PRESENT: Byron Matteson, Mayor Ronald Christianson, Mayor Pro Tempore Jim Singley, Councilmember Thomas J. Schwab, City Manager Brenda Stanfill, City Clerk Phil Bush, Finance Director John Harper, City Attorney ABSENT: Gene Carlstrom, Councilmember Herman Hilkey, Councilmember Randall Anstine, Assistant City Manager Patrizia Materassi, Planning Director Joe Kicak, City Engineer Mayor Matteson convened Joint City Council, Community Redevelopment Agency, and Public Financing Authority meeting at 9: 00 A.M 1. Approving Documents Related to Bond Financing Curt DeCrinis, Prager, McCarthy, & Sealy, Los Angeles; spoke in the capacity as the Underwriter for the bond financing. He indicated that the bond documents, official statement, and all supporting documentation were sent to three insurance companies in both Moody's and Standard and Poor's. He remarked that the documentation was sent to apply for a rating and to qualify for bond insurance. He expressed optimism that Capital Guarantee and/or MBIA would provide an insurance commitment that would result in a triple A rating on the bonds. He commented further that his company also applied for a rating from Moody's and Standard and Poor's, adding that an analyst from S & P would be at City Hall that morning. He advised C R A AGENDA ITEM NO. 1 Council/CRA/Public Financing Authority Minutes - 07/26/93 Page 2 the City to examine the merits of insuring the bonds. City Attorney Harper, stipulating a scenario whereby the deal was already insured with a triple A rating, inquired as to the interest rates for the taxable and nontaxable bonds. Curt DeCrinis, Prager, McCarthy, & Sealy, Los (--` Angeles; indicated that the current market rates, in average interest costs over 25 years, would be 5 1/2% for the tax exempt bonds. He commented that today's interest rates begin at about 3% in the tax-free market. He remarked that the municipal, taxable obligation would be between 80 and 100 points over the long-term treasury bonds and speculated that the rate would be approximately 8%. Mayor Matteson, questioned the distinction between the taxable and nontaxable bonds. City Attorney Harper, responded that the difference resides in the use of the funds, explaining that the refunding of the existing debt is tax free. He _ clarified further that the taxable portion is the loan repayment. He indicated that the Internal Revenue Service issued guidelines a few years previously that precluded the Redevelopment Agency from loaning money to a related agency in the same city on a tax exempt basis. Mayor Matteson, inquired as to the division between the taxable and nontaxable obligation. Curt DeCrinis, Prager, McCarthy, & Sealy, Los Angeles; replied that $5 million is tax exempt and $8 million is taxable. Mayor Matteson, questioned whether the bonds would be sold at different rates. Curt DeCrinis, Prager, McCarthy, & Sealy, Los Angeles; explained that there are two issuance Series - one taxable and one tax exempt. He commented further that the General Fund would no longer be obligated for the City Hall financing once the bonds are issued. City Attorney Harper, clarified that the bonds were originally issued as Certificates of Participation. Council/CRA/Public Financing Authority Minutes - 07/26/93 Page 3 He explained that the Certificates are being replaced with tax increment financing. Mayor Matteson, inquired as to the rate the City has been paying on the current loan. Curt DeCrinis, Prager, McCarthy, & Sealy, Los Angeles; replied that the rate is 7 3/4%. Mayor Matteson, questioned the overall cost to the City to issue the bonds. Mayor Pro Tem Christianson, commenting that the City is borrowing $14 million and spending $5 million on City Hall financing and $2 1/2 million paying the amount owed by the Redevelopment Agency, inquired as to the distribution of the remaining $7 million. City Manager Schwab, explained that the concept behind the bond issue was to protect the Redevelopment Agency in the event that the State raided the unallocated tax increment. He remarked that the $7 million is intended to bond the City's debt capacity to the maximum amount available to the Redevelopment Agency. City Attorney Harper, stated that the issuance of the bonds accomplishes the refunding of the Certificates, protects the tax increment from the State, allows the set-aside of a 20% pass-through, which the City had been receiving from the Redevelopment Agency over the past 10 years, adding that the amount was over $1 million, provides for the repayment of the loan from the City to the Redevelopment Agency, and provides a taxable, standing fund that will be available to the City. Councilmember Sinalev, questioned whether the available fund could be used to construct a gymnasium. City Manager Schwab, replied in the affirmative but indicated that the operational costs of such a facility would be prohibitive. City Attorney