Commendation to David Sandoval, Coordinator/Teacher.
2C. Mayor Pro Tem Grant read a Proclamation proclaiming the month of
September, 1990, as "Bicycle Safety Awareness Month."
Mayor Matteson introduced Jennifer Santamaria who is a student at
Colton High School and has been nominated as a Congressional
Scholar to represent her school and community in the delegation of

a new law became effective,
dirt, rock, sand or gravel must be covered unless the load is kept
six inches below the lip of the truck. She felt that the City
should look into the new law and enforce it. She indicated that
she attended a special program put on by the DARE officer at the
school and stated that she was very impressed with the officer and
the program. She noted that there was low attendance from the
parents and encouraged everyone to attend the next program and do
their part to fight drugs. She made reference to the August 23rd
meeting indicating that discussion took place regarding the street
cut Ordinance, and it was stated by the City Attorney that Council
will need to take action establishing the once -a -year fee by
amending the fee schedule. She asked when this will be placed on
the agenda.
City Manager Schwab, stated that it was his understanding that the
City Engineer has the authority to set the security amount for each
individual utility. He indicated that he will do some research and
talk to the City Attorney to determine how we will set the
securities and then report back to Council.

6A. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,
CALIFORNI , E TABLISHING A MUNICIPAL SERVICE FOR THE COLLECTION AND
DISPOSAL OF REFUSE CREATED, ACCUMULATED OR PRODUCED WITHIN THE CITY
OF GRAND TERRACE
City Manager Schwab, indicated that the City currently does not
regulate refuse collection and disposal in any way other than the
provisions made by the State Health & Safety sections regulating
refuse disposal and collection. The passage of Assembly Bill 939
requires that cities be the agency responsible for the task of
controlling and reducing the refuse wastestream. In order for the
City to be able to meet the mandates of AB 939, it will be
necessary for the City to have control of the wastestream. The
Refuse Ordinance gives the City the ability to control the manner
in which waste is collected and gives the power to grant franchises
that further spell out methods of disposal and the rates that may
be charged for such disposal. The Ordinance exempts parcels over
one acre in size and allows Council to grant exemptions if
sufficient cause can be shown that an exemption is warranted.
Mayor Matteson opened discussion to the public, there being none,
Mayor Matteson returned discussion to Council.
Mayor Pro Tem Grant, asked why parcels over one acre in size are
exempt from the Ordinance.
City Manager Schwab, indicated that in the past there was concern
on behalf of the residents with large lots with horses or
agriculture who felt it was unfair for them to have mandated refuse
service because they may have a large enough volume of trash to
justify hauling it to the dump themselves. This exemption is to
give them the option to be able to contract for that service or
haul it themselves.
Councilmember Carlstrom, indicated that he would like to see the
requirement changed to 20,000 sq. ft. or more.
Mayor Matteson, agreed with Councilmember Carlstrom that the lot
size for exemption should be lowered. He felt that six months
imprisonment for violation is too severe.
City Manager Schwab, stated that six months is the maximum
allowable penalty. He indicated that under extreme circumstances
you could be looking at someone who violates the Refuse Ordinance
by dumping hazardous waste and that penalty could be necessary. He
indicated that an option would be to make it a misdemeanor.
Deputy City Attorney Burns, indicated that the $500 and six months
in jail is the standard misdemeanor violation for any ordinance
that you adopt. It's now up to $1,000 or six months in jail. You
do have the discression of reducing that if you specifically state,

down to an infraction, however, he recommended that Council
consider not doing that. He indicated that there are very few
times that anybody goes to jail at all and the most would be five
days. He indicated that you want the flexability to go for a
corporate prosecution, some high corporate officer that just
blatantly violates the Ordinance.
Councilmember Pfennighausen, indicated that this type of Ordinance
has come up before and was met with some resistence. She stated
that it is now required by law that municipal government be held
responsible for the implementation of legislation to reduce the
wastestream.
CC-90-147 MOTION BY COUNCILMEMBER CARLSTROM, SECOND BY COUNCILMEMBER SINGLEY,
CARRIED 5-0, to adopt the Refuse Ordinance with the exemption
changed to lot sizes of 20,000 sq. ft. or more.
6B. TPM-89-03 (Cook)
Community Development Director Sawyer, indicated that the applicant
submitted an application to subdivide a single 3.22 net acre R1
parcel into four individual parcels located at 11917 Rosedale
Avenue. The Tentative Parcel Map proposes to subdivide the
property into two lots with one additional lot for dedication
purposes to the adjacent parcel. The existing single-family
residence and accessory shed will remain on Lot 1. The size of
both lots 1 and 2 is 20,050 square feet, Lot 3 contains 100,188
square feet and Lot A is 4,941 square feet. Lots 1, 2 and 3 meet
the minimum lot size requirement of 20,000 square feet. He
recommended that Council adopt the Resolution approving TPM-87-03
subject to the conditions of approval contained therein
Mayor Matteson opened discussion to the public, there being none,

