Mt. Vernon, Grand Terrace, expressed dismay that her application for child care was rejected because her child is not enrolled in the local public school system. Stating her opinion that the City is a prime business location, she recommended that the City open a full-time child care center in Grand Terrace. Expressing dissatisfaction with the local school system, she remarked that she has opened her own private elementary school in the City, commenting that until she finds a more suitable facility, her daughter will remain as the only child enrolled in the school . She indicated her belief that there are limitations on City services available for residents and expressed concern regarding an apparent increase in crime in the City over the past few months. She suggested that the City increase the effectiveness of its Neighborhood Watch Program by implementing a foot patrol concurrently with the regular Citizens' and Sheriff's vehicular patrols. Citing the success of the Parks Program in the City of Rialto, she suggested that the City's Parks & Recreation Department similarly utilize school sites for recreational activities. She offered to perform volunteer work for the City and requested that her daughter also be allowed to learn more about the City through volunteer assignments. Virginia Harford, 11825 Arliss Way, Grand Terrace, emphatically indicated her dissatisfaction with the old G.T.I. Market site and remarked that there is no audio on the cable T.V. channel that broadcasts the Council meetings. She expressed her objection to the difficulty of parking in the Town and Country Center and suggested that the G.T.I. Market building be razed and the site converted into a parking lot. Mayor Pro Tem Grant, responded that the Council has addressed the G.T.I. Market issue but clarified that the owner of the building has thwarted the City's attempts to rectify the situation. He requested for the record that the City Manager explain the City_'s efforts to mitigate the G.T.I. Market problem. City Manager Schwab, stated that the owner of the G.T.I. Market requested permission to re-open the building with only superficial renovations but indicated that Council dismissed that proposal . Clarifying that the building in question has no economic value, he revealed that the property owner rejected an offer by the Community Redevelopment Agency to incur the cost of the demolition of the Council Minutes - 03/26/92 Page 3 structure. He commented further that the City cannot condemn the building unless the City can determine that the structure can be utilized for a public purpose and asserted that the City wishes to bring that location into conformance with the Specific Plan but cannot do so without the cooperation of the property owner. He revealed that the owner must maintain the building according to City Code safety standards but remarked that the City can do nothing further if the property owner does not wish to raze or properly renovate the structure. Although expressing doubt about the timely resolution of the matter and citing the property owner's uncooperative attitude, he revealed that the owner has listed the property for sale. He indicated further, however, that the Community Redevelopment Agency does not have the right to invoke eminent domain for commercial development purposes. ORAL REPORTS 5A. Committee Reports 1. Council Reports Mayor Matteson, announced that April 11, 1992 will be Free Dump Day for the citizens of Grand Terrace. He added that one of the the City's goals during 1992-95 is a reduction in the volume of waste discarded in landfills and commented that persons interested in removing their names from junk mailing lists may contact the City Manager for the address of an organization that will perform that service. Councilmember Hilkey, expressed concern regarding the funding of the Miss Grand Terrace Pageant. City Manager Schwab, remarked that a committee was formed to sponsor the pageants, commenting that the Miss, Junior Miss, and Little Miss Grand Terrace Pageants will not be affected by the inactivity of the Grand Terrace Chamber of Commerce. Council Minutes - 03/26/92 Page 4 Mayor Pro Tem Grant, inquired as to whether the Chamber of Commerce was no longer involved in the pageants. City Manager Schwab, responded that the Chamber recently voted to cease operations temporarily and stated that he will discuss the matter in his upcoming report. Councilmember Carlstrom, announced that he attended the League of California Cities, Inland Empire Division meeting at the Highland Springs Resort on March 25, 1992 with Mayor Matteson and Councilmember Christianson, commenting that the speaker discussed economic development in Cathedral City. He inquired whether the City experienced any problems during the recent rains. Assistant City Manager Anstine, indicating that the damage to the City's roadway and sewer infrastructure was relatively minor, commented that the City has applied to the Federal Emergency Management Agency (FEMA) for disaster relief assistance. In addition, individual cities shall have some responsibility to supply the