APPROVAL OF CHECK REGISTER NO CRA032786 CRA-86-14 Motion by Mrs Pfennighausen, Second by Vice Chairman Matteson, ALL AYES, to approve Check Register No. CRA032786, as submitted CIVIC CENTER REFINANCING City Attorney hopkins related background of tax and sewer assessment liens on Civic Center property, recommended appropriation of $9,300 to cover monies owed, thereby ensuring clear title for refinancing purposes, advised cancellation of the property taxes has been initiated pursuant to the Revenue and Taxation Code, but noted process is timely, therefore, due to April 7th closing date, both the taxes and sewer assessment fees must be deposited in escrow to guarantee clear title - when the taxes are cancelled, monies will be refunded. SPECIAL PRESENTATIONS Proclamation - Child Abuse Prevention Month, April 1986 Mayor Grant read Proclamation and encouraged community involvement, advised it will be delivered to the appropriate party. Grand Terrace Area Youth Basketball Mayor Grant advised that five framed pictures of the Grand Terrace Area Youth Basketball Team, with each Councilmember's name inscribed, were delivered to the City Clerk's Office by Rhoda Saterfield, a previous member of the Parks and Recreation Committee, to be given to each Councilmember in appreciation of their sponsoring the team It was noted that each Councilmember personally contributed $25 00 Council expressed appreciation CONSENT CALENDAR The following items were removed from the Consent Calendar for discussion 3D - Minutes of 3/13/86 and 3E - Bids for Street Striping and Traffic Control Devices (GTB #86-06) CC-86-66 Motion by Mayor Pro Tem Matteson, Second by Councilman Petta, ALL AYES, to approve the following Consent Calendar items Page 1 - (3/27/86) A. Authorize Finance Director to Attend the California Tax Outlook Conference in Sacramento, April 9 - 10, 1986, G Authorize Community Services Director to Attend California Safety Conference in Sacramento, May 20 - 22, 1986, APPROVAL OF 3/13/86 MINUTES Relative to proposed off-street parking requirements, Councilman Evans requested issue of potential litigation with respect to the Mt. Vernon Villas project, as addressed by City Attorney Hopkins, be reflected in the minutes. Following discussion relative to whether approval should be deferred, CC-86-67 Motion by Mayor Pro Tem Matteson, Second by Councilman Petta, to approve the Minutes of March 13, 1986, as presented, subject to the addition of the following discussion by City Attorney Hopkins regarding proposed off-street parking requirements relative to potential litigation by Forest City Dillon (Mt Vernon Villas project) "Relative to that portion of the Mt Vernon Villas project not as yet approved, Councilman Evans questioned possible legal repercussions above action could have City Attorney Hopkins related that Forest City Dillon feels the City put them to exposure by the sale and official statement of the bonds, resulting in their expenditure of $75,000 toward the entire project, thus, changing zoning requirements at this point could result in potential liability for the City " Motion No CC-86-67 carried, 4-1, with Mayor Grant voting NOE. REQUEST OF BIDS - STREET STRIPING AND TRAFFIC CONTROL DEVICES G B - Responding to Councilwoman Pfennighausen relative to specifics, City Engineer Kicak advised implementation of all the Traffic Safety Engineer's requirements would far exceed cost proposed, therefore, plan is to install the most critical traffic safety signs and re -stripe all streets previously striped with the addition of a couple collectors. Did not foresee all recommended signage covered within the $15,000, however, advised when the bids are received, Council could appropriate additional funding Community Services Director Anstine related, once all critical signs are identified, signs of less critical nature would be alternately bid, advised a list of selected signs will be incorporated into the actual plan and provided to Council Page 2 - (3/27/86) Following discussion regarding status CC-86-68 Motion by Councilman Petta, Second by AYES, to authorize request of bids for control devices (GTB #86 -06) PUBLIC PARTICIPATION of projects previously budgeted, Councilwoman Pfennighausen, ALL street striping and traffic Gene McMeans, Manager of Riverside Highland Water Company and Assistant Manager Rich Haubert briefed Council on current water system including breadth and capacities, water quality assurance procedures, improvements, replacement programs, and billing and collection procedures Councilwoman Pfennighausen questioned delivery and storage systems, requested copy of map outlining the seven-year improvement program including the coloring indicating phasing of the plan Relative to the map, Mr McMeans related that as each phase is considered, priorities may change - as one project is phased out, importance of additional projects will be evaluated Regarding company's intentions to abate vandalism of the 2,000,000 gallon water storage tank, advised bolts have been welded and further plans include installation of a post and gate to preclude access. Completion of new 1,000,000 gallon reservoir on Palm Avenue anticipated in three to four weeks. Discussed engineering plans to upgrade the Lytle Creek line - a pre -bid meting is projected for April 2, 1986. Advised objective throughout entire planning process is to accomplish all projects in line with the City's planning Responding to Mayor Pro Tem Matteson relative to availability of water when difficulties arise with a particular storage tank, Mr. McMeans advised each zone has more than one tank and transfers can be accomplished, however, many main and distribution lines cannot be isolated, therefore, part of the water system improvement program has been initiated to help alleviate problem by providing more flexibility and redistribution capabilities Assured company will work closely with staff to coordinate priority of projects so as not to overlap with City and create additional problems In response to Councilman Evans regarding the rapid deterioration of lines, felt problem was a combination of the corrosive nature of the soil and old age - company plans to install materials to overcome problem Regarding criteria of selecting priorities of line installation, stated the first was the 24" line to afford ability to fully utilize the Lytle Creek well field, and, second was badly deteriorated lines Relative to availability of funding, related some funds are available, however, attempting to use those as leverage to secure additional funding from various sources City Engineer Kicak related staff is investigating possiblities of working weekends to minimize potential problems with school children during construction of the 24" line Steve Kiacz, 11809 Holly, referencing letter sent to the City Manager, requested what consideration or action has been taken relative to the drainage problem stated therein City Engineer Kicak advised he Page 3 - (3/27/86) investigated complaint and related solving problem would entail reconstruction of the curb, gutter, and sidewalk, advised similar problems exist throughout the City, therefore, to correct this particular problem would require a major expenditure, thereby setting a precedent for others with similar cases Advised staff could provide projected costs with respect to