Councilmember Pfennighausen, referred to the section that states
that prior to building permits being issued, approved fire hydrants
and pavement markers shall be installed. She asked if this is
standard. She indicated that in 1981-82 the Womens Club took on a
project to place blue dots designating where a fire hydrant is
located and over the years most of them have disappeared. She
indicated that she has not seen a single blue dot installed on any
street in any of the new tracts and felt that if this has been
standard, we need to see that this is getting done.
Community Development Director Sawyer, indicated that through a
conversation with the Fire Department on another project, there has
been some change in the regulations and this may be a new
requirement imposed now that was not a standard condition
previously.
Councilmember Pfennighausen, asked that this be looked into to see
now long this nas 5een required.

City Engineer Kicak, indicated that this is the first time he has
seen this as a condition of approval and suggested that the blue
dots be replaced through the street striping.
Councilmember Pfennighausen, stated that she would like to see blue
dots identifying every fire hydrant within the City within six
months.
It was the concensus of Council to place blue dots on the next
agenda for action.
CC-90-148 MOTION BY MAYOR MATTESON, SECOND BY COUNCILMEMBER SINGLEY, CARRIED
5-0, to adopt the Resolution approving TPM-87-03 subject to the
conditions of approval contained therein.
6C. TPM-90-02
Community Development Director Sawyer, indicated that the applicant
submitted an application to subdivide a single 2.17 net acre R1-10
with agricultural overlay into two individual parcels located at
23100 Vista Grande Way. The subject property contains
approximately 94,525 square feet. The Tentative Parcel Map
proposes to subdivide the property into two lots designated as Lot
1 and Lot 2. Lot 1 is 1.55 acres and Lot 2 is .23 acres.
Incorporated in this area is .39 acres, approximately 16,988 square
feet for street dedication. He recommended that Council adopt the
Resolution approving TPM-90-02 subject to the conditions of
approval contained therein.
Mayor Matteson opened discussion to the Public.
Chauncey Eller, Applicant, 23100 Vista Grande Way, Grand Terrace,
referred to the conditions of approval and stated that he is
opposed to installing curbs, gutter and sidewalks. He indicated
that there is not one home that has curbs and it would stick out
like a sore thumb. He indicated that he is opposed to the
improvements because of the cost and he would have to remove one
full row of orange trees.
Mayor Matteson returned discussion to Council.
Mayor Matteson, asked the reason for putting this project in the
existing Lighting and Landscaping District.
Community Development Director Sawyer, indicated that all new
subdivisions, parcel maps and tract maps have that condition on
them now that we have that district set up so that at any time when
we do need to have lights go into that area, that property will be
included in the assessment district to pay for them.
City Manager Schwab, indicated that if he is placed in the
assessment district he will only be assessed to the extent of the
benefit that he would receive. If there is no street lighting he

