Staff and the Mayor met the first part of the year and asked Mr. London to meet with the mobile home park residents and determine whether a level of interest exists. This has been completed and it has been indicated that interest does exist to convert the mobile home park to ownership. A survey conducted among the residents indicates over 90% of the residents favor considering conversion to ownership. Substantial benefits can be gained by conversion, whereby the resident has an ownership interest in the land. The mobile home residents benefit from an equity standpoint, as well as fixing the costs of residency, rather than the continued escalation of rental rates. The proposal indicates that a conversion fee of $2,300 will be paid per space. This $2,300 would be paid through escrow and would be borne by the mobile home unit owner as part of the financing. The Redevelopment Agency would front the initial consultant's fee of $3,000 per month for a period of five months for a total of $15,000. Since the majority, if not all, of the residents within the mobile home park would fall within the moderate income category, it would be appropriate to utilize the low and moderate income housing funds that exist in the Redevelop- ment Agency to maintain and upgrade moderate housing stock. STAFF RECOMMENDS THAT: COUNCIL REVIEW THE ATTACHED PROPOSAL AND CONSULTING AGREEMENT AUTHORIZING THE EXECUTIVE DIRECTOR TO ENTER INTO A CONSULTING AGREEMENT FOR CONVERSION OF MOBILE HOME PARKS LOCATED AT 22111 NEWPORT AVENUE AND 12135 MICHIGAN AVENUE. Mayor Pro Tem Christianson recessed the City Council meeting for 5 minutes to view a new fire truck purchased by the California Department of Forestry. Mayor Pro Tem Christianson reconvened the City Council Meeting- PUBLIC COMMENT 1 Council Minutes - 08/12/93 Page 3 Janet Lenaker, 23125 Westwood Street, Grand Terrace, remarking that she has three children enrolled in schools in the Colton School District, proclaimed that she was speaking on behalf of the group Citizens for a Grand Terrace School District. She explained that the group's goal is to separate from the Colton Joint Unified School District and form a Grand Terrace School District, ' including a high school. She thanked the City Council for approving the mini-feasibility study for the possible establishment of a school district in the City, indicating that the outcome of the study was positive She stated her belief that the School District is a project that could succeed, commenting that the new district would have a higher population than many of the school districts in existence in the state She reported that two architects surmised that the cost to residents to develop the district would be $32 - $65 per household per year, exempting residents 65 years of age and older. She offered the opinion that the City currently has adequate facilities to house the students and indicated further that the schools are owned by the State and would not have to be purchased by the City. Commenting that the group has mailed an information flyer to the registered voters in the City, she announced that the group will hold a meeting at City Hall on August 25, 1993 at 7: 3 0 p.m. and invited the public to attend the meeting to sign the petition for the establishment of a Grand Terrace School District. She indicated that the signed petition will be forwarded to the San Bernardino County Superintendent of Schools for another feasibility study That study will then be sent to the State Board of Education and if the Board ascertains that the District is feasible, the issue will be placed on the ballot. She revealed that those interested in forming a Grand Terrace School District can contact the Citizen's group at (909) 424-3352 . Thelma Winkler, 12570 Mt. Vernon, Grand Terrace; speaking as a member of Citizens for a Grand Terrace School District, encouraged senior citizens to attend the School District formation meeting. She complimented the City's efforts to improve life in the community, citing the Child Care Center, senior center, and Advocate School but expressing her belief that the City needs a local high school. She remarked that a local school district will add to the completeness and stability of the community. Jo Ann Johnson, 12723 S. Mt. Vernon, Grand Terrace, requested that Council investigate establishing a four- way stop at the intersection of Mt. Vernon and Grand Council Minutes - 08/12/93 Page 4 Terrace Road, referring to the number of accidents and near-collisions that have occurred at that location Council directed staff to place the issue of traffic signals on the next Agenda for consideration. Therese Shafer, Grand Terrace resident, announced that Colton High School will hold its 20-year reunion at the Mission Inn on Saturday, August 28, 1993 from 6: 00 p.m. to 1. 