Because you are a newly created organization, we are not now making a final determination of your foundation status under Code section 509(a). However, we have determined that you can reasonably be expected to be a publicly supported organization described in the sections shown above. Accordingly, you will be treated as a publicly supported organization, and not as a private foundation, during the advance ruling period. This advance ruling period begins on the date you were organized and ends on the date shown above. Before the end of your advance ruling period, you will be asked to furnish to your key District Director information needed to determine whether you have met the requirements of the applicable support test during the advance ruling period. (If you received a 2 or 3 year advance ruling, you will be given an opportunity to extent] the advance ruling to 5 years.) If you establish that you have been a publicly supported organi- zation, you will be classified as a section 509 (a) (1) or 509 (a) (2) organi- zation as long as you continue to meet the requirements of the applicable support test. If you do not meet the public support requirements during the advance ruling period, (or do not request an extension to 5 years, if appropriate), you will be classified as a private foundation for future periods. Also, if you are classified as a private foundation, you will be treated as a private foundation from the effective date of your exemp- tion for purposes of section 4940, which imposes an excise tax on your net investment income, and section 507(d), which defines, in the event of termination of status, the aggregate tax benefit derived from tax exemption as a section 501(c) (3) organization. -2- Meals for People Grantors and donors may rely on the advance ruling that you are not a private foundation until 90 days after your advance ruling period ends. If you submit the required information within the 90 days, grantors and donors may continue to rely on the advance ruling until we make a final determination of your foundation status. However, if notice that you will no longer be treated as the type of organization shown above is published in the Internal Revenue Bulletin, grantors and donors may not rely on this advance ruling after the date of such publication. Also, a grantor or donor may not rely on this determination if he or she was in part responsible for, or was aware of, the act or failure to act that resulted in your loss of the foundation classification shown above, or if he or she acquired knowledge that we had given notice that you would be removed from classification as the type of organization shown above. If your sources of support, or your purposes, character, or methods of operation change, please let your key district know so that office can consider the effect of the change on your exempt status and foundation status. Also, you should inform your key District Director of all changes in your name or address. Unless specifically excepted, beginning January 1, 1984, you must pay taxes under the Federal Insurance Contributions Act (social security taxes) for each Employee who is paid $100 or more in a calendar year. You are not required to pay tax under the Federal Unemployment Tax Act (FUTA) . Since you are not a private foundation, you are not sub3ect to the excise taxes under Chapter 42 of the Code. However, you are not automatically exempt from other federal excise taxes. If you have questions about excise, employment, or other federal taxes, contact your key District Director. Donors may deduct contributions to you as provided in Code section 170. Bequests, legacies, devises, transfers, or gifts to you or for your use are deductible for federal estate and gift tax purposes if they meet the applicable provisions of sections 2055, 2106, and 2522. You are required to file Form 990, Return of Organization Exempt fram Income Tax, only if your gross receipts each year are normally more than $25,000. If your gross receipts are not normally more than $25,000 we ask that you establish that you are not required to file Form 990 by completing Part I of that Form for your first tax year. Thereafter, you will not be required to file a return until your gross receipts normally exceed the $25,000 minimum. For guidance in determining if your gross receipts are "normally" not more than the $25,000 limit, see the instructions for the Forn 990. The City has granted the Grand Terrace Seniors $30,000 of Block Grant Funds to upgrade the kitchen at the Community Center as a potential seniors' nutrition site It was determined, initially, that the Seniors/Community Center was the only eligible pro3ect for our Block Grant Funding Council directed staff to solicit input on what improvements should be made to the Senior/Community Center. We have received a recommendation by both the Grand Terrace Lions' Club Community Center Improvement