would receive no benefit and, therefore, would receive no
assessment. He indicated that staff would not object to Mr.
Eller's request that he be allowed to deferr the public
improvements in the front as well as deferr joining the assessment
district until a further date when we would request him to do so.
CC-90-149 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER
PFENNIGHAUSEN, CARRIED 5-0, to adopt the resolution approving
TPM-90-02 subject to signing a Deferral Agreement for conditions of
approval #2 and #3.
NEW BUSINESS
8A. Voting Delegate for 1990 League of California Cities Conference
Mayor Matteson, indicated that the three members of Council who
will be attending the Conference are Councilmember Pfennighausen,
Mayor Pro Tem Grant and Mayor Matteson.
CC-90-150 MOTION BY MAYOR PRO TEM GRANT, SECOND BY COUNCILMEMBER SINGLEY,
CARRIED 5-0, to appoint Mayor Matteson as the voting delegate for
the 1990 League of California Cities Conference.
CC-90-151 MOTION BY COUNCILMEMBER PFENNIGHAUSEN, SECOND BY MAYOR MATTESON,
CARRIED 5-0, to appoint Mayor Pro Tem Grant as the alternate voting
delegate for the 1990 League of California Cities Conference.
8B. Franchise Agreement for Residential Refuse
City Manager Schwab, indicated that Council has adopted the first
reading of a Refuse Ordinance which allows the City to grant a
franchise for the collection and disposal of refuse A franchise
agreement will allow the City to have some control over the refuse
operations within the City. He indicated that staff is proposing
that an exclusive residential franchise be considered for Loma
Linda Disposal Company and that the commercial disposal remain on
an open -competition basis. Loma Linda Disposal is the traditional
residential hauler for the City, and currently collect almost 100%
of the residential collections. Any current residential customers
being picked up by any other company other than Loma Linda Disposal
will be allowed, as set by state statute, to continue to collect
those stops for a period of five years.
Councilmember Singlet', stated that the complaint brought before
Council at the previous meeting regarding Loma Linda Disposal has
been handled and he commended the City Manager and Loma Linda
Disposal for their expeditious action.
Deputy City Attorney Burns, referred to page 9 of the agreement and
indicated that Health & Safety Code Section 4272 has been repealed
and superceded by Public Resources Code Section 49500 and that
change should be made to the agreement. He indicated that we are

He explained that the rate structure is set up in two components,
which are service and disposal. The CPI would apply to the service
portion and disposal increases would apply to the rate of pasture.
The franchise fee would be 10% of the service portion. He
indicated that he will look into it but Loma Linda Disposal is not
capable at this time to handle hazardous waste removal. However,
their regional office is working on a program and if enough people
participate, he may be able to get involved.
Councilmember Carlstrom, asked about red tagging.
Rick Chilton, Loma Linda Disposal, indicated that he has no problem
changing the working from "may" to "must."
Deputy City Attorney Burns, stated that when Council considers the
issue of hazardous waste, it is important to deal with a company
that has a substantial liability policy because of potential legal
action.
Mayor Matteson, stated that Council just adopted the first reading
of the Refuse Ordinance and asked if it is legal to award a
franchise before the second reading.
City Manager Schwab, indicated that the effective date of the
franchise would be 30-days from the date of the second reading.
Mayor Matteson, indicated that it should be awarded pending the
second reading.
Stan Hargrave, 12048 Canary Ct., Grand Terrace, made reference to
page 10 paragraph E of the Agreement and asked that Council
consider using arbitration to avoid remedies at law or in equity if
possible. He requested that the second reading of the Refuse
Ordinance be open for public hearing.
Deputy C,ty Attorney Burns, stated that there are pro's and con's
to arbitration. It provides a quicker and cheaper method for
settling disputes, however, you do not have the quality of a courts
decision.
City Manager schwab, stated that if there is a problem and Loma
Linda Disposal and the City wish to arbitrate, we have the option
to enter into an agreement to arbitrate that one issue but we could
selectively choose to arbitrate or not.
Deputy City Attorney Burns, stated that in almost all litigation
you are required to go through mandatory, non -binding arbitration
in which you have an arbitration and you get that result and you
can then appeal to the judge or not.