all problem areas for submission to Council, did not see problem as major, but more one of maintenance. Related situation can be temporarily corrected by sweeping debris from the gutter, but not the ultimate solution. Mayor Grant expressed importance of knowing the costs to determine feasibility of City's involvement Ed O'Neal, 22608 Minona, referenced editorial in the Sun Telegram wherein reference was made to a Committee in Victor Valley appointed to investigate methods of funding and implementation relative to long range planning, felt a similar Committee should be established, not responsible to anyone except various elected entities - will report additional information as it becomes available Mayor Grant visualized a variety of groups combined together to look at economic development including political entities from across the County line, City limits and unincorporated areas, voiced importance of establishing an overall plan wherein individuals involved are all headed in the same direction - looked forward to continued input. PLANNING COMMISSION REPORT - Planning Director Kicak advised next meeting will e held April 7, 1986. Mayor Pro Tem Matteson requested update of Commissioners' attendance at meetings PARKS AND RECREATION COMMITTEE REPORT - City Manager Armstead related the Azure Hills Seventh Day Adventist Church has offered the use of its tennis court, details are being coordinated HISTORICAL AND CULTURAL ACTIVITIES COMMITTEE REPORT - Minutes of the March 3, 1986 meeting were provided. CRIME PREVENTION COMMITTEE REPORT - Ed O'Neal, Committee member, reported the following uccess of the Domestic Violence Community Education Workshop held in Council chambers on March 27, 1986, City Manager Armstead commended the San Bernardino County Sheriff's Department for excellent presentations, (2) Letters have been sent out seeking membership to serve on the Committee. EMERGENCY OPERATIONS COMMITTEE REPORT - Minutes of the February 20, meeting were provided ECONOMIC DEVELOPMENT AD HOC COMMITTEE - Councilwoman Pfennighausen reported status on promotional brochure to appear in the Inland Empire Magazine - article, photography, and advertisements are completed. CHAMBER OF COMMERCE REPORT - Barbara Bayus, President Elect, reported the following Expressed excitement with progress on the promotional brochure, (2) Thanked Councilmembers for attendance at Page 4 - (3/27/86) last Board meeting - encouraged future involvement, (3) Tickets now available for the Chamber's April 12th auction - invited participation with volunteer services, dates and times of scheduled events will be provided at next meeting. CITY ENGINEER REPORT - City Engineer Kicak reported the following. The Sisters of St Benedict plan to appeal certain conditions set forth by the staff and Planning Commission with respect to their development on Pico Street, advised a Public Hearing will be set for April loth meeting, (2) A proposed Subdivision Ordinance will be discussed at the Title 18 Ad Hoc Committee's April 3rd meeting. CITY MANAGER REPORT - City Manager Armstead requested Council's approval to authorize the City, as a public service, to collect payments for gas and electric utility bills beginning May 1, 1986. CC-86-69 Motion by Mayor Pro Tem Matteson, Second by Mayor Grant, ALL AYES, to approve the collection of utility bills by the City beginning May 1, 1986. CITY COUNCIL REPORTS Councilwoman Pfennighausen reported Cindi Dean, Grand Terrace's representative to the Miss Teen America pageant, was chosen as Miss Hospitality, she is looking forward to re-entering and going on to the national competition next year. Mayor Pro Tem Matteson thanked the Riverside Highland Water Company for their new approach toward the City. Mayor Grant reported the following (1) Represented Cities at the March t LAFC meeting, (2) Questioned status of trucks parked west of the University Prompt Care Medical Clinic, Community Services Director Anstine advised property owners were cited for commercial vehicle sign violations at that location - four of the vehicles have been removed and one remains that is inoperable, (3) Commended Group W Cable for providing information relative to various City Committees on its Channel 36. Councilman Petta reported Toastmasters' meetings are now held in the ivic Center Community Meeting Room at 6 30 a m. every Friday. FY 1986-87 BUDGET STUDY SESSIONS Finance Director Schwab requested Council set dates for budget study sessions, noted the preliminary budget will be presented to Council at the May 8, 1986 meeting. Following discussion, budget study session dates were set for May 15 and 16, 1986 at 5 30 p m Mayor Grant requested the City Clerk advertise the meetings are open to the public for input City Engineer Kicak noted that Title 18 Ad Hoc Committee would postpone their scheduled May 15th meeting to May 29th Page 5 - (3/27/86) Recessed at 7 16 p m , reconvened at 7 35 p m , with all members present CDBG FUNDING PROPOSAL Planning Director Kicak related the following proposals for future CDBG funding through HUD (1) Community /Senior Center Sign (Estimated $1,049 00), (2) Carpeting of the Community Center (Estimated $3,403 00), (3) Traffic Signal reconstruction (northwest corner of Mt Vernon and Barton) and the acquisition of the necessary rights to construct that portion of the signal (Estimated at $20,000 00) Councilman Petta related an increase in estimated cost for carpeting the Community/Senior Center due to addition of one room, which the Lions Club is currently renovating for community use Mayor Grant clarified the proposed project proposals are merely recommendations and invited public participation. Responding to Mayor Pro Tem Matteson relative to available funding, Planning Director Kicak advised the City's balance for the remainder of this period is approximately $33,000 - monies not utitlized may be carried over to the next year's funding for other projects, related the proposed projects would require competitive bidding. Mayor Grant opened Public Hearing Ed O'Neal, 22608 Minona, supported carpet installation in the Community/Senior Center as first priority for CDBG funding. Introduced Donna McDougal, President of the Colton High School's Key Club and the Toastmasters' Youth Leadership group who, in turn, introduced Marvin Torres, Vice President, Michael Gonzales, and Andy McClellan, Secretary, and thanked Mr. O'Neal and Councilmembers. Mayor Grant closed Public Hearing Following clarification of available funding, Councilman Evans, with Councilwoman Pfennighausen concurring, voiced support for applying all available funds toward the Traffic Signal reconstruction project CC-86-70 Motion by Mayor Pro Tem Matteson, Second by Mayor Grant, to submit proposed projects for CDBG funding with the traffic signalization at Mt Vernon/Barton as first priority Responding to Councilman Petta, Planning Director Kicak anticipated receiving clearance to proceed with projects as submitted within two and a half months Based on prioritization discussed above, projected funding for the Community/Senior Center carpeting in August or September, advised prioritization would have no significant effect on timing of projects Motion No CC-86-70 carried, ALL AYES Page 6 - (3/27/86) APPEAL OF PLANNING COMMISSION DECISION - TENTATIVE TRACT MAP 13205/ SPECIFIC PLAN - .J. A