AMENDING ITS REDEVELOPMENT PLAN TO ALLOW
FOR ACQUISITION OF NON -RESIDENTIALLY ZONED
PROPERTY BY EMINENT DOMAIN

When the City of Grand Terrace initially created the Redevelopment Plan, property acquisition by the
use of eminent domain was not authorized This ordinance amends the section giving the
Redevelopment Agency the authonzation to utilize emment domain to acquire property in non -
residentially zoned areas only
In an eminent domain proceeding, the Agency can acquire non -residentially zoned land Then, the
Agency must determine, through an eminent domain proceeding, a fair market value for the land and
improvements, if any, to be paid to the property owner It is not likely that the Redevelopment
Agency of Grand Terrace will need to utilize eminent domain, but having the availability of this
redevelopment tool should bring investor property owners to the negotiating table to negotiate price
and tams in good faith.
Notices were required to be sent to each registered property owner within the corporate boundaries
in the City of Grand Terrace We also were required to send by registered mail notices to all taxing
amities within the City's corporate boundaries, and both of these requirements were properly
accomplished by City staff

to acquire, any real property located in the Project Area, by any means authorized by
law
The Agency is hereby empowered under this plan to use emment domain in order to
execute the Plan, but only as to property which is not residentially zoned or as to
property acquired with the consent of the property owner Additionally, real property
in the Project Area may be acquired by gift, devise, exchange, purchase, or any other
lawful method
The Agency shall not acquire real property retained by an owner pursuant to a
Participation Agreement if the owner fully performs under the Agreement The
Agency is authorized to acquire structures without acquiring the land upon which
those structures are located The Agency is authorized to acquire either the entire fee
or any other interest in real property less than a fee The Agency is not authorized to
acquire real property owned by public bodies which do not consent to such
acquisition The Agency is authorized to acquire public property transferred to private
ownership before the project is completed, unless the Agency and private owner enter
into a Participation Agreement and the owner completes his responsibilities under the
Participation Agreement
2 Personal Property
Generally, personal property shall not be acquired However, where necessary in the
execution of this Plan, the Agency is authorized to acquire personal property in a
Project Area by lawful means

Community Services Officer Cahill, indicated that in conjunction with the schools they
target situations in the community by finding out where there may be problems When
registrants are released into the community the Sheriff's Department is advised of their
release and where they will be residing She then gets with the schools and finds out
where the bus stops are in the community and mares sure that their homes are not within
a certain number of feet She keeps track and makes sure that they are in compliance
Councilmember , indicated that there are no high risk sex offenders in the 92313
zip code, however there are some in the 92324 zip code He is waiting for confirmation
from the school district to distribute a flyer to all of the schools on Megan's Law and
how to research it

8A Budget Reduction Strategy Forum
City Manager Schwab indicated that staff has put together a presentation on how the City
got where it is today and went over the list of proposed cuts
Barney Karger, 11668 Bernardo Way, feels that some of the code enforcement can be
done by a deputy as opposed to having a code enforcement officer, the sewer billing can
be done through the City of Colton He feels that private individuals can be contracted
with to provide some of the services at a lower cost He feels that the City needs to cut
their expenses He feels that the community is not informed on a lot of issues and he
would like to be more educated on the budget
Gale Drews, 22740 De Berry Streeet, feels that the community has not gotten involved
enough He went through the budget from 1995 to the current year He expressed his
concern with the increase in salaries and benefits of staff over the past five years and
feels that there needs to be a reduction in salaries as opposed to services until the budget
can be worked out and balanced
CC& Manager Schwab, responded that the City Council directed staff to change the way
the budget is done He indicated that in previous years each dapartment's budget was
broken up in several areas so the true costs were not reflected in the budget There has
not been the increase that Mr Drews has indicated in each department and indicated that
the salaries for the employees would be at the bottom if compared to other cities in the
County of San Bernardino

WHEREAS, a Special Municipal Election was held and conducted in the City of
Grand Terrace, California, on Tuesday, June 8, 1999, as required by law, and
WHEREAS, notice of the election was given in time, form and manner as provided
by law, that voting precincts were properly established, that election officers were
appointed and that in all respects the election was held and conducted and the votes were
cast, received and canvassed and the returns made and declared in time, form and
manner as required by the provisions of the Elections Code of the State of California for
the holding of elections in general law cities, and
WHEREAS, pursuant to Resolution No 99-31 adopted December 10, 1998, the
County Registrar of Voters canvassed the returns of the election and has certified the

When the City of Grand Terrace initially created the Redevelopment Plan, property acquisition by the
use of eminent domain was not authorized This ordinance amends the section giving the
Redevelopment Agency the authorization to utilize eminent domain to acquire property in non -
residentially zoned areas only
In an eminent domain proceeding, the Agency can acquire non -residentially zoned land Then, the
Agency must determine, through an eminent domain proceeding, a fair market value for the land and
improvements, if any, to be paid to the property owner It is not likely that the Redevelopment
Agency of Grand Terrace will need to utilize eminent domain, but having the availability of this
redevelopment tool should bring investor property owners to the negotiating table to negotiate price
and terms in good faith.
Notices were required to be sent to each registered property owner within the corporate boundaries
in the City of Grand Terrace We also were required to send by registered mail notices to all taxing
entities within the City's corporate boundaries, and both of these requirements were properly
accomplished by City staff