00 a.m. at a cost of $40 per person. She remarked that tickets are available from Susan Derue at (714) 857- 8729 or Diane Austin at (909) 794-7601. She thanked the numerous individuals and organizations that advertised the reunion. Mike Schenker, Vice-President, General Manager Comcast Cable; reported that the equipment that was owed to the City has been installed, adding that the equipment has been made portable and can be transported to any location in the City to cover any event. He remarked that the system has features that limit the number of staff necessary to operate the system, commenting that it also has a built-in character generator. Councilmember Hilkey, inquired whether Comcast would train staff to operate the equipment. Mike Schenker, Vice-President, General Manager Comcast Cable; responded in the affirmative, remarking that the company is willing to hold public access classes. Citing the delicate nature of the equipment, however, he suggested that the City establish rules for use of the equipment. Councilmember Hilkey, questioned when the company would alter the channel line-up. Mike Schenker, Vice-President, General Manager Comcast Cable; remarked that the channel line-up would be changed on September 1, 1993 He reported that the company would be adding numerous programs on that date. Dick Rollins, 22700 DeBerry Street, Grand Terrace; announced that the Crime Prevention Committee and the Citizen Patrol are selling personal alarms, which can be carried in a purse or attached to a belt. He added that they have a larger version of the alarm that is also available, commenting that it emits 150 decibels of sound. He added that the alarms are $32 .95 and 37.95 Council Minutes - 08/12/93 Page 5 respectively, indicating that the alarms can be purchased through Crime Prevention at City Hall at 824-6621. Council Reports Councilmember Hilkey, complimented the workmanship involved in the replacement of the lights on the sidewalk around City Hall. He reiterated that the Grand Terrace School District meeting will be held on August 25, 1993 at 7: 30 p.m. , and inquired as to the result of staff's investigation into combining all of the newsletters published by the City. City Manager Schwab, indicated that joining the Chamber newsletter with the City newsletter would be the only feasible option, remarking that the City has not arrived at a formal decision and adding that the upcoming issue was not combined due to time constraints. He speculated that the City will have a consensus regarding the combining of the newsletters within one month. Councilmember Hilkey, indicated that Council would abide by the staff's decision regarding the newsletter. He remarked that the City would send the zip code request petitions to the Postal Office during the week, indicating that the City will Council Minutes - 08/12/93 Page 6 benefit from the growth of Colton. He commented that a new zip code may be assigned to Colton and remarked that the Postal Office traditionally honors city boundaries when issuing new zip codes, speculating that that might allow Grand Terrace to have its own zip code. He praised the Chamber's efforts regarding EARS, explaining that the EARS program assists businesses to maintain their viability in the City. � f Councilmember Singley, remarked that the Orco Tool Company is frequently the target of taggers but noted that the graffiti is removed promptly. However, he commented that Caltrans is removing the graffiti. He expressed disheartenment that the Barton Road exit sign at the Newport overpass is surrounded by concertina wire. He commended the Chamber and the citizens who participated in the graffiti paint-over and indicated that he wishes to participate in the next paint-over. He indicated that anyone who wishes to contribute for the purchase of paint to cover graffiti in the City can submit $8. 00 to the Chamber of Commerce. Councilmember Carlstrom, commented that property owners adjacent to the I-215 freeway are receiving notices from Caltrans regarding the potential purchase of their land and related that one citizen expressed chagrin that he could not lease his property because of the notification. He stressed that the City needs to maintain input to the project to ensure that the project is favorable to Grand Terrace. Mayor Pro Tem Christianson, requested an update on the repair of the railroad crossing at Main Street. City Engineer Kicak, responded that the City is working with a company in Riverside on the matter and speculated that a report will be sent to the railroad company within the next week. He indicated that if the railroad company repairs the tracks, the City will repair the roadway. Mayor Pro Tem Christianson, inquired as to the status of the D.A.R.E. Program, questioning whether the School Board will help to fund the program. City Manager Schwab, remarked that the City staff met with the School District at the joint quarterly Council Minutes - 08/12/93 Page 7 meeting on Tuesday, August 10, 1993 to explore options regarding the program. He reported that the two elementary schools in the City will be the only schools in the Colton Joint Unified School District that will not have the D.A.R.E. program. = He commented that the City believed that the program would not be funded at the unincorporated schools in Bloomington, however, Block grant funds were found to fund those programs. He indicated that the City is investigating three alternatives to provide funding for the program. He related that the School District and City staff determined that the City should approach Council with the School District's offer to fund 50% of the cost of the D.A.R E. program officer for the two Grand Terrace schools. He indicated that the proposal would be presented to Council at an upcoming meeting, adding that the City will still pursue other sources of funding. He expressed optimism that