Planning Director Kicak related Planning Commission's decision at their meeting of February 17, 1986, to reject the proposed Tentative Tract Map 13205 and Specific Plan 85-12 located on the northeast corner of Oriole and Main Street Concerns discussed included size of the homes and the location of an existing corral with respect to the property line of the proposed development. Main reason for denial was strong public opposition, with the Planning Commission in agreement, relative to the proposed size of the homes together with lot size Advised of Developer's alternate plan subsequently submitted which proposes homes ranging from 1200 to 1700 square feet, priced from $105,000 to $125,000 respectively Mayor Pro Tem Matteson questioned validity of presenting a new proposal to Council prior to presentation to the Planning Commission. City Attorney Hopkins advised if proposal had not previously been considered by the Planning Commission, it should be resubmitted for review Councilman Evans felt issue should be continued to allow sufficient time to review specific plan and definitive criteria. Following discussion and clarification, Motion by Mayor Pro Tem Matteson to deny appeal and refer new proposal for Tentative Tract Map 13205 and Specific Plan 85-12 back to the Planning Commission. Motion died for lack of second. Councilman Petta, with Mayor Grant in concurrence, felt Council should hear input from both the Developer and public. Mayor Grant opened Public Hearing. Bill Storm, representing T.J Austyn, related, due to the current economic climate and decline of interest rates, the feasibility of submitting a new proposal to meet with conditions of approval imposed by the Planning Commission, discussed specifics of proposal including increased square footage, floor plans, prices and possible solution to the previously mentioned corral problem. Bill McKeever, 12714 Blue Mountain Court, adjacent property owner north of proposed project, cited proposed development as an incompatible land use which would jeopardize property values in the area - felt project could be amended to provide increased lot sizes in areas adjacent to larger parcels, however, expressed concern with development itself - portion of project dead ends on Main Street providing no alternate access to properties to the east Expressed opposition to both the proposed square footage and lot size. Merrie Anderson, 22872 Main Street, property owner east of proposed development, voiced concern with lack of alternate access for fire protection - questioned developer's plans regarding potential water problems and landscaping to conceal her corrals Dennis Kidd, 22874 Pico, supported project, felt large lots do not guarantee quality and the City can control the quality through the Planning Commission's Site and Architectural Review process, noted Page 7 - (3/27/86) alternate access to Mrs. Anderson's property was cut off by Mr. McKeever's development project, related necessity for developer to install a new water line which would give Mrs Anderson additional access to domestic water, felt smaller homes compatible in the Oriole area and larger homes could be constructed on the hill toward Mr McKeever's property Grayson Planck, 22872 Main, questioned effect project would have on current zoning Karen McKeever, 12714 Blue Mountain Court, observed the square footage of houses abutting proposed development range from approximately 2400 to 3300 square feet, voiced concern with preserving current property values and property use Dale Reiley, 22657 Tanager, felt proposed development would considerably decrease his property value, objected to idea of installing a park in project area Bill McKeever, 12714 Blue Mountain Court, speaking in rebuttal, advised his development project did not cut off alternate access to Mrs Anderson's property, related driveway easement was replaced by an improved road in order to maintain access Mayor Grant closed Public Hearing CC-86-71 Motion by Mayor Pro Tem Matteson, Second by Mayor Grant, to refer Tentative Tract Map 13205/Specific Plan 85-12 back to the Planning Commission for review of new proposal. Councilman Petta related Title 18 Ad Hoc Committee's recommendation to require a minimum square footage of 1350 per unit, felt idea should be to upgrade rather than downgrade property values Questioned available protection to current A-1 property owners. City Attorney Hopkins indicated Developer's willingness to grant a covenant to run with the land (recorded document) for future home owners relative to existing adjoining property uses to include their intention to not disrupt or disturb those uses, however, related future land use problems that could arise relative to A-1 property restrictions. The Municipal Code provides that any building or enclosures for fowl or livestock on A-1 property must be erected a minimum of 70 feet from any place used for human habitation, public park, or school on adjoining property and 35 feet from any residential district boundaries or exterior lot lines, related restrictions mentioned could result in great financial hardship for property owners as well as a detriment to current property use Suggested considering variance process relative to those particular portions of the Zoning Ordinance Councilwoman Pfennighausen, although sympathetic toward concerns of property owners, felt the horse ranches in question were presently protected by current land use, the General Plan Update process, and Zoning Ordinance Felt home size should not be of highest consideration, but rather the quality of the development, saw no relationship between the size of a house and the quality of people Page 8 - (3/27/86) generated thereby. Relative to the proposed park previously mentioned, related location would run over an aqueduct to make use of an undevelopable area - noted park not intended to be full scale, but a play area for neighborhood children Councilman Evans voiced concern with Council being placed in the position of considering an appeal without specifics relative to reasons for denial and prior to review of Specific Plan, requested detailed information be provided in the future. Mayor Pro Tem Matteson observed current and future problems with proposed project, felt size of lots above water line should be at least a half acre to blend in with existing property usage. Councilwoman Pfennighausen, concurring with Motion, felt it should include direction that specifics be provided if resubmitted to Council. Motion No. CC-86-71 carried, ALL AYES ORDINANCE NO. 100 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, AMENDING THE MUNICIPAL CODE OF THE CITY OF GRAND TERRACE, SECTIONS 18 60 040A, 18.60 040B AND 18.60.040C, PERTAINING TO OFF STREET PARKING (2nd Reading) City Attorney Hopkins read the title of Ordinance and briefly outlined proposed amendment thereto relative to the single car enclosed garage requirement (to be attached to the main building of the residential district) for multi -family dwelling units, related an alternate Ordinance had been prepared including off street parking requirements for single family homes. Councilman Evans expressed confusion with differing views regarding intent of proposed Ordinance as reflected to him by Planning Commissioners and Councilmembers who initially felt it encompassed all residential