S.B.0 F.C. with certain information to comply with the permit. Specifically, within the City of Grand Terrace, City shall be responsible for the following 1 . Inspection of Storm Drains for illegal connections, with first inspection in 1993 and each 3 years thereafter 2 Locating any dischargers who may be in violation of the Permit, if it is determined by the County that the source is in fact from within the city limits 3 Reporting as may be required by R W Q.0 B of each co-permittee . COUNCIL AGENDA ITEM#3 G Staff Report April 3, 1992 Page 2 On the County level , monitoring stations will be set up to collect run-off water at points approved by the R.W Q C B., water to be tested and reports provided to the R.W Q C.B. Within the Federal Regulations, there are provisions for individuals who are grading parcels 5 acres or larger to file "Notice of Intent" with the State Water Resources Control Board and be subject to a special permit as an individual . This regulation would apply to Public Works Projects within public agencies It has not yet been determined based on current regulations if for example a street overlay covering an area of 5 acres in public right-of-way less than 1" thick would be subject to a special permit. However, street reconstruction or new street construction definitely would require such permit if over 5 acres To meet the requirements of N P D.E S Permit No 8000200, San Bernardino County, San Bernardino County Flood Control , and all the cities within San Bernardino County tributary to Santa Ana River have determined that a single permit number is the most efficient and economical method of proceeding The costs associated with administering the program are shared by the co-permittees, based on the formula defined in Appendix "A" of the agreement It takes into consideration, the land area, the use of that land area, and adjusts the varying land uses into an equivalent area on the same basis for all the co-permittees The costs for the program in San Bernardino County is estimated at $800,000 00 for the F.Y 92-93 Based on that estimate and the adjusted area within the City of Grand Terrace, City's share of the cost for the F Y 92-93 is $5,500 00. The cost of the program will vary annually, and from all indications based on the regulations, the costs will increase in the future years. Although each city has not yet been notified of their actual cost, in order to meet the May 5 deadline for adoption of this agreement, we have requested the costs to the City, in order that the Council may act on it prior to the end of April . These costs ($800,000.00 County-Wide) are subject to audit at the end of the fiscal year and appropriate credit given and/or balance due, by each of the cities will be determined. JK/ct 1 National Pollutant Discharge Elimination System 2 Stormwater Permit Implementation Agreement 3 Santa Ana Region 4 5 6 This AGREEMENT entered into as of this day of , 1992 by 7 the County of San Bernardino, (herein called the COUNTY), the San Bernardino County Flood 8 Control District (herein called the DISTRICT) and the Cities of Big Bear Lake, Chino, Chino 9 Hills, Colton, Fontana, Grand Terrace, Highland, Loma Linda, Montclair, Ontario, Rancho 10 Cucamonga, Redlands, Rialto, San Bernardino, Upland & Yucaipa (herein called the C111ES) 11 establishes the responsibilities of each party with respect to compliance with National Pollutant 12 Discharge Elimination System (NPDES) Stormwater regulations administered by the Cahfornia 13 Regional Water Quality Control Board (RWQCB, SAR) by the authority granted by the Clean 14 Water Act(CWA)and its 1987 amendments and the Water Quality Act(WQA) 15 16 RECITALS 17 18 Whereas 19 - Congress m 1987 amended Section 402 of the Federal Clean Water Act (33 US CA 20 1342(p)) to require the federal Environmental Protection Agency to promulgate regulations for 21 apphcations for permits for stormwater discharges, and 22 23 Whereas 24 These permit regulations will require the control of pollutants from stormwater discharges 25 by requiring a National Pollutant Discharge Elimination System(NPDES)Permit for the discharge 26 of stormwaters into waters of the United States, and 27 28 Whereas 29 These EPA regulations will require NPDES permits for discharges from municipal storm 30 sewers on a system—wide or jurisdiction-wide basis, and 31 32 Whereas 33 The State Legislature, in enacting the San Bernardino County Flood Control Act, created 34 the San Bernardino County Flood Control District to provide for the control of flood and storm 35 waters, and 36 37 Whereas 38 The Powers granted to the DISTRICT include carrying on technical and other 39 investigations, examinations, or tests of all kinds, making measurements, collecting data, and 40 making analyses, studies, and inspections pertaining to water supply, control of floods, use of 41 water, water quality, nuisance, pollution, waste, and contamination of water both within and 42 without the DISTRICT; and 43 44 Whereas - 45 The CITIES, the COUNTY and the DISTRICT desire to develop an integrated stormwater 46 discharge management program with