the program will be maintained at the local school system. Mayor Pro Tem Christianson, mentioned that he attended the Grand Opening of the Guardian car purchasing company and the Chamber Mixer at the Town and Country Center. He thanked the Chamber, the Citizen Patrol, and others for participating in the Grand Opening ceremony. PUBLIC HEARING 6A. An Ordinance of the City Council of the City of Grand Terrace Amending Title 4 of the Municipal Code and Establishing a Comprehensive Schedule for Fees, Taxes, and Fines for Permits, Licenses, Services, Facilities, and Activities Provided by the City of Grand Terrace. Mayor Pro Tem Christianson opened discussion to the public. Barney Karger, 11668 Bernardo Way, Grand Terrace; spoke in opposition to the proposed fee increases, speculating that the increases will discourage enterprise. Jack Ingalls, 21900 Barton Road, Grand Terrace; questioned the percentage of the increase and expressed opposition to increasing the fees, citing that businesses have located in Grand Terrace to escape high fees elsewhere. Council Minutes - 08/12/93 Page 8 Finance Director Bush, responded that the rate varies in accordance with the gross receipts of the company. Councilmember Singlev, remarked that the fees for the City of Grand Terrace are the lowest of all the surrounding cities, stressing that even with the increase, Grand Terrace fees are still less than other areas. Jack Ingalls, 21900 Barton Road, Grand Terrace; agreed with the increase yet suggested that the fees be locked at the new level. City Manger Schwab, stated that the City has not increased its fee structure for many years and added that Grand Terrace is still 1/3 below the other cities. He stressed that the City refuses to resort to levying a Utility User's Tax to raise revenue. John Taylor, 22843 Vista Grande Way, Grand Terrace; questioned whether the City receives revenue from fines. Finance Director Bush, replied that Grand Terrace receives the bail amount but commented that the state has added $5.00 to the bail amount. Councilmember Carlstrom, suggested that the term "gross receipts" be modified to "gross operating income, " in order to fairly levy fees against businesses that operate with a large dollar volume since those types of companies receive only a small percentage of the actual revenue. Mayor Pro Tem Christianson returned discussion to Council. Councilmember Hi.lkey, referring to the poor economic state of the country, opposed the Ordinance and suggested that the Ordinance be reviewed again in six months. City Manager Schwab, emphasized the importance of collecting the additional fees, adding that the increases have been included in the budget. Councilmember Hilkev, questioned whether the Ordinance could be approved selectively. City Manager Schwab, indicated that the City can complete a comparative analysis of actual businesses in the community, remarking that the Ordinance will be reviewed again at the second reading. Council Minutes - 08/12/93 Page 9 Councilmember Hilkey, expressed concern regarding the 50% increase in the Business License Tax. Finance Director Bush, indicated that even with the increase, the fees are still lower than fees levied by other cities. Councilmember Hilkev, inquired as to whether the Business License Fee section could be isolated from the remainder of the Ordinance. City Manager Schwab, stated that the Business License Fee includes commercial and retail businesses and can be separated accordingly. Councilmember Singley, expressed support for the Ordinance, citing the City's need for revenue and emphasizing that the increase is still well below the cost of operating a business in other cities. Mayor Pro Tem Christianson, concurred that the proposed increases are timely and stressed that the City's fees will still be below the fees of other locales. - CC-93-127 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY MAYOR PRO TEM CHRISTIANSON, CARRIED 3-1-1-0 (COUNCILMEMBER HILKEY VOTED NO; MAYOR MATTESON WAS ABSENT) , to approve the first reading of the Ordinance amending Title 4 of the Municipal Code and establishing a comprehensive schedule for fees, taxes, and fines for permits, licenses, services, facilities, and activities provided by the City of Grand Terrace. 6B. Tentative Tract Map 88-02-R1 (KarQer) Mayor Pro Tem Christianson opened discussion to the public. Dennis Stafford, McKeever Engineering, Riverside; indicated agreement with the conditions of the project yet expressed opposition to the additional fire condition requirements, specifically citing nonstandard fire condition No. 1 from the April 15 letter from the Fire Department. He explained that the condition requires that the project adhere to San Bernardino County's Fire Zone 1 Construction and Site standards in addition to sprinkling all of the houses on 15 lots. He related his belief that surrounding developments were not required to adhere to the same standards. He agreed with the City's desire to develop more restrictive fire standards along Council Minutes - 08/12/93 Page 10 Blue Mountain yet recommended that the City adopt the new standards through a Public Hearing and apply them city- wide. Councilmember Hilkey, questioned whether Council has the authority to override the fire condition requirements. Dennis Stafford, McKeever Engineering, Riverside; expressed his