A regular meeting of the City Council of the City of Grand Terrace was called to
order at the Terrace View Elementary School, 22731 Grand Terrace Road, Grand

The meeting was opened with invocation by Pastor John DuNesme, Azure Hills Seventh
Day Adventist Church, followed by the Pledge of Allegiance, led by Ivan Hopkins.

FUNDING PRESENTATION
Mrs. Glen Cooley, 22885 Grand Terrace Road, representing the Grand
Terrace Woman's Club, presented a $200 check to the City for the
purpose of maintaining an interior planter in the new Civic Center as
a memorial to former members of the Grand Terrace Woman's Club.
Mayor Grant expressed appreciation to the Grand Terrace Woman's Club
for their generosity. Mrs. Cooley recommended that a representative
of the Grand Terrace Republican Club be included on the Civic Center
Dedication Committee.
CIVIC CENTER CONSTRUCTION
Architect Field Report Nos 26 and 27 were provided.
Fire/Smoke Alarm System - City Manager Armstead advised Architect
arry Wol s on vacation for two weeks; advised additional price
quotations were obtained ranging from approximately $7,000 to
$17,000. Price quotations were also obtained for battery operated
fire and smoke alarm systems, which could be provided at considerably
lower cost than the systems previously considered. Recommended
purchasing 15 ionized smoke detector and alarm units for approximately
$225 and the purchase of two duofone home monitor systems for
approximately $425 for use in the Civic Center.

CC-84-213 Motion by Councilman Petta, Second by Councilwoman Pfennighausen, ALL
AYES by all present, to approve the following Consent Calendar items:

PUBLIC PARTICIPATION
Byron Matteson, 12175 Michigan, introduced himself as a candidate for
the City Council in the upcoming November election.
PLANNING COMMISSION - The Minutes of July 2, 1984, were provided.
CRIME PREVENTION - Mayor Grant advised many cities have been
recognizing a eTip Organization and showing their support through
a one -page advertisement nationwide; recommended, with Council
concurring, the expenditure of $200 for a one -page notice indicating
the City's support of the WeTip Organization.
Emergency Operations - Councilwoman Pfennighausen reported the
generator receive its monthly service.
FIRE CHIEF REPORT
City Manager Armstead advised a meeting will be held August 16 at
10:00 a.m. with the California Division of Forestry to review all new
subdivisions for streets and addresses and to evaluate the City's
water pressure system. Following that meeting, a meeting will be held
with the Riverside Highland Water Company. Councilwoman Pfennighausen
noted work is being done to remedy the problem of no fire hydrants in
the westerly portion of the City.

CITY MANAGER REPORT
City Manager Armstead reviewed a proposed letter to be sent to each
member of the Board of Supervisors requesting support of augmentation
funding for the Grand Terrace library; recommended the letter be sent
the first week of September since the Board of Supervisor's meeting to
consider approval of that funding will be held Monday, September 10,
at 9:00 a.m. Councilwoman Pfennighausen advised she received a call
from Supervisor Riordan recommending that letters of support be sent
to each member of the Board of Supervisors from the City Council and
other organizations such as senior citizens and the PTA.
CC-84-214 Motion by Councilwoman Pfennighausen, Second by Councilman Petta, ALL
AYES by all present, to authorize the Mayor to execute the proposed
letter requesting support of the Grand Terrace library funding, to be
sent, on behalf of the City Council, to each member of the Board of
Supervisors.
Councilwoman Pfennighausen and City Manager Armstead will meet with
Supervisor Riordan to request that she consider authorizing the County
Librarian to proceed on certain matters relative to the Grand Terrace
library at this time.
CITY COUNCIL REPORTS
Councilwoman Pfennighausen reported the following: (1) Referenced
correspondence Council received regarding a vehicle which was towed
away from a residence on Holly Street for exceeding the 72-hour
parking limitation; noted this is a problem area since there is
limited parking behind those houses and no parking in the front of the
houses. Noted that in driving around the City observed other vehicles
which appeared to have exceeded the parking limitations, including a
truck with no motor. In checking with the new Code Enforcement
Officer, learned that six vehicles were towed away that month. Feels
something should be done in the area of Mt. Vernon and Holly Street
due to limited parking in that area. Felt the basic purpose of the
parking ordinance was to ensure that motorhomes, campers, and boats
did not remain parked on streets for a long period of time.
Recommended that enforcement of the ordinance be reviewed with law
enforcement; (2) Stated she has always supported Mr. Hughes and his
right to maintain his private property; however, recently has become
concerned as to whether Mr. and Mrs. Hughes are capable of taking care
of themselves, and feels if help is needed, the City should assist.
There is reportedly no running water in the house. Requested the City
pursue this matter. City Manager Armstead advised that the County
Health Department was requested to investigate the matter, and a
report was received; recommended the report be reviewed prior to
further discussion.
(3) Councilwoman Pfennighausen reported as follows: "The next item I
have to disc ss is a very sensitive item, and I'm going to try to keep
it as non -emotional as possible; the things I am going to say are for
the record and I want them made that way:

