He also reported that he has requested that the City Manager look into what I % increments of utility user fees would bring into the City per year and agendize it on the Council meeting of March 9, 1995 or March 23, 1995 so that Council may discuss this in a public setting. mayor Matteson, stated that he is totally against utility user fees. He questioned when the City would receive the Sheriffs contract. Lt. I{yritsis, Sheriff's Department responded that the contract would not be ready until mid March, and stated that they are projecting a 4 to 5 % increase. Ma= Matteson, stated that the Crime Prevention Committee was supposed to get a copy of the latest Sheriff s Contract to see where they felt correction could be made. The motion by Barbara Fasenmyer, second by Crystal Pearl. DIRECTORS REPORT - None. **It was reported that the Basketball League out of Colton does not carry insurance for the City of Grand Terrace. A motion was made by Dick Rollins and seconded by Crystal Pearl to "Require all organized athletic leagues playing on athletic fields in Grand Terrace to be adequately insured in the event that players, members or spectators are injured during the course of practice or play." There were no dissenting votes. **Basketball will begin regular games soon. A point -was made that out of 16 girls on the Colton Junior Varsity, 13 are from Grand Terrace. **Mike O'Connell reported that 550 children participate in Little League and that this is the last weekend of try -outs and that opening ceremonies will be held on March 18th at Pico Park He fiuther indicated that Pico Park was looking very good. He voiced a need for keys to the snack bar. **Soccer finished yesterday with All Stars, and registration will begin this Saturday. **The Seniors are enjoying -the picnic tables and looking forward to using the Barbecue Grills. They are also anxious to get the horse shoe pits going. Discussion of the prospects of a bench being available led finally to the suggestion that it be put in front of the building to serve as a bus stop bench. **It was pointed out that Ten -ace Hills Junior Idigh School is now Terrace Hills Middle School. John Donlevy voiced a need to fertilize the fields very soon. Some discussion indicated that perhaps now would be a good time since there were no scheduled activities requiring the fields. John also said that the rain had done wonders for Pico Park The parks had been closed during the week ends during the heavy rain to preserve the fields. Dick Rollins reported on an unbelievable amount of graffiti at the De Berry Park which he had cleaned up and painted over. It was also reported that the lights on the ball field at De Berry were on during the afternoon, unnecessarily. BACKGROUND: "Litigation about controlling adult entertainment uses is on the rise", says Deborah J. Fox, an attorney specializing in this issue. Our current regulations are outdated and may not be legally defendable. Currently, we do not have an Adult Business Ordinance or a definition of what an adult business is. Therefore, the City Mayor requested staff to update our codes and develop and ordinance specifically to address these uses. The ordinance, in order to be legally defendable, "should not prohibit adult businesses altogether, but may restrict their location". Cities also shall make findings which justify the regulations focusing on mitigating negative impacts on the neighborhoods or community, and not restricting expressions or restricting content of any communicative material related to this protected use itself. The Planning Commission conducted a preliminary meeting on January 19, 1995 and a public hearing on February 16, 1995 for the review and consideration of proposed Adult Business Ordinance. The Planning Commission recommended to the City Council the approval of the ordinance as amended. All changes approved at the Planning Commission public hearing have been incorporated into the ordinance and are highlighted for the Council's information.