opinion that the City can counter the ` J requirements with its own Ordinance. Community Development Director Materassi, cautioned that ' the City has always supported the recommendations of the Fire Department, stressing the County's right to impose the regulations. She related further that the map is already below the fire code. She recommended that the City continue to support the Fire Department. Councilmember Singley, questioned whether the County's Ordinance was recently adopted. Community Development Director Materassi, responded in the affirmative. Councilmember Singley, suggested that the other developments be subject to the fire conditions retroactively. Community Development Director Materassi, indicated that the other developers in the vicinity will be required to adhere to the fire conditions when they obtain their building permits. Dennis Stafford, McKeever Engineering, Riverside; indicated that installing the sprinklers in the homes is a prohibitive expense and reiterated his request that the requirements be applied on a City-wide basis. City Manager Schwab, remarked that the conditions of the development in question differ from the surrounding developments. Ernylee Chamlee, Fire Captain, California Department of Forestry, County Fire Warden's Department; indicated that the City requires that cul-de-sacs be less than 600' in length. She related that the cul-de-sac is already longer than 600' and asserted further that the Uniform Fire Code, which was adopted by the City, requires that there be two points of access to a project. She stated Council Minutes - 08/12/93 Page 11 that the project does not meet City Codes based on the two factors mentioned She related that she developed the mitigation measures in order to avoid recommending the denial of the project and added that she did not apply other requirements due to the hardship those requirements would have caused to the developer She explained that sprinklers are designed to save lives, not property but added that the requirements she recommended will provide some property protection. CC-93-128 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY MAYOR PRO TEM CHRISTIANSON, CARRIED 4-0-1-0 (MAYOR MATTESON WAS ABSENT) , to adopt the Resolution that approves TTM-88- 02R1 (Tentative Map 14078) , E-93-04 , and V-93-01 and adopts the Negative Declaration subject to the following conditions: 1. An Erosion Control Plan was submitted and approved by the City Engineer prior to the Planning Commission Meeting of July 15, 1993 . It shall be installed by September 30, 1993 , prior to this year's rainy season. Otherwise, the approval of this map is null and void 2 . The applicant shall construct a six foot high solid, decorative block wall around the perimeter. Additionally, around the wall, there shall be high trees and densely landscaped materials to properly shield reservoir site from public view as much as possible. These materials to be approved by the Planning Director prior to final inspection of block wall. Landscaping to be maintained by property owners of Lots 9, 10, 12, 13 , and 14 respectively. The applicant shall be allowed to construct a chain link fence on the east side of the reservoir site only, Lot A, instead of a block wall, until the development to the east takes place. At that time, the six foot high solid, decorative block wall shall be completed on the east side of the reservoir site, Lot A. 3 . The reservoir tank shall not extend higher than six feet above the required six foot high block wall. (The Negative Declaration to be provided pnor to the City Council Meeting) The purpose of this proposed Zoning Amendment is to clear up ambiguity in the Zoning Code, create an official review of all new construction that otherwise would not be considered as certain structures would not require a Building Permit (such as small types of playhouses) but due to increased complaints staff felt the Code does not provide the proper code authonty for review, and clarification of accessory structures definition. In any case,accessory structures were not allowed to exceed 20',with exception of a tower and other similar structures which could go above district height of 35' subject to a Conditional Use Permit When amendments were made to increase staff level review, the height criteria was replaced by the percentage of structure size and bulk in relation to the main st—icture and lot coverage. The new criteria have been working very successfully with exception in the case ' of playhouses and elevated decks, since it does not address these structures. Elevated decks were also not addressed by the previous code Previous and current code do not address the issue of neighbors' privacy with the exception of adopted Balcony and Overhead Deck Policy Guidelines These guidelines do not address elevated decks or playhouses Also, during latest amendments, certain footnotes and portions of the previous code were not removed and are in conflict with new criteria and creating ambiguity of interpretations. From being prohibited and/or subject to the Planning Commission to not being reviewed at all, certain accessory structures have become one of the current issues in the Planning Department Numerous citizen complaints provide evidence that neighbors' privacy is a 22795 Barton Road•Grand Terrace, California 92324-5295 •(909)824-6621 