"I was very upset two weeks ago when I walked into the City Hall and
found an employee, whom I considered extremely valuable, no longer
with us; and that employee was Tom Coyle. Aside from the fact that
Tom Coyle was told that he didn't have any friends in this City, I
want everybody to know he had a lot of friends in the City. I feel
that this City suffered a great loss in three extremely important
areas - the area of emergency operations being one.
"We have worked for well over a year to get an emergency operations
plan in writing and in force in the City. The time is running out.
Tom had taken a week's training in San Luis Obispo - specialized
training for this; he had worked closely with the Committee. He had
just returned a short time ago from San Diego from taking more
extensive training and things were really rolling. And now we have to
start all over with that training again and another employee; I feel
this is a big mistake. I can't do a thing about ... it's been made
clear to me in the past I can do nothing about personnel policies, but
I do wish to voice my displeasure with the dismissal of this employee.
"The other thing was in the area of sign codes. I was at the Planning
Commission meeting the other night - Tom Coyle had worked closely with
the Chamber of Commerce working on the changes in the sign code. When
this came before the Planning Commission the other night, it had to be
delayed because the man who had done all the work wasn't there, and
they didn't know what to do about it; they could not get any advice.
Back to ground zero and start all over again.
"The one place that I found Tom of extreme value, and over and above
those, was in the area of code enforcement. The Code Enforcement
Officer for this City has much more to do than go out and cite people
when they are in violation. The Code Enforcement Officer is there
when people have a complaint about the way code enforcement is being
carried out; and Tom was extremely good at this. He could take a
person that was terrifically agitated and, in 10 or 15 minutes, that
person walked out, maybe not happy because they had a ticket, they
understood why, and they were satisfied the City did not have an
option. Just recently, within the last week, an individual called
City Hall with a problem in code enforcement; I want it made clear I
am not putting down the person that has taken over this job, Randy,
because he is already a too burdened employee, and it isn't his
fault. But the access to Randy was at eight in the morning and five
in the afternoon. He isn't in the office a great deal, and that
valuable service now has been lost, and I am very unhappy. I know
more things about this, and I do not feel that this is the time or
place to carry it out, but I want it for the record. I think we have
lost a valued employee."
Councilman Petta reported he received a call from Mr. Ernie Bauer, a
resident of o ton who lives in the area behind the Stater Bros.
warehouse, objecting to accessive noise coming from the area of the
warehouse. Requested that Staff investigate the matter to see if the
problem could be resolved.

