WHEREAS, The National RED RIBBON CAMPAIGN will be
celebrated in communities across America during RED RIBBON --
WEEK, October 22-29, 1989, and '
WHEREAS, Californians for Drug -Free Youth, Inc.
is coordinating this grass roots community effort in a
united effort with the National Federation of Parents for '
Drug - Free Youth, and 1
WHEREAS, business, government, law enforcement,
schools, religious institutions, service organizations, and
individuals will demonstrate their commitment to healthy, -
drug -free lifestyles by wearing and displaying red ribbons
during this week-long campaign, and
WHEREAS, the community of Grand Terrace further
commits its resources to ensure the success of the RED
RIBBON CAMPAIGN,

will no longer be treated as the type of organization shown above is
published in the Internal Revenue Bulletin, grantors and donors may not
rely on this advance ruling after the date of such publication. Also,
a grantor or donor may not rely on this determination if he or she was in
part responsible for, or was aware of, the act or failure to act that
resulted in your loss of the foundation classification shown above, or if
he or she acquired knowledge that we had given notice that you would be
removed from classification as the type of organization shown above.

to help in case of disaster. We handed out our Emergency Prepardness
Pamphlets. Jim will contact Sharon Korgan to see if she would
like to obtain copies of our pamphlets for her use in her work
NEW BUSINESS - Jim brought a brochure from JPL on Earthquake
Prepardness Companies. We received a book on "Right -to -Know
Emergency Planning" by George B. Lowry and Robert C. Lowery.
Cindy Williams stated that all medical supplies have been received.

The meeting was called to order by the chairman, Jim Hodder
At 7 03 P.M.
MEMBERS PRESENT- Vic Pfennighausen, Jim Hodder, Eileen Hodder
GUESTS. Dick Rollins, representing the Crime Prevention Comm.
Vic and Jim tested the internal telephone system and all
units are operating in building 3. The tower is here and all emer-
gency portable flood lights are operational.
INTERNAL PROCEDURES - The first 5 internal procedures are finished
The chain linc fence has been installed around the building
and the parking lot area has been paved.
EOC PLAN - Jim received the guidelines from Ed on Business and
Industry.
Dick Rollins stated that the Crime Prevention Committee and
the Citizens Patrol will be available during an emergency.
Jim gave Dick some Emergency Prepardness Pamphlets to be used
with the Crime Prevention's program on earthquake prepardness.

Minutes of the October 2nd Meeting
The meeting was called to order by Chairman Viola Gratson at
7 05 PM. All were present except Pauline Grant. The Secretary's
report was read and corrected. The second paragraph should have
included the words "read and approved" after meeting were and the
fourth paragraph should have been "olds', not "new". Motion to
accept made by Ann, seconded by Marie. Treasurer's report shows
$137.35 spent, balance $2,862.65.
Country Fair Irene will work on publicity this week. Ann is
having a flyer prepared to take around to neighborhoods. Next
year the Committee will discuss making a change to include those
people who work in Grand Terrace as well. Also, we will work on
defining "hobbies" more clearly. Hannah will get paper goods.
There will be coffee and doughnuts for sale. Members are reminded
to wear their name tags. Viola will talk to Randy about the
microphone. Tony Petta will be asked to EC the cooking contest.
Kathy Harmon, Cindy Smith, Torn Schwab, Jim Rigley, Hugh Grant,
Dick or Doreen Yost, and Dwight Winans will be asked to be the
judges. We need five.
The next meeting will be November 6th. The meeting was adjourned
at 8 PM. Irene made the motion, Marie seconded.

Council is already aware that the Department of Housing and
Community Development disallowed the Mt Vernon/Barton 25/ share
of the traffic signal and the Michigan sidewalk improvements as
eligible pr03ects This required the City to reevaluate our
Block Grant Funding to other pr03ects. The City has granted the
Grand Terrace Seniors $30,000 of Block Grant Funds to upgrade the
kitchen at the Community Center as a potential seniors' nutrition
site
It was determined, initially, that the Seniors/Community Center
was the only eligible pro3ect for our Block Grant Funding
Council directed staff to solicit input on what improvements
should be made to the Senior/Community Center. We have received
a recommendation by both the Grand Terrace Lions' Club Community
Center Improvement Committee as well as the Seniors' Center
Committee of the Grand Terrace Seniors. Both proposals are
attached for your information.
The Lions' Club Committee has recommended we make improvements to
enhance the Senior/Community Center and the Grand Terrace Seniors
are recommending that a separate facility be built at the Grand
Terrace Road site utilizing a modular unit. They have indicated
that the modular unit and the improvements to place it at the
Grand Terrace Road site will amount to approximately $100,000.
Reallocation of the funding requires the Council to hold a
noticed Public Hearing and to take public input regarding the
expenditure of federal funds. The Public Hearing is set tonight
to consider the alternatives for the expenditure of federal
funds.