the objective of improving water quality in the County of San 47 Bernardino, and 48 49 Whereas 50 The California State Water Resources Control Board(CSWRCB) as designee of the EPA 51 has delegated authority to the Regional Water Quality Control Board-Santa Ana Region (RWQCB, 1 ( 52 SAR) for administration of the NPDES Storm Water permit application process within the 53 boundaries of their Regions, and 54 55 Whereas, 56 The RWQCB, SAR issued NPDES Permit Number 8000200 on October 19, 1990 for the 57 regulation of stormwaters, 58 59 Whereas 60 The DISTRICT, COUNTY and CITIES have been designated as co-permittees by the 61 RWQCB,SAR, and 62 - 63 Whereas 64 The DISTRICT has been designated as the Principle Permittee in the NPDES Permit, and 65 66 Whereas 67 The COUNTY and the CITIES have been designated as the Co-Permittees in the NPDES 68 Permit, and 69 7o Whereas 71 Cooperation between the CITIES, the COUNTY and the DISTRICT to jointly file 72 applications for NPDES Storm water permits is in the best interests of the CITIES, the COUNTY 73 and the DISTRICT, 74 75 NOW THEREFORE, the parties hereto do mutually agree as follows 76 77 I Filing Status The COUNTY,DISTRICT and C1I ES will file the applications for 78 storm water permits as co-penmittees The COUNTY, the DISTRICT and each 79 individual City will be a co-permittee 80 _1 81 II Incorporation of Federal Regulations The terms of all applicable Federal and State 82 guidelines, as presently wntten or as changed during the life of this agreement are 83 hereby incorporated by reference and made a part of this AGREEMENT and take 84 precedence over any mconsistent terms of this agreement. 85 86 III Delegation of Responsibilities. The responsibihties of each of the parties shall be as 87 follows 88 89 A The DISTRICT,on a cost-shared basis, shall admimster system compliance 90 by 91 92 1 Prepanng and implementing an annual operating budget with the 93 participation of the co-pemuttees The budget year shall coincide 94 with the fiscal year of the DISTRICT,July 1 -June 30 95 96 a The co-permittees shall be permitted to review and approve 97 the annual operating budget for the forthcoming year 98 -Cntena for approval shall be an affirmative response from a 99 majority of the co-permittees The review period shall be 100 from November 1 to November 30 of each year with 102 15 roval of the final budget to be completed by December 103 104 2 Preparing compliance reports to the Regional Board and providing 105 copies to the co-permittees 2 106 107 3 Preparing a draft system—wide Best Management Practices (BMP) 108 Program report for review and approval by the co—permittees 109 110 4 Monitoring the implementation and ensuring the effectiveness of 111 system—wide BMPs This will include field reconnaissance to 112 evaluate structural and procedural BMPs 113 114 5 Preparing an annual report to the RWQCB, SAR presenting the 115 results of these evaluations 116 117 B The DISTRICT shall, to the max um extent practicable and on a cost- 118 shared basis except in paragraph low, 119 1 120 1 Perform the water quality and hydrographic monitoring for permit 121 compliance 122 123 2 Develop uniform cntena for annual inspection of drainage facilities 124 125 3 Perform inspections, at no cost to the CITIES or the COUNTY, on 126 those facilities owned by the DISTRICT Contract, for such 127 inspections within the CITIES or COUNTY may be undertaken at 128 the sole expense of the requesting city or county 129 130 C The C1T1ES shall, to the maximum,extent practicable and at no cost to 131 COUNTY or DISTRICT, 132 133 1 Implement a facility inspection program in accordance with the 134 uniform criteria developed by the DISTRICT, for all municipal ,( 135 separate storm sewers as defined by the NPDES permit and within 136 the jurisdictional boundaries of that city 137 138 2 Submit to the DISTRICT on an annual basis, storm drain maps 139 which reflect the modifications that were made to the storm drain 140 system during the past year 141 142 3 Prepare watershed characterizations,including 143 144 a Zoning Designations and 145 146 b Identification of areas where hazardous materials presently 147 are or are suspected to have been stored, manufactured or 148 disposed of This shall include sites at which a hazardous 149 material spill has occurred 150 4 Review, approve, and implement system—wide BMPs 151 152 5 Eliminate or have eliminated, illegal/illicit connections to the storm 153 drain system 154 155 6 Identify the legal authority for control of discharges to the storm 156 drain system 157 158 7 Provide to the DISTRICT annual reports (on forms pro'(+ided by the 159 DISTRICT) and any other information, in a timely fashion, needed 3 c 160 to satisfy annual reporting requirements of the RWQCB, SAR 161 162 8. Adopt and enforce a water pollution control ordinance, which 163 prohibits non—NPDES permitted discharges to the municipal 164 separate storm sewer system 165 166 D The COUNTY shall,to the maximum extent practicable and at no cost to the 167 CITIES or the DISTRICT, undertake in the unincorporated areas of the 168 COUNTY, all activities required above of the CITIES that are not 169 responsibilities of the DISTRICT as outlined in Section III B 170 471 IV Program Costs The responsibilities for payment of all shared costs of equipment, _,-172 services,contracted analytical services, and the cost of the NPDES Permit,shall be 173 distributed among the DISTRICT,COUNTY and CLUES as follows 174 175 Participant Percent Contribution 176 177 DISTRICT 5 178 CITIES +COUNTY 95 179 180 Using the COUNTY's Geographical Information System, the DISTRICT well 181 determine the adjusted acreage for each CITY and the COUNTY from the land use, 182 area, and run-off coefficients as contained in Appendix A on an annual basis. 