Mayor Grant reported the following: (1) Attended the SANBAG meeting
of Augustand the LAFC meeting of August 8; (2) Signed a Certificate
of Commendation which was prepared for First Sergeant Samuel
Walls, Jr., USMC, who participated in the Fire Station Dedication
Ceremony. Copies have been provided to Council; (3) The Inland Empire
Division of the League of California Cities will hold a general
assembly meeting at the Red Lion Inn in Ontario on August 29; the
guest speaker is to be Lt. Governor Leo McCarthy. Staff is to be
advised of any Council Members wishing to attend; (4) Stated the
Council meeting Minutes of June 28 will reflect that he requested
Staff to investigate the possibility of making an exception for
residents on Mt. Vernon and Holly Street for parking on street
sweeping days, due to limited parking and no driveways; feels an
exception should be made for the area from Brentwood south to the
point where the residences have driveways and also on Holly Street and
Mt. Vernon; (4) Referenced Councilwoman Pfennighausen's statements
regarding the vehicle which was towed away from Holly Street; stated
he understands a resident on that block called the Sheriff to report
the vehicle; felt in the interest of promoting good relations, an
effort should be made to contact individuals prior to issuing
citations; on the other hand, feels that as long as the City has an
ordinance, it should be enforced, or if determined to be improper,
should be repealed.
CONTRACT AWARD-SENIOR/COMMUNITY CENTER PARKING LOT PROJECT (GTB84-10)
City Engineer Kicak advised that in accordance with Council direction,
lighting was incorporated into the project and will be energized
through an existing school subpanel with the energy being provided by
the School District at an estimated cost of $5.50 a month; seven bids
were received at the bid opening on June 7 ranging from $45,198.01 to
$60,291.43; recommended awarding the contract to Fisher's Grading &
Excavation, the low bidder, in the amount of $45,198.01.
Following clarification that the bid includes lighting and that the
CC-84-215 proposed contractor is well qualified, Motion by Councilman Petta,
Second by Councilwoman Pfennighausen, ALL AYES by all present, to
award the contract for the construction of the Senior/Community Center
Parking Lot Project to Fisher's Grading & Excavation for $45,198.01
subject to contract approval by the San Bernardino Office of Community
Development.
City Engineer Kicak advised construction is to begin August 20, with
completion scheduled for September 10 when school begins.
ZONE CHANGE
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,
CALIFORNIA, APPROVING ZONE CHANGE AMENDMENTS IN COMPLIANCE WITH THE
GENERAL PLAN UPDATE OF APRIL 26, 1984 (First Reading)
Attorney Hopkins read the title of the Ordinance. Planning Director
Kicak advised the new General Plan was adopted on April 26, 1984;

State law requires zoning to be brought into conformance with the
General Plan within a reasonable period of time; Council directed
Staff to process a mass zone change, at no cost to the property
owners, to bring all zoning into conformance with the General Plan.
Staff identified 37 areas which would require a zone change. All
affected property owners, including those within a 300-foot radius of
the affected parcels, were notified, by mail, of the proposed zone
changes. The Planning Commission held a public hearing on the
proposed zone changes on August 6. Administrative errors were noted
and corrected at that time, as follows: Area 32, located between
Mt. Vernon and Michigan, on the northerly side of DeBerry, was
incorrectly shown as R-1, and should indicate R-2; Area 34 - Council
sometime ago directed Staff to change the zoning of the parcel on the
west side of Michigan from CPD-Overlay to C-2 because of the existing
use of that property.
The Planning Commission recommended that Council consider changes to
the proposed zoning in Areas 10, 11, 12 and 30 as follows:
(1) Areas 10, 11 and 12 - Consider changing the designation from R-3
to - - e present General Plan designation for those areas is
R-3, multiple family residential, which allows a density of up to
20 units per acre. The R-3-12 designation would limit the density
to 12 units per acre;
(2) Area 30 - Change the designation from R-3 to R-3-11, limiting the
ensi y to 11 units per acre;
(3) A small parcel located at the intersection of Mavis and Michigan
was incorrectly designated as Public, which in fact is a
privately -owned water company parcel; the Planning Commission
recommends that parcel be designated C-2, since that area was
changed to commercial at the time the General Plan Amendment was
considered.
Mr. Kicak recommended maintaining the R-3 designation for Areas 10,
_ 111% 12 and 30 in accordance with the General Plan, rather than
specifying the number of units for various parcels. Stated all
proposed development requires Planning Commission review and approval,
and that a Specific Plan is required for all development with
densities of 16 or more units per acre, which must be approved by the
Planning Commission. Felt densities should be determined for parcels
on an individual basis, since parcels will vary in the number of units
they can support, based on variables such as shape, topography,
setbacks and other requirements which must be met.
Advised the State, when reviewing the Housing Element of the General
Plan, was critical of the City's low density designations, due to the
land costs in this area; since the General Plan has now been approved
by the State, felt if the City were to change the densities through
zoning, pre-empting the approved R-3 designations and allowing a
certain number of units on one parcel and not on another in R-3 could
cause problems, should a developer contact the State and be able to