development, not exclusively multi -family dwellings. Mayor Pro Tem Matteson, with Councilman Petta concurring, felt the same requirements should be imposed for single family homes for consistency, leaving no option for installation of carports. CC -86-72 Motion by Mayor Pro Tem Matteson, Second by Councilman Petta, to adopt Ordinance No. 100 by title only. Councilwoman Pfennighausen voiced objection relative to the recent Planning Commission approval of carports for the Sisters of St. Benedict in relation to the proposed imposition of attached garage requirements on future developments. Motion No CC -86-72 carried, 3 -2, with Councilmembers Pfennighausen and Evans voting NOE. CC-86-73 Motion by Mayor Pro Tem Matteson, Second by Councilman Petta, to amend the Municipal Code, Section 18 60.030, Residential Single-family Dwellings, by deleting "or carport," for adoption of first reading at next meeting. Finance Director Schwab related purpose of proposed Ordinance is to compile into one document the legal authority to charge fees, fines, and taxes for licenses, permits, services, facilities, activities and infractions With the exception of fines for nuisance infractions and storm drain capital improvement fees, increases average 10%. Noted the nuisance fines are proposed to be tripled and the storm drain fees, in order to be compatible with the neighboring cities, are proposed to be doubled. Recommended adopting the Ordinance following Public Hearing. Mayor Grant opened and closed Public Hearing, with no testimony given. Motion by Mayor Pro Tem Matteson, Second by Councilman Petta, to adopt second reading of Fee Ordinance by title only. Councilwoman Pfennighausen expressed opposition to proposed Ordinance in relation to the tripling of nuisance violations, imposition of a business license tax, and lack of differentiation between capital improvement and maintenance fees for single and multi -family dwelling units. Councilman Evans voiced support of certain areas and opposition to others, therefore, could not support Ordinance in its entirety In light of above comments, Mayor Pro Tem Matteson suggested delaying matter until next meeting to allow sufficient time for review, therefore, withdrew Motion, with its Second not in concurrence. Councilwoman Pfennighausen urged Councilman Petta to withdraw his Second to enable further review time. Since the Motion for the first such agreement, made in 1979, placed a five-year period in which the covenant would run with the land, that set a precedent for subsequent lien agreements. The City Clerk recently was requested to record a release of one of the liens which had exceeded the five-year period for purpose of closing an escrow. Requesting legal advice from the City Attorney, was advised a release should be recorded for all such expired documents Since there are two items on the Agenda involving potential Lien Agreements, the City Attorney recommended Council establish a policy for the time period. FUNDING REQUIRED NO FUNDING REQUIRED xx Attached, you will find a letter dated March 21, 1986, from Brown and Rawdon Architects, appealing Planning Commission recommendations as set forth at their meeting of March 17, 1986, in addition they are requesting the waiver of the $117.00 appeal fee. The appeal addresses the following 1. Eliminate the requirement for curb and gutter 2. Forestry and Fire Warden requirement to install one on -site fire hydrant. 3. Forestry and Fire Warden requirement for 20 foot wide, unobstructed width roadway with turning radius and capable of supporting and accommodating large fire apparatus. 4 Waiver of $117.00 Appeal Fee. It should be pointed out that one other requirement was considered by the Planning Commission, specifically the installation of sidewalks along the frontage of subject property Planning Commission unanimously recommended to the City Council that the sidewalk requirements be eliminated. Much of the discussion on the curb and gutter requirement focused on the existing street width and the existing improvements along the parcels to the west and to the east of the subject parcel. It was pointed out that parcel to the west, due to the frontage and small portion of the parcel being developed was required to install portion of the frontage improvements. Balance of the improvements to be constructed as the balance of the parcel developes. The parcel to the east was divided and developed under several parcel maps, and in accordance with the County Standards was not required to install improvements Beyond that, it must also be recognized that Blue Mountain Court was developed as a private street, therefore, no responsibility for maintenance was assumed by the County. With respect to the width, our General Plan Circulation Element designates that portion of Pico Street as collector, having 66 feet of right-of-way and 44 foot curb separation, or 22 feet from centerline to the new curb face. The existing berm is located at 22 feet from street centerline STAFF REPORT - CITY C OUNC ` APRIL 10, 1986 12-8 5045 PAGE 2 Planning Commission recommended the installation of curb and gutter. With respect to Forestry and Fire Warden requirements, Planning Commission recommended that Applicant contact the Fire Warden, receive clarification in the form of an amended letter, which if and however amended, would be the condition of approval. In addition, the Applicant stated that a letter from Riverside Highland Water Company would be provided indicating that the required fireflow of 1500 G.P M at 20 psi residual pressure is available at that location. As to the on -site roadway requirements, the recommendations to the Applicant was the same as for modifying the fireflow requirement, to contact Fire Warden for further clarification. There was no discussion regarding the waiver of the fee for the appeal STAFF RECOMMENDS THAT THE CITY COUNCIL- 1. There is an existing AC curb across the complete property frontage (302.90') installed by the City not more than 3 years ago, at a distance from the centerline greater than the proposed concrete curb would be. Since the northerly half of the street is unimproved the concrete curb requirement would result in an inadequate street width until the property on the north side of the street is improved. From the Sisters property eastward the zoning is A-1, not R-1 and is essentially horse ranch country and groves to the base of the mountain. 