was held in the Council Chambers, Grand Terrace Civic Center, 22795 Barton

i PFENNIGHAUSEN, CARRIED 5-0, to approve July 26, 1990 CRA Minutes.
AGREEMENT WITH UNITED STATES ESCROW FOR THE LOW AND MODERATE INCOME
HOUSING PROGRAM
City Manager Schwab, indicated that the Community Redevelopment
Agency adopted and appropriated funds to implement a Low and
Moderate Income Housing Program. United States Escrow has made a
proposal to provide services to set up the program, including
determining guidelines for eligible projects, create the process to
underwrite and manage the loan portfolio, as well as control the
contractor disbursements for the needed work.
CRA-90-29 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY MAYOR PRO TEM GRANT,
CARRIED 5-0, to approve the agreement and authorize the Chairman to
execute the service agreement between the City of Grand Terrace
Redevelopment Agency and United States Escrow, Inc.
Chairman Matteson adjourned the CRA meeting at 6 15 p.m., until the
next regular City Council/CRA meeting, which is scheduled to be
held on Thursday, August 23, 1990 at 6 00 p.m.

At the City Council Meeting of August 9, 1990, Council directed
staff to place on the agenda a resolution regarding AB 1333
This bill made changes which affect the Brown Act notification
requirements. Attached is the resolution for Council
- consideration and adoption.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, URGING THE LEGIS-
LATURE TO AMEND THE STATUTE WHEREBY THEY
REPEALED THE REQUIREMENT TO HAVE LOCAL AGENCIES
ADHERE TO CERTAIN MANDATED PROGRAMS OR EXECUTIVE
ORDER, WHICH AFFECTS THE REQUIREMENT THAT LOCAL
AGENCIES MUST POST WITHIN THE 72-HOUR AGENDA
POSTING REQUIREMENT AND ELIMINATED THE REQUIRE-
MENT OF PUBLIC PARTICIPATION DURING MEETINGS
WHEREAS, the State Legislature has recently approved a
bill which has been interpreted to relax the January 1, 1987
requirement that there be a posting of agendas at least 72 hours
before a regular meeting, and
WHEREAS, the State Legislature also eliminated the
mandated requirement that local government bodies provide p u b 1 1 c
comment time during meetings, and
WHEREAS, the City of Grand Terrace shall continue to
observe the Ralph M. Brown Act of January 1, 1987 whereby the
7 2 - h o u r posting be observed and, to continue to place pub11c
comment on the agenda so that members of the public may address the
Council, and
WHEREAS, the City of Grand Terrace feels that current
t_ statute provides adequate disclosure and should be maintained.
NOW, THEREFORE, the City of Grand Terrace, by resolution,
urges immediate legislation to restore the statute requiring the
72-hour p o s t 1 n g of agendas before meetings and to place on the
agenda the provision of public comment during meetings.

signs that were placed approximately a year ago at many prima
facie stop locations throughout the City

The meeting was called to order at 7 05 p m by Ann Petta
Chairman Viola Gratson and Secretary Hannah Laister were
absent Others present were Pauline Grant, Irene Mason and

case located in the Civic Center lobby It was decided to

"Terrace Tribune The newspapers were then placed in the
case
The meeting was adjourned at 8 15 p m. Pauline made the motion
to adjourn, seconded by Irene The next meeting will be
September 10 instead of September 3 because of Labor Day.

WHEREAS, the City Council has initiated proceedings for the annual levy of
the assessments for a street lighting district pursuant to the terms and
provisions of the "Landscaping and Lighting Act of 197211, being Part 2 of
Division 15 of the Streets and Highways Code of the State of California, in a
district known and designated as
CITY OF GRAND TERRACE
LANDSCAPING AND SIREET LIGHTING DISTRICT NO. 89-1
WHEREAS, the City Council has ordered the preparation of a report and the
City Engineer has prepared and filed with this City Council a report pursuant
to law for its consideration and subsequently thereto this City Council did
adopt its Resolution of Intention to levy and collect assessments for the next
ensuing fiscal year relating to the above -referenced District, and further did
proceed to give notice of the time and place for a Public Hearing on all
matters relating to said annual levy of the proposed assessment; and,
WHEREAS, at this time, this City Council has heard all testimony and
evidence and is desirous of proceeding with said annexation and additional
territory and annual levy of assessments.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lake
Elsinore does hereby resolve, determine and order as follows:
SECTION 1. That the above -recitals are all true and correct.