Mayor Pro Tem Grant, asked if Council can have another public
hearing at the second reading of the Refuse Ordinance.
Deputy City Attorney Burns, indicated that it would have to be a
new first reading.
Peggy Taylor, 22843 Vista Grande Way, Grand Terrace, asked when
trash separation and recycling will be mandatory.
City Manager Schwab, indicated that at the first meeting in
October, Loma Linda Disposal will be making a presentation to
Council to consider recycling but it probably would not be
mandatory.
Councilmember Pfennighausen, indicated that there has been problems
with recycling in that the industry is not set up to use the
recycled material and it is ending up in the landfills. She
indicated that it is encumbent upon us to put pressure on the
manufacturers and our legislators to gear up the industry to
receive our recyclable waste. She indicated that recycling is not
the only method we should use to control our wastestream.
Mayor Matteson, stated that he is not in favor of the five years.
He felt that it should be a three-year evergreen or completely
renegotiated after the fourth year.
Councilmember Singley, felt that it is to the benefit of the City
and its residents to keep quality equipment and indicated that by
giving them a five-year amortization we allow them to continually
upgrade their equipment.
CC-90-152 MOTION BY MAYOR MATTESON, SECOND BY COUNCILMEMBER CARLSTROM, FAILED
2-3 (MAYOR MATTESON AND COUNCILMEMBER CARLSTROM VOTED AYE), to
adopt the Franchise Agreement with a three-year evergreen, changing
paragraph J to bi-monthly, changing paragraph L from "may" to
"shall", and changing the code section on page 9.
Councilmember Singley, stated that he is in favor of a franchise
but has a problem with with the amortization and changing the bin
collection from every three months to every two months.
Councilmember Pfennighausen, concurred with Councilmember Singley.

HISTORICAL & CULTURAL ACTIVITIES COMMITTEE
Minutes of the September 10, 1990 Meeting
The meeting was called to order at 7 PM by Ann Petta who was
acting for Chairman Viola Gratson who is recuperating from
surgery. Hannah is back from surgery and both she and Viola
thanked the Committee for the flowers. Those present were
Ann, Hannah, Irene Mason and Marie Schmidt.
The minutesof the August 6th meeting were read and appioved
Irene made the motion to accept and Marie seconded. Ann
reported that there is $2,000 in our treasury for the new
fiscal year.
Old Business Country Fair to be held November 3rd will be
our 9th annual fair. 30 large posters will be ordered and
300 small letter size flyers.
Plaques for Sister City Plates: The Committee will have to
decide what to say on plaques, what color also. The City will
have these done up for us. We will ask Randy Anstine for help
with this and invite him to our next meeting.
New Business: Cornerstone for new building on the north-west
corner of Barton and Mt. Vernon. The Committee has no objection
to this. The present building has no historic value but does
have nostalgic value. A memo bill be sent to the Planning
Commission to this effect. Hannah will take pictures of the
old building as well as the old fruit stand on Barton and
Proston.
The next meeting will be October 1, 1990. Meeting was aajourned
at 7 25 PM.

Approved minutes of the June 4, 1990 meeting
New business - Accepted applications for membership to the Park and
Rec committee for William Johansen and JoAnn Johnson Lenny will
place as action item to City Council Marsha and William Johansen
will be out town for the Oct meeting and ask for a leave of absent
The company representative for the ground cover showed us the
product ( sample that was taken from Bloomington park - the wood
shavings were over 6 months old ) He stated 1) it is fire
resistant - will char but not burn 2) it will not blow away 3) it
is prickly -so kids don't throw it 4) will need additional filler
after about 5 years 5) should be raked weekly 6) should prevent
most falling accidental injures by the cushioning effect of the
material He stated and showed us the documentation that in San
Bernardino County Schools the average playground accident cost the
school district $12 000 each in the last school year
The committee voted to use the Zeburg funds to purchase the ground
cover for under the playground equipment in our two parks
Old business -
Tour de Terrace is coming along,
Kathy is going on the SF trip put on by GT Park and Rec
No injuries reported this month
Kathy Gerber reported a teenage dance is to be planned for the
fall
Programs for the fall are expanding - new programs will be added
Lenny asked Karen to see if the Electric Company would change their
stand on our placing playground equipment in PICO PARK as there is
a real need and this is our heaviest use part of GT PARK
Marcia reported on the Senior Citizen activities and progress on
the new Senior center

