Should the Council desire to proceed in an ordinance amending the Redevelopment Plan, the Council would have to form a Project Area Committee to draft the language of the amendment and hold public hearings on the ordinance amending the plan. CITY CLERK of the City of Grand Terrace MAYOR of the City of Grand Terrace Community Services Department Staff Report COUNCIL ITEM (XX) MEETING DATE APRIL 22, 1999 SUBJECT ORDINANCE PROHIBITING USE OF ROLLORSKATING, SKATEBOARDING AND BICYCLES IN DESIGNATED AREAS NO FUNDING REQUIRED BACKGROUND: Since the 1994 opening of Pico Park and the rise in popularity of skateboarding, the City has experienced a significant increase in nuisance complaints and problems ansing from the use of skateboards, rollerblades and bicycles in public area Specifically, the two main problems have included the following - - 1 Damage to park facilities including damaged benches, dismantled parking lot barriers and park fencing as well as the scarring of park areas 2 Injuries to persons attendmg events in the parks from either being pushed or knocked over by persons using these devices, or from loose skateboards running into persons Additionally, their exists the potential liability for the City from persons injured by or while using these devices, given the fact that there is no prohibition to their use in City facilities The main request for the initiation of this ordinance is from youth organizations who are expenencmg considerable problems during their leagues or events because there are no regulations in the City specifically prohibiting their use in the parks DISCUSSION: The Ordinance as drafted establishes a prohibition for enforcement in a variety of "public" areas, which in some instances can involve private property As defined in the Ordinance, enforcement of this regulation can occur in • Business Districts as defined in the Vehicle Code • Private Property which is used for business, commercial or recreational purposes COUNCIL AGENDA REAR NQ.� �A ORDINANCE NO. SECMN 1: A Chapter amded `Rollerslcating, Skid ebaatding, and Bicycling prohibited in certain designated areas,' is hereby added to the Grand Terrace Municipal Code. SEC MN 2: - For purposes of this Chapter, the following words shall have the meanings ascribed below: A. 'Business Distract' shall be defined as designated in Section 235 of the California State Vehicle Code. B. 'Private Property' shall mean any property held by private musts which :s used pnrnanly for business, commercial or recreational purposes. C. 'public Property' shall mean any property owned or maintained by the City of Grand Terrace. D. 'Rollerslaate' shall mean any footwear, or device which may be attached to the foot or footwear, to winch wheels are attached and such wheels may be used to aid the wearer in moving or propulsion. E. 'Skateboard' shall mean a board of any material, which has wheels attached to it and which if propelled or moved by human, gravitational, or mechanical power, and to which there is not fixed any device or mechanism to turn or control the wheels. SECTION 3: General Prohibition - It shall be unlawful and subject to punishment m accordance with Section 8 of this Chapter, for any pug ublizing or riding upon rollerskates• bicycles, skateboards, or similar devices to ride or move about in or on any public or private property when the same has been designated by Resolution of the City Council and posted as a no rollerskating, skateboarding, bicycling, etc. area. SECTION 4: D=Mfm of Public Prue= as no RoLterskahnSY. $lWnaM20 or - The City Council may, upon review and recommendation by the City Engineer, designate any public roadway, sidewalk, or other public property as a no rollersiating, skmteboarding, bicycling, etc, area. The City Council shall designate such area by Resolution and order the posting of appropriate signage in accordance with Section 6 of this Chapter. SECTION 5: B osHn' g Area - The City Council may, by Resolution, designate any private property within ORDWANCE NO. PAGE 3 Phrase or portion of this Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court of co gdent jurisdiction, such docisions shall not affect the validity of the remauung portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each section, aiibsection, subdivision, sentence, clause, phrase, or portion dierwf, irrespective of the fad that any am or more sections, subsections, subdivmons, sentences, dlauses, phrases or portions thereof be declared invalid or unconstitutional.