2) The requirement of the Forestry and Fire Warden Department to provide one on site fire hydrant. There is an existing street hydrant within 420 feet of the most remote point of the house. The Riverside -Highland Water Company is sending us a "can serve" letter stating that a fire flow of 1500 gpm at 90 psi residual pressure can be provided. Section 5.04.030 is hereby amended to read as follow "Section 5.04.030 Other license taxes or fees unaffected. Persons required to pay a license tax or fee under the provisions of this chapter are not relieved from payment of any tax or fees under any other cit ordinance unless so specified therein." SECTION 4. Section 5.04.110 is hereby amended to read as follow "Section 5.04.110 Nontransferability--New locations, Name chang No license issued under this chapter is transferable. Licensees may, upon application and paying a fee as set by fee schedule, have their licenses amended to conduct business at a new location or under a new name, as long a the owner of the business does not change. To do this the licensee must submit in writing to the collector the reason for the change and include the old license." SECTION 5. Section 5.04.290 is hereby amended to read as folloH "Section 5.04.290 Flat -rate taxes. Every person transacting, conducting, managing, engaging in and carrying on the business and activitie set forth hereafter in this section shall pay a license tax as set by the City A. Auctioneers The provisions of this section shall not apply to any person having an established permanent place of business for conducts a public auction, or to any fixed business which may auction any merchandise for purposes of winding up the affairs of the business or for the purpose of closing out of a special line of merchandise, B. Outdoor festivals, any music festival, dance festival or similar musical activity which is held at any place other than in a permanent building constructed for such purpose, C. Carnival. "Carnival" means any shows, entertainments, mechanical rides, amusements, performances or games of any kind, which as a result of the operation, things or representatives of value are given or paid, D Circus. "Circus" means an exhibition or entertainment at which feats of horsemanship, acrobatics and trained or wild animals are exhibited or displayed, to which exhibition or entertainment an admission fee is charged, E. Contractors, F. Dancing, public dance without charge, G. Dancing, public dance for admission fee or charge, H. Delivery by vehicle, making deliveries of merchandise to business establishments in Grand Terrace, and not having a fixed place of business in the city, I. Handbill distributor not having a fixed place of business within the city and conducting the business of advertising by the distribution of handbills, circulars or other written or printed materials, J. Security service, night -watch service, security service, private policeman or detective agency, K. Peddler or solicitor, peddling or soliciting by use of telephone service or other communication, travel by foot or any type of conveyance from place to place, and carrying goods, wares or merchandise for sale and having no fixed place of business within the city, L. Shoeshine stand, M. Redemption store, redeeming any stamps, coupons, tickets, cards or other devices issued for or with the sale of goods, wares or merchandise which stamps, coupons, tickets, cards or other devices so issued entitle the purchaser receiving the same to procure from the person, firm, corporation any goods, wares or merchandise free of charge upon the production of one or any number of such stamps, coupons, tickets, cards or other devices, N. Swap meet. 1. "Swap meet" means any business which rents spaces to various dealers or individuals for selling or offering for sale, goods, wares and merchandise, and where an admission fee is charged to enter the area where the merchandise is being offered for sale. 2. Receipts for the space rental shall be written in triplicate on numbered receipts, and shall contain the name and addresses of the deal er or i ndiv i dual , and the make and 1 icense number of hi s automobil e. One copy of the receipt shall be furnished to the dealer, one copy filed with the city, immediately after the sale, and one copy retained by the swap meet operator for a period of three years for audit purposes, 0. Transportation of passengers, auto livery, bus, taxi, 4 ambulance or other vehicle, for the transportation of passengers for hire, P. No fixed place of business; not having a fixed place of business within the city who engages in business within,Grand Terrace and not having been classified under any other section of this chapter, Q. Fixed place of business, having a fixed place of business within the city and not included under Section 5.04.260." SECTION 6. Section 5 04.340 Inspection of premises is hereby repealed in its entirety - 2 - SECTION 7. Section 5.20.020 is hereby amended to read as follows "Section 5.20.020 License required. It is unlawful for any person, corporation or association of persons to operate, conduct or carry on a public dance or a public dancehal l without first obtaining a license so to do, as provided in this chapter." SECTION 8. Section 5.20.030 (A) is hereby amended to read as follows "Section 5.20.030 Application --Denial grounds. A. Application for a license un er t is c apter shal I be made to the city clerk in writing and shall state the name and address of the applicant and the place where the dance or dancehall is to be conducted." SECTION 9. Section 5.20.040 (A) is hereby amended to read as fol1 ows "Section 5.20 040 Issuance--Nontransferability--Posting. A. Upon approval of such 1 icense by the counci , the city clerk sFaTTissue a 1 icense to the appl scant, such 1 icense shal 1 set forth the name of the applicant and the place where the dance or dancehall is to be conducted." SECTION 10. Section 5.24.010 is hereby amended to read as follows "Section 5.24.010 License required. It is unlawful for any person, without firstobtaining from the city clerk a license to be designated as a "distress sale license," to advertise or conduct any sale of goods at retail, which sale is represented by that person or any agent of his as " (Subparagraphs A through F remain unchanged) SECTION 11. Section 5.24.110 is hereby amended to read as follows - "Section 5.24.110 Selling other than closed -out stock. It is unlawful to se , offer or expose for sale at any such sale, or to list on such inventory, any goods, wares or merchandise which are not the regular stock of the store or other place, the business of which is to be closed out by such sale, or to make any replenishment or addition as to such stock for the purpose of such sale, except those items listed as provided in Section 5.24.030(D), or during the time thereof, or to fail, neglect or refuse to keep accurate records of the articles or things sold, from which records the license -issuing authority may ascertain the kind and quantity of goods sold, and it is unlawful to fail to make and keep all records of the distress sale available for inspection at any reasonable business hour by a representative of the city." SECTION 12. Section 5 24.120 Enforcement is hereby repealed in its entirety. - 3 - SECTION 13. Section 5 28.080 is hereby amended to read as follows "Section 5 28 080 Changes in management or supervisory personnel. Any change in personnel aving management or supervision of applicant's business shall be reported to the city clerk within ten days after such change. A violation of this provision shall be grounds for suspension or revocation of such license." SECTION 14. Section 5.28.090 Entertainer permit is hereby repealed in its entirety. SECTION 15. "Section 5.36.010 Definition. For the purpose of this chapter 'fortunetelling means the practice of the art of astrology, palmistry, phrenology, 1 i fe reading, fortunetelling, cartomancy, clairvoyance, clairaudience, crystal gazing, mediumship, spirit, augury, devination, necromancy, character reading, or fortunetelling by handwriting analysis or other similar business or art, whether predicted by manual or electronic device, and demand or receive directly or indirectly a fee, gift, donation, or