Council support the Chamber of Commerce in their efforts to encourage and attract tenants to the developments in the City. Mayor Matteson, declared that the Union 76 station in Grand Terrace will recycle used motor oil . Councilmember Christianson, indicated that cooking-contest participants are needed for the 10th Annual Grand Terrace Country Fair that will be held on November 2, 1991 at the Grand Terrace Community Center and added that the Women 's Club will hold their barbeque at the Fair from 10 00 a.m. to 4 00 p.m. He suggested that the public contact Vi Gratson at 783-0634 or Ann Petta at 783-0658 for more information about the Country Fair and mentioned that the deadline for participation is October 15, 1991. He reported that the Tour de Terrace will be held on October 6, 1991 from 6 00 a.m. to 12 00 noon and announced that his son, Kevin Michael Christianson, was born on September 17, 1991. Councilmember Carlstrom, commented about articles that were printed in a Colton Joint Unified School District publication regarding gang attire and the dangers of a new alcoholic beverage know as a Cisco Cocktail , which has a comparatively high alcohol content. He expressed his belief that Grand Terrace should be conscientious in monitoring the sale of liquor to minors. Indicating a high regard for Dr. Fischer, he read aletter which he received from Superintendent Fischer that thanks Councilmember Carlstrom for meeting with him and indicates that Dr. Fischer will attend a Council meeting once he has met with all of the City's Councilmembers regarding the Grand Terrace -School District issue. He also recited a letter he received from Mayor Holcomb regarding a draft Resolution to repeal the booking fee initiative and a luncheon meeting regarding the booking fees which is scheduled to Council Minutes - 9/26/91 Page 5 be held on October 2, 1991 at the Third Floor Board Room of the City Hall Annex at 201 N. "E" Street, San Bernardino. He stated further that the letter requests that comments regarding the Resolution be directed to Fred Wilson, Assistant City Administrator, at 384-5122. He also reported that he attended the SANBAG Congestion Management Program (CMP) meeting, the purpose of which was to establish guidelines for reporting on area traffic problems and to determine traffic volume and the impact of new development on traffic flow. Mayor Matteson , stated that the City received a letter of appreciation from the Grand Terrace Soccer Team for the City's contribution to the team. Rod Lambert, Grand Terrace Chamber of Commerce, reported that the Chamber's second annual Retreat planning session will be held on Saturday, October 5, 1991 from 8 30 a.m. to 1 00 p.m. He indicated that the Chamber of Commerce's Directors and Ambassadors will attend the opening of the Day Care Center on October 4, 1991 and mentioned that Council is invited to a social hour which will be held prior to the Retreat at the Executive Director's residence. The initial spirit of the granting of exemptions was to grant exemptions to those individuals that can show a trend of providing comprehensive recycling on their own, or some other undo hardship. The City has been receiving recycling exemption requests that show less and less evidence of residents actually recycling and, in this case, provides one instance on 9/4/91 where they returned some California redemption-valued cans or bottles in for cash. Our Recycling Program has been an overwhelming success in a very short period of time. Exemptions should be granted only in cases where the evidence is more substantial that recycling actually occurs, rather than just not wanting to be bothered with the service or the $1 .15 cost per month. Renewal of CUP-90-06 Submittal of an application for renewal of Conditional Use Permit to allow continued operation of a outdoor remote , control race car track within the Village Commercial Area of the Barton Road Specific Plan APPLICANT K&M RC Accessories Mike Blake LOCATION 22474A Barton Road RECOMMENDATION Approval subject to conditions ******************************************************** BACKGROUND The review and approval of subject Conditional Use Permit goes back to June 19, 1990, when the application was submitted in order for the business to comply with City codes and regulations Since then, the project was denied by the Planning Commission The applicant appealed the Planning Commission decision to the City Council The City Council considered the proposal on October 25, 1990, subjecting the entertainment use to several conditions of approval, most of which to be accomplished within three (3) months One of the conditions was that the Conditional Use Permit was to be reevaluated within one (1) year The applicant received two (2) extensions of time to be able to comply with approval conditions Building permit plans have been reviewed and approved and final site inspection was satisfactorily completed September 26, 1991 by the Planning Department (Please refer to Attachment 1 for dates and detailed chronology of events ) The Conditional Use Permit expires on October 25, 1991 COUNCIL AGEMM MU•G5 22795 Barton Road • Grand Terrace, California 92324-5295 • (714) 824-6621 CUP-90-06 CC 10-10-91 page 2 DISCUSSION CUP-90-06, according to condition of approval #15, may be administratively extended for one year without cost to the applicant, if the Community Development Director finds that there is no adverse impact to the surrounding land uses However, this finding could not be made Even though most conditions of approval have been met and final site inspections ,—, were according to the plans and City codes, several complaints have been received by the City regarding the operations of subject activity It appears that this entertainment use at this location has potential to adversely impact the surrounding land uses, unless conditions of approval are strictly followed The Public Hearing will grant the public the right to provide input for or against the project and would allow the City Council to establish if the conditions of approval can be satisfactorily followed, and whether or not this project will have an adverse impact on its vicinity On August 21, 1991, the applicant was informed by staff that complaints were received by the City Manager's Office within the past two (2) weeks regarding the amplifier noise and business hours of operation exceeding the CUP approval and City Noise Ordinance Recent complaints were regarding the promoted special race track event of Saturday, September 21st, specifically referring to the crowds in excess of 100 and the loud speaker system disturbing residents in the surrounding vicinity at late hours Conditions violated were Conditions of Approval #6 and 9 Condition 6 - "Occupancy of the race track facility shall be limited to 75 persons " Condition 9 - "The hours of operation shall be limited to the following Fridays 7 00 p m to 10 30 p m Saturdays 10 00 a m to 5 00 p m Sundays 10 00 a m to 5 00 p m Staff has kept in contact and has met with the applicant to go over complaints Applicant is therefore aware of problems and has complied with site improvement conditions (Please refer to Attachment 2 - Development Director recommended that the activity cease at the location until the project was brought into conformance with all applicable codes On October 2, 1990, the Planning Commission denied the project based on inadequate and insufficient information reflected in the submitted plans and inadequate compliance with the Parking Code according to the Grand Terrace Municipal Code The applicant was ordered to cease and desist the operation of the remote control car race track facility and all improvements that had been done on the site in relation to the remote control car race track (outdoor improvements) were to be removed and the site returned to its original condition The applicant submitted an appeal application to the City Clerk and was scheduled for the October 25, 1990 City Council Meeting The City Council approved the applicant's Conditional Use Permit subject to certain conditions of approval The City Council also granted the applicant 90 days to come into compliance with the conditions of approval as noted in a followup letter to the applicant The applicant had until the end of the day, January 23, 1991 to complete all of the conditions of approval DRISCOLL, Chief County Fire Warden By e Protec a Planning Officer DATE October 4 , 1991 STAFF REPORT CRA ITEM ( ) COUNCIL ITEM ( XX) MEETING DATE October 4 , 1991 SUBJECT• REQUEST FROM GRAND TERRACE SCHOOL SITE COUNCIL FOR ,014 CROSSING GUARD FUNDING REQUIRED XX NO FUNDING REQUIRED The City is in receipt of a letter from the Grand Terrace School Site Council requesting an additional Crossing Guard on Vivienda Avenue at 3 20 p .m , when school is dismissed In discussion with School Site Chairman , Mrs Harker , she indicated that the afternoon dismissal is very busy with motorist activity She feels that a crossing guard is needed at this crosswalk The City currently provides a crossing guard on Barton Road for children walking to school in the morning , and again in the afternoon when school is over In addition , I have received citizen requests for additional crosswalks , as well as additional signage in the vicinity of Grand Terrace Elementary School I agree that additional signage would be helpful in alerting motorists of students attending year-round school schedules , but both Mrs Harker and I feel that additional crosswalks would confuse students by adding potential places where they may cross This would require additional Crossing Guards Placing a Crossing Guard at the Vivienda Avenue crosswalk only , and not adding additional crosswalks , designates that area as the place for students to cross Vivienda Avenue . Staff estimates the cost of providing a Crossing Guard for one hour per day at approximately $ 1 , 700 per year With eight months remaining in the fiscal year , approximately $ 1 , 200 would be required for salary and benefits . Approximately $600 would be needed for additional signage STAFF RECOMMENDS COUNCIL APPROPRIATE $ 1 , 800 TO PROVIDE A CROSSING GUARD AT THE VIVIENDA AVENUE CROSSWALK FOR ONE HOUR PER DAY , AND FOR ADDITIONAL SIGNAGE IN THE VICINITY OF GRAND TERRACE ELEMENTARY SCHOOL .