AN ORDINANCE OF THE CITY OF GRAND
TERRACE ESTABLISHING A MUNICIPAL
SERVICE FOR THE COLLECTION AND
DISPOSAL OF REFUSE CREATED,
ACCUMULATED OR PRODUCED WITHIN THE
CITY OF GRAND TERRACE
_ THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Refuse and Garbage Collection by City or Its Agents. All
residential and commercial refuse collection service from all places and premises located
within the City of Grand Terrace shall be by the City or by any of its duly licensed,
permitted or franchised agents, and all occupants or persons in possession, charge or
control of such places and premises within the City of Grand Terrace who provide and pay
for the collection of refuse shall use the City's collection service or the service provided by
any of its duly licensed, permitted or franchised agents. It shall be unlawful for any person
other than the authorized agent or employees of the City to collect, remove or dispose of
refuse within the City of Grand Terrace; provided, however, that nothing contained herein
shall prevent any such person from removing their own refuse or from using garbage
disposal devices as permitted by the City of Grand Terrace when an extraordinary or
unusual accumulation of refuse exists.
Section 2. Power of City Council to Contract for Disposal. The City Council
may let contracts for the collection and disposal of refuse herein, and may as a condition
for granting such contract require a bond from the contractor in an amount determined
by the City Council for the faithful performance of such agreement. In the event the
Contractor shall fail to conform to the conditions of such agreement as provided for herein,
the City Council, at its option, after Public Hearing, of which the Contractor shall have
thirty (30) days notice in writing, may terminate such agreement and let the contract to
another person considered by the City Council to be more capable of carrying out the terms
of such agreement. In lettmg contracts for refuse disposal, the City Council shall not be
required to let the same to the lowest bidder, but shall let such contract to the person most
suited to comply with the terms, conditions and intent of this chapter.
All refuse accumulated within the City shall be collected, conveyed and
disposed of by the City or its agent. No other person shall collect, convey over any of the
streets or alleys of the City, or dispose of any refuse accumulated within the City.
Collectors of such refuse from outside the City shall not be prohibited from hauling such
refuse over City streets, provided such collectors comply with provisions of this chapter and
other applicable rules and regulations.

Section 3. Refuse. Refuse shall mean and include all garbage or vegetable
household waste. All combustible or waste which ordinarily is created or accumulated in
the operation and maintenance of a household, business or industry, including leaves,
cuttings, trimmings from trees, shrubs, and grass Refuse does not include heavy or bulky
articles such as trees, tree limbs, logs, automobile bodies, large motor vehicle parts,
building or construction materials, abandoned appliances, earth and waste from building
operations, or animal feces.
Section 4. Fees for Collection of Refuse Fees for the collection of residential
and commercial refuse shall be those as established by resolution of the City Council by
franchise agreement.
Section 5. Definitions Residential. Residential shall mean any single-family
dwelling which shall include family units of four (4) attached units or less
Section 6. Definitions Commercial. Commercial shall mean anything other
than residential as defined in Section No. 5 of this Ordinance.
Section 7. Nuisance. The keeping of refuse in containers other than the
containers prescribed herein or the keeping upon premises of refuse which is allowed to
become offensive and annoying, shall constitute a public nuisance and may be abated in the
manner provided by law for the abatement of nuisances
Section 8. Refuse Containers Required It shall be the duty of every owner,
lessee, manager and/or person in possession charge or control of a building on any premises
located within the City to provide or cause to be provided and at all tunes to keep or cause
to be kept sufficient and convenient portable refuse containers upon such premises.
Section 9. Tvne and Size of Containers. Each refuse container shall be of
sound construction and shall be water -tight and shall have no ragged or sharp edges or any
other defect liable to hamper or injure the person collecting the contents thereof.
Containers shall be made of metal, plastic or otherwise impervious materials, equipped with
suitable handles. Containers shall not weigh more than sixty (60) pounds when filled with
refuse and shall have a capacity of not more than thirty-six (36) gallons.
Section 10. Covering Containers. All containers shall have a tight fitting
cover. The covers shall not be removed from refuse containers except when necessary to
place refuse therein or to remove refuse therefrom