reward for the exercise or exhibition. "Section 5.36 020 Permit required. No person shall conduct or carry on any fortunetelling business or activity without first having applied and received a permit to do so from the city council as herein provided, or after any such permit shall be revoked. "Section 5.36.030 Application for permit. Any person required by this chapter to have a permit shall submit a written application to the city clerk. A fee shall be charged to cover the costs incurred by the city for processing the application and is in addition to the business license tax. The application shall contain A. Name and address of person proposing to operate said business. B. Method and means used to arrive at these fortunetelling predictions. C. Proposed location. D. Operating hours. At the time of such filing the applicant shall also furnish to the city clerk written statements of at least three bona fide residents, who have been residents in the city no less than three years, that the applicant is of good moral character. - 4 - "Section 5 36.040 Investigation --requirements. A. Upon the filing of the application required by this section toget er with the fee, the city clerk shall transmit one copy to the Chief of Police. The Chief of Police shall report to the city council in writing recommending the approval or denial of the permit and stating the reasons therefore. B. The city council shall not order the issuance of the permit unless all of the following requirements are met, 1. The applicant has submitted a correct and complete application form. 2. The applicant has paid all required fees and taxes. 3. The applicant has not been charged with or convicted of any felony or any crime involving theft, embezzlement or moral turpitude, or committed any act constituting dishonesty or fraud. 4. The time and place of proposed licensed activities is in accordance with the regulations set forth in this chapter. "Section 5.36.050 Business license required, permit expiration and renewal. A business license application shall e made and a business icense tax paid based on gross receipts in accordance with this code. All permits and licenses shall be issued on an annual basis and expire on December 31. A renewal permit may be issued upon application to the city clerk. Any application for renewal must be made before December 31. A person whose perms t has expi red shal 1 be deemed a new appl scant and shal 1 have to requal i fy under provisions herein. No such renewal shall be issued without first having been submitted to the Chief of Police for his approval. Any objection to the renewal of the application shall be submitted in writing to the city council for a hearing. "Section 5.36.060 Religious exemptions. Churches or recognized religious organizations shall e exempt from permit and license regulations of this chapter provided that the generated revenue is for the exclusive benefit of the church, all revenue will be deposited directly to the church treasury, no single person will benefit from the generated revenue, and that the church has maintained headouarters or a place of worship in the city for at least one year preceeding the date on which the activity shall be initiated. Proof of religious exemption shall be furnished to the city clerk in the form of a determination letter from the United States Treasury (Internal Revenue Service) relating to federal taxes or a determination letter from the State of California Franchise Tax Board relating to franchise taxes. All churches or houses of worship shall comply with regulations of the Municipal Code of the City of Grand Terrace pertaining to conditional use permits. "Section 5.36.070 Surety bond required. Every applicant for a license as a fortuneteller, shall, e ore the issuance of the permit to operate, file with the city a surety bond in the amount of $10,000 from a reputable surety company licensed to do business in the state, conditioned that such licensee shall not suffer or permit any fraud or imposition to be practiced upon the public and that he comply with all terms of this chapter. Said bond shall be maintained in the city clerk's office and shall be renewed annually in accordance with the permit renewal date. Cancellation of said surety bond shall be constituted as a reason for revocation of the permit to operate "Section 5.36 080 Minors prohibited. Any person conducting a business as a fortuneteller shall not provide to any minor child any fortunetelling services without said minor being accompanied by a parent or - 5 - t 1 egal guardian. A readable sign shall be posted at the main entrance identifying the establishment as a fortuneteller premises and no person under the age of 18 is permitted unless accompanied by a parent or guardian. "Section 5.36.090 Revocation. Any permit issued hereunder may be revoked by the city council at any time whenever it appears to the city council that the holder thereof has violated any provisions of this article or that the continued conducting of such business would be detrimental to the city or the inhabitants thereof. "Section 5.36 100 Inspection of premises, devices of trick or deceit. The premises for which the applicant is issued a permit to con uct the business of fortunetell ing shall be subject to inspection by the Chief of Police for purposes of determination that no devices shall be present which might act to deceive or mislead customers of this service. Refusal to allow said inspection may be considered grounds for revocation of the permit." SECTION 16. Section 5.48.020 is hereby amended to read as follows "Section 5.48.020 Licensed required. It is unlawful for any person to practice, engage in or carry on the business or activities of a massage technician or massage parlor within the city without having a license under this chapter to do so and complying with all regulations and requirements as contained and set forth in this chapter. It is unlawful for any owner, operator, responsible managing employee, manager or permittee in charge of or in control of a massage parlor to employ or permit a person to act as a massage technician, as defined in this chapter, who is not in possession of a valid unrev oked massage technician license issued by the city." 