Harper, indicated that the reserve fund is slated for expenditure on the daily operations of the City or the Redevelopment Agency over the next ten years. Council/CRA/Public Financing Authority Minutes - 07/26/93 Page 4 Mayor Matteson, questioned why the City was acquiring $14 million when the debt obligation totals only $7 million. City Manager Schwab, clarified that originally the bond issuance was begun to protect the City's tax increment from the State. He explained that since the debt will be bonded and the money will be obligated to the debt, technically, no money would 1 be available for seizure by the State. Mayor Matteson, expressed concern regarding the future use of the funds. City Attorney Harper, remarked that if the economy improves, the money can be used for other purposes, adding that the funds are normal tax allocation bond proceeds that can be expended on any project. , He commented further that as the tax increment increases, the City has the capacity to issue more bonds. Mayor Matteson, inquired as to the rate at which the money has been invested. City Manager Schwab, indicated that the rate is 4 1/2%. City Attorney Harper, explained that the money is not tax exempt, commenting that there are no rebate restrictions on the funds Mayor Pro Tem Christianson, expressed concern if the State questions the City's fund protection City Manager Schwab, assured Council that the process is a legal contract and added that the State cannot intervene. City Attorney Harper, indicated that the State only has access to tax revenue but commented that the , State can disband Redevelopment Agencies and eliminate tax increment. He remarked that that would not affect the current bond issuance but added that the State could still acquire the money if it were not obligated to the debt through the issuance of the bonds. Curt DeCrinis, Prager, McCarthy, & Sealy, Los Angeles; noted that the City of Cerritos has Council/CRA/Public Financing Authority Minutes - 07/26/93 Page 5 similarly protected its funds by selling $80 million in taxable bonds and $40 million in tax exempt bonds. City Attorney Harper, indicated that even if the State eliminates tax increment, the bond holder is protected by insurance. He remarked that the Agency is not obligated to pay any nonexistent money through the tax increment. Curt DeCrinis, Prager, McCarthy, & Sealy, Los Angeles; reported that the sale of the taxable bonds will cost the City $164, 000 while the tax exempt bonds will cost $98, 000 for underwriting in addition to $130, 000 for issuance. He commented that the issuance cost is factored into the Refunding Analysis. City Attorney Harper, observed that the cost of issuance will be distributed over 25 years. He stated that Council will cast its vote in the joint capacity as the Community Redevelopment Agency, the Public Financing Authority, and the City Council. City Attorney Harper, advised that a bond issue may necessitate the calling of a Special Meeting. Mayor Pro Tem Christianson, referring to correspondence from Stater Brother's security, suggested that the City develop an ordinance prohibiting skateboarding. Mayor Matteson, requested that staff investigate the issue and return the matter to Council. City Manager Schwab, indicated that the City has experienced some difficulties with skateboarders. Mayor Matteson, inquired whether the City has an ordinance prohibiting skateboarding. City Manager Schwab, replied in the negative Mayor Matteson, questioned the method the City uses to curtail problem skateboarders Lt. Rodney Hoops, respc-ded that the skateboarders are cited under public nuisance and trespassing laws. He indicated that the Sheriff's Department has requested that the Bank of America and Stater Brother's post signs that will read "Skateboarding prohibited under Penal Code Section 602 . All violators will be prosecuted. " He revealed that the Sheriff's Department has met with concerned parents, adding that most of the skateboarding issues have been resolved. Mayor Pro Tem Christianson, in reference to a letter Council received regarding the lumpers on Barton Road, indicated that the Sheriff's Department is addressing the issue. Council Minutes - 07/08/93 Page 5 Councilmember Carlstrom, reported that he attended the monthly SANBAG meeting on Wednesday, July 7, 1993 , remarking that the meeting marked the 20th anniversary of the formation of the organization. He also commented that the SANBAG budget was discussed, remarking that revenue from Measure "I" and Proposition ill has diminished. He expressed his opinion that the State balanced its budget at the expense of the cities and counties and voiced concern regarding Grand Terrace's loss of revenue. Councilmember Singles, remarked that he attended the Grand Terrace Chamber of Commerce Installation Dinner on June 30, 1993 with the Mayor, Mayor Pro Tem, and the City Manager. He reported