Attachment A legitimate concern and has to do with perceived property values This is the opinion of Planning staff and management Staff policy in view of code ambiguity is to review (at staff level) all new construction regardless of permit requirement For the information of the Commission, this policy has been very successful, i e the 22950 De Berry playhouse will be painted to match neighbor's fence and tarp red roof will be replaced with a less bright roof Two rows of Platanus trees will separate view from neighbor's yards The 22561 Kentfield playhouse will have its second story demolished The 22789 Miriam Way playhouse will be reduced in height and painted to match adjacent structures close to the fence t The Uniform Building Code does not address playhouses, therefore, if a playhouse has two stories, more than 125 sq ft and has footings, it will need to comply with energy and other UBC requirements for a habitable structure Staff requests that at least the code ambiguity be clarified and that current Administrative Site and Architectural Review criteria be maintained, since they have been very successful for all other projects of larger scale and environmental impact Proposed Code Amendments Proposed amendments clarify the Site and Architectural review procedures including, but not limited to, accessory structures Following is a summary of amendments proposed: 1 Create an official application for all new construction which would incorporate the current "Plan Check"of building plans to be called Land Use Application. From$10 charged currently, the fee will be raised to be compatible with other cities This action will make current Planning Department policy official. The Land Use Application would allow Director's discretion in terms of noticing procedures. As usual, Director's actions would be appealable to the Planning Commission In practice, unless a complaint is filed, structures which do not disturb neighbors' privacy would continue not being revie , sd The exceptions would be the ones that require a permit and are observed by the Building Official. Site and Architectural Review Application The purpose of this application is to allow major projects to receive full review from the Site and Architectural Review Board through a pi'hlic hearing process Site and Architectural Review by the Site and Architectural Review Board includes, but is not limited to 1 All items which are not subject to Land Use or Administrative Site and Architectural Review Applications 2 Any conversion of a single ownership property to a condominium ownership or stock cooperative project 3 Any placement of a modular structure in any district in accordance with this title 4 Any other project subject to "Site and Architectural Review" as listed in this title or in the Barton Road Specific Plan 5 Any item which could not be satisfactorily reviewed at the staff level per discretion of the Community Development Director Section 18.63.030 Scope: Where site and architectural review is required the Site and Architectural Review Board and/or the Community Development Director shall consider the following issues (the Site other relevant issues not listed below may also be considered) A. The proposed site plan for the property shall be reviewed taking into consideration the following 1 Placement of all structures and improvements (including adherence to setback requirements) 2 Vehicular ingress and egress 3 Internal vehicular circulation and parking lot design 4 Pedestrian and vehicular safety 5 Landscaping 6 Pedestrian amenities 7 Lighting 8 Location of all service facilities including waste recycling bins 9 Walls and fences 10 Police and fire protection 11 Relationship to adjoining properties, structures and the site's and surrounding area's natural topography 12 Grading and drainage issues 13 Relationship to existing and/or the planned use of adjoining properties and within the general area 4314 Consistency with this title and the General Plan 15 Traffic control measures B The proposed architecture of all structures shall be reviewed taking into consideration the following 1 Architectural style and building design 2 Proposed building materials and colors 3 Height of structures 4 Design and location of all signs 5 Size and bulk of the structures in relation to existing and/or planned structures on the subject site, adjoining properties and within the general area 6 Consistency with this title and the General Plan ? 1 Section 18 63.040 Submittal Process. Applications for site and architectural review shall be submitted to the Planning Department The Planning Director shall review each application and determine its completeness in accordance with planning department policy Upon determination that an application is complete, the application shall be scheduled either for review by the Site and Architectural Review Board or by the Pluming Community Development Director as applicable according to Section 18 63 020 Land Use Applications may be completed by assigned planners at the counter or taken in for review as needed An application for site and architectural review shall contain the following- A. Completed application form B Site plan, twenty-five (25) blueline copies plus one (1) blueline copy colored for presentation purposes The site plan shall be a fully dimensioned drawing clearly showing 1 