show that the City is denying him the right to provide what is
reasonable. Felt it would be better to control the density through
the Specific Plan and reasonable development, rather than placing
specific designations which are not in compliance with the General
Plan designations.
Mayor Grant opened the meeting to public participation and closed
public participation, there being no testimony given.
Based on Staff's recommendation, and with the understanding that
amendments can be made following input received at the public hearing
on August 23, Motion by Councilman Petta, Second by Councilwoman
CC-84-216 Pfennighausen, ALL AYES by all present, to approve the first reading
q0 ,10 of the Ordinance approving zone change amendments in compliance with
_Ithe General Plan update of April 26, 1984, by title only, with second
reading and public hearing to be set for August 23, 1984, at 7:30 p.m.
Councilwoman Pfennighausen commended Staff on the extensive
notification of the public hearing through the newspaper and mailing
the information to the residents. It was further clarified that
approval by Council of the first reading of the ordinance did not
include a density overlay for Areas 10, 11, 12, and 30, as recommended
by the Planning Commission, and the densities would be determined on a
parcel by parcel basis.

from the State of California, in the amount of $10,500.CO. Said
grant is to be utilized for a Traffic Control Device Inventory.
Staff inadvertently did not establish a revenue and expenditure
account for this project. At this time, staff is seeking Council
authorization to establish Account # 10-4180-600 as the expenditure
line item, and #10-3272-000 as the revenue account line item. Since
this is a grant, the revenue received from the State will offset
the expenditure.
Staff Recommends that the Council:
A) APPROPRIATE $10,500 IN EXPENDITURE LINE ITEM #10-4180-600 FOR A
TRAFFIC CONTROL DEVICE INVENTORY.

Every three years the Federal Department of Housing and Community Development
requires the San Bernardino County Office of Community Development to notify
each eligible City within the County, of the qualification process for Urban
County participation in the Community Development Block Grant Program. This
qualification process allows the City an opportunity to participate with the
County in the upcoming three year CDBG Program or to elect to have their
population excluded from the County's Urban County total and consequently seek
CDBG Funds on their own, through the State of California Small Cities CDBG
Program.
In the past years, the City has received it's fair share of Community Development
Block Grant Funds. Staff feels that the City would stand a better chance of
receiving it's Block Grants if it will continue as a cooperating City with the
County, rather than compete with other small Cities throughout the State.
In order to continue receiving it's yearly allocation of Community Development
Block Grant Funds, it is mandatory that the City approve the execution of the
attached 3-year cooperation agreement with the County.
Staff recommends that the City Council:
AUTHORIZE THE MAYOR, CITY MANAGER, AND CITY ATTORNEY TO EXECUTE THE ATTACHED
COOPERATION AGREEMENT WITH THE COUNTY FOR COMMUNITY DEVELOPMENT BLOCK GRANTS