also that the CDF Fire District and Water Assessments will not be levied against the public. Councilmember Hilkey, indicated that a Transit Needs Survey to determine potential bus ridership in the City will appear in the Fall edition of the community newsletter. He indicated that at the Omnitrans meeting he discovered that Metrolink will open a station in Highgrove prior to 1995, speculating that the commuter rail will enhance the possibility of establishing a bus route through Grand Terrace. Mayor Matteson, expressed opposition to the Highgrove station location, citing the potential traffic increase through Grand Terrace. PUBLIC HEARING 6A. There was some discussion on general apathy toward disaster preparedness and the general concensus was that the turnout was not due to improper planning. b) The committee decided that because of the activities for Earthquake Preparedness Week that there would be no participation in Grand Terrace Days. Cindy will call Sharon Korgan. c) Gary reported that he had discussions with Finance Director Phil Bush on being present at the budget hearings. SUBJECT: CITY COMPREHENSIVE FEE ORDINANCE REVISION FUNDING REQUIRED NO FUNDING REQUIRED _ City staff are proposing revisions to the Comprensive Fee Ordinance (No. 112) Revisions include changes to Business License Taxes, Parking Citation Fines, Building and Safety, Engineering and Planning fees. A comparative analysis of local cities business license fees for selected businesses (see attachment "A") shows Grand Terrace ' s Business License Tax rates to be significantly less than other surrounding localities. Therefore City staff have proposed increasing business license taxes structure (see attachment "B") to bring our fees more in line with other local cities. Staff estimates that proposed increases will provide $25, 000 of additional revenue to the City' s general fund. Parking Citation Fines have been revised to incorporate the 1992 Isenberg Trial Court Reform Act which authorized counties to increase parking violation penalties to $5 per violation. This legislation mandates $3 00 to go to the County and $2 . 00 to the state general fund. In addition some fines have been increased to reflect state vehicle code increases (example: illegal parking in a handicap zone is now $250 up from $52) Building and Safety, Engineering and Planning fees have also been increased to more closely reflect the fees of other local cities (see attachment "C") . The attached study is a comparative analysis of the Planning, Building and Safety, Engineering Departments fees of the City of Grand Terrace compared to the surrounding Cities of Loma Linda, Colton, San Bernardino, Riverside and Moreno Valley, as well as the Counties of San Bernardino and Riverside The goal throughout this proposal is to maintain the lowest fees in the area and staff feels this has been accomplished as the analysis indicates The Community Development Department proposes to increase Planning and Building fees The rationale used for basing increases was either to keep our fee a little lower than the lowest fee of those studied, select the average of all fees for the City of Grand Terrace in case of high fee discrepancies or choose a lower average when applicable The lower average included only immediate surrounding cities as Loma Linda, Colton and San Bernardino excluding County of San Bernardino, Riverside, and Moreno Valley, to provide an average among the lower fees Approximately 33% of the Building and Safety Department fees and 78% of the Planning Department fees are proposed for increases The Engineer Department was included m this study however due to the method of processing maps compared to the surrounding cities most of the increases were applicable to Planning Department processing of maps, therefore, there are no increases proposed for the Engineering Department fees The fee increases proposed are geared to bring the City in compatibility with the surrounding areas Overall, the study indicates that approximately 30% of our current City Building Department fees are 5-15% below and that 50% of the Planning fees are 200% to 400% below surrounding cities' fees. —.�n. trl . 