For Council's consideration I will list what I consider to be the
pros and cons of the alternatives.
PROS
1. A separate Seniors' Facility would create an area exclusive to
the seniors that would help develop continued senior -related
activities in the future
2. The seniors have indicated that the building could be
available to other groups or activities when the seniors
were not utilizing the facility.
3 The separate facility would create a distinct identity for
Grand Terrace Seniors and provide a place for the seniors to
meet and socialize.
4 Block Grant Funding for this purpose has been approved by the
Office of Housing and Community Development.
DISADVANTAGES
1. Currently, the Senior/Community Center is utilized by over
two dozen organizations that reach out to all segments of
the community. The City has utilized Block Grant Funding
in the past to upgrade and modernize the facility in con-
junction with the Lions' Club The Office of Housing and
Community Development has indicated that if we shift our
Block Grant Funding to an alternate Senior Center, the
Senior/Community Center will no longer be eligible for
funding. They indicated that future Block Grant Funds
could be allocated only to the Senior or Child Care
Programs.
2. Block Grant Funding is available for the purchase of a
modular unit, as well as improvements necessary to set
up the unit and make improvements such as parking lot
provisions, utilities and landscaping. It does not,
however, provide for any furniture, equipment or supplies,
or any other ongoing expenses that would be incurred as a
consequence of having an additional structure.
3. Currently, at the Community Center the Lions' Club pays for
all utilities, maintenance and upkeep of the Senior/
Community Center A separate and independent Seniors'
Facility would require an ongoing funding source to pay
for the related expenses which could easily be $1,000 a
month or more

EXPENDITURES.
5. IT WAS INDICATED BY THE SENIOR CENTER COMMITTEE THAT THE
FACILITY COULD BE AVAILABLE FOR OTHER USES WHEN NOT BEING
UTILIZED BY THE SENIORS' GROUP DIRECT THE SENIORS' GROUP
TO DEVELOP A SCHEDULING PLAN TO ENSURE THAT THE FACILITY
WILL BE SIGNIFICANTLY UTILIZED THROUGHOUT THE YEAR TO

We recommend that the existing Community Block Grant Funding be

preferably the Grand Terrace Road Park Site
Research has indicated that a 2000 square foot or more modular unit could
be purchased for approximately $70,000 and the site improvements might

services that would add much to the quality of life of our large expanding

Committee held a preliminary meeting recently and the following
items were proposed
1. Renovate kitchen.

extravagant, expensive kitchen was not required, nor

DISCUSSION -
Included with this report is a copy of the City's Draft Housing Element (Attachment
A) This document has been prepared by Wildan Associates to meet the requirements
of California State law regarding the mandatory five year revision of the City's Housing
Element
The document looks at various characteristics of the community such as population,
existing housing stock, housing availability as well as present and future housing needs
It includes revisions per the recent amendment to the General Plan's Community
Development Element and Land Use Map It also reflects a reevaluation and subsequent
revision of the Housing Assistance Plan and the various programs included therein
Mr Al Warot of Wildan Associates will be at the meeting to present the Draft Housing
Element to the Council in detail and answer any questions you may have
The purpose of this meeting is to conduct a public hearing on the proposed draft
element, consider the proposed Negative Declaration (Attachment B) and to approve the
draft element for the purpose of submittal to the state for their review The state will
then review the draft element and return their comments to the City within 45 days At
that time the City Council will consider the state's comments for inclusion in the draft
element and subsequent final approval of the Draft Housing Element
RECOMMENDATION:
The Planning Department recommends the City Council approve the Draft Housing
Element (Attachment A) for the purpose of submittal to the State Department of
Housing and Urban Development for their review and comment as required by California
State Law

The City of Grand Terrace currently has a license agreement
between the City and Pedestal Post for the placement and
operation of two existing bus -stop shelters within the City of
Grand Terrace The shelters have been sold to Bustop Shelters
of California, Inc and we have received a request to transfer
the license agreement. The current agreement prohibits transfer
of the agreement without the consent of the City.
STAFF RECOMMENDS THAT
1. COUNCIL ENTER INTO A NEW LICENSE AGREEMENT IDENTICAL TO THE
AGREEMENT WITH PEDESTAL POST WHICH IS ATTACHED
2 COUNCIL AUTHORIZE THE MAYOR TO EXECUTE SAID AGREEMENT.