SECTION 2 That upon the conclusion of the Public Hearing, written
protests filed, and not withdrawn, did not represent property owners owning
more than fifty percent (50%) of the area of assessable lands within the
District, and all protests are overruled and denied
SECTION 3 That this City Council hereby confirms the diagram and
assessment as submitted and order the annexation of additional territory and
annual levy of the assessment for the fiscal year and in the amounts as set
forth in the Engineer's Report and as referred to in the Resolution of
Intention as previously adopted relating to said annual assessment levy.
SECTION 4 That the diagram and assessment as set forth and contained in
said Report are hereby confirmed and adopted by this City Council.
SECTION 5 That the adoption of this Resolution constitutes the levy of
the assessment for the fiscal year.
SECTION 6. That the estimates of costs, the assessment diagram, the
assessments and all other matters, as set forth in Engineer's "Report",
pursuant to said "Landscaping and Lighting Act of 197211, as submitted, are
hereby approved, adopted by this City Council and hereby confirmed.
SECTION 7. That the maintenance works of uprovements contemplated by the
Resolution of Intention shall be performed pursuant to law and the County
Auditor shall enter on the County Assessment Roll the amount of the Assessment
and said assessment shall then be collected at the same time and in the same
manner as the County taxes are collected. After collection by said County,
the net amount of the assessment shall be paid to the City Treasurer of said
City

SECTION 8. That the City Treasurer has previously established a special
fund known as the

into which the City Treasurer shall place all monies collected by the Tax
Collector pursuant to the provisions of this Resolution and law and said

available to said City Treasurer

certified copy of the diagram and assessment roll with the County Audlitor,
together with a certified copy of this Resolution upon its adoption.

THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, DOES
HEREBY ORDAIN AS FOLLOWS
Section 1 Chapter 12 08, Sections 12 08 080 and 12 08 360 of tlic Giand
Teiiace Municipal Code are hereby repealed and deleted and new Sections 12 08 080 and
12 08 360 are added to lead as follows

12 08 080 Cash Deposits Before an excavation permit as provided in this
chapter is issued, the applicant shall deposit with the city finance depai tment a cash deposit
in the amount to be determined by the city engineer to secin e proper i epairs of the street
cut
A Each permittee, prior to receiving a permit pursuant to this chapter, shall
deposit a minimum of five hundred dollars with the city finance depai tment This amount
is to secure emergency street repasts required as a result of the permittee's street cuts
This amount shall be placed by the finance director into a special account The deposit
shall be utilized by the city to make any emergency street r epast s requu ed, which repairs
cannot be done by the permittee The amount of the deposit above the five -hundred dollar
minimum shall be computed in accor dance with the fees schedule set by resolution Such
deposit shall be refunded to the permittee upon request twenty-four months after
completion and acceptance of the project

B Return of the deposit shall be conditioned upon the permittee's compliance
with this chapter, and further conditioned that the permrttee must fill up, restore and place
in good and safe condition as near as may be to its original condition, and to the
satisfaction of the city engineer, all openings and excavations made in streets, and must
maintain any street whei e excavation is made in as good condition foi the period of twenty-
four months after the work has been done Any settlement of the surface within that two-
year period shall be deemed conclusive evidence of defective backfilling by the permrttee
Nothing contained in this subsection shall be construed to require the permittee to maintain
any repairs to pavement made by the city if such repaus should prove defective Any
owner or real estate repairing or engaging another to repair his own sidewalk shall not be
required to give such deposit An acceptable bond or letter of credit may be given under
this provision, which shall remain in force for two years, conditioned as above in the
amount specified, and in other respects as specified but applicable as to all excavation work
in streets by the principal making such deposit during the term of two years from such
date
C An application for an excavation permit to peilorm excavation woik
undei this chapter shall be accompanied by a cash deposit, payable to the city, in
accordance with a schedule of fees set by resolution No deposit shall be Iess than five -
hundred dollars Any person intending to make openings, cuts or excavations in streets or
public places may make and maintain with the city finance dnector a general annual
deposit in the sum of not less than five -hundred dollars, and the person so depositing shall
not be requir ed to make the special deposits provided in this section, but shall, ho« ever,
be required to comply with all) other applicable provisions of this chapter Any special
general deposit made under this section shall serve as security foi the repair and
performance of work necessary to put the street in as good a condition as it was prior to
the excavation if the permrttee fails to make the necessary repairs or to complete the proper
refilling of the opening and the excavation work under the excavation permit Such cash
deposit, except in the case of an annual deposit, shall be refunded by the city to the
permittee upon the expiration of such twenty-four month period and upon request of the
permrttee, provided, that the city may use any or all of any such deposit to pay the cost of
any work the city performs to restore or maintain the street or public place as provided in
this chapter in the event the permrttee fails to per form such work, in which event the
amount refunded to the permrttee shall be reduced by the amount thus expended by the
city The decisions of the city engineer as to the cost of the work done or repairs made by
him under the provisions of this chapter shall be final and conclusive as to cost