1 4 Please note that there are two inserts proposed for the fee schedule One is to base a portion of the Building and Safety permit fees on the current UBC Building Permit Fees Table 3 A, and the other is to include a Code Enforcement Service Fee Schedule from the City of Colton into the Planning Department Fee Section The Code Enforcement Service Fee Schedule is to cover City overhead costs of code enforcement, particularly when dealing with reoccurrence of violations We propose to implement this by inserting a statement on the Notice of Violation sent out to violators indicating that they may not only be processed in court and pay fines but may also pay for staff overhead costs related to the processing of their cases Please review comparative tabulations attached for the Planning Department fees (Attachment D), Building and Safety Department fees (Attachment E) and Engineenng Fees (Attachment F) PLANNING FEES A COMPARATIVE ANALYSIS BY PERCENT DIFFERENCE GOAL To maintain the lowest fees in the area. Title 4 of the Grand Terrace Municipal Code is hereby amended and the revised chapters 4 08, 4 12, 4 24, 4 44, 4 76, 4 88 and 4 96 which are included herewith as Exhibit A are hereby adopted Section 2. Lastly, the ongmal map did not meet the 600 foot road requirement for Fire standards thus, a portion of FR1 (Fire Regulation Conditions)were required by the Fire Warden's Department due to the close proximity of the proposed project to Blue Mountain and higher fire hazard areas The City Staff is researching and preparing to bang to the City Council a Fire Overlay Zone and requirements for that area in the near future per recommendation of the Fire Department As such, the Fire Warden's Department for this particular project is attempting to mitigate the illegal situation of less than 600 feet between intersections and provided mitigated measures to give the applicant some flexibility It should be noted that this map as revised incorporates the reservoir lot, thus elmimatmg the need for a separate map for that purpose Only one final map is permitted. By doing so, the tentative tract map will be altered on the following items such as lot square footage, street alignment, pad level alterations to block wall suuroundzng the Riverside Highland Water Reservoir pad-level,relocation of a 24" transmission water main, lot width, depth, sidewalk, drainage etc. DISCUSSION During the preliminary meeting and followup contacts, several issues were discussed between the applicant, his engineer, City Staff and Fire Warden's Representative The following issues needed to be addressed 1 Vacant site causes improper drainage and runoff control 2 Inadequate Circulation Plan between site and adjacent properties Lack of proper street alignment with surrounding si.,,3ivisions 3 The project site lies near a high fire hazard zone, Blue Mountain area, according to the Fire Warden's Department 4 Lot sizes, lot width, and lot depth and street frontage are not in conformance with the GTMC 5 Interior road does not contain sidewalks on both side 6 Drainage easement west of west curbline of Court "A" is not acceptable 7 Option to file separate final maps to be determined by applicant These items are addressed in the ISSUE SEC:I ION below ISSUES 1 Vacant site causes improper drainage and runoff control. There is presently no development or on-site improvements on the site The site generates a soil and drainage runoff that floods at the southwest corner of the property, joining with the run off from Blue Mountain and contmumg down Pico Avenue. In the past few years, the City has received complaints regarding the accumulation of mud and water runoff from this site. As a result this project is conditioned by the City Engmeer to have the applicant submit an Erosion Control Plan for review by the Planning Commission The same shall be implemented by September 1993 prior to the next rainy season. This is a mitigation measure of the Negative Declaration and will be monitored by the City Engineer and Riverside Corona Resource Conservation District Since this report was distributed, the Erosion Control Plan has been submitted to the City Engineer and approved by him. The City Engineer is satisfied that he can resolve any drainage issues such as drainage from the east, drainage across the rear yards of lots, drainage across Lot A and drainage from A Court by requirements during the process of this map He is available to answer any questions 2 Inadequate Circulation Plan between site and adjacent properties. Lack of proper street alignment with surrounding subdivisions. The previous submitted map did not adequately indicate a proper Circulation connection and street alignment to the adjacent properties and subdivisions As a result the applicant revised the map and added a detailed circulation plan for the review by the Planning Commission On the onginal approved map 14078,TTM-88- 02 the circulation tie-in to adjacent subdivisions were not clearly indicated The Circulation Plan before the Planning Commission indicates possible alternatives as agreed upon by City Staff and Fire Warden's Department. a) Possible future connection with the property owner to the east, Dennis Kidd's parcel,with installation of standard cul-de-sac, or b) Fire approved angled hammerhead in the City nght of way at the end of Pico Avenue The applicant has since indicated to staff that the connection into the Dennis Kidd parcel is no longer a viable option as the owner is not interested in selling, a portion or nis land at this time and cannot reacn an agreement with the applicant Therefore, the angled hammerhead which is basically two driveways will be within the City right of way and should not exceed approximately more than 5' feet on either side of the right of way The applicant is in the process of designing the hammerhead in accordance with the specifications of the Fire Warden's Department and City Engineer's Department The Circulation Plan before the Planning Commission gives a clearer circulation and street alignment tie-in with the proposed development and surrounding parcels. 