1996-24 RESOLUTION NO. 96-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, APPROVING A RENEWAL OF CUP90-06 (R5),A REQUEST FOR AN OUTDOOR RADIO CONTROL VEHICLE RACE TRACK AND ASSOCIATED HOBBY SHOP WHEREAS,the Applicant, K&M Accessories, applied for a Conditional use Permit to renew operation of an outdoor radio control vehicle race track with associated hobby shop within the Village Commercial Zone of the Barton Road Specific Plan located at 22474 "A"Barton Road; and WHEREAS, a properly noticed public hearing was held by the City Council on October 10, 1996 to hear said project. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Grand Terrace, California,that the following findings have been made in accordance with the approval of CUP90-06 renewal: 1. As conditioned, and operated accordingly,the project will not be detrimental to the general health, safety,morals, comfort or general welfare of the persons residing or working within the neighborhood or proposed use or within the City. 2. The occupation of this site subject to the conditions listed below will not be injurious to the property or improvements in the neighborhood or within the City. 3. The proposed use is consistent with the latest adopted General Plan. The current General Plan land use designation for this property is GC, General Commercial. 4. The conditions of approval as listed below are necessary to secure the purpose of the City of Grand Terrace General Plan and Zoning Ordinance (Barton Road Specific Plan). NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Grand Terrace, California,that: 1. All conditions as recommended by the Forestry and Fire Warden's Department in their memorandum dated July 19, 1990. 2. All conditions as recommended by the California Department of Forestry and Fire Protection(Ranger Unit) on their Inspection Sheet dated September 27, 1996. f� �' - 1 - 3. All conditions as recommended by the Department of Building & Safety, Public Works and Housing in their memorandum dated 10/8/96. 4. Occupancy of the race track facility shall be limited to 100 persons within the fenced area of the site. 5. Existing speaker system will be allowed to remain in operation provided that it shall not exceed ambient noise levels or 55 dbs adjacent to the residential areas, whichever is less. This should be interpreted as being in the front yard of houses across the street from Mount Vernon,yards of the apartments at Britton Way and on the yards of the Convalescent Hospital,plus any other sensitive residential- type use in the area. 6. Hours of operation shall be limited to the following: Wednesday 4:00 p.m. to 8:00 p.m. Friday 6:30 p.m. to 10:30 p.m. Saturday 10:00 a.m. to 10:30 p.m. Sunday 10:00 a.m. to 5:00 p.m. 7. Ten minutes prior to the designated closing time,the lights shall be dimmed by turning off three 1500 watt lights currently mounted to poles surrounding the race track; music will also be turned off completely ten minutes prior to designated closing time so that by 10:30 p.m., all will be quiet and the lights turned off. 8. When the track is not in operation, access shall be secured and locked. 9. The proposed project shall be maintained in accordance with City Council approval of October 10, 1996. Minor changes can be approved by the Community Development Director. Expansion or relocation will require a Public Hearing with the Planning Commission. 10. The proposed project including landscaping, irrigation systems,building maintenance and operations shall be maintained in a clean and functional manner and operated in accordance with this approval and the overall goals and objectives of the City of Grand Terrace. 11. Applicant agrees to idemnify, defined and hold the City harmless from any and all liability arising out of the operation conducted pursuant to this approval save and except liability caused by the City's sole negligence. 12. Conditional Use Permit expires on October 11, 1998 unless applicant requests an extension of the Conditional Use Permit,prior to expiration. Conditional Use Permit shall be subject to full re-evaluation anytime during the year upon receipt - 2 - of two formal complaints by two different citizens/residents. 13. By accepting the benefits of this permit,the permittee waives the right to challenge any conditions set forth herein. 14. Due to the cost incurred by the City in processing CUP renewal application, applicant shall be subject to the minimum fees applicable for full Conditional Use Permit($260.00), as well as the cost of mailing, upon renewal request in 1998. F-7 Prior to final inspection or occupancy, private roadways which exceed one-hundred and fifty (150) feet in length shall be approved by the Fire Department having jurisdiction, and shall be extended to within one hundred and fifty (150) feet of, and shall give reasonable access to all portions of the exterior walls of the first story of any building. An access road shall be provided within fifty (50) feet of all buildings if the natural grade between the = access. road and the building is in excess of thirty percent (30). - Where the access roadway-cannot be provided, an approved fire protection system or systems shall be provided, as required and approved by the Fire Department. Prior to final inspection or occupancy a turn-around shall be provided at -the end of each roadway, one- hundred and fifty (150) feet or more in length and shall be approved by the Fire Department. Cul-de-sac length shall not exceed six hundred (600) feet except as identified in the development code and approved by the chief. -9 Private road maintenance, including but not limited to grading and snow removal, shall be provided for prior to recordation or approval. Written documentation shall be submitted to the Fire Department having jurisdiction. Private fire access roads shall provide - an all weather surface with mini olm paving width of twenty (20) feet. - F-10 Water systems designed to meet the required fire flow of this development shall be approved by ,the Fire Department having jurisdiction. The developer shall furnish the Fire Department with two copies of -the water system improvement plan for approval and a •letter from the Water Purveyor stating the availability of the required fire flow prior to recordation. - Water systems shall be operational and _ approved by the Fire-Department prior to any construction occurring. The required fire flow shall be determined by appropriate calculations, using the - • San Bernardino County "Guide for the Determination of Aemdxed Fire Flow." In areas without water-serving utilities, the fire protection water system shall be based on MTA pamphlet number 1231 and Unif ona fire - code requirements. F-10 MS-IL3 THROUGH ILS - Water systems designed to meet the required fire flow shall be operational and approved by the Fire Department prior to any construction occurring. The required fire flow shall be determined by appropriate calculations, using the San Bernardino County "Guide For The Determination of Required Fire Flow". In areas without water-serving utilities, or fire protection water serving utilities, the fire protection water system shall be based on N.F.P.A. Pamphlet Number 1231 and the San Bernardino County Uniform Fire Code. - Prior to Building permits being issued approved fire hydrants and fire hydrant pavement markers shall be installed. Fire hydrants shall be 6" diameter with a minimum one 4" and one 2 1/2" connection. The hydrant and fire hydrant markers shall be approved by Fire Department. . All fire hydrant spacing shall be 300 feet with the exception of single family residerA which may be increased to. 600 feet maximum. j V F-12 Prior to final inspection or occupancy this development shall comply with Fire .Safety overlay conditions as' adopted in County Ordinance Number 3341. The development is located in Fire Review Area. f F-13 Prior to issuance of a building permit a fuel -,modification zone in compliance with county standards is required. F-14 Prior to final inspection or occupancy, an approved Fire Department key box is required. If automatic electric security gates are used an approved lock switch is required on each gate in lieu of the box.