COOPERATION AGREEMENT FOR
COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
FOR FISCAL YEARS 1985-86, 1986-87, 1987-88
COUNTY OF SAN BERNARDINO, of the State of California, hereinafter called
COUNTY, and the CITY OF GRAND TERRACE, a CITY within said COUNTY, hereinafter
called CITY, mutually agree as follows:
1. GENERAL
The Housing and Community Development Act of 1974 (Public Law 93-383, -
hereinafter called ACT) as amended in 1983 provides that Block Grant funds may
be used for essential community development and housing assistance activities.
COUNTY and CITY mutually desire to qualify COUNTY as an "Urban County"
under the ACT; therefore, COUNTY and CITY hereby agree to cooperate to
undertake, or assist in undertaking, community renewal and lower income housing
assistance activities, specifically urban renewal and publicly assisted
housing.
This agreement gives COUNTY authority to carry out activities which will
be funded from annual Community Development Block Grants (hereinafter called
CDBG) from Fiscal Years 1985, 1986, and 1987 appropriations.
2. TERMS
The term of this agreement shall be for not less than the period
commencing on the effective date specified below and extending through the
third program year covered by COUNTY'S Three Year 19ZS-88 participation in the
CDBG program, unless an earlier date of termination is fired by the Department
of Housing and Urban Development (hereinafter called HUD) pursuant to the ACT.
This agreement may not be terminated by the parties herein covenanted for any
circumstance or rc:uscn during the three year tor-M. of this agreement.
3. PREPAR11 ATIO"; OF APRLICATIC11
COUNTY, by and through its Office of Community Development, subject to
approval of COUNTY'S Board of Supervisors, shall be responsible for preparing
and submitting to HUD all necessary applications for basic grant under the ACT.
This duty shall include the preparation of a community development plan and
program and a housing assistancE plan which satisfy the application
requirements of the ACT and its Regulations.
4. COMPLIANCE WITH FINAL PROGRAiMiS AND PL'NS
Both COUNTY and CITY shall comply in all respects with the final community
development plan and program and the housing assistance plan which are
developed through mutual cooperation pursuant to the application requirements
of the ACT and its Regulations and approved by HUD.
5. COMPLIANCE WITH ACT AND REGULATIONS
Both COUNTY and CITY will comply with all applicable requirements of the
ACT and its Regulations in utilizing basic grant funds under the ACT, and shall
take all actions to comply with the provisions of the National Environmental
Policy Act of 1969, Title VI of the Civil Rights Act of 1964, Title VIII of the
Civil Rights Act of 1968, Executive Order 11988, Section 109 of Title I of the
Housing and Community Development Act of 1974, and other applicable laws.
6. DISPOSITION OF FUNDS
Consistent with Federal Regulations and Section 4 and 5 of this Agreement,
it is the intent and understood by the parties to this Agreement that, to the
extent possible, funds will be allocated by COUNTY to CITY according to its
proportional demographics and utilized to fund activities and/or projects
prioritized by CITY to alleviate its identified needs. COUNTY, by its Board of
Supervisors, shall be responsible for determining the final disposition and
distribution Gf all furs received by COUNTY under the ACT, for sel.Cr iftg
the pro ects for which such funds shall be used. COUNTY is also resrcrsitle
for filing the Annual Final Statements.
7. EFFECTIVE DATE
This agreement shall be effective for all purposes when this agreement and
like agreements have been executed by COUNTY and CITY and properly subc;itted to
HUD the grantor by the designated deadline.
8. O T HEM: AG?EEiMEN T S
COUNTY and CITY shall enter into such further agreement or agreements as
may be necessary to carry out the purposes of this agreement and of the ACT.
This agreement revises and supersedes any prior Cooperation Agreement between
COUNTY and CITY.

On July 25, 1984 City Staff met with Caltrans to discuss the Administration
and Inspection duties for the Barton Road Reconstruction Project.
In reviewing the City's existing change order policy, Caltrans felt that the
City should use Caltrans Change Order Policy for this particular project.
Presently, all change orders must be approved by the City Manager, Finance
Officer and City Engineer. If the change order is over $10,000.00 it must be
approved by the City Council.
Attached for your approval, is a copy of the Caltrans Change Order Policy
taken from their Local Programs Manual Volume II.
Staff recommends that City Council:

SECTION 2-17-CONTRACT CHANGE ORDERS
Any change of the approved plans or specifications or work
required which was not included in the contract must be covered
by a contract change order, which has been approved in advance
of any work being done on the change, or reimbursement may not
be made by the Federal government. Funds for the entire item or
change may, in fact, be jeopardized if work is done before approval
is given. It is recommended that Section 2-50 of the State's
Construction Manual be reviewed for a discussion on change orders.
The procedures described therein will be followed on "State Administered"
local assistance projects. For "Locally Administered" projects the
following procedures apply.
For the purpose of approval, contract change orders are divided into
Major and Minor categories.
For Major change orders, District approval must be obtained prior
to performance of the work.
If the work is of an emergency nature, the Local Agency engineer
is to inform the District representative. Approval may be given verbally,
but the Local Agency is to request the District to immediately confirm
such approval in writing.
After obtaining the required District approvals, the agency may
follow its own procedures in obtaining the proper signatures of the
agency governing body and the contractor in executing the change order.
Major change orders are defined as those covering the following
types of changes:
• Revisions to geometric design (main road, ramps, frontage road,
or crossing).
• Revision of the structural section above subbase level. Local
adjustment of subbase necessitated by differences in quality
of subgrade materials will not be considered major, but revision
of subbase thickness over a substantial length of the project
will be considered a major change.