183 National forests, state parks, airports, landfills, and military installations are 184 excluded 185 186 These calculations shall be completed by November 1 of each year and shall be 187 included in the annual budget proposal 88 i 89 The total of shared costs shall not exceed($ )for fiscal year 1992/1993 A 190 deposit which constitutes a share percentage according to Appendix A of the total 191 anticipated first year costs shall be required of each city The DISTRICT shall 192 invoice each co—permittee on a quarterly basis with the first payment due within 45 193 days of the date of the invoice 194 195 If at any time during a subsequent fiscal year the program costs exceed the sum of 196 the deposits,the DISTRICT shall submit invoices to the CITIES and the COUNTY 197 to recover the deficit The share for each city shall be prorated according to the 198 formula above Each city and the county shall pay the invoice within 45 days of the 199 billing date. 200 201 The DISTRICT shall prepare a fiscal year end accounting within 60 days of the end 202 of each fiscal year and distribute copies to the co—permittees for their review Co- 203 permittees shall have forty—five calendar days from the date of their receipt of the 204 fiscal year end accounting to dispute in writing or concur with the findings If the 205 fiscal year end accounting results in costs exceeding the sum of the deposits 206 (including interest earnings), the DISTRICT shall invoice each city and the county 207 for its prorated share of the excess cost Each city and the county shall pay the > 208 billing within 45 days of the date of the invoice If the fiscal year end accounting 209 results in the sum of the deposits (including interest earnings)exceeding costs, the 210 excess deposits will carry forward to reduce the billings for the following year 4 211 After the initial billing for the program, the DISTRICT shall invoice each city and 212 the county for its annual deposit after July 1, the start of the fiscal year Each city 213 shall pay the deposit within 45 days of the date of the invoice Each city's deposit 214 shall be based on their prorated share of the approved annual budget, reduced for 215 any surplus identified in the prior fiscal year end accounting 216 217 Interest earned on the CITIES and the COUNTY deposits will not be paid to the 218 CITIES and the COUNTY, but will be credit against the CITIES' and the 219 COUNTY's share of the program costs 220 221 Upon termination of the program a final accounting shall be performed by the 222 DISTRICT If costs exceed the sum of the deposits (including interest earnings), 223 the DISTRICT shall invoice each city and the county for its prorated share of the 224 excess. Each city and the county shall pay the invoice within 45 days of the dated 225 of the invoice If the sum of the deposits (including interest earnings) exceed the 226 costs, the COUNTY shall reimburse to each city and the County its prorated share 227 of the excess, within 45 days of the final accounting Interest earnings are used to 228 offset the CITIES and the COUNTY's share of program costs and will not be 229 refunded to the CITIES and the County 230 231 Each city and the COUNTY shall bear the financial responsibility for implementing 232 the Program, within its jurisdictional boundaries, as outlined in Section III C and 233 D 234 235 The annual fee for the NPDES Permit and the annual administrative costs incurred 236 by the DISTRICT shall be included in the total cost and paid according to Section 237 IV and Appendix A 238 239 The financial responsibility for this agreement will be effective beginning with the ' ; 240 1992/93 fiscal year 241 • 242 V Life of the AGREEMENT The life of the AGREEMENT shall be for an indefinite 243 period and such indefinite period shall end at such time as the Clean Water Act 244 and/or the RWQCB, SAR ceases to mandate compliance 245 246 VI Additional Parties Any city or other entity which wishes to be a co—permittee on 247 the San Bernardino County Stormwater NPDES Permit that was issued by 248 RWQCB, SAR shall agree to the provisions in this funding agreement and shall 249 sign this agreement prior to being included m the permit The date of initiation, for 250 determining participant costs for any new co—permittee shall be the date of inclusion 251 in the San Bernardino County Stormwater NPDES Permit issued by RWQCB, 252 SAR The cost for adding any