All buildings, property lines and easements 2 All parking spaces, driveways and drive aisles 3 All landscaped areas 4 All walls and fences 5. Location of all signs 6. Public improvements to the street centerline 7 Site address and assessor's parcel number 8. Property owner name and address 9 Number of lots and their sizes (in square feet) 10. North arrow, graphic and numeric scales C Elevations, twenty-five (25) blueline copies plus one (1) bluelme copy colored for presentation purposes The elevations shall be scaled, dimensioned drawings of each side of each building and/or sign D Landscape plan, twenty-five (25) bluehne copies plus one (1) bluehne copy co:Lred for presentation purposes The landscape plan shall show the location of all proposed plant material, common and botanical names, quantities and sizes,paved areas and paving materials and property lines E Grading Plan, twenty-five (25) blueline copies plus one (1) bluelme copy colored for presentation purposes. The grading plan shall show existing and proposed topography for the site and within 100 feet of the property lines The plan shall also show all trees with a trunk diameter greater than four inches. F Material Board, one (1) 8 1/2" by 11" mounting board showing samples of exterior design elements such as roofing material, paint chips, brick, stone or other accent features G 300 foot radius map, property owner mailing list keyed to the radius map and a signed mailing list affidavit H Application fee In case of Administrative Site and Architectural Review and Land Use Applications, the number of plans and specific requirements will be determined by the Community Development Director on a case-by-case basis according to the scale and impact of projects The Ong Community Development Director may require additional information or delete certain requirements from an application depending on the specific situation Section 18.63.050 Public Hearing: The Site and Architectural Review Board shall hold a public hearing on any proposed site and architectural review application and shall notice said hearing in accordance with Section 65091 of the California Government Code Section 18.63.060 Approval Process. After review of an application, the Site and Architectural Review Board shall approve the application only if A. The following findings are made, 1 The proposed project is consistent with the intent of the Grand Terrace Municipal Code and the General Plan 2 The location and configuration of all structures associated with this project are visually harmonious with this site and surrounding sites and structures, that they do not interfere with the neighbors' privacy that they do not unnecessarily block scenic views from other structures and/or public areas and are in scale with the townscape and natural landscape of the area. 3 The architectural design of structures, their materials and colors are visually harmonious with surrounding development, natural landforms, are functional for the proposed project and are consistent with the Grand Terrace Municipal Code. 4 The plan for landscaping and open spaces provide a functional and visually pleasing setting for the structures on this site and is harmonious with the natural landscape of the area and nearby developments 5 There is no indiscriminate clearing of property, destruction of trees or natural vegetation or the excessive and unsightly grading of hillsides, thus the natural beauty of the city, its setting and natural landforms are preserved 6 The design and location of all signs associated with this project are consistent with the scale and character of the building to which they are attached or otherwise associated with and are consistent with the Grand Terrace Municipal Code 7 Conditions of approval for this project necessary to secure the purposes of the Grand Terrace Municipal Code and General Plan are made a part of this approval Section 18.63.070 Appeal Process: The decisioai of the Site and Architectural Review Board shall be final unless appealed to the City Council within ten (10) calendar days Such an appeal may be made by the applicant, any member of the City Council or any other interested person A. An appeal of a Site and Architectural Review Board decision shall be made in the following manner 1 Filing with the City Clerk's Office a completed Application for Appeal 2 Payment of the appropriate appeal fee B. After accepting an application for appeal, the City Clerk shall set a date for the City Council to hear the appeal Notices of the appeal shall be given to the applicant, the Site and Architectural Review Board and the appellant_ C The Site and Architectural Review Board shall submit a report to the City Council containing the reasons for the Board's decision and the minutes of its meeting regarding the appealed decision.. D The City Council shall hear the appeal and make its own determination regarding the application and its consistency with this title and the General Plan. Upon such determination, the City Council shall uphold, modify or reverse the Site and Architectural Review Board's decision If during the City Council's hearing of the appeal, new information is provided that was not considered by the Site and Architectural Review Board, the City Council may refer the application back to the Site and Architectural Review Board for reconsideration