a Revisions in conflict with standards upon which project approval
was based.
a Revisions involving addition, deletion, or relocation of major
structures.
a Any change in planned access provisions.
a Any change which would alter the scope of the contract.
a Any change related to type or quality of materials to be
furnished.
a Changes in specifications or specified method of processing.
a Changes resulting in an increase or decrease of over 25 percent
in a significant item of the contract or total contract amount,
or changes resulting in adjustment in unit prices when due to
change in the character of the work. A "significant" item
will be one for which the bid schedule amount for the item
exceeds 5 percent of the total bid. Adjustments resulting from
the application of Section 9-1.08 of the State's Standard Speci-
fications will not be considered major.
a Force account work over $15,000 in amount and not provided for
in an approved PS&E as supplemental work.
All other change orders are considered Minor and may be approved
under Local Agency rules.
Copies of change orders, whether Major or Minor, must be submitted to
the District representative. The District representative will review the
change order for the propriety of the work, the general form of the docu-
ment, method of payment, the adequacy of funds, and eligibility for partici-
pation.
A change may be participating, participating in part, or non -partici-
pating. In general, most changes will be participating provided they are
necessary to complete the project as originally contemplated at the time
the plans and specifications were approved.

Following are some items which normally are non -participating:
Guarantees other than electrical or mechanical.
Electrical/Mechanical guarantees over G nonths.
Delivery of salvaged material off the project.
Utility work - betterments or work not programmed.
Plant establishment periods of over 1 year.
Work outside project limits.
Work not on properly designated route.
R/W obligation not programmed.
R/W obligation already compensated.
Work chargeable to other programs.
Maintenance work (except Demonstration Programs).
Work not in accordance with approved Specifications, unless
quality is not reduced.
Non -highway related work.
Work outside of Local Agency rules or limits.
Work not in accordance with AASHTO standards (unless exception
granted by FHWA).
Work done before authorization is received for major CCO's.
Work over and above amount programmed.
Deviations from design standards.
The Local Agency engineer should discuss pending change orders with the
District representative as early as possible. A concise transmittal letter
explaining needs, conditions, methods of payment, time extensions, and other
pertinent facts should accompany the change order when submitted for State
action.
When there is a question concerning participation, the District •
representative should be contacted in advance of executing the change
order.

A contract for the collection of special assessments with San Bernardino
County is necessary to allow the County to collect special assessnents
from property owners in behalf of the City, when necessary.
In April, 1984 the•City, with the approval of Council, took action to
abate properties located at 11958 Canal Street and 1261G Michigan Street;
reimbursement for the cost of abating those properties was requested
from the property owners; since payment was never received, it is
necessary to collect the costs due the City through special assessments
on the property owners' tax bills. This contract will accomplish
that purpose.

CONTRACT FOR THE COLLECTION OF SPECIAL ASSESSMENTS
The County of San Bernardino shall collect special assessments for the
under -signed:
1. The following charges shall be -made for the collection of special
assessments or special assessment taxes:
(a) Assessments for any district, special district zone or
improvement district thereof: Not to exceed $2.00 for each
parcel bearing such an assessment.
(b) Special assessment or special assessment taxes levied upon
any land or real property by any city, county, district or
other public corporation, officer or body: Not to exceed
$2.00 for each parcel bearing such an assessment.
(c) Pursuant to Government Code Section 29304, such charge shall
be added to the amount of the assessment for each parcel
bearing such an assessment.
2. This contract may be terminated for any ensuing fiscal year prior
to June 1, or the preceding fiscal year by giving ten days notice
in writing to the other party.

Section 29304 of the California Government Code requires that whenever any
special charges or assessments are to be collected by the County, there shall -
be added to the amount of the special charges or assessments an amount fixed
by agreement between the district and the County.
Enclosed are four copies of a blank contract pertaining to the collection of
these charges. This contract provides for an amount not to exceed $2.00 per
parcel. However, at the present time, the amount to be added is only $1.00 for
hard copy parcel listings or $.25 for parcel listings provided on magnetic
tape.
A responsible official, usually the Chairman of the Board of Directors, should
sign the contract for the district, and another official should attest to the
signing. Please return three signed copies to this office and we will secure
the signatures of the Chairman of the Board of Supervisors and the Clerk of
the Board. A copy of the completed contract will then be forwarded to you.