SUBJECT CIVIC CENTER STRUCTURAL REPAIRS AND

BACKGROUND -
For approximately the past two and one half years, the Community Services Department along with
Building and Safety have been working on issues surrounding cracking being experienced in vanous
walls and location along the West Wall of the Civic Center The issues and investigations to this
point have led to a need to begin a process of restoration and repairs which will restore the integrity
of the building and structurally strengthen the Civic Center
As a result of testing and various investigations into the causes of the cracking in the west wall of the
` Civic Center, it has been determined that a combination of material product failure, deficient
" mortar/grout construction, unproper grout fill and water infiltration has led to a carbonization of the
reinforcing steel in the brick of the wall, causing expansion of the re -bar and cracking of the brick
Reports, detailing the problems are attached as Exhibits to this report
The problems being experienced are pnmarily located above the roof line on the West Wall of the
Civic Center and the Elevator shaft Extensive spauhng and cracking is being experienced, which is
in need of address
To address these issues, Staff contacted WLC Architects, the onginal design team for the Civic
Center to serve as a consultant on the restoration and repair project To this point, WLC has
performed advisory services at no cost in the areas of directing the preliminary testing and review of
the engineering reports presented They have put together a team which can address multiple areas
of a restoration process, including architectural, structural and materials engineering
DISCUSSION
Staff is recommending that the City Council award a contract to WLC Architects in the amount of
$24,200 00 to begin the restoration work Staff is recommending WLC based on the fact that they
are the original architect on the building and efficiency is created through their past experience with
the building
Their proposal includes a full amount of work on the project, including

I am writing this letter to submit our proposal to provide architectural/engmeenng services for
construction documents and construction administration support services to complete structural
repairs and weatherproofing of damaged brick masonry walls Based upon the level of testing
and analysis conducted to date, we believe the probable causes of the problem can be identified,
and corrective action can be successfully initiated Our proposal reflects a two-step course of
action
Correct west side, above roof west facing wall areas, elevator shaft, and interior lintel at
second level elevator bridge
2 Provide additional random testing of other Civic Center areas to identify potential for

Probable Cause
At the present time, WLC believes that the masonry wall conditions at the Civic Center result

Bidding Services
Bidding services shall include the prescription of an appropriate project delivery method to use
prequalified contractors' experience in masonry restoration A bid proposal shall be created to
reflect a combination of fixed unit prices for time and material with a guaranteed not -to -exceed
maximum cost WLC shall assist the City to identify qualified contractors and to create bidding
documents that meet the City's unique and special requirements Consideration for temporary
occupancy, extended hours of construction, and other means and methods to minimize City staff
and public inconvenience will be achieved
Construction Testing and Observation

Ladies and Gentlemen
Dunng November of 1998, a preliminary inspection of the masonry walls of the Civic Center
structure revealed extensive cracking in the extenor of the walls above the roof line Cracking
appeared to be most prevalent in the west wall of the atnum, the three exposed walls of the
elevator shaft, and the three exposed walls of the storage room, north of the elevator shaft
The cracks were noted to be generally vertical, and were generally associated with the cells of
the masonry units rather than the joints between the units Sounding in the vicinity of the
cracks frequently illicited a 'hollow' response, suggesting disbonding of the face shell from the
grout A portion of the southwest comer of the elevator shaft wall had developed a large
vertical crack with a portion of the masonry assemblage westerly of the crack appeanng to have
been pushed outward Examination of the reinforcing steel exposed in the crack revealed
extensive corrosion In the interior of the building, a lintel across a walkway in the second or
mezzanine floor had developed a honzontal crack in the bottom course, and a separation crack
between the bottom course of vertical masonry units and the first course of honzontal units
The area of the crack exhibits extensive efflorescence
To allow further evaluation of the masonry walls in the areas of cracking, 19 cores were
obtained from the walls during December of 1998 The locations of the cores are illustrated on
Enclosure 1 with this report Six-inch diameter core holes were drilled with a diamond -tipped
core bit to expose the reinforcing steel Care was taken to not cut the steel bars The grout at
each core location was removed by chipping to completely expose the reinforcing steel In
addition to the reinforcing steel exposures, 2 core samples of unreinforced, but grouted cells,
were obtained for future testing (see Core Nos 16 and 17) Photographs of the reinforcing
steel exposures are presented as Enclosure 2
At every core location, the reinforcing steel exposed exhibited corrosion The corrosion of the
reinforcing steel has produced expansion pressures that have resulted in the cracking and
occasional face shell disbonding The extent of the corrosion was vanable At Core No 1, it
appears that one of the bars has expenenced as much as 50 percent loss in bar diameter due
to the corrosion Observations in other core openings, however, suggest that the more typical
loss in bar diameter would be less than 10 percent.

Dear John:
At your request, I met with Rar Ban Leung, S.E., the structural
engineer, to discuss the next steps in the evaluation of the
building and initiation of repair activities. Basically, we
agreed to the following points:
1. There should be a second phase to the building evaluation.
Those portions of the masonry walls above the roof line on
the west side of the building, south of where the major
damage is, should be further investigated. Those portions
of the masonry walls above the roof line on the east side
should also be investigated. The investigation should
consist of the evaluation with a corrosion rate meter. The
corrosion rate meter requires a few core holes to
investigate a large area of wall. The core holes are made
at locations where rebar is encountered such that there can
be a positive connection made to the reinforcing steel and
thus provide a continuous circuit for the meter, which is
moved to different locations of the wall and readings taken.
The readings are plotted on a plan and then evaluations of
corrosion made based upon areas of equal meter readings. At
each location where a core is taken, we would be able to
evaluate the unit weight, carbonation, and chlorides on an
individual basis. A report would be prepared providing an
evaluation of the extent of any corrosion observed within
those portions of the building.

6. After the review of these portions of the building and the
repair procedures confirmed, there should be another meeting
with the City in order to evaluate the need for further
testing of the remainder of the building.
We recommend that these items be considered and carried out by
the City. If you have any questions, please do not hesitate to