'k A. Permit Required No person shall dig up, break, excavate, tunnel, undermine any street or public place without first obtaining an excavation permit from the City Engineer. All excavations shall be subject to inspection by the City Engineer. Actual costs of such inspection will be paid by the permittee. Be Acquisition Charge All property of every kind within the City lets shall be charged In addition to other charges as established, a sewer acquisition charge. All Class I users proposing to connect to or contribute to the POTW shall -- obtain a wastewater discharge permit before connecting to or contributing to the POTW. All existing Class I users connected to or contributing to the POTW shall obtain a permit within one hundred eight (108) days after the effective date of the Ordinance. Users required to obtain a permit shall complete and file with the City Engineer an application in a form presecribed Iv by him and submit the required filing fee. The base service for acquisition of sewerr services shall be the sum of $1,500.00 and the charge for each additional drainage fixture unit in excess of 18 shall be $60.00. Existing ; Class I users shall apply for a permit within sixty (60) days after the �1 effective date of the Ordinance. New Class I users shall apply at leas ninety (90) days prior to connecting to or contributing to the POTW. The acquisition charge shall be due and payable prior to the issuance of a NC building permit. No sewer facilities shall be furnished or connection made unless such charge is paid. C. Building Alteration or Rehabilitation - Inspection If alteration will increase the sewage discharge beyond the basic units of service (commercial or residential) then those increased units shall be charged accordingly. E. Disconnection for Nonpayment The connection of any sewer facilities without payments gives the City the right to go upon private or public property and disconnect the sewer facilities. F. Cesspools and Similar Facilities - Use No person shall make any connection with any cesspool or other facility for IQ C depositing sewage, except with and into the City sewage disposal lines. G. Cesspools and Similar Facilities - Discontinuing Use On any lot where there is an existing cesspool or other place where sewage is being deposited, such building may continue to be served from such cesspool or other facility. However, no person shall continue to use any cesspool or NC place where sewage has been or is being deposited which the County Health Officer finds unsuitable, after the expiration of thirty days from service of notice upon the property owner and/or occupant to this effect. H. Permit - Required - Fee No person shall make or attempt to make any connection with the main sewer NC lines without a permit or payment of the connection fee. I. Separate Connection for each Building Every building or other structure situated within the City shall be separately and independently connected with a connecting sewer, except where more than one building or other structure may, by special permit authorized by the Chief Building Official, be joined in the use of one house and connecting sewer. Such buildings and structures must be owned by the same person. J. Old Sewers and Maintenance of Laterals No buildings or other structures shall be connected to an old sewer, nor shall any old sewer line be used until a connection permit has been granted u and certificate of inspection obtained from the Chief Building Official. It shall be the responsibility of each property owner to maintain their sewer 11 a lateral. K. Violation - Penalty Any user who is found to have violated, or who willfully or negligently failed to comply with a wastewater discharge permit issued under this chapter, may be fined up to five hundred dollars. Each day on which a violation occurs or continues, shall be deemed a separate and distinct Al C offense. In addition to the penalties provided in this section, the City mays recover reasonable attorney's fees, court costs, court reports, fees, and other expenses of litigation by appropriate suit against the guilty person. ITEM 12 - SEWER USER CHARGES The following sewer user charges have been established pursuant to the City of Grand Terrace Municipal Code Chapter 13.08. A. Sewer User Rates 1. Residential users shall be charged the rate of seven dollars ($7.00) per month. Each single family dwelling, each dwelling unit in a multiple NC' residential complex (including duplexes, apartments, condominiums, etc.), and each dwelling unit in a mobile home park shall be charged at a rate of $7.00� per month. 2. Commercial and/or industrial users shall be charged 670' of the of $0.32 per one hundred cubic feet of water per month or any portion thereof,C. however, the minimum monthly charge for such users shall be $7.00 per month. 3. Each church user shall be charged the rate of $7.00 per month; however, each church -owned property shall be charged at the appropriate use rate as provided herein. 4. Individual schools shall be charged a rate of $7.00 per month for each one hundred (100) average daily attendance or portion thereof. These amounts A/( -- shall be computed on the basis of the previous 12 months. B. Billing - Delinquency Sewer Service charges shall be billed on a bimonthly basis, in advance off service. All such charges will be due and payable on the date of such billing and shall become delinquent thirty days thereafter. All unpaid delinquent balls shall be assessed against the using property in the manner I provided for by law. In addition, the City Manager is directed to use any and all other means as provided for by law for the collections of the unpaid delinquent bills. (Municipal Code 13.08.020) i A collection fee of $5.00 shall be charged to a delinquent sewer each preceeding billing which has not been paid. / �G 12 user for v - V C. Lien Status of Delinquent Charges - Interest Delinquent charges, plus penalties, shall constitute a lien upon the real' property served, except that no such lien shall be created against any publicly owned property, and such lien shall continue until the charge and all penalties thereon are fully paid, or the property sold therefor. A list of all such delinquent charges plus penalties, shall be recorded at least every six months. In the event a lien is filed for unpaid sewer service charges or any action at law is commenced for the collection of unpaid sewer service charges, such unpaid charges shall bear interest at the rate of one-half of one percent per month from the date of delinquency of each charge. (Municipal Code 13.08.130) D. Waiver by Council The City Council may waive any provision provided for in Municipal Code 13.04jlv)C as to any particular user and may hear requests for such waiver Niue to special hardship or special conditions. Disconnection Authorized As an alternative method of enforcing the provisions of Municipal Code 13.04 and other ordinances, resolutions, and rules and regulations of the City relating to sewer service, the City may disconnect the user from the sewer mains of the City . After a building sewer has been disconnected from the sewer system it shall not be reconnected until all such delinquent charges plus penalties have all been paid. All costs incurred by the City for N� disconnection and reconnection of sewer services as a result of non-payment of sewer service charges shall become a charge against the property being ` served which has been disconnected or reconnected. Said charges shall be billed to the property, along with all delinquent charges, and other delinquent charges shall, from the date of disconnection, bear interest at the rate of ten percent (10%) per annum. FEE REFUNDS The Building Department may authorize the refunding of any fee paid under the following conditions: A fee that was erroneously paid or collected. A refund shall not be more than eighty per cent (80%) of the permit fee paid when no work has been done under a �J permit. The City Council has adopted a resolution declaring a State of Emergency due to the disaster, for damage caused by or occurring in the same disaster and the application for the building permit is filed with the Department of Building and Safety within on hundred and eighty (180) days after the resolution has been adopted by the City Council. 