Section 11. Loose Materials All loose materials not placed in a refuse
container must be securely tied in bundles or bags and shall not weigh more than thirty (30)
pounds each, and shall not measure more than eighteen (18) inches in diameter or four (4)
feet in length
Section 12. Location of Container. Each refuse container shall be kept in
or placed in such a manner as not to be visible from the public street and so as to be easily
accessible to the refuse collector provided that during or for the time fixed for the collection
of refuse from said containers they shall be kept or placed as follows:
(a) Near Alley Where there is an alley other than
a blind alley in the rear of such premises, the
refuse container shall be placed on the premises,
within three (3) feet of the rear property line.
(b) On Curb. Where there is no alley other than a
blind alley in the rear of the premises, each
refuse container shall be placed immediately
behind the curb on a public street, in front of the
premises Where no curb exists, containers shall
be placed in a position as though a curb did
exist.
Section 13. Refuse Container in Public Way. No person shall place a refuse
container in any street, alley, sidewalk, court or other public way in the City at any time
other than the regular tune for the collection of refuse. Every person who so placed a
container for the purpose of refuse collection shall place the container no earlier than two
(2) hours before sundown prior to the date of collection, and shall remove same no later
than 7:00 p.m. on the day of collection or two (2) hours after the container is empty, which
ever is later.
Section 14. Dumping of Refuse. No person shall deposit or cause or permit
to be deposited any refuse upon or in any public street, alley or other public place, or upon
any premises in this City except in refuse containers as provided for in this chapter.
Section 15. Unusual Accumulations Collection in Certain Places. For
collection of unusual accumulations of refuse, or collection of refuse from location not
otherwise provided for in this chapter, reasonable collection charges may be charged as
shall be agreed upon by the garbage contractor and the customer.

Section 16 Interference with Refuse Container. It shall be unlawful for any
person, other than the owner of the refuse container or any officer, agent, or employee of
laid owner or the City or its agents to interfere in any manner with any container or to
remove any container from the location where it shall have been placed by the owner
thereof.
r _ Section 17. Improper Substances in Container. No person shall place or
permit to be placed in any refuse container and substance or material other than refuse as
defined in this chapter.
Section 18. Vehicle for Collection. All vehicles used in collecting and
transporting refuse shall be provided with metal bodies and shall be constructed as to be
water -tight and to prevent the loss of any contents being collected or transported therein
upon the streets, alleys and other public ways within the City.
Section 19. Collection - Non -single Family. Multi -family residential,
commercial and industrial units shall have their refuse collected in the same manner and
for such rates as the City Council may adopt for various levels of service. The frequency
of collection shall be negotiated individually but shall be collected at least once a week.
Section 20. Exemption - Application Parcels over one acre in size are
exempt from this chapter and where practical difficulties or results inconsistent with the
general purposes of this chapter would result from its strict literal enforcement, the City
Council may grant an exemption from certain or all of its provisions, upon such terms and
conditions as it deems necessary. A written application for exemption shall be filed with
the City Clerk setting forth provisions the applicant seeks to be exempt from and settling
forth with specificity the reasons why such an exemption should be granted
Section 21. PENALTIES IF ANY PERSON SHALL VIOLATE ANY OF
THE PROVISIONS OF THE CHAPTER, HE SHALL BE DEEMED GUILTY OF A
MISDEMEANOR, AND, UPON CONVICTION THEREOF, SHALL BE PUNISHABLE
BY A FINE OF NOT MORE THAN FIVE HUNDRED ($500) DOLLARS OR BY
IMPRISONMENT FOR A PERIOD OF NOT MORE THAN SIX (6) MONTHS OR BY
BOTH SUCH FINE AND IMPRISONMENT. SUCH PERSON SHALL BE DEEMED
GUILTY OF A SEPARATE OFFENSE FOR EVERY DAY DURING SUCH PORTION
WHICH ANY VIOLATION OF THIS CHAPTER IS COMMITTED, CONTINUED OR
PERMITTED BY SUCH PERSON AND SHALL BE PUNISHABLE AS PROVIDED FOR
BY THIS CHAPTER.

Section 23 Effective date This Ordinance shall be in full force and effect
at 12.01 a.m on the 31st day after its adoption.
Section 22 Vandity If any section, subsection, sentence, clause or phrase
of this chapter is for any reason held to be invalid, such holding or holdings shall not affect
the validity of the remaining portions of the chapter The City Council hereby declares
that it would of passed this chapter and each section, subsection, sentence, clause or phrase
thereof irrespective of the fact that any one or more sections, subsections, sentences,
clauses, phrases be declared invalid
Section 24 Posting. The City Clerk shall cause this Ordinance to be posted
in three (3) public places designated for such purpose by the City Council.
First read at a regular meeting of the City Council of said City held on the
6th day of September, 1990, and finally adopted and ordered posted at a regular meeting
of said City Council on the 27th day of September, 1990.
