The staff has prepared plans and specifications to remodel and add additional space to the existing apartment located at the Southeast corner of the Civic Center property. This will be utilized to provide office space for the Department of Building and Safety, Public Works and Housing Division of the Community Redevelopment Agency. Initially it was anticipated that remodeling the existing building and adding a small addition would be adequate. However in the design process it was determined that due to the fact the City has boxes of documents and plans stored in several places, some being unprotected, and that the City has the responsibility to maintain these records and documents, it was felt additional space should be added at this time in order to properly store and have access to these records. Also within this space is approximately 209 square feet of library storage and 216 square feet of Maintenance Department storage. CC-95-43 MOTION BY COUNCILMEMBER HILKEY, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the Consent Calendar. COUNCIL AGENDA ITEM it 31) Council Minutes 05/25/95 Page 3 Mayor Matteson, reported that he has solicited bids from three different police agencies for law enforcement for the City of Grand Terrace. Councilmember Singley, expressed his concern that all the councilmembers be included in soliciting bids for the law enforcement contract. Mayor Matteson, questioned whether the City has received a contract from the Sheriffs Department. Cty Manager Schwab, responded that the contract isn't changing what is changing is Schedule A which is an attachment. He stated that the contract is an ongoing contract with a termination clause of one year by either party. Councilmember Hilkgy, stated that the Crime Prevention Committee was given power to examine the Sheriffs Contract and he feels that the recommendations of the Committee should be looked at to see if it can fit into the current contract. He expressed his frustration that he hasn't seen the contract and questioned when it expires? When is it renewed? and Why can't it be changed? He has asked to use Reserves, and questioned if it is a Union issue and stated that these items need to be looked at. Mayor Matteson, requested that the City Manager give a copy of last years Contract to all of the Councilmembers. City Manager Schwab, responded in the affirmative and stated that every member of the City Council has received a copy of the Contract. Last year a new contract that included the language that dealt with booking fees was presented to the City Council and adopted by the City Council. Every year during budget hearings the issue of level of service is discussed. Staff and the Sheriffs Department Staff will provide any information the Council requests. 2. Historical & Cultural Activities Committee (a) Minutes of 05-01-95 CC-95-45 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY MAYOR PRO TEM CARLSTROM, CARRIED 5-0, to accept the Historical & Cultural Activities Committee Minutes of May 1, 1995. 5B. Council Reports Councilmember Hilkey, reported that he received from the State Department of Education a Negative Declaration on the Environmental Impact on the proposed School District. The certified letter stated that the proposed School District would have no impact on the environment of the local community and they have also set up an appointment with the State Department of Education in July to review the situation. He also reported that he was chosen to be on the panel to choose a youth volunteer of the year given by Assemblyman Brown's Office, Council Minutes 05/25/95 Page 5 CC-95-48 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER BUCHANAN, CARRIED 5-0, to authorize participation in the San Bernardino County Summer Youth Employment Training Program (SYETP), for the summer 1995, and authorize the Mayor and City Manager to execute all required agreements and affidavits. In addition, approve both block grant allocations totalling $28,873. 8C. COUNciLAGMA MM iCj ORDINANCE NO._ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ESTABLISHING GUIDELINES FOR PROCESSING THOSE CLAIMS FOR MONEY OR DAMAGES NOT NOW GOVERNED BY STATE 040 OR LOCAL LAWS WHEREAS, any party with a claim for money or damages against a public agency must first file a claim directly with that entity, and WHEREAS, the agency then has the ability to deny or reject said claims, and WHEREAS, the party filing the claim may file a lawsuit, and under Government Code Section 905, there are twelve exceptions to claim filing requirements, and WHEREAS, subdivision (i) of the Government Code Section 905 exempts claims by the State or by a State department or agency or by another public agency from the requirement of filing a claim with a public entity, thereby allowing a claim to be filed directly in Court without the necessity of having been previously considered by the Agency, and WHEREAS, Government Code Section 935 provides an option for public entities to establish their own policies and procedures for the presentation of claims which are exempted by Section 905 of the Government Code, and WHEREAS, enactment of the subject Ordinance will require State and other public agencies to follow the same claim filing procedures as all other claims. COUNCIL AGENDA ITEM # %q RESOLUTION NO. 95- A RESOLUTION OF THE CITY COUNCIL DECLARING ITS INTENTION TO PROVIDE FOR AN ANNUAL LEVY AND COLLECTION OF ASSESSMENTS FOR CERTAIN MAINTENANCE IN AN EXISTING DISTRICT, PURSUANT TO THE PROVISIONS OF DIVISION 15, PART 2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, AND SETTING A TIME AND PLACE FOR PUBLIC HEARING THEREON WHEREAS, the CITY COUNCIL of the CITY OF GRAND TERRACE, CALIFORNIA, has previously formed a street lighting district pursuant to the terms and provisions of the "Landscaping and Lighting Act of 1972", being Division 15, Part 2 of the Streets and Highways Code of the State of California, in that is known and designated as CITY OF GRAND TERRACE LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1 (hereinafter referred to as the "District"); and WHEREAS, at this time, this City Council is desirous to take proceedings to provide for the annual levy of assessments for the next ensuing fiscal year, to provide for the costs and expenses necessary for continual maintenance of improvements within said District; and WHEREAS, at this time there has been presented and approved by this City Council, the Engineer's "Report" as required by law, and this City Council is desirous of proceeding with the proceedings for said annual levy. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Grand Terrace does hereby resolve, determine and order as follows: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the public interest and convenience requires, and it is the intention of this City Council, to undertake proceedings for the annual levy and collection COUNCIL AGENDA ITEM ik 7a Resolution No. 95- Page 3 "SPECIAL FUND CITY OF GRAND TERRACE LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1 it Payment shall be made out of said fund only for the purpose provided for in this #AW Resolution, and in order to expedite the making of this maintenance and improvement, the City Council may transfer into said fund as it may deem necessary to expedite the proceedings. Any funds shall be repaid out of the proceeds of the assessments provided for in this Resolution. SECTION 8. Said contemplated maintenance work is, in the opinion of this City Council, of direct benefit to the properties within the boundaries of the District, and this City Council makes the costs and expenses of said maintenance chargeable upon a district, which district said City Council hereby declares to be the district benefitted by said improvement and maintenance, and to be further assessed to pay the costs and expenses thereof. Said District shall include each and every parcel of land within the 4W boundaries of said District, as said District is shown on a map as approved by this City Council and on file in the Office of the City Clerk, and so designated by the name of the District. SECTION 9. Any lots or parcels of land known as public property, as the same are defined in Section 22663 of Division 15, Part 2 of the Streets and Highways Code of the State of California, which are included within the boundaries of the District, shall be omitted and exempt from any assessment to be made under these proceedings to cover any of the costs and expenses of said improvement and maintenance work. 101AILK"ut:00-1 SECTION 10.