PEDESTAL POST, INC hereinafter referred to as "LICENSEE "
WHEREAS, CITY is the fee owner of, or has heretofore acquired an easement
for public street purposes over, certain real property within City of Grand
Te,,r-( , , and
WHEREAS, LICENSEE desires to construct and maintain shelters with
commercial advertising thereon to be located upon the aforesaid property at
bus stops and possibly other designated areas throughout the City of Grand
T2r'r?ce , and
WHEREAS, CITY desires to permit the construction and maintenance of said
bus shelters subject to the terms and conditions hereinafter set forth, and
WHEREAS, the proposed license and encroachment into the public
right-of-way will be in the public interest and will not interfere with the
use of said property by the public
NOW, THEREFORE, FOR AND IN CONSIDERATION OF THE MUTUAL PROMISES,
COVENANTS AND CONDITIONS HEREIN CONTAINED, THE PARTIES HERETO AGREE AS
FOLLOWS
All contract documents and plans referred to in paragraph 1 are intended
to cooperate and be coordinated so that anything called for and anything not
mentioned in the other or vise versa, is to be performed the same as if
mentioned in all contract documents and set forth in the specifications and
drawings
This agreement may be amended only by written instrument signed by bozo
parties hereto This agreement and any modifications or additions hereto
shall be binding upon and inure to the benefit of the respective parties and
their successor and assigns
1 LICENSE City does hereby qrant to LICENSEE a license to encroacn
upon certain real property as hereinafter specified for purposes or
constructing and maintaining bus shelters with commercial advertising thereon
at certain bus stops within the CiTY (hereinafter "Shelters") in the manner
hereinafter provided Said real property is either owned in fee by the Ci'-y

on an easement for public right-of-way purpose has heretofore been acquired
over said real property by the CITY
2 SHELTER DESIGN Said Shelters and associated amenities shall be
designed, constructed and maintained in accordance with and in conformity to
those certain plans, specifications and architectural drawings heretofore
approved by the CITY and attached hereto marked Exhibit "B' and incorporated
herein by this reference
3 NUMBER OF SHELTERS Within a period of ninety (90) days after the
issue date of a permit, LICENSEE shall install, construct and have in
operation a minimum of 444 (- }(6�helters, installed at mutually agreed
locations and shall install additional shelters from time to time by mutual
agreement of LICENSE and CITY, up to the maximum number of shelters which can
be reasonably accommodated based upon CITY`s location and placement criteria
4 COMPENSATION LICENSEE shall pay to the CITY a sum of money equal to
15%. of the gross revenue received after advertising agency fees deduction each
month from the sale of advertising on each Shelter installed under the
program

THE CITY shall have the right to inspect the LICENSEE's revenue records
5 COSTS OF IMPROVEMENTS
LICENSEE shall pay all costs and expenses
A The design, construction, maintenance and removal of the
Shelters, and
B The restoring to their proper condition of the sidewalks, curbs
or streets which may be disturbed during the construction or
removal of the Shelter, and
6 LICENSEE SUBJECT TO RIGHTS The grant of this license by CITY is
subject to whatever right, interest or privilege others may have in the use
and occupation of the sidewalks, curbs or streets where the Shelters are
located
7 OWNERSHIP LICENSEE shall be the owner of the shelters constructed
8 ADVERTISING All proposed advertising to be located on said Shelter
shall not
A Display the words "STOP," "DRIVE-IN," "DANGER," or any other
word, phrase, symbol or character which may interfere gith,
mislead or direct vehicular traffic
B Comprise rotating, revolving or flashing lighting devices

