The meeting was opened with invocation by Councilman Herman Hilkey followed by the Pledge
of Allegiance led by Councilman Jim Singley
SPECIAL PRESENTATIONS
Ed O'Neal, 22608 Minona Drive, announced that beginning September 7, 1997 the
Grand Terrace Branch Library will be opened on Sundays through next year for four
hours in the afternoon
Jack Ingalls. President - Grand Terrace Lions Club, presented a check in the amount of
$1,000.00 to Laune Shearer, Grand Terrace Branch Librarian and Jack Ignakalski, Head
Librarian in order for the Grand Terrace Branch Library to be opened on Sunday
afternoons: , - 4
Jack Ianakalsla. Head Librarian, stated that he is very appreciative of the City's support
of the hbrary and the support of the Lions's Club for this program He feels that this
program will be a great success
Mayor thanked the Lion's Club for their donation and feels that it is well spent
money.
Mayor Matteson presented Tom Denham from the Sheriffs Department with a plaque
from the City of Grand Terrace for his service as Captain in the City of Grand Terrace
from September 21, 1992 to July 19, 1997 who has now been promoted to Deputy Chief
in charge of the valley region

5B Council Reports
Mayor Matteson, reported that the City Profile brochure that was done by the
Community/Economic Development Department is very good and urged each
Councilmember to read it and beep it for reference. The League of Cahforma Cities has
sent out the Agenda for their Annual conference in October He requested that Assistant
City Manager Donlevy report on the second concert in the park that was held on August
3, 1997
Assistant CitX Manager Donlevy, reported that "Orange Colored Sky" performed at the
Richard Rollins Park on August 3, there were approximately two -hundred people in
attendance The band did a great job He reported that the last concert in the park will
be held on August 24 and it will be a country western band.
Mayor Matteson, requested that City'Manager Schwab give an update on the sale of city
bonds - '
City Manager Schwab, reported that as Council is aware staff has been looking at the
market in order to create a financing for the refunding of the 1991 Public Financing
Authority Lease which paid for the child care center, senior center construction, and the
construction of Pico Park. There is an opportunity in the market to take a look at going
out in the market and seeing if we can't advance refund that issue and save some money
A substantial amount of money has been saved, over and above the amount that was
originally projected
Mayor Pro Tem Buchanan, expressed his satisfaction with the arrangement that has been
made with the library providing Sunday afternoon hours. He reported that he attended
the Chamber of Commerce installation dinner at the Blue Mountain Coffee House. He
gave an update on the fire consolidation issue and reported that he and City Manager
Schwab have been meeting with representatives from the cities of Highland and Yucaipa
The city managers worked on a scope of a request for proposal to seek bids from
consultants to do the analytical portion necessary to support the LAFCO application to

minors 5 Training of community groups in merchant intervention strategies to stop
the sale of tobacco to minors 6 Media relations assistance in promoting merchants
which comply with laws restricting the sale of tobacco to minors, as well as publicity for
the City when presentations and statistics are completed She stated that this program
is funded through Proposition 99 and urged the Council to support the Resolution
CC-97-126 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY
COUNCII.MEMBER GARCIA, CARRIED 5-0, to adopt a Resolution of the City
Council of the City of Grand Terrace supporting a University -City Tobacco Pact
with the Behavioral Health Institute, California State University San Bernardino
(CSUSB).

In 1995, the City of Grand Terrace applied for an $800,000 grant for the purpose of constructing a bike
lane and staging areas with various landscape amenities along the route. In December,1995, the City
was awarded a $369,472 grant from the San Bernardino County Association of Governments (SANBAG)
for the purpose of constructing the hard scape portion of the pedestrian/bike lane These funds were
made possible through the Transportation Development Act, Article 3 Per City Council approval, David
Evans and Associates was awarded the contract for project design in June 1996, and work was underway
for the overall design of the route In October 1996, an Open House was held introducing the conceptual
design to the Council, local government committees, task force and the Planning Commission The
response was very favorable Note that according to the terms of the grant contract, all construction
and/or spending related to the grant was to be completed in full by December 31,1997, unless extension
was approved by SANBAG
Since that time, work has continued on the design, landscape and construction plans for this
transportation project. The design of the project was completed and accepted by City Council on May 8,
1997 This project entailed negotiation with property owners to procure dedication of public right-of-
way where street width was not complete, curb and gutter not in place and/or where sidewalk was not in
place At this time, all public right-of-ways have been secured, documents are in front of City Council
tonight for your acceptance and signature
Construction bid opening was July 30, 1997 Today staff is presenting the bids to the City Council with
an evaluation and selection of one bidder Should the construction firm and public right-of-way
dedications be approved and accepted respectively, staff expects the project to be completed in
approximately 80 working days