On August 9, 1984, the City Council approved an Ordinance on the first reading
for the Mass Zone Change within the City of Grand Terrace. This Mass Zone
Change resulted from the adoption of the General Plan on April 26, 1984.
The Planning Commission at their regular meeting of August 6, 1984, held
their Public Hearing and recommended to the City Council certain modifications
to the Staff proposal. These modifications were reviewed with the City Council
at their meeting of August 9, 1984, and in one specific case the Staff
recommended that the City Council does not adopt the Planning Commission
recommendation.
The Staff recommendation pertained to the areas 10, 11, and 12 whereby the
Planning Commission in approving the R-3 zoning as recommended, however,
attached a maximum density of 12 units per acre. In a case of Area 30, the
R-3 designation, the Planning Commission attached a density of 11 units per
acre. In view of background, the reason for the Staff recommendation to the
City Council to delete the density designation in both of those areas is
primarily to accomplish the true purpose of this zone change, that is to
make the zoning conform to the General Plan. The General Plan Housing
Element provides for densities up to 20 units per acre in the R-3 zoning.
It is the opinion of Staff, that with the approved Housing Element of the
General Plan and the densities specified (Not to Exceed 20 Units), attaching
a maximum of 11 and 12 units per acre could be construed as not having the
zoning and the General Plan being in conformance. Such non-conformance could
cause the City legal problems. As you recall the adoption of the General Plan
within the City of Grand Terrace was delayed by several months while the
Consultant, Beland & Associates was attempting to resolve the differences
with the Department of Housing and Community Development with regard to
these densities.
The designated maximum 20 units per acre is a guide and therefore the density
can fluctuate in accordance with other requirements as they pertain to good
planning. This includes: open space, utilities, circulation, architecture,
and other considerations that are part of a good planning process.

Dear Mayor Grant:
I am a property owner in Grand Terrace who is affected by the
recent recommendation of the Planning Commission pertaining to R-3
zones. I would like to express my vigorous objection to their action
taken on Monday evening August 6, 1984.
Construction
The responsibility the Planning Commission was given by the City
Council was to recommend that the zoning of the city be in
conformance with the General Plan. The designation on the general
plan for planning areas 10, 11, and 12 is medium density residential.
The provisions of the zoning ordinance meeting that designation is R3.
To safeguard the city against inferior development the zoning
ordinance makes provisions, that for proposed projects greater than 16
units, a "Specific Plan" must be submitted and approved by the City
Council. It is through this process that the city has control over
the planning, engineering, landscape, and design of specific projects.
I feel this process represents a proven and fair set of procedures
for evaluation and approval of major projects.
The action of the Planning Commission, to recommend to the City
Council an arbitrary maximum density, seems to be unnecessary and
restrictive in light of the review safeguards already built into the
R3 zone. The review procedures which have been established for this
zone - which have been established after years of careful analysis and
public debate - are superior to the recent recommendations, which
appear to have been reached in a moment of uncertainty and with the
emotional need to take action, no matter what the repercussions of
that action might be.
I feel confident, that after careful evaluation of this uncalled for
recommendation, that the wisdom of those with a long term interest in
the city will prcvail and the Planning Commission recommendation to

The elements that give value to the city are landscape, unity of
design, a safe environment and public park areas. These are the
design elements suggested in the master planning of this area. We
recommend that priority be given to these vital city planning elements
and we urge that the City Council approve the R3 zone and continue the
process of reviewing projects under the "Specific Plan" provisions of
the zone. This allows the city to maintain control over development
and challenges the developer to exercise creativity in seeking
solutions to meet the housing needs of generations to come.
My company and I purchased property in Grand Terrace and have plans to
make further purchases, all with a mind to bring quality affordable
housing to your city. My track record for responsible development in
cooperation with city and county officials is a matter of record, and
I feel my projects would be something of which both the residents and
the city could be proud.