12. Any exceptions must be approved in writing by the Community Services Director. B. The City may require licensed security officers for additional supervision on any reservation. These officers will be hired by the City of Grand Terrace and all related fees to be paid in addition to the other charges for the use of the facility, by permittee. 1 - 100 Guests - One Security Guard Required C. Group must appear within fifteen (15) minutes of beginning time specified or permit will be cancelled and all fees forfeited. D. In order to reserve a facility all deposits must be paid at the time of application. All fees must be paid prior to five (5) working days before the scheduled event/reservation. Deposits are refundable ONLY if facilities are left in a clean and orderly manner and no damage has occurred. APPLICATION A person who wishes to move a building or structure must file an application with the City Engineer. If the building or structure to be moved is subject tolkj regulations by the City Building and Safety Department, the applicant shall obtain and file with his application a building and safety department approvals for the moving of the building or structure. B. FEES AND DEPOSITS Every applicant for a moving permit shall deposit with the City Engineer a surety bond in the amount of five thousand dollars for the protection of highways from injury and to provide indemnity for any damages resulting from the operation or movement under permit. C. INSPECTION FEE The applicant shall pay an inspection fee based on a value of a new building structure. When the structure is located more than fifty miles outside the boundaries of the City, the Department of Building and Safety may request and C reimburse a local agency in that area for an on -site inspection and report. There shall be no inspection or inspection fee on a building or structure to moved out of the City. D. INSPECTION AND REPORT The Director of Building and Safety shall inspect the building or structure to be moved and prepare a written report which shall be forwarded to the applicant If approved for moving, the report shall contain the requirements necessary to %( make the building or structure conform to all building code requirements. E. INSPECTION REPORT TERM - Additions to Report Additional corrections may be added to the report whenever the structure has been vandalized, damaged during transportation or altered in any manner after the on -site inspection. Otherwise, the inspection report shall remain valid fo a period of ninety days (90) after the building or structure has been inspected C At the end of that time, if the building or structure has not been relocated, new report and inspection fee will be required. Ja ITEM 19 - ANIMAL CONTROL The following fees have been established pursuant to the City of Grand Terrace Municipal Code Title 6, Chapter 6.04. A. Authority to Release - Any officer having in his custody any unlicensed, impounded dog or cat not suffering from any infectious or communicable disease may release the same to any adult person who will pay the pound fees and charges as established by the San Bernardino County, if a resident of the City, will t also pay for rabies vaccination and license fees if it is a dog that such resident of the City has bought. Only male cats will be sold. B. Impoundment of dogs running at large - There shall be a reclaiming fee for 36 ,all impounded dogs, as established by San Bernardino County. n � C. Wild, Exotic Animals - The Health Officer may authorize the keeping or maintaining of any wild, exotic, dangerous or nondomestic animal when, in his opinion, any such animal may be kept or maintained without �1C endangering the safety of any person, or other animal or property, nor create ��VV nuisance. The Health Officer may require any such animal to be properly caged, or restrained, and require a license fee as established by San Bernardino County. D. Pet Shops - An application for a license to operate a pet shop, pet grooming parlor, public aquarium, petting zoo, wild animal breeding or boarding facility ' or animal menagerie, shall be made in writing to the Health Officer. No license shall be issued or renewed unless and until all general regulations relating to animals as set forth by the Health Officer, are complied with and after payment of an animal fee as established by San Bernardino County. E. Dog License Fees - Each application for a dog license shall be accompanied NC by a license fee as established by San Bernardino County. F. Dog License - Penalty Fee - Any person who obtains a license not in conformity with any of the above provisions shall pay a penalty fee, as jv C established by San Bernardino County, in addition to the regular license fee. G. Dog License - Transfer of Ownership - If, during the licensing year, a licensed dog is sold or title to the dog is otherwise transferred to a new owner, such new owner may apply to the Health Officer for a transfer of such dog's tag and license and pay a transfer fee as established by San Bernardino County. ITEM 20 - ALARM DEVICES AND SYSTEMS The following fees have been established pursuant to the City of Grand Terrace Municipal Code, Title 8 Chapter 8.20. A. Service Charge - Imposition - There shall be a service charge based on police or fire staff time, assessed against the alarm user when a police or fir response occurs as a result of a third or subsequent false alarm from an alarm system at the same address or location within any twelve - consecutive - ,J calendar - month period. ITEM 21 - AMBULANCES The following fees have been established pursuant to the City of Grand Terrace Municipal Code Title 8, Chapter 8.24. A. All permits shall be issued to expire on December 31st of each year, and the annual fee therefor may be prorated on a quarterly basis for the first year. Permit fees �v may be waived by the City Council if public need and necessity requires it for nonprofit agencies supported by public subscription. After approval by the Planning Director, and before commencing operation, the applicant shall apply to the Environmental Health Officer for a commercial fertilizer operation permit and shall pay the following fees: A. Penalty - A fifty percent penalty shall be added for failure to make application for yearly renewal within thirty days from the date of expiration or� for failure to apply for a permit. ITEM 24 - ABANDONED ORCHARDS The following fees have been established pursuant to the City of Grand Terrace Municipal Code. Title 8, Chapter 8.72. 38 The Planning Director shall cause any orchard to be brought into compliance with this chapter after the expiration of twenty eight days after the last - ► notice is sent to the applicant, either the notice to remove or the notice of the City Council determination. The compliance shall be achieved as reasonably and economically as possible in accordance with the discretion of the Planning Director. The City's Finance Director shall pay the cost of such compliance from available funds to the City. The total cost of such compliance shall be computed and an administrative fee of twenty percent of such cost shall be added. A bill for the entire sum of the costs and administrative fee shall be mailed to the record owner of such orchard. The bill shall include an itemized statement covering the work necessary for such removal; such itemized stateme shall be due and payable within thirty days after mailing.