Advertising displays shall not deal with material which the City in its sole
discretion determines is offensive to community standards of good taste
The City will make the final determination on unacceptable advertising and
such advertising must be removed by LICENSEE Nithin 24 hours of official
notification
9 TERM The term of the agreement shall be for a period of �Qcc (/b)
years commencing on the date of permit specified in paragraph 3 herein
10 REMOVAL OF SHELTER WithinS(6a) days following the expiration
of the term of t is Agreement, or any ex ension thereof, or within (6o) days

following termination of this Agreement as herein provided, or within ��
(� c) days following written notification from CITY that said Shelter 211
interfere with any construction, maintenance or repairs of any public utility,

days of a determination by CITY that a shelter location is not onger
appropriate LICENSEE shall, at its sole cost and expense, completely remove
said Shelter and restore such property including sidewalks, curbs and streets
to their proper and original condition in accordance with all CITY
specifications
11 TERMINATION AND CANCELLATION In the event LICENSEE shall fail to
comply with any provision herein contained and shall not have cured such
default within ( ) days after receiving written notice thereof/ from the
CITY, or if such default cannot reasonably be cured within such (36 day
period, shall not have begun to remedy such default within such --�= (30) day
period and continued to do so diligently and in good faith unti ompletion
thereof, the CITY in addition to any other rights reserved to itself under
this Agreement or by law and not in substitution thereof shall have the right
to terminate and cancel this Agreement Such termination and cancellation
shall be by action of the City Council of CITY and shall become effective
immediately
12 TELEPHONE COMMISSION All telephone revenue commission derived from
a public telephone attached to a Shelter shall go directly to the licensee
regardless of whether the installation was initiated by the LICENSEE or the
CITY
13 BENCH REMOVAL In the event LICENSEE received approval to locate
any Shelter at a location then occupied by a bus bench existing under a permit
from CITY, CITY shall commence proceedings for the removal of said berch
pursuant to the Municipal Code and at the earliest possible date
14 INTERESTS OF LICENSEE The LICENSEE covenants that the LICENSEE has
no interest and sha not acquire any interest, direct or indirect, which
would conflict in any manner with the performance of the services contemplated
by this Agreement No person having such interest shall be employed by or
associated with the LICENSEE
15 INSURANCE
A Insurance LICENSE shall submit to the CITY certificates
indicating comp i- i ance with the following minimum insurance requirements not
less than 4,eH (IL?) days prior to the oeginning of performance under this
Agreement
1 Worker's Compensation Insurance to cover its employees as
required by the California Labor Code
Before execution of the contract by the CITY, the LICENSEE shall
file the CITY the following signed certification
"I am aware of, and will comply with, Divisions 4 and 5 of
the California Labor Code by securing, ,paying for, and
maintaining in full force and effect for the duration of the
contract, complete Worker's Compensation Insurance, and
shall furnish a Certificate of Insurance to the City before
execution of the Agreement "
The CITY, its officers, or employees, will not be responsible for
any claims in law or equity occasioned by failure of the LICENSEE
to comply with this paragraph Said certificate of insurance
shall contain an endorsement which
(a) Names and lists as additional insureds the City, its
officers, and employees
(b) Provides that it shall not be cancelled or materially
changed withoujt (3 0) days written notice thereof given
to the CITY by regis ered mail
The LICENSEE shall require all subcontractors similarly to
provide such compensation insurance for their respective
employees
2 Comprehensive Personal Injury and Property Damage Liability
Insurance, including automobiles, with minimum personal injury
liability limits of S500,000 per person and $1,000,000 per
occurrence, and property damage limits of $100,000 per
occurrence Each such policy of insurance shall
(a) Be issued by an insurance company approved in writing
by which is admitted to do business in the State of
California,
(b) Name and list as additional insured the CITY, its
officers and employees,
(c) Specify its acts as primary insurance

(d) Cover the operations of LICENSEE pursuant to the terns
of this Agreement
3 LICENSEE shall not commence the performance of its services
under this contract until the above insurance has been obtained
and Certificates of Insurance have been filed with the City
16 ATTORNEY'S FEES in the event that either party hereto fails to
comply with any of the terms of this Agreement and the other party commences
legal proceedings to enforce any of the terms of this Agreement or to
terminate this Agreement, the prevailing party in any such suit shall receive
from the other a reasonable sum including attorney's fees and costs as may be
established by the Court or Jury
17 ASSIGNMENT The LICENSEE shall not assign or otherwise transfer the
LICENSEE's rights and obligations under this Agreement without prior written
consent of the City Any such assignment without such consent shall be void
and shall, at the option of the CITY, terminate this Agreement
18 CAPACITY AS INDEPENDENT CONTRACTOR The performance of LICENSEE'&
services hereunder shall be in the capacity of an independent contractor and
not as an officer, agent or employee of the CITY
19 EXTENT OF AGREEMENT This Agreement represents the entire
integrated agreement between the City and the Licensee, and supersedes all
prior negotiations, representations or agreements, either written or oral