of the application with the new information Section 18 63 080 Building Permit Process After the appropriate appeal period has ended or after a final determination is made by the City Council, the applicant may submit for building permits The application shall include three (3) sets of the approved site plan, elevations, landscape plan and grading plan, each set shall be approved and signed by the Ong Community Development Director and shall have attached to it a copy of any conditions of approval required by the Site and Architectural Review Board or the City Council Two of the required sets of plans shall be submitted to the Department of Building and Safety along with the appropriate construction specification plans for the approved project The third set shall be kept on file in the Planning Department The Department of Building and Safety " shall then prepare the appropriate permits in accordance with all applicable state and local codes Section 18.63.090 Minor Alterations and Revisions. An applicant may request minor alterations or revisions to approved plans by the Site and Architectural Review Board after the initial approval of the plans as follows A. Minor alterations to the approved plans which result in a change to the extenor facade of a structure, any element of the landscaping plan or the design of the site plan may be approved by the Plaiiiiiiig Community Development Director Other minor alterations may be approved by the Building and Safety Director All approved minor alterations shall not result in a substantial change from the approved plans B Any proposed revisions which result in a substantial change to the approved plans shall be submitted to the Site and Architectural Review Board for consideration pursuant to the procedures set forth in this chapter for initial application Section 18.63.100 expiration and Extensions: The approval of a site and architectural review application shall expire one (1) year from the date of its approval unless one of the following actions occur A. SUBJECT: REVISION OF BUSINESS LICENSE TAXES FUNDING REQUIRED NO FUNDING REQUIRED _X_ At the August 12, 1993 City Council meeting, Council requested City staff to provide an analysis reflecting the impact of the proposed Business License Tax increase on Grand Terrace companies (see attached worksheet) . This analysis shows annual increases of $2 to $400 depending on the gross revenue of the business. Staff estimates that nearly one-half of City enterprises will experience a $2 increase; these are the small businesses with less than $50, 000 annual gross revenue. The taxes for some businesses will more than double while other businesses will see an increase of only a few dollars. This is because the proposed tax rates correct inequities of the current rates. Presently a business with $100, 000 in gross revenue pays the same $55 tax as a business with revenue of $299,999. Thus at $100, 000 the tax rate is . 055% (55/100, 000) and the larger business rate is .018% (55/299,999) . The proposed rates for the above revenue are . 07% (70/100, 000) and . 057% (170/299,999) which is more equitable. This equality is accomplished by adding three additional flat rates in the proposed tax schedule (making a total of eight) . The far right column of the analysis reflects the estimated difference between the six city average (Loma Linda, Colton, Fontana, Rialto, San Bernardino, and Redlands) and the Grand Terrace proposed tax. Even with this increase Grand Terrace has the lowest Business License Taxes in the area. The Grand Terrace Business Licence Tax structure was established in 1979 with a minimum tax of $25 and maximum of $715. A revision occurred in 1988 which increased the minimum tax to $28 and the maximum to $800 (this is the current structure now in use) . Thus, the small businessman has seen only one $3 Business License Tax increase in the last 15 years. Staff Recommends that Council: 1. Severability - If any provision or clause of this Ordinance or the application thereof to any person or circumstance is held to be unconstitutional or to be otherwise invalid by any court of competent jurisdiction, such invalidity shall not affect other Ordinance provisions or clauses or applications thereof which can be implemented without the invalid provisions or clause or application, and of this end the provisions and clauses of the Ordinance are declared to be severable Section 5. A A fee that was erroneously paid or collected, B A refund shall not be more than eighty percent of the permit fee paid when no work has been done under a permit. A refund shall not be more than eighty percent of the plan review fee paid when an application for a permit for which a plan review fee has been paid is withdrawn or canceled before any plan reviewing is done; C A refund of not more than eighty percent of any planning fee when the request for the planning action is withdrawn or canceled before any work by the department is done; D In no case shall the building official retain more than fifty-five dollars of the fees paid, as described in this section nor shall he refund any amount of the fees less than fourteen dollars; E. However, to ensure consistency in continuation of the program, the School District has offered to pay one-half the cost of the DARE Program, which currently totals $24, 000 per year.