in the city either under regulations of the State Public Utilities Commission or authorized
by the state to open ate the public utility, and having the right, either by general or special

permission to enter upon the streets and open and excavate pavements, sidewalks or disturb
the surface thereon by excavation or other work, shall be required to apply for a permit
for a permit and pay all applicable fees and deposits for all work in the public right-of-way
A blanket permit for excavation may be issued for periods up to one year, but excavations
in excess of two feet by four feet shall not be made without prior approval of plans by the
city engineer
Section 2 This Ordinance shall become effective thirty (30) days fz om the
date of adoption

01, REPEALING TITLE 18 OF THE GRAND TERRACE
MUNICIPAL CODE AND ADOPTING A REVISED TITLE 18
AND ITS ASSOCIATED NEGATIVE DECLARATION (E-90-
02)
WHEREAS, the City Council approved a revised General Plan on December 8, 1988,

WHEREAS, the City's Zoning Districts are to be revised to conform with the revised
General Plan, and
WHEREAS, the proposed Zoning Amendment, Z-90-01, set out in full in Exhibit A,
herein repeals Title 18 of the Grand Terrace Municipal Code in its entirety, and
WHEREAS, the proposed Zomng Amendment, Z-90-01, establishes the Barton Road
Specific Plan (SP-90-01) as an independent zoning district (BRSP), and
WHEREAS, the proposed Zoning Amendment, Z-90-01, establishes the Commercial
Manufacturing District as an independent zoning district (CM), and
WHEREAS, the proposed Zoning Amendment, Z-90-01, establishes the Public
Facilities District as an independent zoning district (PUB), and
WHEREAS, the proposed Zoning Amendment, Z-90-01, establishes the Agricultural
Overlay District as an independent zoning overlay district (AG), and
WHEREAS, the proposed Zoning Amendment, Z-90-01 amends the City's Zoning
Map as indicated on Exhibit B, and
WHEREAS, in accordance with the provisions of the California Environmental
Quality Act, an Initial Study has been conducted and a Negative Declaration (E-90-02) has
been prepared and is attached as Exhibit C, and
WHEREAS, the City Council held a properly noticed public hearing regarding Z-90-

01 and E-90-02 on July 24, 1990, and
WHEREAS, the City Council in accordance with California State Senate Bill SB 512,
hereby directs staff to conduct a city wide inventory of all illegal signs within six (6) months
of the date of approval of this ordinance, and that an abatement program shall be initiated
within 60 days thereafter
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS
SECTION 1 E-90-02, a negative declaration prepared for Z-90-01 included
herewith as Exhibit C is hereby approved, and
SECTION 2 Title 18 of the Grand Terrace Municipal Code is hereby
repealed and a revised Title 18 for the Grand Terrace
Municipal Code which is setout in full and included herewith as
Exhibit A is hereby adopted, and
SECTION 3 The City's Zoning Map is hereby amended as proposed and
included herewith as Exhibit B
SECTION 4 Effective Date - This Ordinance shall be in full force and effect
at 12 01 A.M on the 31st day of its adoption
SECTION 5 Posting - The City Clerk shall cause this Ordinance to be
posted in three (3) public places within fifteen (15) days of its
adoption, as designated for such purpose by the City Council
SECTION 6 First read at a regular meeting of the City Council of said City
held on the 24th day of July, 1990, and finally adopted and
ordered posted at a regular meeting of said City Council on the
9th day of August, 1990