As part of the 1996-97 CDBG Program, the City Council approved the installation of
ADA approved Crosswalk Pushbuttons Staff has recently completed bid process for
this project Generally, the project will include installation of 42 ADA accessible
crosswalk pushbuttons at all City intersections
On August 13, 1997, the City held a bid opening for the project The City received two
(2) qualified bids These included
Peek/Signal Maintenance, Inc $2,122 46
Computer Service Company $3,647 00
Staff has approved in the bid from Signal Maintenance a "Replacement/Equal Pushbutton
(McCain Brand) as a substitution for the Synctromx Button specified
It is recommended that the City Council award the contract to the low bid from
Peek/Signal Maintenance, Inc in the amount of $2,122 46
RECOMMENDATION:
That the City Council award a contract for Project No 97-05 Pedestrian Pushbutton
Replacement Project to PEEK/Signal Maintenance, Inc in the amount of $2,122 46
FISCAL IMPACT:

Z-95-01-Al, an Amendment to the Adult Entertainment Ordinance to make a
correction to include an additional requirement to maintain a minimum distance from
certain sensitive uses such as parks, schools, churches, day care facilities, freeways and
residential uses, and Addendum to the adopted Negative Declaration This
requirement was approved by the Planning Commission and included in the
report to City Council, however it was inadvertently left out of the final text of
the ordinance.
Approval based on findings outlined in attached Ordinance.
City of Grand Terrace Community and Economic Development Department is initiating the subject amendments to the
id Terrace Municipal Code Chapter 18 70, Adult Business Regulations The purpose of this amendment is to incorporate

of an AW overlay zone if the underlying planning -area
wherein such adult business is proposed already has three
other adult businesses.- No adult business shall be located
within one thousand feet of another adult business, whether
or not said adjacent adult business is within the city
limits of Grand Terrace. _
B. Each adult business must, prior to commencement or
continuation of such business, first applyfor and receive
from the city council a conditional use permit.
C. Each adult business must, prior to commencement or
continuation of such business, first apply for and receive
an -adult business permit.
D. Each adult business must comply with all applica-
ble regulations specified in this chapter.

"Litigation about controlling adult entertainment uses is on the rise", says Deborah J.
Fox, an attorney specializing in this issue. your current regulations are outdated and
may not be legally defendable. Therefore, the City Mayor requested staff to -update
our codes and develop and ordinance specifically to address these uses The
ordinance, in order to be legally defendable, "should not prohibit adult businesses
altogether, but may restrict their location". Cities also shall make findings which
lustify the regulations focusing on mitigating negative impacts on the neighborhoods
or community, and not restricting expressions or restricting content of any
communicative material related to this protected use itself.

Consequently, staff proposes to alter the Business License Section to match
existing procedures, replacing the terms as follows
"Business License" with "Business Permit"
"Community Development Director" with "City Clerk"
"Planning Commission" with "City Council"
No appeals or other reviews will be required by the Planning Commission in
addition to the CUP application.
In addition, a Business License Tax Certificate will be required and will be
included as one of the Business Permit requirements A separate ordinance
including all these amendments with strike out and underlined portions will be
provided at the meeting.
2. Adding an additional requirement to Adult Businesses permitted in the Adult
Business Overlay District. The additional requirement consists of distances
from sensitive uses as follows:
Section 18.70.006(2) - "A minimal distance to be maintained from certain
sensitive uses as follows:
500' from parks, schools, churches and day care centers
600' from the freeway
1,000' from residential uses

3 The proposed amendment to the Adult Entertainment Ordinance is compatible
with and complimentary to the permitted uses in the same neighborhood
FACTS The area near Adult Business (AB) Overlay District is located in the
Industrial and General Commercial Districts of the City's General Plan, and as proposed,
distances from sensitive land uses will mitigate the visual impacts, as well as protect the
general welfare of the City Restricting adult businesses to industrial and commercial
zones allows them to function in a business environment through the enforceable
mechanism of a conditional use permit.
4 The proposed amendment will not adversely affect the public health, safety, and
welfare, nor be materially detrimental to the use, enjoyment, or valuation of
persons or other property in the surrounding area because it is required to comply
with applicable health, safety, and zoning codes
FACTS The proposed amendments to the Adult Entertainment Ordinance will not
in and of itself create any adverse impacts to affect the public health, safety and welfare
of the surrounding property owners All future development plans will be required to
comply with all applicable health, building and zoning codes `