additional co—permittee to the program, including 253 additional permit and processing fees, shall be paid by the added co—permittee 254 Monies, if any, to be reimbursed to the existing co—permittees shall be credited to 255 their respective annual program operating fees for the following budget year 256 257 VII Withdrawal from the AGREEMENT A co—permittee may withdraw from this 258 agreement at the end of any fiscal year with written notice being received by the 259 DISTRICT 90 days prior to the end of the fiscal year The withdrawing co- 260 permittee shall agree to file for a separate NPDES permit and to comply with all of 261 the requirements established by the RWQCB,SAR The withdrawing co-permittee 262 shall be responsible for all lawfully assessed penalties as'a consequence of 263 withdrawal The cost allocations to the remaining members will be recalculated in 264 the following budget year 5 , 265 266 VIII Non-compliance with NPDES Permit Requirements Any co-permlttee found in 267 non-compliance with the conditions of the NPDES permit within their jurisdictional 268 responsibilities shall be solely liable for any lawfully assessed penalties,pursuant to 269 Section 13385 of the Water Code Penalties that apply to all the permittees shall be 270 assessed according to the formula in Appendix A 271 272 IX Legal Action/Costs/Attorney Fees Where any legal action is necessary to enforce 273 any provision hereof for damages by reason of an alleged breach of any provisions 274 of this AGREEMENT the prevailing party shall be entitled to receive from the 275 losing party all attorney's fees and costs incurred in conjunction with such legal Z76 action { 277 278 X Amendments to the AGREEMENT This AGREEMENT may be amended by 279 consent of a two-thirds majority of the co-pemuttees (rounded to the nearest whole 280 number) Amendments to this Agreement may be adopted and executed 281 concurrently, and shall become effective upon its execution by a majority of the co- 282 permittees as defined above 283 284 XI Authorized Signatories Each permittee and co-permittee will determine by either 285 resolution or ordinance who will be the authonzmg signatory This person shall be 286 authorized to execute the application(s) for NPDES Stormwater permit(s) and take 287 all other procedural steps necessary to file the application(s) for NPDES 288 Stormwater permit(s) 289 290 XII Notices All notices shall be deemed duly given if delivered by hand, or five (5) 291 working days after deposit in the U S Mail,certified mail, return receipt requested 292 '93 XIII Governing Law This AGREEMENT will be governed and construed in 194 accordance with laws of the State of California, If any provision or provisions of 295 this AGREEMENT shall,be held to be invalid,illegal or unenforceable,the validity, 296 legality and enforceability of the remaining provisions shall not in any way be 297 affected or impaired hereby 298 299 XIV Consent to Breach not Waiver No term or provision hereof shall be deemed 300 waived and no breach excused, unless such waiver or consent shall be in writing 301 and signed by any permittee to have waived or consented Any consent by any 302 permittee to, or waiver of, a breach by the other, whether expressed or implied, 303 shall not constitute a consent to, waiver of, or excuse for any other different or 304 subsequent breach 305 306 XV Applicability of Prior Agreements This document constitutes the entire 307 AGREEMENT between the co-penmttees with respect to the subject matter, all 308 prior agreements, representations, statements, negotiations and undertakings are 309 superseded hereby 310 311 XVI Execution of the AGREEMENT This AGREEMENT may be executed in 312 counterpart and the signed counterparts shall constitute a single instrument 6 313 IN WITNESS The development was originally approved by the Planning Commission as a 19-unit development with minimal recreation space. At the City Council level, the project was reduced by one unit, and was required to include a swimming pool. Ultimately, construction never commenced on this project due to economic constraints. The developer now has a desire to proceed with the project. They are requesting that Council consider a modification to the conditions of approval that will involve replacing the pool with open recreational space that will include a gazebo, and a barbecue area. This planned unit development will operate much like a condominium association in which each of the property owners will pay for the maintenance, insurance, and overhead of maintaining the entire development. If the modifications are not approved, the property owners would also be responsible for the maintenance, security, and liability of a swimming pool at an individual cost per unit of $50- $75 per month. This would add a substantial burden to the already high cost of new housing. Staff concurs with the developer that the replacement of the pool with open recreational space would make the project more financially affordable to the new homebuyer and provide recreation facilities that would be better utilized at a lower cost.