Department, is that equal treatment must be provided to all prospective sources of
services that the City needs to obtain. Axiomatic to the first principle, is the
requirement for maximum open and free competition. Competition is sought for every
departmental contract, regardless of the dollar value of the service to be obtained.
However, this statement is not to infer that competition is obtained for each and
every procurement. There are simply some situtions where no competition exists,
or where it is not prudent to obtain it. When this situation occurs, staff will
make every effort to justify this action to Council.
SERVICE - ANNUAL PARK & PARKWAY MAINTENANCE
CONTRACTOR - DANIELS LANDSCAPING
During the month of September, the existing contract with Daniels Landscaping for
annual park & parkway maintenance expires. Staff feels justified in recommending
that Council approve renewing with Daniels Landscaping for annual park & parkway
maintenance. Justification:
1) Daniels Landscaping guarantees an increase of no more than 10%
over the upcomming contract period, this after taking a 17%
reduction within the current contract period;
2) Staff solicited estimates from a total of seven (7) landscape
contractors. Of this seven, four (4) responded with estimates.
These estimates ranged from $650 a month to $4,500 a month.
3) Daniels Landscaping personnel are familiar with the City specifications,
have a great deal of commercial landscape experience;
4) Equipment reliability seems to be in accordance with industry standards;
5) Staff feels that the contractor has for the last two (2) years, met,
and will continue to meet City standards.
Staff Recommends that the Council:
APPROVE & AUTHORIZE THE MAYOR TO EXECUTE A CONTRACT FOR ANNUAL PARK & PARKWAY

THIS AGREEMENT, made and entered into by and between the CITY OF GRAND
TERRACE, a municipal corporation, hereinafter called "City", and DANIELS'
LANDSCAPING SERVICES, hereinafter called "Contractor".
That the City and the Contractor, for the consideration hereinafter
named, agree as follows:
1. The complete contract includes all of the contract documents as if
set forth in full herein, to wit, this Contract Agreement, Addendum Nos. ,
the Special Provisions, Drawings, Description of Work, the Standard Specifica-
tions for Public Works Construction (1979 edition), all of which are essential
parts of this Contract. In the event of any conflict in the provisions thereof,
the terms of said documents as set forth above shall control, each over the
other, in the order provided.
2. The Contractor shall furnish all materials, except as otherwise
provided in the Specifications or Plans, and will perform all the work for the
Annual Maintenance Terrace Hills Community Park and other City parkways, which is
necessary to complete in a good, workmanlike and substantial manner the above
described work in acordance with the Contract Documents incorporated herein as
Exhibit "A".
3. The City will pay the Contractor, and the Contractor agrees to
receive and accept in full payment for services rendered under this Agreement,
the amount of $1,075 per month during the term of this Agreement as full payment
for furnishing all materials and for doing all the work set forth under the
A9• greement• and also for * loss or damages damages arisiout of the nature of
the work, unforeseen difficulties or obstructions which may arise or be
encountered in the prosecution of the work until it is accepted by the City; and
for all expenses incurred by or in consequence of the suspension or
discontinuance of work; and for well and faithfully completing the work, the
whole thereof in the manner and in accordance with the Contract Documents
therefor, and the requirements of the Engineer under them.
4. This Agreement shall commence September 1, 1984, and shall continue
until June 30, 1985.
5. Either party hereto may terminate this Agreement at any time within
thirty (30) days written notice to the other party.
6. The Contractor shall supply the City with a Certificate evidencing
liability insurance policy or policies which shall provide the coverage set forth
in the Special Provisions prior to execution of this Contract by the City.
7. Should the City bring any legal or equitable action for the purpose
of protecting or enforcing its rights under this Agreement, the City shall
recover, in addition to all other relief, its reasonable attorney's fees and
court costs to be fixed by the Court.
8. The Contractor hereby agrees that he will not proceed with any Extra
Work unless he has been authorized in writing to do so by the City Staff prior to
the commencement of said Extra Work.

9. The parties do for themselves, their heirs, executors,
administrators, successors, and assigns agree to the full performance of all the
provisions herein contained. The Contractor may not, either voluntarily or by
action of law, assign any obligation assumed by the Contractor hereunder without

none of which wanted to do it strictly for time and materials;
• 4) Of those contacted, none would guarantee immediate emergency response;
• 5) Having worked with Harber Companies, Inc. for the past two years, their work
has met City standards;
'6) Emergency response by Harber Companies, Inc. has been excellent;
•7) Increase by Harber Companies, Inc. for FY 1984-85 would only be $5.00 per hour
labor increase, with asphalt costs increasing $5.00 per ton.

APPROVE & AUTHORIZE THE MAYOR TO EXECUTE A RENEWAL CONTRACT FOR ANNUAL STREET & STORM
DRAIN MAINTENANCE WITH HARBER COMPANIES, INC., TO EXPIRE 6-30-85, IN AN AMOUNT NOT TO
EXCEED $27,000.