3. The project site lies near a high fire hazard zone,Blue Mountain area,according to the Fire Warden's Department. The Fire Warden's Department Representative expressed fire concerns with the high fire hazard area near Blue Mountain. The Fire Warden's recommendation in the , memorandum to the City dated April 22, 1993 and amended sheet includes fire prevention requirements FR1 classification which can include sprinkling of buildings as one mitigation measure. The applicant is working with the Fire Warden's Department to design the project suitable for a fire hazard zone. The Fire Department will provide some flexibility since the City has not yet adopted FR1 or 2 for this area. 4. Lot sizes, lot width, and lot depth are not in conformance with the GTMC. In order to revise the map per recommendation of the City Engineer, the applicant had to reduce and realign the lots to avoid any conflicts in development on or near the easement areas, particularly the State of California Aqueduct (Department of Water Resources). Therefore, the apphcant is requesting variances for lot sizes, lot width, and lot depth. The Grand Terrace Municipal Code require a minimum 20,000 square foot lot size There are lot sizes in the revised tentative map that do not meet the City Code However, as indicated in the revised map, the lot sizes range from 2,930 12,970 square feet to 35,660 square feet The average lot size is 28;136 22,000 square feet The Planning Department requests your attention on a Variance allowance for the lot sizes for lots 2, 3, 4, 5, 11, 12, 13, 14, and 15 2 through 5 and :ow 11 through 15 Additionally, the lot width required for this zone district is 100 feet and the lot depth is 150 feet The applicant is requesting a variance for a few lots that do not meet the width or depth requirements, lots 2, 3, 5, 11, 13 and 14 Due to the hardship the applicant faces by meeting the requirements of DWR easement, staff recommends approval since we can make variance State findings or requirements Refer to Attachment H, Variance Table 5. Interior road does not contain sidewalks on both sides as indicated in the General Plan. The circulation plan of the General Plan indicates the development dimensions of all streets in the City. The interior road, Court "A", does not meet the specifics of the General Plan. It is surrounded on the South by residential parcels of 3 acre and larger; on the East by a citrus grove and on the West and North by 7200 S.F. single family lots. The site is constrained by a 60 foot Edison easement along its North boundary, a 100 foot California Aqueduct easement running diagonally across the property and by the Riverside Highland reservoir (Lot "A" ) on its East boundary. The variances requested are needed to allow a reasonable site design in relation to all of this parcels encumbrances. Variances are being requested from the site development standards shown in Table 18.10.040 of the City Zoning Code. They are discussed below and summarized in the enclosed table. 1) Lot Area: Nine lots are proposed at less than the required 20,000 SF. Our lots range in size from 12,970+ SF to 35, 660± SF. Our average net lot size is 20.136 SF. The density of the project (excluding the reservoir) is 1.75 lots/acre. 2) Lot Width: Three of the lots propose widths of 90' and 94' . The standard being 100' . All lots have ample building width and minimum side slopes. 3 ) Lot Depth: Three lots will require lot depths of 118 '-140' , the standard being 150' . These depths are necessary because of constraints imposed by the reservoir location. 4) Street Frontage: Five lots propose street frontages of 40' , the standard being 50' . This reduced width is required to allow lots 6-9 to have reasonable. access to our proposed cul-de-sac, without the cul-de-sac infringing on the California Aqueduct right-of-way. Tract 14078 is essentially a buffer between the smaller residential lots West and North of the site, and the larger parcels South and East of the site. Our proposed lots are two to four times larger than the adjacent residential lots. Pico Street, the reservoir, and topographic constraints separate the Tract from the larger parcels to the South and East. The requested variances will allow the flexibility to design the project in a manner that will fit the considerable constraints while providing a reasonable buffer between the smaller and larger parcels in the area.