Committee as well as the Seniors' Center Committee of the Grand Terrace Seniors. Both proposals are attached for your information. The Lions' Club Committee has recommended we make improvements to enhance the Senior/Community Center and the Grand Terrace Seniors are recommending that a separate facility be built at the Grand Terrace Road site utilizing a modular unit. They have indicated that the modular unit and the improvements to place it at the Grand Terrace Road site will amount to approximately $100,000. Reallocation of the funding requires the Council to hold a noticed Public Hearing and to take public input regarding the expenditure of federal funds. The Public Hearing is set tonight to consider the alternatives for the expenditure of federal funds. rl-2t S. !r 1 1 f I—r 1 i — a r, 1I- STAFF REPORT -- BLOCK GRANT FUND ALLOCATION October 20, 1989 Page Two For Council's consideration I will list what I consider to be the pros and cons of the alternatives. PROS 1. A separate Seniors' Facility would create an area exclusive to the seniors that would help develop continued senior -related activities in the future 2. The seniors have indicated that the building could be available to other groups or activities when the seniors were not utilizing the facility. 3 The separate facility would create a distinct identity for Grand Terrace Seniors and provide a place for the seniors to meet and socialize. 4 Block Grant Funding for this purpose has been approved by the Office of Housing and Community Development. DISADVANTAGES 1. Currently, the Senior/Community Center is utilized by over two dozen organizations that reach out to all segments of the community. The City has utilized Block Grant Funding in the past to upgrade and modernize the facility in con- junction with the Lions' Club The Office of Housing and Community Development has indicated that if we shift our Block Grant Funding to an alternate Senior Center, the Senior/Community Center will no longer be eligible for funding. They indicated that future Block Grant Funds could be allocated only to the Senior or Child Care Programs. 2. Block Grant Funding is available for the purchase of a modular unit, as well as improvements necessary to set up the unit and make improvements such as parking lot provisions, utilities and landscaping. It does not, however, provide for any furniture, equipment or supplies, or any other ongoing expenses that would be incurred as a consequence of having an additional structure. 3. Currently, at the Community Center the Lions' Club pays for all utilities, maintenance and upkeep of the Senior/ Community Center A separate and independent Seniors' Facility would require an ongoing funding source to pay for the related expenses which could easily be $1,000 a month or more STAFF REPORT -- BLOCK GRANT FUND ALLOCATION October 20, 1989 Page Three STAFF RECOMMENDS THAT 1 COUNCIL CONDUCT A PUBLIC HEARING TO SOLICIT INPUT REGARD- ING THE EXPENDITURE OF FEDERAL FUNDING 2. COUNCIL ALLOCATE $109,000 FOR THE PURCHASE OF A MODULAR UNIT AND SITE IMPROVEMENTS TO BE LOCATED ON THE LAND PURCHASED FROM MR ROBERTS ON GRAND TERRACE ROAD 3 COUNCIL ALLOCATE $5,000 OF THE CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT FUNDING FOR PEDESTRIAN AND HANDICAP RAMP INSTALL- ATION AT THE EXISTING SENIOR/COMMUNITY CENTER. THIS WORK HAS BEEN COMPLETED UNDER OUR CURRENT ALLOCATION AND REMAINS ELIGIBLE FOR THIS YEAR. 4 COUNCIL DIRECT THE SENIOR CITIZENS' GROUP TO DEVELOP A FINANCE AND FUNDING PLAN FOR THE OPERATION OF THE SENIORS' FACILITY TO INCLUDE POTENTIAL FUNDING SOURCES, AS WELL AS POTENTIAL EXPENDITURES INCLUDING INITIAL CAPITAL STARTUP EXPENDITURES. 5. IT WAS INDICATED BY THE SENIOR CENTER COMMITTEE THAT THE FACILITY COULD BE AVAILABLE FOR OTHER USES WHEN NOT BEING UTILIZED BY THE SENIORS' GROUP DIRECT THE SENIORS' GROUP TO DEVELOP A SCHEDULING PLAN TO ENSURE THAT THE FACILITY WILL BE SIGNIFICANTLY UTILIZED THROUGHOUT THE YEAR TO JUSTIFY THE ONGOING EXPENDITURES OF CITY FUNDS 6. Renovate kitchen. a The kitchen should be upgraded to the extent of meeting anticipated needs It was determined that a large, extravagant, expensive kitchen was not required, nor desired 2 Reinf orce the flooring 3. Install metal doors and door frames throughout 4 Install a security system a. This proposal should be discussed Some committee members thought a security alarm system would cause too many problems for the benefits obtained. 5. Perform a termite inspection a. Accomplish necessary work generated by the inspection, including replacing the infested flooring in the front entry way Also, upgrade and enhance the front entry way. 6. Install wrought iron over all windows a It was felt this would preclude installation of a security system 7 Discuss beautifying the "mini latrine" in the Lions/Seniors Room 8 Renovate the stage area. a Discuss utilizing the area under the stage for storage. 9.
